What´s going on in my mind? Revenues versus bureaucracy
• Revenues on the Federal level are very small:
– With a statement of a federal Agency for Cartography and Geodesy, the revenue for spatial data during the last year was less than 100.000,-- Euro
• Costs for bureaucracy: – Even with low revenues, individual user agreements must be
concluded at the national level – Revenues and necessary bureaucracy keep here in an
unreasonable relation

Costs for bureaucracy
• Federal level: – ca. 25 Agencies holding spatial data
• Round about 300 Data Deliveries / Year / Agency: – Correspondence, Licensing, inquiries, … – Time duration: 1 – 4 Hours / procedure
• Costs for the Agencies:
– 25 * 300 * 2h * 36 Euro = 540.000,-- Euro
• Costs for the Enterprises, using the data: – 25 * 300 * 2h * 33,20 Euro = 498.000,-- Euro

Paradigm shift: Spatial Information „free of charge”
• Fundamental amendment to the geoinformation legislation Act: – On the federal level in general all spatial data and metadata shall be
made available via spatial data services free of charge for commercial and non-commercial use.
• This supports the activation of the value-added potential for all underlying federal spatial data.
• The fee exemption relieves (unburdens) the spatial data suppliers of the obligation to provide programs for e-business.
• Free access to spatial data supports the objectives of the German federal "open government" initiative and the Revision of the directive “Re-use of public sector information”.
• This leads to less bureaucracy by uniformed terms of use.

Synchronizing different initiatives
• Open Government Partnership, 46 world wide (9/2011)
– Political openness, transparency and cooperation in the society
• Initiatives of the European Commission – Revision of the directive “Re-use of public sector information”
• German government program „networked and transparent administration“ – Project „Open Government“, part „Open Data“ – Project „E-Government - legislation“
• German project „licensing and costs“ – Common project of the federal level, the state level (16) and the
municipalities to establish common licensing cost models for spatial information
– On state level and municipality level, charges for spatial data are popular – The amount depends from surface, number of objects, commercial use,..

Regulation (Ordinance) to determine the conditions for use
• Goal 1: Common framework – We need a common framework for commercial and non-commercial use
• Goal 2: General legal regulation
– Instead of individual licensing and contracting: General legal regulation
• Goal 3: Be very open: – duplicate, print out and present spatial data – work with the data, combine the data and change the data – use the data in internal and external business processes, products and
applications
• Goal 4: Small restriction: – Linking to the source references
