FROM THE PASTOR
Should It Matter to Us Who Is On the Supreme Court? The Supreme Court has the final judicial say on
whether a law is in conformity with the U. S.
Constitution. This means the court the power to
overrule all lower courts. When the Supreme
Court makes a bad decision, the consequences
can be felt by millions of people for many years.
For example:
1. Dred Scott vs. Sandford (1857):The court ruled that “persons of African descent” could not
become citizens of the United States. This decision declared it was unconstitutional for Congress to
free slaves in federal territories. But instead of settling the controversy over slavery, this decision
helped lead to the Civil War.
2. Plessy vs. Ferguson (1896): The court ruled that it was constitutional to have racially
segregated public facilities, including schools, as long as those facilities were “equal in quality.”
This led to an increase in racial segregation for at least 58 years, when a later Supreme Court ruled
against racial segregation in schools.
3. Roe vs. Wade (1973): The court ruled that existing legal protections for prenatal babies (all 50
states had some restrictions on abortion prior to this decision) went against the U. S. Constitution.
The court claimed that the “right to abortion” was found in the “right to privacy.” Does the
Constitution even mention a “right to privacy”? No, but a previous Supreme Court Justice claimed
that right was found in the “penumbras” and “emanations’ of the Constitution! Roe vs. Wade has
resulted in the violence of the deliberate killing of millions of prenatal human beings.
4. Obergefell v. Hodges (2015): The court overturned centuries of tradition by declaring that the
right to marry is guaranteed to same-sex couples. This ruling, which in effect dramatically changed
the meaning of marriage for everyone, required all 50 states to permit same-sex “marriages.”
This decision will certainly have serious consequences, especially for children, who very much
benefit from having both a mother and a father.
As these cases indicate, the decisions of the U. S.
Supreme Court can have very serious
consequences for all of us. Those decisions can
cause much good or much harm to individuals and to
our society. So it is very important who is on the
U. S. Supreme Court. Let us pray that a truly just
person will be confirmed by the Senate to replace
the retiring Justice Anthony Kennedy.
