EIA Notification dated 27.01.1994, for “Crude Oil Pipeline from Mundra coast in Gujarat to Bathinda in
Punjab” states that “There will be no change in the pipeline route, design, capacity without the prior
approval of this Ministry. While laying the pipeline, OISD standards with regard to distance etc. from
private buildings, industrial buildings or places or habitation etc. should be followed.”
MoEFCC had transferred this EC to M/s Guru Gobind Singh Refineries Limited, a wholly owned
subsidiary of HPCL vide letter no. J. 11011/25/98-IA II dated 12.04.2001. As implementation of
various activities on the project had already started since 24.11.2000 which was within 5 years of the grant of

environmental damage e.g. floods, earthquakes,
landslides, cloudburst etc)?
Yes
Earthquake
The IPS-1 site lies in Seismic Zone V and IPS-2 site lies in Seismic Zone IV.
IPS-4 and IPS-5 sites lie in Seismic Zone III & II respectively. Therefore, all
construction, design and other features of the project at these sites that can
be impacted due to earthquakes will be as per earthquake sensitive designs
and construction
Floods

9. Factors which should be considered (such as consequential development) which could lead to environmental effects or the
potential for cumulative impacts with other existing or planned activities in the locality
S. No. Information/Checklist confirmation Yes / No? Details thereof (with approximate quantities/ rates, wherever
possible) with source of information data
9.1
Lead to development of supporting facilities, ancillary
development or development stimulated by the project
which could have impact on the environment e.g.:
supporting infrastructure (roads, power supply, waste or
waste water treatment, etc.) housing development
extractive industries supply industries, (other)
No
The project is a closed system comprising two licensed underground tanks of
20m3 storage capacity each at the respective stations (already exist as
permitted) and a pumping system for boosting the pressure of the crude oil
inside the pipeline that is required to increase the flow in the pipeline as
mentioned above. Therefore development of any support/ancilliary system is
not envisaged.
9.2 Lead to after-use of the site, which could have an impact on
the environment No
Not likely, further the site is likely to be used for the existing activities well
into the foreseeable future.
9.3 Set a precedent for later developments No Not Applicable
9.4 Have cumulative effects due to proximity to other existing or
planned projects with similar effects No

CAPACITY EXPANSION OF MUNDRA – BATHINDA CRUDE OIL PIPELINE PROPOSED TERMS OF REFERENCES
M/S HPCL-MITTAL PIPELINES LTD | DECEMBER’ 2015 23
2 PROPOSED TERMS OF REFERENCE
The proposal to expand the capacity of SPM, COT, the connecting pipeline from SPM to COT at Mundra Port and
the Crude Oil Pipeline from Mundra coast in Gujarat to Bathinda in Punjab including the existing intermediate
pumping station does not involve any of the following :
1. Change in process or technology : The process and technology being used at the existing intermediate
pumping station will merely be repeated in these two stations.
2. Any land acquisition : Sufficient land owned by HMPL exists at these pigging stations for conversion into
pumping stations.
3. Any change to the Crude Oil Pipeline from Mundra coast in Gujarat to Bathinda in Punjab
including the existing intermediate pumping station : The pipeline has sufficient strength and
additional capacity to handle the new flow requirement.
4. Any change to SPM, COT, the connecting pipeline from SPM to COT at Mundra Port : The capacity
expansion of the SPM will simply be achieved by increasing the berth occupancy at the SPM from present
approx. 19% to approx. 24% i.e. by unloading more crude oil tankers at the SPM to fill the storage tanks at
COT at a higher frequency. Similarly capacity expansion of the COT from present 9 MMTPA to 11.25 MMTPA
can be achieved by receiving crude oil from the SPM at a higher frequency commensurate to its berth
occupancy of approx. 24% and pumping out the crude oil into the Mundra – Bathinda pipeline at a higher
flow rate. In fact, the quantity of liquid effluents at COT and fugitive emissions will also remain within the
already approved quantity.
5. Increase in the production capacity or change in product mix : The SPM, COT, the connecting
pipeline from SPM to COT at Mundra Port and the Crude Oil Pipeline from Mundra coast in Gujarat to
Bathinda in Punjab is used for unloading, storing and transporting imported crude oil from Mundra Port in
Gujarat to Guru Gobind Singh Refinery of M/s HPCL-Mittal Energy Limited near Bathinda in Punjab. As such,
no production or product mix is involved.
Para 4 of EIA Notification dated 14th September, 2006 states that:
“Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of
section 3 of the Environment (Protection) Act, 1986, read with clause (d) of sub-rule (3) of rule 5 of the
Environment (Protection) Rules, 1986 and in supersession of the notification number S.O. 60 (E) dated the 27th
January, 1994, except in respect of things done or omitted to be done before such supersession, the
Central Government hereby directs that on and from the date of its publication the required construction of
new projects or activities or the expansion or modernization of existing projects or activities listed in the
Schedule to this notification entailing capacity addition with change in process and or technology
shall be undertaken in any part of India only after the prior environmental clearance from the
Central Government or as the case may be, by the State Level Environment Impact Assessment
Authority, duly constituted by the Central Government under sub-section (3) of section 3 of the said Act, in
accordance with the procedure specified hereinafter in this notification.”
Further, section 7 ii of EIA Notification dated 14th September, 2006 states that:
“All applications seeking prior environmental clearance for expansion with increase in the
production capacity beyond the capacity for which prior environmental clearance has been granted
under this notification or with increase in either lease area or production capacity in the case of mining projects or
for the modernization of an existing unit with increase in the total production capacity beyond the

threshold limit prescribed in the Schedule to this notification through change in process and or
technology or involving a change in the product –mix shall be made in Form I and they shall be
considered by the concerned Expert Appraisal Committee or State Level Expert Appraisal Committee within sixty
days, who will decide on the due diligence necessary including preparation of EIA and public consultations and the
application shall be appraised accordingly for grant of environmental clearance.”
Since, the proposed capacity addition to the SPM, COT, the connecting pipeline from SPM to COT at Mundra Port
and the Crude Oil Pipeline from Mundra coast in Gujarat to Bathinda in Punjab including the existing intermediate
pumping station from 9 MMTPA to 11.25 MMTPA do not involve any change in process or technology, we
understand that prior environmental clearance for the capacity addition may not be required.
We, therefore do not propose any TOR for the proposal.
