Applicability (Interim) • Any demolition involving the removal of more than 2/3 of

floor joists/ roof rafters with any modification to the exterior wall must meet requirements of complete demolition

Demolition Contractor License • Class A and Class B license categories • Demolition Supervisor and Site Safety Manager • No need to maintain a 3527 License • Subcontractors performing demolition operations require

licensure • Change in contractor requires an amended permit. Original

issue date still determines latest construction start.

Site Safety Plan • Describe construction type and identify means and methods of

demolition, required protections, and special hazards; • Must be prepared by the Demolition Supervisor.

- May be prepared by an engineer if endorsed by the Demolition Supervisor.

• Include detail relevant to the site; • Specific provisions for structural steel, reinforced concrete, and

heavy timber; • A narrative prepared by demo supervisor; • Communication w/ Examiner.

Site Plan • Include all required dimension; • Any sidewalk protections must be identified.

B-3303.8.1 A safety zone shall be maintained around all demolition areas to prevent non-authorized persons from entering such zone. Where mechanical demolition equipment, other than handheld devices, is to be used for the demolition of a building, the safety zone shall be equal to or greater than half the height of the building to be demolished.

Non- mechanical demo- Safety Zone is currently established using Table B- 3306.1.

B-3307.1.1 Notification. Where a construction or demolition project will require access to

adjoining property, in order to protect the adjoining property or otherwise, written notification shall be provided to the adjoining property owner a minimum of 10 days prior to the commencement of work. Such notification shall describe the nature of work, estimated schedule and duration, details of monitoring to be performed on the adjoining property, protection to be installed on the adjoining property, and contact information for the project.

B-3307.2 License to enter adjoining property. The responsibility of affording any license to enter adjoining property shall rest upon the owner of the adjoining property involved. It is the responsibility of the person making or causing construction or demolition operations to obtain any necessary license to enter adjoining property from the owner of such property prior to the start of work. If the person who causes the construction, demolition, or excavation work is denied a license to enter by the adjoining property owner, and the building undergoing work is an imminent danger to the adjoining property, as determined by the Department, such duty to preserve and protect the adjacent property shall devolve to the owner of the adjoining property.

A permit will not be issued until it has been determined that the Contractor may legally access the adjacent property.

Special Inspections • Complete demolition of a building more than 3 stories or

40’ in height. • Complete demolition utilizing mechanical means where

there is an occupied structure within the safety zone or the structure undergoing demolition is physically connected to a structure to remain.

• Where mechanical demolition equipment, other than handheld devices, is to be used in the full or partial demolition of a building from within the building, or is to be used within the building to remove debris or move material.

• Special Cases (B-1704.15)

• Statement of Special Inspections, signed by Design Professional in Responsible Charge, required prior to permit issuance.

• List of inspectors also required prior to permit issuance under Section A-305.2 of the Administrative Code; however, the requirement was not enforced.

• Special Inspections Compliance Form required prior to issuance of CO/COA.

Component Qualifications

Underpinning (Phila Code)

Primary Inspector Must be a professional engineer (Civil or Structural). Must have a minimum of one year relevant experience.

Supplemental Inspector: Must have a Bachelor’s Degree (Civil or Structural engineering). Equivalent Degree with two years relevant experience.

PE (prior to each phase and as prescribed) Supplemental Inspector is permitted to provide continuous inspection during excavation/ pouring

Demolition (Phila Code)

Primary Inspector or Inspection Supervisor: Must be a professional engineer (Civil or Structural). Must have a minimum of one year relevant experience.

Supplemental Inspector:

Must work under the direct supervision of a Primary Inspector or Inspection Supervisor.

Completed OSHA 30 (Construction) or a course in 29 CFR 1926 Subpart T-Demolition standards and applicable 29 CFR 1910.

Must have a minimum of 3 (three) years of relevant experience.

The DPRC-SI must identify required special inspections .

Any required inspections which are not specifically identified on statement must be entered by the DPRC-SI on Page 2 of form.

The DPRC-SI must sign and seal Statement of Special Inspections.

Inspector, Contractor and Owner

The agreement must be signed by the owner, DPRC- SI, and the contractor and submitted prior to permit issuance.

Contractor • Coordinate a pre-construction meeting with the DPRC-SI,

special inspector, applicable sub-contractors, and building inspector;

• Provide 48 hours advance notice to the special inspector prior to the need for field inspections’

• Provide the building inspector and special inspector an opportunity to witness the approved repairs identified in reports;

• Provide a daily sign-in sheet at the jobsite for the special inspector.

• Pre-construction Meeting

• Individual inspection reports must be furnished upon request.

• Final Compliance Form verifying that all inspections have been completed must be prepared by DPRC-SI and submitted to the inspector prior to the issuance of the CO/COA.

Bill No. 130685 (Feb 2014) established a special inspection agency registration, required for all companies performing special inspections.

New Licenses

Phase 1: Education

• All existing general contractor license holders must submit proof of safety training for license renewal. Failure to do so will preclude renewal.

• Department will take enforcement action against all noncompliant contractors (in any category).

• All workers on a construction or demolition site must complete a basic training course (OSHA 10 Construction or approved equivalent that meets or exceeds OSHA 10).

• This requirement does apply to all trades and registered PA Home Improvement Contractors.

• This requirement does not apply to delivery persons, design professionals and their staff, special inspectors and similar persons performing duties at a construction or demolition site whose work is not considered construction or demolition work regulated by a permit. (Excluded by regulation)

All licensed contractors (excluding plumbing, electrical, fire suppression, and warm air apparatus contractors) must identify at least one supervisory employee who has completed an extended safety training course (OSHA 30 Construction or approved equivalent)

The required training course must be completed within

the past five years of the date of application for a contractor's license or the renewal of the contractor's license.

• Contractors licensed under 9-1004 of the Philadelphia Code and

demolition contractors licensed under 9-1008 are required to identify at least one supervisory employee with safety responsibility who has completed an OSHA 30 course (or approved equivalent) as a condition of the license.

• This requirement does apply to sign installers and mechanical contractors licensed under Section 9-1004 of the Philadelphia Code.

• This requirement does not apply to plumbing, electrical, fire

suppression, PA State Home Improvement, and warm air apparatus contractors. HVAC, sign installers, roofers, etc.. cannot be excluded because they possess a general contractor’s license.

• Construction or demolition on major buildings requires continuous oversight by a site safety manager who has completed an OSHA 30 course (or approved equivalent).

• For construction operations, this role may be filled by an independent contractor. A demolition site safety manager must be employed by the demolition contractor.

• The new construction, exterior alteration or demolition of a building exceeding 3 stories or 40’ in height (excluding parapets and roof top structures) requires the continuous presence of a site safety manager with OSHA 30 training (or approved equivalent).

• Alteration or demolition limited to the interior of a building which does not impact the exterior (including fire sprinkler, plumbing, electrical or mechanical work) does not require the continuous presence of a site safety manager. (Excluded by regulation)

• Same criteria used for work site information panels.
