Introduction

From the 1st April 2017, all Non-Household Customers will be free to select a Retailer (Licensee or

Undertaker of Retail Business) who will be responsible for the customer service and billing elements

of their water and waste-water services. Yorkshire Water (YW) Wholesale will only be responsible

for the provision of water and waste water wholesale services. Under the changes, YW Wholesale

will retain ownership of the Non-Household Customer’s water meter.

YW Wholesale data logger policy allows Applicants to attach data logging equipment to Yorkshire

Water meter assets. Relevant Applicants shall include a Retailer, a Non-Household Customer or a

Third Party Organisation. YW Wholesale will fit a data logger cable which will provide a pulsed

output connection to allow the future connection of data logging equipment by the Applicant.

Under this policy:

YW Wholesale shall own the data logger cable;

YW Wholesale shall be responsible for the maintenance of the data logger cable during the warranty period (12 months warranty from the date of installation);

YW Wholesale shall be responsible for replacement or repair of the data logger cable outside the warranty period for which a charge will apply;

the Applicant shall own and be responsible for the maintenance of the data logging equipment.

The Applicant must obtain written confirmation (authorisation) from YW Wholesale prior to

attempting to install any data logging equipment to the meter, via the procedure outlined in this

policy.

This policy is intended to provide clear guidance to the Market Operator, Retailers, Third Parties and

Non-Household Customers on how to connect to a Yorkshire Water meter. Consumption monitoring

can assist in reducing wastage by promoting the more efficient use of water. The fitting of data

logging equipment to the meter will not affect the normal activities of collection of metering data for

billing purposes by the Retailer, or operational purposes by YW Wholesale for very large consumers

of water.

This process will be compliant with the Wholesale-Retail Code Part 3: Operational Terms, Part B

Metering, Section D - Data loggers (or similar devices for data capture and transmission) fitted on

meters.

Aim

This policy sets out the general principles by which YW Wholesale will allow the data logging of its

Non-Household Customer meters. The aims of the policy are:

To ensure a consistent approach to data logging of meters is followed within YW Wholesale operational area;

To provide Applicants with guidelines that shall be complied with at all times;

To inform Applicants of the process to follow to have a data logger cable fitted.

If Applicants are found to be in breach of this policy, YW Wholesale may take enforcement action. The purpose of enforcement is to ensure that preventative or remedial action is taken to secure compliance with our policy, market codes and associated regulation.

Exclusions from Market Codes

Accredited Entities – we do not permit the use of Accredited Entities for any activity defined

within this policy.

Principles

To ensure the policy is enforced fairly, the following section contains the process that shall be

followed by all Applicants.

General Guidance

1. An Applicant must obtain written confirmation (authorisation) from YW Wholesale prior to installing any data logging equipment via the application procedure outlined in this document.

2. By signing the ‘Data Logger Connection Request Form’ the Applicant is agreeing to the YW Wholesale Policy, and shall indemnify and keep indemnified YW Wholesale from and against all claims, demands, actions, costs, expenses, liabilities and damages or losses, or in connection with any and all fraudulent or negligent acts or omission of, or breaches of these terms and conditions by the Non-Household Customer, its officers or employees, or its sub-suppliers.

3. The meter, any automatic meter reading (AMR/AMI) systems fitted along with associated pipework, fittings to facilitate the isolation and removal of the meter, chamber and cover are the property of YW Wholesale.

4. The Applicant must not remove or interfere with any data logging equipment they find attached to the meter.

5. YW Wholesale reserves the right to refuse access to its meters for logging purposes.

6. YW Wholesale reserves the right to disconnect any data logging equipment at any time, for

example if it interferes with the reading of its meters, or affects the performance of its radio devices installed on the meter. Notice will be given in writing one month prior to disconnection.

7. The Applicant is responsible for removal and refitting of their data logging equipment.

8. These terms and conditions do not affect any potential liabilities for damage caused to a Non-Household Customer’s property as set out in YW Wholesale’s statutory duties or customers’ rights.

Data Logger Cable

9. YW Wholesale will select the appropriate data cable based on the meter manufacturer, model and age.

10. YW Wholesale will install a splitter cable to provide a primary and secondary pulsed output. The primary output will be for YW Wholesale’s data logging equipment and the secondary output will be for the Applicant’s data logging equipment.

Non-Household Customer’s Data Logging Equipment

11. As part of the application process the Applicant must supply a detailed product specification for the data logging equipment which is to be fitted to the meter in order that the correct data logger cable can be fitted. Note: If the Applicant wishes to install data logging equipment that is not bespoke (i.e. as supplied by the meter manufacturer), then a barrier relay must be fitted by the Applicant at their expense. In addition, no alterations may be made to the meter chamber without prior approval. YW Wholesale cannot provide any technical advice or recommend any type of data logging equipment.

12. Any data logging equipment installed on an YW Wholesale meter must be clearly marked

with a contact name and telephone number.

13. Meter chambers are likely to be flooded at any time due to rainfall/ground water levels or other causes. It should be noted that all data logging equipment should be IP68 rated (able to be submersed in water) in order to function correctly.

14. The Applicant should also be aware that devices fitted in waterlogged chambers or under

heavy meter lids are less likely to be able to transmit data. An above the ground housing unit is recommended in such instances.

15. YW Wholesale does not check signal strength within the chamber as part of a standard or non-standard data cable installation and accepts no liability for the failure of any Applicant’s data logging equipment.

16. The Applicant shall be liable for any damage caused to the YW Wholesale meter, associated pipework, fittings or chamber as a result of installing data logging equipment. Equipment must not be installed where it will interfere with ability to visually read the meter.

17. YW Wholesale will give the Applicant the option to remove their data logging equipment prior to exchanging the meter or carrying out repairs under warranty. If the Applicant chooses not to make its own arrangement for disconnecting the equipment then YW Wholesale will remove the data logging equipment and use reasonable endeavours to reconnect such equipment once the work is completed. Where it has removed a logger, YW Wholesale will not be responsible for any damage to the logger other than as a result of negligence or breach of statutory duty.

YW Wholesale’s Data Logging Equipment

18. YW Wholesale may choose to install data logging equipment on a Non-Household Customer meter for leakage monitoring purposes only. This data is exclusively for the use of YW Wholesale and data will not be shared.

19. YW Wholesale owns and is responsible for this data logging equipment. 20. Where YW Wholesale has existing data sharing relationships in place direct with the Non-

Household Customer, arrangements will be made to install separate data loggers as part of the ongoing leakage programme of work.

21. Where YW Wholesale has a data logging equipment already fitted, a splitter will be installed to provide a second pulsed output connection onto which the Applicant can connect their data logging equipment.

22. YW Wholesale’s data logging equipment shall take priority. Where there is insufficient room to fit a second data logger within the chamber, a quote will be provided for a non-standard installation.

Connections for Building Management Systems or Dosing Systems

23. The Applicant may wish to have the meter hardwired to their Building Management System or to take a pulse from the meter in order to install a dosing system. The Applicant needs to select this option on the ‘Data Logger Connection Request Form’.

24. YW Wholesale will install a data cable onto which the Applicant can connect their equipment.

Minimum Safety Requirements

25. YW Wholesale will allow the Applicant entry into the meter chamber for the purposes of accessing data logging equipment. Except in respect of death or personal injury caused by YW Wholesale’s negligence, YW Wholesale accepts no liability for any death or personal injury caused to individuals whilst undertaking this activity.

26. Where the Applicant uses a Third Party to install the data logging equipment on their behalf they must ensure they comply with applicable Health & Safety legislation and have the appropriate technical competencies.

27. YW Wholesale water meters are generally housed in an external meter chamber. These may

be a confined space which is substantially enclosed (though not always entirely), and where serious injury can occur from hazardous substances or conditions within the space or nearby (e.g. lack of oxygen). Under domestic law (the Health and Safety at Work etc. Act 1974) employers are responsible for ensuring the safety of their employees and others. This responsibility is reinforced by The Confined Spaces Regulations 1997. Therefore individuals involved in installing data logging equipment shall have the appropriate competencies.

28. Any work on or near the highway must comply with The New Roads and Street Works Act

(NRSWA) 1991 and the Traffic Management Act (TMA) 2004.

29. YW Wholesale will allow the Applicant to fit data logging equipment where this work is ‘non’ invasive i.e. there is no direct contact with the water meter, pipework and fittings.

Lithium Batteries in Data Logging Equipment

30. Data logging equipment is generally fitted with a Lithium based cell(s) or battery. YW Wholesale has mandatory and minimum safety requirements which must be adopted and complied with prior to placing or connecting any device which is powered by or contains Lithium based cell(s) or batteries to any YW Wholesale asset in any YW Wholesale location, site or chamber.

31. YW Wholesale mandatory and minimum safety requirements are detailed in Appendix 1. These must be adopted and complied with prior to placing or connecting any device which is powered by or contains Lithium based cell(s) or batteries i.e. data logging equipment, to any YW Wholesale asset in any YW Wholesale location, site or chamber.

32. The Applicant is responsible for completing and submitting the Self Certification Form and ensuring that the equipment to be fitted satisfies the Mandatory Requirements in Appendix 1.

Data Logger Cable Standard Installation

33. The data logger cable standard installation covers:

processing of the application;

cross referencing the meter details with our records to confirm the meter serial number(s), make and location details are correct and the meter is loggable;

undertaking a survey at the Eligible Premise (includes survey of multiple meters);

approval of the Permission to Connect Form;

site visit and meter survey (Monday to Friday only, during office hours); installation of data logger cable with two outputs. The secondary output will be for the

Applicant to attach their data logging equipment;

providing an accurate quotation for a non-standard installation.

Data Logger Cable Non-Standard Installation

34. A non-standard installation may be required when the data logger cable cannot be fitted as part of the visit to the eligible premises, for example:

the meter does not have a pulsed output connection and requires exchanging;

any excavation work is required;

an above ground housing unit is required;

work is required to gain access to the meter on the Eligible Premise, i.e. materials stored on top of the chamber.

35. The Applicant shall be bound by any decision regarding the most technically appropriate and

cost effective solution. The Applicant will be provided with a written response outlining the findings of the survey.

36. YW Wholesale reserves the right to install a new meter at any time and for any reason

where a meter exchange is deemed necessary. YW Wholesale will not be liable for any charges, costs or losses incurred by the Applicant in relation to any change in meter type or any resulting additional cost relating to procuring or installing new data logging equipment.

37. YW Wholesale reserves the right to specify an above the ground housing unit where it is

deemed that data logging equipment cannot be fitted safely i.e. the chamber is a confined space or is overcrowded.

Application Process

38. The Applicant will submit the following information:

F/01 form F4 (Non Household Customer Enquiry) (for Retailer use only);

Data Logger Connection Request Form (see page 11);

Permission to Connect Form (see page 16). The initial application may be refused or returned to the Applicant for resubmission where the form is not completed in full or contains insufficient information. Note: Where the Applicant requests a hard wired connection on the Data Logger Connection Request Form, for connection to a Building Management System or dosing system, then the General Enquiry Form and the Permission to Connect Form are not required.

39. A separate Application is required for each individual meter which includes multiple meters at the same address.

40. The standard installation fee can be found at:

41. YW Wholesale will visit the Eligible Premise by prior arrangement with the Applicant, or the Non-Household Customer with the Applicant’s consent, to undertake the survey. The survey will be used to confirm whether the meter has a pulsed output and is loggable.

42. YW Wholesale will install a pulsed output connection as part of the survey where the meter is loggable and no other issues preventing installation are identified.

43. Where the survey identifies that a non-standard installation is required, YW Wholesale will inform the Applicant of its findings and provide a quote for the non-standard installation.

44. If the pulsed output connection cannot be fitted due to an issue that YW Wholesale needs to rectify then arrangements will be made to carry out rectification work before the data cable is fitted. Examples include:

the meter is leaking;

the chamber damaged and is flooded;

the meter is buried.

45. The Applicant will confirm its request to proceed with the non-standard installation.

46. If the Applicant decides not to proceed with the non-standard installation, in the period between confirming its request and the time of the work, the 1 or 2 person Meter Survey fee will still be payable, see https://www.yorkshirewater.com/business/services#ls2.

47. YW Wholesale will arrange with the Applicant, or the Non-Household Customer with the Applicant’s consent, a date for the non-standard installation.

48. Where YW Wholesale is exchanging the meter it will follow the YW Wholesale Policy on installation, repair and replacement of a Non-Household Water Meter.

49. The water supply will be turned off when the meter is exchanged. The Non-Household Customer shall make their own arrangements to provide drinking and sanitary water provisions during this period.

50. YW Wholesale is responsible for isolation and re-commissioning of the Non-Household Customer’s water supply.

51. YW Wholesale will inform the Applicant when the installation has been completed and they can install their data logging equipment

Scheme Charges

52. Where charges ‘may’ apply refer to YW Wholesale’s Charges Scheme at

https://www.yorkshirewater.com/business/services#ls2. 53. The 1 or 2 person Meter Survey fee will still be payable in the event of an aborted visit. A

return appointment will not be made until the Applicant has rectified the issue which is preventing installation and confirmed that they wish to proceed.

54. The quotation from YW Wholesale will be valid for three months from the date of the quote.

After three months a re-quotation will be required.

Warranty

55. YW Wholesale only offers a 12 month warranty and call out service on data logger cables. If a data logger cable fails outside the warranty period, a charge will be made for a replacement cable. If a meter is replaced by YW Wholesale within 24 months of the data logger cable being installed and the original cable is incompatible, YW Wholesale will return to site and install a data logger cable free of charge.

No Data / Flat lining Data Logger

56. Retailers must notify YW Wholesale of any malfunctions they can attribute to the meter or data logger cable. Any repairs or replacements will be carried out by YW Wholesale in accordance with the warranty period.

57. In those instances where YW Wholesale is called out to a no data / flat lining issue and subsequently finds that the data logger cable is functioning correctly, the logger cable investigation fee will be payable by the Applicant. Interpretation

58. This policy shall take precedence over any other terms and conditions. No terms or conditions endorsed upon, delivered with or contained in the Applicants purchase order, confirmation order specification or other documents will form part of this Agreement.

Appendix 1 - Mandatory Requirements regarding Lithium Batteries

61. The Applicant must complete the ‘Permission to Connect Form’ and have the detailed specification of the data logging equipment reviewed and approved for use as part of the overall process outlined in this Data Logging Policy.

62. The Parties to this ‘Permission to Connect’ are YW Wholesale and relevant Applicants. 63. Written permission from YW Wholesale (following the process outlined in this Data Logging

Policy) must be received by the Applicant before any placement or connection of equipment to YW Wholesale’s assets.

64. YW Wholesale will not warrant or give product, design or safety review approval or certification to any device provided by or used by the Applicant. For the avoidance of doubt all safety design responsibility assessment and liability for the device(s) remains with the Applicant.

65. Except in respect of death or personal injury caused by YW Wholesale’s negligence, YW Wholesale accepts no liability which any Applicant may incur through its use of the connection irrespective of the outcome of the request for permission and howsoever such liabilities may have been incurred.

66. The Applicant shall indemnify and keep indemnified, defend and hold harmless YW Wholesale, it’s officers, directors, employees, agents, successors and assigns, from any and all losses that a court finally awards or that is agreed in a settlement approved by the Applicant, incurred or suffered by or made against any of them to the extent resulting directly or indirectly from, or connected in any way with any of the matters listed below (whether or not such losses were foreseeable at the date of entering into these conditions):

All losses awarded against YW Wholesale arising out of or in respect of, or caused or contributed to by the services, the Applicant’s equipment and/or the Applicant’s breach of these conditions;

Any act or omission (including negligence, wilful default or dishonesty) of the Applicant and/or any Applicant’s personnel;

Any death of or personal injury to any employees, agents, sub-contractors or other persons of the Applicant or YW Wholesale or to any third party, to the extent caused by any act, omission or default of the Applicant and/or any Applicant’s personnel.

67. YW Wholesale reserves the right to refuse permission to connect data logging equipment

without requirement to provide any reason or justification for the refusal.

Self Certification by the Applicant

68. Only the Applicant or authorised officer of the Applicant can complete the ‘Permission to Connect Form’ on behalf of the Non-Household Customer.

69. The ‘Permission to Connect Form’ contains a list of compliance statements in response to

the mandatory and minimum safety requirements, and should be submitted to YW Wholesale with other information outlined in this Data Logger Policy.

70. By signing the ‘Permission to Connect Form’ the Applicant agrees to be bound by these

Terms and Conditions.

71. The Applicant shall review the following compliance statements (Sections A – F) and record on the ‘Permission to Connect Form’ (see page 16), if the data logging equipment is compliant or non-compliant against each statement.

Note: YW Wholesale will only permit the use of a compliant device.

A) Device Power

72. The device’s power unit (hereafter termed “battery” or “battery-pack”) must be selected, or designed, specifically for use with the device.

73. The battery used by the device must be explicitly identified and advised to YW Wholesale, as should the original manufacturer of the battery.

74. Please provide Lithium content in grams per cell and per composite battery. Please provide ATEX certification, all CE accreditations and any accompanying information (i.e. Materials Safety Data Sheets and Technical Specification Data Sheets).

75. The Device and battery units, either connected or unconnected, must be submersible to IP68 standard.

B) Tracking, Deliveries and Maintenance

76. The Device must be labelled with a serial number and identification of the Applicant. Any external battery pack must also be labelled with agreed details, including serial number and hazard warning information. The label must be reliably attached to the front of the battery such that it can be clearly seen when in-situ. Devices with internal batteries must have the hazard warning labels clearly displayed on the device.

77. Deliveries to any YW Wholesale location, including meter chambers, shall be made in conformance to:

European Agreement concerning the International Carriage of Dangerous Goods by Road ADR applicable as from 1 January 2015.

Transport regulations UN 3090 for Lithium batteries and UN 3091 for Lithium batteries contained in equipment or packed with equipment. LEV Lithium batteries belong to dangerous goods class 9 and packaging group.

78. The device should be capable of identifying when and where low battery power conditions

exist prior to battery failure (exhaustion), or the Applicant must have equivalent robust procedures in place.

C) Disposal

79. The Applicant must take and retain full responsibility and have established procedures in place for the safe and secure disposal of the Device and battery at the end of its useful life.

80. The arrangements the Applicant will put in place for disposal must comply with the Waste Electrical and Electronic Equipment (WEEE) Directive 2012/19/EU, or any superseding legislation.

81. No onsite logger or battery maintenance is permitted, a ‘swap-out’ (full unit exchange) policy must be adopted and adhered to.

D) Safety Certification and Warrant

82. The supplier shall warrant the Device and associated battery unit so that: A) It is fit for purpose and safe under all anticipated operating conditions (these, and the

limits of, operating conditions shall be explicitly stated by the supplier); B) The battery and/or battery pack has been designed and approved in line with

international standards (e.g. BS EN 60086-1:2011 Primary batteries) and that a suitable authority has approved the design as safe;

C) The construction of the battery and / or battery pack is by a reputable manufacturer

registered to ISO 9001:2015 Quality management systems requirements.

83. The battery and / or battery pack has been tested to:

BS EN 62281:2013. Safety of primary and secondary lithium cells and batteries during transport. The assembled pack to BS EN 60086-2:2011. Primary batteries parts 1 to 6.

84. The Applicant shall ensure the data logger is not to be located in an area with a potentially

explosive atmosphere. Note: If the data logger is to be located in an area with a potentially explosive atmosphere, then YW Wholesale shall require the Applicant to ensure the data logger is compliant with:

BS EN 60079-11:2012 Explosive atmospheres. Equipment protection by intrinsic safety "i" and UL1642 Standards for Safety. Lithium Batteries.

E) Testing

85. In addition, the battery pack shall be tested by the Applicant and certified that it remains safe (i.e. no venting, explosion, discharge or heat gain in excess of 60 degrees centigrade) under each of: A) Forced and complete discharge; B) Electrical Shorting; C) Prolonged submersion.

F) Product Data Sheet

86. A Product data sheet must be provided. Note: It is essential that documentary evidence is provided that to demonstrate that the lithium batteries have successfully passed all ‘UL’ and ‘UN’ standards for lithium batteries, as outlined in the compliance statements.

Assessment of Overall Compliance

87. YW Wholesale shall review the ‘Permission to Connect Form’ to ensure the equipment which contains a lithium battery is compliant against the mandatory and minimum safety requirements.
