• LAW ON ELECTRONIC COMMUNICATIONS
• ERĮ Articles: 8, 10 and 44.
• TASKS of RRT: ensure, that the equipment and devices used in the Republic of
Lithuania are in conformity with the mandatory requirements in force in the Republic of
Lithuania and ensure the electromagnetic compatibility of the equipment and devices.
RIGHTS of the RRT: 1) assess the conformity of equipment and devices, radio
equipment and terminal equipment with mandatory requirements and/or standards; 2)
make measurements and perform other actions aimed at assessing whether the
technical parameters of equipment and devices, radio equipment and terminal equipment
conform to mandatory requirements. REGULATION by the RRT: The conditions for
applying electromagnetic compatibility requirements, the procedure and conditions for
the placing on the market and use of equipment and devices, the requirements for
equipment and devices, the requirements for their installation and use, the procedure
and conditions of assessment, approval and monitoring of compliance with
electromagnetic compatibility shall be laid down in the Technical Regulation on
Electromagnetic Compatibility approved by the order of the director of the
Communications Regulatory Authority.

• A hundred and sixty-eight (168) products were obtained and evaluated.
• The results of the technical compliance with the applicable harmonised
standards showed large differences:
• - Rather low compliance with the emissions limits: 61.5% of the tested,
one hundred and sixty-six (166) products were found to be compliant
• - There was a better level of compliance with the immunity limits: 91.5%
of the tested, forty-six (46) products were found to be compliant.
• The overall administrative compliance was only 28.8% and, mainly
regarded the CE marking and the Declaration of Conformity (DoC)
requirements.

New Legislative Framework
Experience has shown in EU market certain weaknesses and inconsistencies
in the implementation and enforcement of this legislation, leading to:
• – the presence of non-compliant or dangerous products on the market
and consequently a certain lack of trust in CE marking
• – competitive disadvantages for economic operators complying with the
legislation as opposed to those circumventing the rules
• – unequal treatment in the case of non-compliant products and distortion
of competition amongst economic operators due to different enforcement
practices
• – differing practices in the designation of conformity assessment bodies
by national authorities
• – problems with the quality of certain notified bodies.

• Consultation of interested parties
The alignment of Directive 2004/108/EC to the NLF Decision has been
discussed with national experts responsible for the implementation of this
Directive, the notified body group, the administrative cooperation group as
well as in bilateral meetings with industry associations.
• From June to October 2010 a public consultation was organised that
comprised all the sectors involved in this initiative. It consisted of four
targeted questionnaires for economic operators, authorities, notified
bodies and users and the Commission services received 300 replies. The

• In addition to the general consultation a specific SME consultation was
carried out. 603 SMEs were consulted through the Enterprise Europe
Network in May/June 2010.

Directive are foreseen.
• Deviations from the New Legislative Framework need to
be duly justified.
• Progress in European Council and Parliament is difficult to
estimate at this stage.

• New Chapter: 2 – Obligations of economic operators
• Importers shall indicate their name, registered trade name or registered
trade mark and the address at which they can be contacted on the
apparatus or, where that is not possible, on its packaging or in a
document accompanying the apparatus.
• An importer or distributor shall be considered a manufacturer for the
purposes of this Directive and he shall be subject to the obligations of the
manufacturer under Article 7, where he places apparatus on the market
under his name or trademark or modifies apparatus already placed on the
market in such a way that compliance with the requirements of this
directive may be affected.

• Chapter 3 – Conformity of Equipment
• Two conformity assessments:
– Module A or (Module B + Module C)
Annex II – Internal production control
Annex III – EU-Type Examination (NB involved).
• The manufacturer shall lodge an application for EU-type examination with
a single notified body of his choice.
• Where the type meets the requirements of this Directive that apply to the
apparatus concerned, the notified body shall issue an EU-type
examination certificate to the manufacturer.

• Requirements relating to notifying authorities.

• Conformity assessment bodies shall take out liability insurance unless
liability is assumed by the State in accordance with national law, or the
Member State itself is directly responsible for the conformity assessment.
• The Commission shall assign an identification number to a notified body.
