ORDINANCE NO. 2837
AN ORDINANCE OF THE CITY OF ISSAQUAH, WASHINGTON, AMENDING TABLE 4.3B OF THE CENTRAL ISSAQUAH DEVELOPMENT AND DESIGN STANDARDS TO LIMIT SELF STORAGE USES TO CERTAIN LOCATIONS WITHIN THE MIXED USE (MU) ZONING DISTRICT; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Issaquah created the Central Issaquah Plan in order to
accommodate the State’s 2006-2031 mandatory housing and job growth targets in an area where
almost 75% of the developable land is used for surface parking, while protecting existing
neighborhoods outside the Central Issaquah Plan area, and respecting the Urban Growth
Boundary; and
WHEREAS, since 2016, the City has reviewed development standards, uses and
visions for Central Issaquah during the temporary development moratorium; and
WHEREAS, the City Administration initiated amendments to the Central
Issaquah Development and Design Standards in order to limit new hotels, motels, time share
lodging, conference centers and completely enclosed self-storage uses within Central Issaquah;
and
WHEREAS, new hotels, motels, conference centers and completely enclosed
self-storage uses are permitted in other zoning districts outside Central Issaquah; and
WHEREAS, the City currently has 5 hotels/motels and 6 completely enclosed
self-storage uses in the City limits; and
WHEREAS, environmental review was done on the proposed amendments and a
Determination of Nonsignificance (DNS) for a non-project action was issued on March 1, 2018

for these amendments, and required notice to the State of Washington was sent on March 14,
2018; and
WHEREAS, the comment period and appeal period for the DNS expired on
March 23, 2018; and
WHEREAS, pursuant to legal notice published in The Issaquah Sammamish
Reporter on March 2, 2018, the Planning Policy Commission held a public hearing to consider
the proposed amendments on March 22, 2018; and
WHEREAS, all persons desiring to comment on the proposal were given a full
and complete opportunity to be heard; and
WHEREAS, after completing the public hearing, the Planning Policy
Commission voted on several motions regarding the limitation of completely enclosed self-
storage uses all of which resulted in tie votes, and so decided to forward their tie vote regarding
the proposed amendments, and
WHEREAS, after completing the public hearing, the Planning Policy
Commission voted not to recommend the limitation of hotel/motel uses, and
WHEREAS, the Planning Policy Commission adopted findings describing its tie
vote on March 22, 2018 and thereafter forwarded those findings to the City Council; and
WHEREAS, the City of Issaquah Administration continues to support the
original proposal shared with the Planning Policy Commission; and
WHEREAS, the Issaquah City Council’s Land and Shore Committee considered
the findings of the Planning Policy Commission and the original proposal of the City
Administration at a meeting on April 19, 2018, and, after reviewing the City Administration’s
recommendation has decided not to recommend that the full Council adopt the recommendation;

and
WHEREAS, the Issaquah City Council has considered the recommendations of
the Council Land and Shore Committee, the City of Issaquah Administration and the findings of
the Planning Policy Commission, and has determined to adopt the Administration’s
recommendation regarding self-storage uses, but not the Administration’s recommendation on
hotels, motels, time share lodging, and conference centers. NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF ISSAQUAH, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Permitted Land Uses. Central Issaquah Development and Design

Aboveground storage tanks for hazardous substances or hazardous waste with primary and secondary containment area and spill protection plan are allowed in Class 1, 2, and 3 CARA subject to compliance with federal and state standards. Processing, storage, and disposal of radioactive substances (except certain medical uses) is prohibited in Class 1, 2, and 3 CARA.

Underground storage tanks with hazardous substances are required to demonstrate to the City that the facility complies with federal and state laws. No dry wells shall be allowed. Wrecking yards are prohibited in Class 1, 2, and 3 CARA.
15. Use, including vehicle maintenance and service activities must be enclosed within a Building and comply with Design Standards including, but not limited to, ground floor storefront orientation to the sidewalk and street, parking and outdoor storage, including vehicle storage, located to the rear or side of the site and screened from Circulation Facility view.
16. If the majority of the square footage of the buildings or structures within the brewery or winery are devoted to manufacturing of the product, then “manufacturing” shall be considered the primary use. The review process and development standards shall be based upon the primary use, as defined by the majority of the structure square footage. The parking requirements shall be calculated based on all the uses, as governed by Chapter 8.0 Parking.
17. Not operated as a home occupation. For home occupations, see IMC 18.07.310, Home Occupation Standards.
18. No adult entertainment facility shall be permitted to locate in any zone, including the IC zone, within the territory of the North Issaquah annexation area, as described in Ordinance No. 2255. In general this applies north of NE Locust Street.
19. Accessory outdoor storage regulated by design standards. 20. See IMC 18.07.527, Self-storage Facility Standards. 21. Marijuana Cooperatives are prohibited in all zoning districts of the City in accord with RCW 69.51A.250(3).

Section 2. Adoption of Findings. In support of the actions taken in this ordinance,
the Issaquah City Council adopts the rationale for limitations on self-storage uses contained in
the March 22, 2018 staff memo attached to this ordinance as Exhibit A as the Council's findings.
The City Council does not adopt the rationale supporting limitations on hotels, motels, time
shares and conference centers as this ordinance does not adopt such limitations.
Section 3. Ordinance to be transmitted to Department. Pursuant to RCW
36.70A.106, this Ordinance shall be transmitted to the Washington Department of Commerce as
required by law.
Section 4. SevembiUty. If any section, sentence, clause or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 5. Effective Date. This ordinance or a summary thereof consisting of the
title shall be published in the official newspaper of the City, and shall take effect and be in full
force five (5) days after publication.

This proposed amendment specifically limits new Hotels, Motels, Time Share Lodging, Conference Centers to the Urban Core Zoning District (Pickering Neighborhood, only) and Self Storage (completely enclosed) uses to the Mixed Use Zoning District (Parcels fronting East Lake Sammamish Parkway SE or 221st Place SE only) in Central Issaquah. These amendments are intended to locate these uses in proximity to urban densities in those zones. Limiting these uses in Central Issaquah also provides more opportunities for other uses that support the planned housing and job growth, and related services needed in this area to implement the Central Issaquah Vision.
