Appendix 1 BRIEF FOR KIOSKS AT THE COLONNADE, BEXHILL Rother District Council is now inviting proposals from businesses interested in trading from the 7 kiosks which form part of the Council’s prestigious redevelopment at The Colonnade, Bexhill-on-Sea. The kiosks will be offered on non-secure leases for a period of one year, and whilst the Council has set out its required minimum rental, rental offers are invited. The proposed Heads of Terms for the leases are set out below. If you are interested in renting a kiosk please let us have an expression of interest setting out your rental offer, together with a description of the product range that you propose to sell from the kiosk, and any other supporting information you may wish to provide about your business. Preference will be given to businesses that offer high quality products and that contribute positively to the quality and range of products available in Bexhill as a whole. The Council will also have regard to the overall mix of businesses across all 7 kiosks. In order to avoid any direct competition with the Tenant of the main restaurant area at The Colonnade it is unlikely that we will favour food or drinks outlets unless these are providing a separate and distinctive offer. BRIEF FOR KIOSKS AT THE COLONNADE, BEXHILL

Rother District Council is now inviting proposals from businesses interested in trading from the 7 kiosks which form part of the Council’s prestigious redevelopment at The Colonnade, Bexhill-on-Sea.

The kiosks will be offered on non-secure leases for a period of one year, and whilst the Council has set out its required minimum rental, rental offers are invited. The proposed Heads of Terms for the leases are set out below.

Insurance: The tenant will be responsible for insuring their own contents and for their own public liability insurance. The Council will insure the structure of the property.

Repairs & maintenance: The tenant will be liable for the maintenance/decoration of the interior of the Kiosk, the entrance door and its security provisions.

Deposit: A deposit of £200 will be payable upon completion of the Lease, to be refundable when the tenant vacates providing the property is handed back in a suitable condition.

Assignment & subletting: No assignment or subletting will be permitted. The tenant will be given the option to surrender the Kiosk back to the Council by giving a one month written notice.

Opening: During the period 1 April to 30 September Tenants will be required to be to open for business for 6 days a week, including weekends, as a minimum between the hours of 10:00am to 6:00pm.

At all other times throughout the year tenants will be required to be open for business as a minimum every weekend from 10:00am to 4:00pm but can open from longer if desired.

completely regenerate Bexhill’s popular seafront & promenade, including the Grade II Listed King George V Colonnade. Seven kiosks have been constructed, which will complement the main Colonnade space from which a restaurant will operate in the New Year. The Kiosks vary in size from 7sqm to 8sqm.

Prospective Tenants are invited to submit proposals in writing to the Council detailing their rental offer, together with a description of the product range to be sold and any other supporting information as necessary in support of their application. If successful Tenants will be allocated a Kiosk by the Council, it is not possible to specify which Kiosk prospective Tenants would prefer.

CLOSING DATE FOR ALL PROPOSALS TO BE RECEIVED BY –

FRIDAY 10 FEBRUARY 2012

The terms are as set out below:-

RENT Best Offers are invited in excess of £2,000 per annum + VAT. Rent to be payable monthly in advance.

TERM 12 Months with effect from 19 March 2012.

OUTGOINGS Tenant to be responsible for payment of business rates, and all utilities (utilities will be recharged by Rother District Council via check meter)

Rateable Value To follow – estimated to be between 900 & 1400Rates payable for 2011/2012 vary from £389.70 per annum to £606.20 per annum.
