The Staff Attorney will focus on challengingnew and expanding fossil fuel infrastructure development inTexas and the Gulf South Region.

The position will focus on Texas, but will include other partsof the U.S. Gulf Region, and will be based out of a satelliteoffice space shared with other Fossil Fuel Program staff inNew Orleans or remote in Texas.

Responsibilities:

Develop new cases in a strategic fashion; conductfactual investigations; develop legal theories; draft



pleadings and briefs; and otherwise manage newand existing cases within state and federal courtsand administrative agencies.Litigate cases from beginning to end, performing allaspects of litigation.Develop and maintain partnerships with clients,allies, and coalition partners in litigation and otheradvocacy.Collaborate and manage relationships with co-counsel, clients, and coalition partners.Supervise the work of Associate Attorneys, LitigationAssistants, and Law Clerks.Integrate communications and legislative advocacyinto litigation and other legal strategies, workingeffectively with other departments withinEarthjustice, including Communications,Development, and Policy and Legislation.Support efforts to ensure a diverse, equitable andinclusive work culture that encourages andcelebrates differences.

Qualifications:

Internship Timeline

Interns are accepted on a rolling basis until filled.

Professionallaw clerk positions are available in the New Jersey Judiciary forindividuals with strong communication and analytical skills. SupremeCourt law clerks work with justices on complex cases involving difficultissues of law. Appellate Division law clerks conduct research, analyzelegal data, prepare legal memoranda, process emergent motionapplications, and proofread published opinions. Law clerks forassignment judges learn all aspects of court administration and assistwith processing emergent motions. Trial court law clerks gain practicalexperience while gaining valuable insight into the judicial process.Under the direction of one or more judges over the course of the year,trial court law clerks observe judicial proceedings, attend conferenceswith attorneys and judges, receive training in mediation and mediatesmall claims cases and summarize information for judges. Tax Courtlaw clerks perform duties similar to those assigned to law clerks in theAppellate Division and trial courts, but do not mediate cases.

As of June 15, 2020, applicants may apply directly to justices orjudges through the Judiciary's web-based portal. Applications will notbe accepted before that date. Applicants will be contacted directly bythe justices or judges for interviews on or after June 22, 2020.

Qualifications: Law clerks must have graduated from a law schoolapproved by the American Bar Association by the time of their lawclerk appointment. The Judiciary's law clerkship program is intendedfor recent law school graduates, which is defined as graduating withinthe last four years. Selected candidates will be required to provide anofficial, final law school transcript, not a photocopy, which includes thedate of graduation from their law school at the time of hire. Excellentwriting and analytical skills are essential. It is helpful to have completed a course in mediation prior to the startof the clerkship. Under Court Rule, all trial court law clerks who willserve as mediators must first complete the Judiciary sponsored 12-hour mediation training or its equivalent. Applicants selected forclerkships can request a waiver from attending the Judiciary's trainingprogram at the start of the court term by providing documentationthat confirms that they successfully completed an approvedalternative dispute resolution course.

Driver's License: Appointee will be required to possess a driver'slicense valid in New Jersey only if the operation of a vehicle isnecessary to perform essential duties of the position. Authorization to Work: US citizenship is not required. Selectedcandidate must be authorized to work in the US according toDepartment of Homeland Security, US Citizenship and ImmigrationServices regulations. Special Note: Individuals selected for clerkships must agree to athorough background check, which will include fingerprinting. All datareceived will be kept in the strictest confidence except to inform theindividual of the findings and what action will be taken as a result ofthis information. Residency Law: Pursuant to N.J.S.A. 52:14-7 (L. 2011, Chapter 70),also known as the "New Jersey First Act," all persons newly hired bythe Judiciary must establish, and then maintain, principal residence inthe State of New Jersey. Law clerks are not subject to the residencylaw during their 53 week term. Additionally, law clerks who serve asecond clerkship in a higher court are exempt from the residencyrequirement. Clerks who anticipate moving into another state positionimmediately following their clerkship(s) must be mindful that, uponconclusion of their clerkship term, they will need to be New Jerseyresidents.Approximately 480 clerkships are available. Of those, a limitednumber of clerkships exist for the Supreme Court, Superior CourtAppellate Division, Superior Court Assignment Judges, Superior CourtChancery Division in general equity court, and in the Tax Court.Applicants interested in those positions should apply early during thehiring process. Most openings exist in the Superior Court Law Divisionin civil and criminal court, and Superior Court Chancery Division infamily court.
