Zoning Amendment Bylaw No. 7756, 2015 PROJECT DESCRIPTION:

In the City of New Westminster’s Zoning Bylaw, the definition of a Commercial School contains a number of uses that are out of step with the curriculum currently being taught at a Commercial School. Staff propose to clarify the definition in order to provide a more inclusive definition of the uses permitted and allow more efficient processing of business licence applications. It is not proposed to make any changes to the definition of a Self-Improvement School. WHAT IS ZONING AMENDMENT BYLAW NO. 7756, 2015 ABOUT?

In Section 120.44 the Zoning Bylaw currently defines a Commercial School as:

120.44 COMMERCIAL SCHOOL means the use of a building, or portion of a building, for the training and or instruction of students in business skills, including secretarial, accounting and bookkeeping, sales and marketing, computer programming, small business machine operating, language instruction, and similar office and commercial use functions. Commercial School also includes Self-Improvement School.

The proposed amendment would change the definition of a commercial school and would allow staff to process business licence applications appropriate to this land use. The proposed new section would read:

120.44 COMMERCIAL SCHOOL means the use of a building, or portion of a building, for the training and or instruction of students in business skills, and similar office and business use functions; and a post-secondary institute offering only programs, and certificates, diplomas, degrees or other qualifications in health care sciences professions or practices and health care administration, and health care research and development, and includes without limitation, medicine, dentistry, nursing, dental assistants, physiotherapy, health consulting, dental technology, and medical technology. A Commercial School also includes Self-Improvement School.

HOW DO I GET MORE INFORMATION?

The bylaw and all pertinent material are available for viewing online at www.newwestcity.ca/publicnotices, and also in the Planning Department at City Hall 10 business days prior to the Public Hearing, May 7, 2015 to May 25, 2015. City Hall hours are Monday between 8:00 am and 8:00 pm, Tuesday through Friday between 8:00am and 5:00pm (except statutory holidays).

HOW CAN I BE HEARD?

The public is welcome to attend the Public Hearing on May 25, 2015, or send a written submission addressed to Mayor and Council prior to the closing of the hearing.

5. Proposed Amendment to the Definition of Commercial School

Bev Grieve, Director of Development Services, introduced the report dated April13, 2015 and provided the following information in response to Council’scomments:

• Existing schools in New Westminster could fit under the new definition;• There is a fine line between the definition of business and health care;• There are various types of schools, nothing that computer technical schools

could be considered as part of the business sector;• The proposed zoning amendment does not pertain to government

educational institutions (eg: Justice Institute);• Schools must comply with all relative City legislation when operating (eg:

business licenses, zoning use, etc.).

Discussion continued and members of Council noted that the proposed bylaw should address training as it relates to succession planning in a job.

MOVED and SECONDED THAT Council consider Zoning Amendment Bylaw Number 7756, 2015 to amend section 120.44 of the Zoning Bylaw for First and Second reading and forward the bylaw to a Public Hearing on May 25, 2015.

CARRIED. All members of Council present voted in favour of the motion.
