Get WellIt’s important that we wait until you’ve completely recovered from your injuries before going further. This way, we can secure money for all the treatment you need to get better.

It’s also important to keep seeing your health-care specialist until you’re back to full strength. If there are time gaps between visits, the other party will argue you’ve recovered and injured yourself doing something else.

Obtaining an Initial Offer Our legal staff will begin by reviewing accident reports, insurance policies and medical information to determine the approximate value of your case.

Often, we are able to obtain a fair settlement without filing suit because insurance companies know Hupy and Abraham, S.C. isn’t afraid to go to court. This forces them to make a serious offer in hopes of settling the case out of court.

Generally the initial offer is not enough. Your attorney will go back and forth with the insurance company to obtain as good an offer as possible.

If your attorney advises you not to accept an offer, but you feel otherwise, your attorney will settle the case immediately. If your attorney advises you to accept an offer, but you want your day in court, your attorney will guide you through the lawsuit process.

If a Lawsuit Is FiledAt the beginning of the lawsuit process, the opposing party will submit a set of interrogatories, a series of detailed questions we’ll need to answer regarding the incident.

Following the interrogatories, you will be summoned for a deposition. At the deposition, you’ll meet with your attorney and the opposing attorney to answer questions about the incident and how it has affected your life.

The opposing party could also send you to a doctor of its choice for an Defense Medical Examination (DME). You will not be charged for such an examination.

Before starting a trial, the court could order a mediation between both parties. This gives the insurance company one last chance to make a fair offer before going to trial.

If your case goes to court, one of Hupy and Abraham, S.C.’s experienced trial lawyers will fight for you. Trials can be lengthy and complicated, but our attorneys are equipped to guide you through the process.

Just because a lawsuit is filed, it doesn’t mean the case will go to court. Keep in mind, the case can be settled at any time. Filing suit incurs additional costs for both sides, so it’s better for everyone to reach a fair settlement before the case goes to trial if possible.

Case ClosedOnce your case is settled, our accounting department will work to finalize the settlement.

The firm’s accountants will pay all medical bills and subtract the legal fees. Often, we’re able to obtain reductions on medical bills. This increases the amount of money you receive.

When everything is settled, we will provide you with a concise settlement statement detailing where all the money is going.

Once you sign the settlement statement, you will receive your check from your attorney or through the mail and a release from the insurance company.
