The Owner is requesting permission to maintain a personal service shop with the following variances:

The subject lands are designated "Prestige Area" by OPA #450 (Employment Area Plan). Section 2.2.3 in OPA #450 states that the Prestige Area designation shall be used for a "wide range of industrial, office, business and civic uses."
The subject lands are also designated "Commercial MixedUse" by the City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. Section 9.2.2.7 in the Vaughan Official Plan 2010 permits retail uses in areas designated "Commercial Mixed-Use".
The proposal conforms to the policies of the Official Plan.
Development Planning staff conducted a site visit with photo documentation on November 25, 2011. The subject lands are currently developed with a multi-unit commercial building that contains various commercial, retail and eating establishment uses.
The subject lands are zoned EM1 Prestige Employment Zone, which permits the use of one Personal Service Shop with a maximum gross floor area of 185m2. Unit 5A has a gross floor area of 143.99m2.
The Development Planning Department is of the opinion that the proposal to permit a second Personal Service Shop at 27 Roytec Road, Unit 5A is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.
