In the other case for misconduct inoffice County Attorney Clements up-

on investigation found that he couldnot secure a conviction and in hismotion filed the following statement

The defendant is charged withhaving violated section 1363 of Ken ¬

tucky Statute by receiving money di ¬

rectly and indirectly from John Hayden in consideration he would dis ¬

miss a prosecution then pendingagainst said Hayden in this courtThe law provides that a defendantcannot be convicted on the testimonyot an accomplice without corroberatins evidence In this case the Com-
