Unofficial minutesThe Commissioners of the City of

Horton met for a regular meeting onMonday, May 20 at 5:15 p.m. at CityHall.

Mayor Stirton called the meetingto order and the prayer was led byJohn Calhoon. The Pledge of Alle-giance was recited by all.

Present: Mayor Bryan Stirton,Commissioners Wade Edwards, RexWest, Bobby Bacon, and Ken Krug.City Attorney Kevin Hill and CityAdministrator John Calhoon werealso present.

Motion by West to adopt theagenda. Seconded by Bacon. All aye.

Motion by Edwards to approve theminutes from the May 6, 2019 regu-lar meeting after requesting a revisionto the minutes. Seconded by Krug.All aye.

Motion by Edwards to approve Ap-propriation Ordinance #3558 (Pay-roll) for the amount of $35,357.56.Seconded by Krug. All aye.

Motion by Edwards to approve Ap-propriation Ordinance #3559 (Dis-bursements) for the amount of$241,791.86. Seconded by Krug. Allaye.

Public Comments--None.Request to be placed on AgendaConnie Werner shared that the Big

Kansas Road Trip will be in Brown,Doniphan, and Nemaha counties onMay 7th – 10th 2020. The planning isin the infant stages right now, but ev-ery city will promote their own countyby coming up with ideas to endorserestaurants, attractions, and events.Connie will keep the Commissionupdated as things progress.

Casey Bratton would like to pur-chase the lot north of the water towerall the way to the alley. Bratton hasbeen maintaining the property. TheCommission tasked Bratton with go-ing to the county to get a legal de-scription of the property, make surethere are no back taxes owed, and getan aerial of the property. Commis-sioner West also recommended thatthe administrator get with the watertower company to make sure theydon’t use the land.

Zoning Change RequestKevin Hill stated that the rezoning

of 1400 5th Avenue West would haveto be adopted via Ordinance, and thathe could prepare for the first readingat the next Commission meeting.Motion by Edwards to accept the rec-ommendation of the Planning Com-mission to approve the zoning change.Seconded by West. All aye.

APPA Annual FeeEdwards finds the proposal is

minimally beneficial to the city andnot worth the monthly fee. Motion byCommissioner Edwards to declinethe proposal from KMEA regardingjoining APPA. Seconded by Commis-sioner West. All aye.

McAfee earnsacademic honorsCarissa McAfee of is one of 12

students named Shepherd Scholarsfor the 2019-20 academic year atEmporia State University.

Eligible students have maintaineda cumulative grade point average ofat least 3.0, at least 60 credit hours.

CRIMINAL:Amber Finch, Horton, KS., en-

tered a plea of no contest to criminaldeprivation of property, a class A mis-demeanor, amended from theft, alevel 9 non-person felony. Disposi-tion of one count identity theft, a se-verity level 8 non-person felony, isnot indicated. Sentencing is July 8.

Sentencing on Roy Keighley,Hiawatha, KS., has been rescheduledto July 8, 2019. He plead no contestto driving under the influence, a classA misdemeanor amended from a non-person felony; and interference withlaw enforcement, a class A misde-meanor amended from a level 9 non-person felony.

Andrew V. Armstrong, Robinson,KS., was sentenced on interferencewith law enforcement, a class A non-person misdemeanor, to 12 monthsin the Brown County Jail with creditfor 2 days served; and on driving whilelicense canceled, suspended, or re-voked, a class B non-person misde-meanor, to 6 months in the BrownCounty Jail. Sentence was stayed un-til May 15, to allow him to enterHouse Arrest or report to jail on a 90-day commitment. He was placed on12 months supervised probation andordered to pay $112 court costs.

Bond appearance on Scott A Gray,Topeka, KS., has been rescheduled toJune 24, 2019. He is charged withpossession of methamphetamine, adrug severity level 5 felony; and pos-session of drug paraphernalia, a classB non-person misdemeanor.

Carolyn A. Barrie, Kansas City,MO., entered a plea of no contest topossession of methamphetamine adrug severity level 5 felony. Sentenc-ing is scheduled for July 8, 2019.

Jami J. Weeks, Hiawatha, KS., wassentenced on possession of metham-phetamine, a drug severity level 5felony, to 14 months in prison withcredit for 5 days served. Sentence wassuspended. She was placed on 12months supervised probation and or-dered to pay $193 court costs, $45booking fee, $100 indigent defensefee, $400 KBI Laboratory fee, $200KBI DNA database fee and $120 pro-bation fee.

Arraignment on Lonnie Coker,Fairview, KS., has been rescheduledto June 3, 2019. He is charged withfleeing or attempting to elude a po-

lice officer, a level 9 person felony;no insurance, a class B non-personmisdemeanor; driving while licensecanceled, suspended, or revoked, aclass B non-person misdemeanor;driving beyond restrictions, a class Bnon-person misdemeanor; and im-proper registration, an unclassifiedmisdemeanor.

Jordan Kahbeah, Horton, KS., en-tered a plea of no contest to battery, aclass B misdemeanor, amended fromaggravated domestic battery, a level7 person felony; and was sentencedto 6 months in the Brown County Jailwith credit for time served. One counteach criminal restraint, a class A per-son misdemeanor; and intimidation ofwitness or victim, a class B personmisdemeanor, were dismissed. Hewas ordered to pay $158 court costs.

Arraignment on Lonnie Coker,Fairview, KS., has been continued toJune 3, 2019. He is charged with do-mestic battery, a class B person mis-demeanor.

Arraignment on Jacinto Ramirez,Hiawatha, KS., has been continued toJuly 8, 2019. He is charged with 2counts criminal threat, a level 9 per-son felony.

Arraignment on Lonnie Coker,Fairview, KS., has been continued toJune 3, 2019. He is charged with 3counts making false information, alevel 8 felony.

Sissy Wilson, Hiawatha, KS., en-tered a plea of no contest to trafficcontraband in correctional facility, alevel 6 felony. One count possessionof methamphetamine, a severity level5 drug felony was dismissed. Sentenc-ing is scheduled for June 3, 2019.

Sentencing on Anna L. Swogar,Hiawatha, KS., has been continueduntil further order of the court. Sheplead no contest to possession ofmethamphetamine with intent to dis-tribute, a drug severity level 4 felony.

A jury trial on Robert A.Hendricks, Hiawatha, KS., has beenscheduled to begin August 28, 2019.Pretrial conference is scheduled forJuly 8, 2019. He is charged with pos-session of methamphetamine withintent to sell, a drug severity level 3felony; possession of drug parapher-nalia, a drug severity level 4 felony;possession of methamphetamine, adrug severity level 5 felony; and taxa-tion; drugs; no drug tax stamp payment

for marijuana or controlled substance,a drug severity level 10 felony.

Status conference on Bradley ADonahue, Powhattan, KS., was beenscheduled for May 30, 2019. He ischarged with violation of protectionorder, a class A person misdemeanor.

A jury trial on Robert A. Hen-dricks, Hiawatha, KS., has beenscheduled to begin August 28. Pre-trial conference is scheduled for July8 He is charged with battery, a classB person misdemeanor.

Sale of Surplus Property on PurpleWave

Calhoon would like to place bigticket items such as vehicles, scrapiron, and asset forfeiture items forsale on Purple Wave. Krug mentionedgiving the bikes away to local kids intown.

Motion by Commissioner Krugauthorizing the sale of asset forfei-ture and surplus property with PurpleWave. Seconded by CommissionerWest. All aye.

Calhoon will provide a list ofitems for sale to the Commissioners.

Razo Property10 Minute Executive Session to

Discuss Attorney-Client PrivilegeMotion by Commissioner West to

go into a 10 minute executive sessionto discuss attorney client privilege toinclude Mayor Stirton, Commission-ers Edwards, Krug, West, and Bacon,John Calhoon, Kim Knudson, andKevin Hill. Seconded by Commis-sioner Edwards. All aye.

After executive session, Motion byEdwards for the city attorney to drafta Resolution for abatement of theproperty referred to as The RazoProperty. Seconded by West. All aye.

Motion by Edwards to appointLynn Marie Allen to the library boardper the recommendation of the libraryboard and Mayor Stirton. Seconded byBacon. All aye.

Lynn will replace KristinFassnacht.

Calhoon thanked Bobby Bacon andhis wife for dedicating their time topaint the dugouts at the ballfields.

Chasity Sinclair, one of thefulltime dispatchers submitted her res-ignation effective 06/05/2019.

Jim Martin announced his retire-ment effective 06/14/2019.

Calhoon stated that RandyMayfield, current Public Works Su-pervisor is very limited in being ableto do what he needs to help with as faras motivating his team and gettingthings done. Calhoon feels that it takestime away from him performing hisAdministrator duties since he isspending a lot of time in the field go-ing back over what was asked of theteam to do. Calhoon suggested that thecity post for a Street/Public Works

Supervisor in hopes of getting moreproductivity.

Motion by West to allow Brad Farrto hay the open field located to theeast of Mission Village and bordersHwy 73 for this year. Seconded byBacon. All aye.

Chuck Oswald proposed that thecity limit sign on the west entranceof town be moved to the city limits.After discussion the Commissiondecided to leave it where it is at be-cause there is not a better place toplace it.

Lanter SPS LLC has looked atdoing repairs on the roof at MissionVillage. Lanter SPS LLC is asking tomake a claim with the insurance pro-vider for Mission Village, or plan Bwould be for them to bid the repairson the roof. West wants to make surethat the roof is even covered underthe insurance policy.

The Commission recommendedthat Mission Village contact their in-surance provider for a copy of thepolicy and provide it to the city andsee if the roof is covered.

Dr. Richard Brown made an an-nouncement to the news that theclinic is tentatively set to open on July1st and the hospital itself in August.

Bacon gave updates about theprogress and current conditions ofthe dugouts at the ballfields that heand his wife have been painting.

Bacon asked the Commission thatsince he is down to one vehicle in hishousehold, if he could use the cityadmin vehicle to do his rounds aroundthe city. The Commission was not infavor.

West asked if the core drilling hasbeen done at Hwy 73 near 18th Street.Calhoon said that Terracon should getto it by the end of the month.

West would like to see the re-placement of corner electric poles intown be considered during the 2020budget prep.

West is concerned by the lack ofpreparation for chip seal that is com-ing up in June.

Edwards inquired about the ParkBoard being established in the 70’sas a Recreation Commission thatmorphed into an advisory board. Hisconcern is that if the public vote es-tablished the board, what was the au-thority to change it? He feels theCommission should be doing whatthe public wanted them to do. Mo-tion by Edwards to authorize the cityattorney to review the issue regard-ing the Park Board as it standing as aRecreation Commission or as an Ad-visory Board. Seconded by Bacon.All aye.

It was the general consensus toallow Kim Knudson to perform lim-ited duties pertaining to Mission Vil-lage during work hours since she ison the Board of Directors.

Krug recommended that the cityprovide Glen Obbards and MattHowell packet information for theupcoming Commission meetingssince they have their names in the hatfor the upcoming election.
