Extensive delays to underground infrastructure improvements in the Park Terrace area of Inwood have left some residents fed up and complaining about torn-up streets, lack of parking, and the prevalence of vermin.

“You can walk at any given time at night, and there’s some creature moving around,” said Traci Werbel, of the gaping holes in the

road that she says have stirred up a number of rats. “It’s ridiculous.”

The city’s Department of Design and Construction (DDC) is replacing the sewer, water main and gas main underground on Park Terrace East and Park Terrace West between West 215th and 218th Streets.

According to the DDC, the upgrades are necessary to “ensure proper delivery of necessary services.” The project is expected to be completed in May 2021.

Work began last summer, but was paused in early March due to the need for seismic testing to ensure the underground work would not crack the foundations of surrounding apartment buildings or stand-alone homes.

However, residents are complaining that an excavator vehicle is still parked on the street, and that work staging areas are still taking up space, despite a three-month pause in the project.

“It’s difficult to even use the street,” said Werbel. “It’s like an obstacle course.”

Park Terrace East resident Ellen Kackmann estimated that the project has taken up “at least 15 to 20 spaces” of parking on the surrounding streets.

“The machines, the fencing, it takes up quite a lot of space,” she said. “It’s harder than ever to find parking in this neighborhood. And if you need to use a garage, sometimes they’re all full.”

Resident Brian Wallace said that during the work period, the streets would be completely blocked off at times. “There were when school

buses could not get up the streets because the machines blocked them off,” he said. “Parents would be standing out waiting for their kids.”

Despite the nuisances, residents acknowledged that the DDC project was needed.

“We need to replace the old gas lines,” said Wallace. “I’d rather the city be proactive about it rather than wait until there is a problem. Or, worse, an explosion.”

“The infrastructure in Northern Manhattan is some of the oldest in the city. It’s long overdue,” remarked Kackmann. However, she said the city should be transparent and communicative with residents about how long the delays will last.

“This will take two more years as it is, and now they’re three months late,” she said.

The city is advancing the work as part of its efforts to bolster infrastructure for the rezoning of the neighborhood.

And in December 2018, the city’s Landmarks Preservation Commission voted to designate the Park Terrace West-West 217th Street Historic District, as the area features 15 homes in the early 20th-century Tudor Revival and Colonial Revival style.

The city’s DDC is replacing the sewer, water main and gas main in Inwood.

Gravity is a go.

Governor Andrew Cuomo has signed a law that lifts the ban on gravity knives in New York State.

A gravity knife is defined as any knife where the blade folds and locks into the handle, and can be opened with the use of one hand.

Criminal justice advocates had long called for legalization of the knives, which are frequently used by stagehands, building superintendents, warehouse workers and other laborers, and commonly sold in hardware stores.

Cuomo signed the legislation on May 30, after twice vetoing earlier versions of the bill. In March, an appeals court ruled that the definition of gravity knife was too vague.

“As I review this bill for a third time, the legal landscape has changed,” Cuomo said. “In March of this year, the United States District Court for the Southern District of New York declared the State’s existing ‘gravity knife’ ban unconstitutional. As argued by many who have advocated for this change in law, the court reasoned that the existing law could result in arbitrary and discriminatory enforcement.”

State Assemblymember Dan Quart, who sponsored the bill, said the law would give peace of mind to workers who need the knives to do their jobs.

“After seven years, we have finally

managed to overhaul New York’s outdated and discriminatory pocket knife ban,” said Quart. “No stagehand, no plumber and no

carpenter should have to risk their freedom to carry a tool they need for work. They will no longer have to.”

The bill, which was unanimously passed by the state legislature, will legalize the possession of commonly sold and lawfully used folding knives by removing the term “gravity knife” from the Penal Law, while leaving intact law enforcement’s ability to pursue those who otherwise use these knives unlawfully.

an end to one of the most discriminatory policing practices in our state, an invidious practice where tens of thousands of Black and Latinx New Yorkers were arrested for merely possessing tools that sell at retailers throughout the city,” said Tina Luongo, Attorney-In-Charge of the Criminal Defense Practice at The Legal Aid Society. “For far too long, the NYPD exploited the gravity knife ban to drive up arrest numbers at the expense of our clients, all of whom were innocent of any wrongdoing. We are grateful that the Legislature unanimously repealed the ban and we cheer Governor Cuomo for signing the repeal into law.”

“The repeal of the gravity knife ban brings an end to a profound injustice and makes New York State a more fair place to live and work,” said the legal non-profit Brooklyn Defender Services in a statement. “Tens of thousands of New Yorkers, the majority of whom Black and/or Latinx, have been arrested and prosecuted, facing job loss, deportation, and more for simply carrying a tool they need for work. We are thankful to the Legislature for unanimously passing the bill and for the Governor for signing it into law.”

Hart Island is the largest public burial site in the country.

About a million people are buried on the island, which is located a few miles east of the Bronx in Long Island Sound. It has been used as a cemetery – sometimes referred to as a potter’s field – for poor and homeless individuals for 150 years.

A pair of bills would transfer control of the island from DOC to NYC Parks and provide for a ferry service for the public. Other bills would establish an Office of Burial Assistance to help low-income New Yorkers with burial arrangements, and create a public burial task force to issue recommendations on policy.

Councilmember Mark Levine pointed out that the New Yorkers who are buried on Hart Island are predominantly low-income people of color.

“Who’s ending up there? It’s the poor. It’s the people who can’t afford a funeral that can cost $15,000. Even a cremation can cost thousands of dollars,” he said.

Dr. Tia Powell directs the Center for Bioethics for

Montefiore Health System and Albert Einstein College of Medicine.

She is a national expert on dementia, and she is a friend. For anyone who wants to learn more about dementia and for anyone who is caring for someone with dementia, Tia's new book Dementia Reimagined will expand and deepen your understanding of this group of conditions. As the subtitle of the book implies, it will also help you put dementia in the same sentence as dignity and joy—two essential elements of life that vanish too often and too quickly when someone is diagnosed with dementia. I spoke with her recently about her new book.

1. What is dementia? Is it a mental illness?

Dementia is a brain illness, and so are mental disorders like anxiety, depression, and schizophrenia. Dementia is actually a group of illnesses, including Alzheimer's Disease—all of which include memory

impairment. All forms of dementia result from harmful changes in the nerve cells and other components of the brain. Of course, depression, schizophrenia, and all serious mental illnesses are also the result of harmful changes to the brain. Those changes are influenced by genetic factors, environmental factors, or often a combination. Indeed, scientists are currently working on the complex interplay between illnesses like depression and dementia; it's not yet clear if one is a risk factor for the other or if they both share common neurological changes.

2. Is there a cure or prevention for dementia? Sadly, there is no cure. The book looks in detail at the history of dementia,

highlighting the work of an extraordinary African American physician-scientist, Solomon Carter Fuller, at the start of the 20th century. His work was largely ignored but predicts current research

that is beginning to uncover how dementia develops. We might be farther along if we'd kept his work in mind. Today, you will sometimes hear about a cure, but those claims are not backed up by trustworthy scientific data. In fact, the FDA has recently sent warning letters to a number of supplement manufacturers to stop making unproven claims. Some interventions may

help slow dementia's onset. The best evidence supports fitness – many major studies show that physical activity helps delay cognitive decline. It's not a guarantee, but it does seem to help. A healthy diet with lots of fruits and vegetables, social interaction, and "exercising" your brain in various ways are all good for our health and good for our brains, but the scientific evidence for these strategies is less definitive.

3. So is there at least treatment for dementia? Yes, here there is some good news. We do not have a cure, but we do have interventions that support and comfort those with dementia and those who care for them. We have come a long way from the dark days

when it was considered appropriate to just tie a person with dementia to a chair and claim this was done for her safety. There are now good scholars researching what helps those with dementia. For example, the ability to enjoy music lasts well into dementia. The Music and Memory program, brain child of Dan Cohen, creates playlists for nursing home residents. Not only does hearing music create joy, it can also help decrease reliance on potentially harmful anti-psychotic medicines to calm those with agitation. This is a big deal. We do need to make evidence-based approaches more widely available, and we need to make sure

Este año es uno de gran significancia para sus constituyentes de color. El proyecto de ley, que fue aprobado por unanimidad por la legislatura del estado, legalizará la posesión de cuchillos plegables de venta común y legal mediante la eliminación del término “cuchillo de gravedad” de la Ley Penal,

mientras que deja intacta la capacidad de las autoridades policiales para perseguir a quienes usen estos cuchillos ilegalmente.

Work is expected to resume on the project in late June, according to DDC spokesperson Ian Michaels, who said the seismic testing is necessary.

“Because of the geography of the area, the work involves excavating over 4,000 cubic yards of rock. DDC has decided to halt the project in order to set up a vibration monitoring system that will track the structures in the local area for shifting or damage,” Michaels said in an email.

“Almost all the buildings in the area have to date been surveyed, and markers have been established at numerous sites to monitor structures. We expect the construction work to resume toward the end of June and for the entire project to be completed by fall 2021,” he said.

Werbel called on the city to move the vehicles and staging areas while the project is paused.

“If they took that away, it would make a huge difference,” she said. “East of Broadway, there are industrial lots that the city owns where the

machines and material could be moved to. Why keep it in a residential area?”

Werbel also called on the city to communicate with local residents about the status of the project.

“They should talk to us,” she said. “We should have been notified of what was going on. That’s a slap in the face.”

Island every year. Inmates from Rikers Island are used to dig graves, and paid about one dollar an hour for their work.

Matt Drury, Director of Government Relations for NYC Parks, said transfer of the island to the agency would occur once the city, led by the Human Resources Administration (HRA), established a process to end future burials on the island.

“The city will develop a plan to facilitate continued public access to Hart Island, as friends and family will continue to visit the gravesites of those buried on the island, even as new burials cease,” he said.

Drury explained that NYC Parks would provide general maintenance on the island, perform upkeep on the gravesites, and facilitate visitor services.

He said that visiting opportunities for gravesites would continue “at a similar frequency to what is currently offered today.”

However, Drury was unable to give a timeline for transition of the island, “given the complexities that need to be discussed

and examined,” he said.“To give an undetermined timeline and

not have a specific vision, I’m not sure is not the best preparation or presentation for this hearing. We expect more details moving forward,” replied Johnson. “The testimony today isn’t good enough.”

Johnson noted that people who attempt to visit loved ones on Hart Island are subjected to a “stressful” process of being escorted by armed guards, and having their belongings confiscated for the duration of their visit.

“Families and friends who want to visit Hart Island feel like they’re visiting a prison,” he said.

“It’s tough because you have to get on a prison bus to get to the burial site,” remarked Maria Soto, who has a relative buried on the island. “It’s a very upsetting process.”

Tami Martino, whose brother was buried on Hart Island in 1983 after dying of AIDS, said the island does not provide a dignified

burial place.“The Department of Corrections has its

place in this world, but it is not a funeral home nor [is it] a director of cemeteries. It certainly cannot provide people with the honor and dignity that every human being deserves when it comes to death and burial and maintaining a resting place for these souls,” she stated.

Nicole Donigher, HRA Chief of Staff, testified that that DOC allows family visitations once a month on Thursdays, and once a month on Saturdays. Appointments must be made 12 business days in advance.

“This is insane. This is crazy. This needs to be changed immediately,” said Johnson, who called on the city to allow better access to

families wishing to visit the graves of loved ones on the island.

“We need to see what we can do in the short-term to make it better, before we legislate this,” stated Johnson, who asked HRA to come up with a report within 30 days on how to improve visitation procedures on the island.

Melinda Hunt, a visual artist who began documenting Hart Island in 1991, said the island should be removed from DOC control but new burials should be continued there. She suggested that graves be recycled after 25 years and that the city should opt for un-embalmed “natural burials in plain pine boxes,” which she said are better for the environment.

“Unlike private cemeteries, which are quickly running out of burial space, Hart Island has plenty of space,” Hunt said. “We have the solution right here. We just have to

come up with a plan.”Hunt noted that the city does

offer low-income residents $900 for burial assistance, but that amount is still not accepted by many funeral directors.

“City burial is the only option for some people,” she said. “The

city should consider doubling burial assistance while also

educating the public about natural burials. These two things will go a

long way toward making Hart Island a culturally acceptable choice instead of a dreaded necessity.”

The subtitle of your book suggests that dignity is frequently lost when individuals are diagnosed with dementia and that it needs to be reclaimed. w There is a very encouraging trend to include those with dementia in setting policies and practices that affect them. An example is the shift in attitudes toward sexual activity for those with dementia. The old approach was that this was always bad and something to be prevented. The newer approach is that those with dementia are adults who have rights to express themselves in basic human ways. Though it is important to protect those who are vulnerable, a more nuanced and specific approach is appropriate regarding sexual activity, including in nursing homes.

5. You have been challenged for the assertion in your book that there are ways to find joy in dementia. Why are people taken aback and why do you think this is so important?

Every life should contain joy, so what is surprising to me is that people are shocked when I say people with dementia should know joy, too. Why should people living with dementia be the exception to the rule? I am not saying it is easy to find. What I am saying is that if we don't consider the possibility and don't even look, we are certainly less likely to find it. Since we don't have a cure, many more of us will join the nearly 6 million people with dementia. So,

we better get busy figuring out how life with dementia can include joy. It is important for the individuals living with dementia as well as for their loved ones.

Tia's book is also scholarly and highly personal. Her grandmother and mother both lived with and died from dementia. The book can help us understand better the history and research on the group of disorders – and understand the complex interplay of biology and environment in putting us at risk for dementia.
