ON ANTI-CORRUPTION CASES FILED AND DISPOSED IN ALLCOURTS

W H E R E A S , t h e p r i n c i p a l m a n d a t e o f t h e C o m p o n e n t W o r k i n gCommi t t ee (CWC) f o r Componen t [ 3 o f t he Jud i c i a l Re fo rm Suppo r tProgram (3RSP) is the enhancement o f the ins t i tu t iona l in tegr i ty o f theJudiciary;

WHEREAS, the issue o f cor rupt ion in the Jud ic ia ry is one o f themat ters tha t the CWC for Component B has to address pursuant to thesaid mandate;

WHEREAS, t he re i s a need f o r a f ac tua l ma t r i x on co r rup t i on t ogu ide and a i d t he CWC fo r Componen t B i n add ress i ng t he i s sue t ha thas been adversely affect ing the integri ty of the Judiciary;

W H E R E A S , a m o n g t h e c o m p o n e n t s o f t h e f a c t u a l m a t r i x a r estat ist ical data on cases of corrupt ion filed against Just ices, judges andcourt officials and personnel;

W H E R E A S , t o a s s i s t t h e g o v e r n m e n t i n i t s fi g h t a g a i n s tc o r r u p t i o n , d a t a o n c a s e s a g a i n s t a l l g o v e r n m e n t o f fi c i a l s a n demployees filed and disposed in courts must also be gathered,

N O W , T H E R E F O R E , t h e f o l l o w i n g g u i d e l i n e s a r e h e r e b yestabl ished for compl iance of the concerned court officials named below:

(1) For the purpose of this Memorandum Order, ~corrupt ion cases" shal lre fer to compla in ts and cases, whether admin is t ra t ive or c r imina l , fi ledaga ins t any Just ice , j udge, cour t o ffic ia l o r cour t employee, as we l l asg o v e r n m e n t o f fi c i a l o r e m p l o y e e , f o r c o m m i t t i n g a c t s o f c o r r u p t i o nincluding those penal ized under Art ic les 212 to 221 of the Revised PenalCode, RA 3019 (Ant i -Gra f t and Cor rupt Prac t ices Act ) , as amended, RA6713 (Code o f Conduct and Eth ica l S tandards fo r Pub l ic Offic ia ls andEmp loyees ) , RA 7080 (P lunde r Law) , Sec t i on 11 (b ) o f RA 9485 (An t i -Red Tape Act} and other pert inent laws.

Co r rup t i on cases sha l l no t be l im i t ed t o cases i nc l uded i n t heregular dockets of the concerned courts but shal l include cases that ares t i l l sub j ec t o f i n f o rma l p re l im ina ry i nves t i ga t i on ( IP I ) , whe the r t hecompla inant is ident ified or anonymous.

(2 ) I n f o rma t i on on co r rup t i on cases fi l ed and d i sposed f o r t he t h ree -year per iod o f 2007 to 2010 sha l l be gathered and genera ted by :

( a ) t h e C l e r k o f C o u r t o f t h e S u p r e m e C o u r t f o r c a s e s fi l e dagainst Supreme Court Just ices, officials and personnel;

( b ) t h e C l e r k s o f C o u r t o f t h e C o u r t o f A p p e a l s , t h eS a n d i g a n b a y a n a n d t h e C o u r t o f Ta x A p p e a l s f o r c a s e s fi l e dagainst Just ices, officials and personnel of their respect ive courtsand

( c ) t h e C o u r t A d m i n i s t r a t o r f o r c a s e s fi l e d a g a i n s t fi r s t a n dsecond level judges, officials and personnel,

S p e c i fi c a l l y, w h e n e v e r a p p l i c a b l e , t h e d a t a s h a l l c o n t a i n t h efol lowing:

(a) the nature o f the cases, whether admin is t ra t ive or c r imina l

( i ) i n adm in i s t r a t i ve cases , whe the r t he cha rges a re f o rma lo r i n f o rma l and whe the r t he comp la i nan t i s anonymous o rident ified and

( i i ) i n a d m i n i s t r a t i v e c a s e s , w h e t h e r t h e c o m p l a i n t h a sa l r eady been docke ted as a r egu la r adm in i s t r a t i ve case o rst i l l subject of IPI;

(b) the number of cases filed according to their nature and

(c) final outcome of the cases

( i ) in admin is t ra t ive cases, whether impos i t ion o f d isc ip l inarysanct ion or d ismissa l o f the charge and whether d ismissa l o ft h e c o m p l a i n t / c a s e w a s i n t h e d o c k e t e d regularadmin is t ra t ive mat ter s tage or in the IP [ s tage and

(i i ) in cr iminal cases, whether convict ion or acquit tal .
