The meeting started with the recitation of verses from Holy Quran. The President and Secretary, Cantonment Board, Peshawar delivered welcome address to the Board.
Before conducting with the business of Board meeting agenda, Brigadier Khizer Sultan Raja, Station Commander, Peshawar Cantonment, administered oath of office to the following nominated members as required under section 18(1) of the Cantonments Act, 1924 (II of 1924), which is reproduced hereunder :-
“18. Oath of affirmation:
(1) Every elected member, and every person who is by virtue of his office, or who is nominated to be a member of a Board shall, before

taking his seat, make at a meeting of the Board an oath or affirmation of his allegiance in the following form, namely: -

ITEM REGULATIONS UNDER SECTION 44(1) OF THE CANTONMENTS ACT, 1924
FOR THE CANTONMENT BOARD, PESHAWAR
To approve the following regulations / procedure for the Board under section 44(1) of the Cantonments Act, 1924: -
1. Meetings of the Cantonment Board shall be held at the Cantonment Board Office or any other place if specially ordered by the President, at such hours and on such dates as may be fixed by the President.
2. Not less than four clear days notice for ordinary meetings and 24 hours
notice for special meeting shall be given to the members.
3. (i) List of business to be transacted at each meeting shall be sent to members alongwith the notices of meetings.
(ii) Extra items of business to be transacted at the meetings may be added to the agenda any time if so required / permitted by the President.
4. The Executive Officer shall, 3 days before each ordinary meeting, have in
readiness at the Cantonment Board Office all papers relating to the business to be transacted at such meetings so as to give members an opportunity of persuing them before the meeting.
5. The President, with the consent of the majority of the members present, may give priority to any item or items of business, irrespective of the order in which such item or items stand on the agenda paper.
6. The proceedings shall be conducted in English, but members who are not able to express themselves in English may address the meeting in the Vernacular, and the purport of their remarks shall be interpreted in English.

7. Each new member shall after taking the oath or affairmation or allegiance provided for in Section 18, proceed to the President, bow and shake hands, before taking his seat.
8. Written speeches may not be read without the permission of the President.
9. In the case of more than one mumber wishing to speak at the same time, the President shall name the member who is to speak. No member while speaking shall directly or indirectly, make any personal or objectionable remarks concerning any member, any officer of Government or a Government / Cantonment Servant. The ruling of the President in this behalf shall be final. This principal shall be followed even at the time of recording note of dissent.
10. If a member be called to order, such member shall be required by the President to keep silent until the President decides the point of order, provided that the member called to order shall be allowed to speak on the point of order raised.
11. If there is any refusal on the part of the member to obey the ruling of the President on a point of order, it shall be competent to the President to dissolve the meeting at once, and when any declaration of dissolution shall have been made, any resolution which may be passed by the residue of the meeting shall be void, and of no effect, and shall not appear in the minutes.
12. A member who proposes to move any substantive motion or resolution shall intimate the fact in writing (attaching a copy of his proposed resolution) to the Executive Officer at least ten days before the meeting at which such motion or resolution is to be brought forward, in order to admit of the publication of the said proposal with the list of business, to be transacted at the said meeting.
13. Unless poll is demanded by any member present at the meeting, a declaration made at the meeting, by the President, that a resolution has been passed, shall be sufficient warrant for the making of an entry to that effect in the minutes, if a poll is demanded by any member present, it shall be taken by show of hands or in writing, and subject to the provisions of sub-sections (1) & (2) of section 43 of the Cantonments Act, 1924, the result of such poll, as declared by the President, shall be deemed to be the decision of the Board.
14. No motion shall be entertained in regard to a question once disposed of until the lapse of three months from the date of such disposal, except on the written application of more than one half of the members of the Board, provided that this regulation shall not apply to questions that have been raised by or are pending in correspondence with the Government.
15. The common seal of the Board shall remain in the custody of the Executive Officer and shall be used on all contracts, deeds, conveyances, licenses and all notices and requisitions issued under the Cantonments Act, 1924 and bye-laws made thereunder.

16. No member shall introduce any matter involving personal attacks against any other member or against any officer of the Government, or a servant of the Board, nor any such discussion shall be permitted.
17. The President may cause to be summarily removed from the building in which the meeting is being held, any person, who interrupts the business of the meeting.
18. The President may direct any member whose conduct is, in his opinion disorderly, unruly, ungentlemanlty, discourteous or contrary to law, to withdraw immediately from the meeting and in the event of disobedience of such order, the member concerned shall be liable to be summarily removed.

These regulations be sent to the Federal Govt through proper channel for publication as required under sub-section (3) of section 44 of the Cantonments Act, 1924. ITEM

To approve the following regulations / procedure as required under section 44(1)(e) of the Cantonments Act, 1924, for Bazar committee constituted under section 43-A of the Cantonments Act, 1924: - DELEGATION OF POWERS AND DUTIES TO THE BAZAR COMMITTEE: Following functions of the Board are proposed to be delegated to the Bazar Committee within the Bazar Area notified under section 43-A of the Cantonments Act, 1924: -

Rule 10 of the CLA Rules 1937
The Bazar Committee shall deal with the above quoted functions strictly in accordance with the regulations defined as under: - REGULATIONS GOVERNING THE FUNCTIONING OF BAZAR COMMITTEE The Committee shall be governed by the following regulations with regard to its meetings: -
(a) Ordinary Meeetings: The Committee shall ordinarily hold at least one
meeting in every month. 48 hours notice shall be given to members for ordinary meetings.
(b) Special Meetings: Special meeting of the Committee shall be convened for urgent reasons, with at least 24 hours notice.
(c) Quorum: Quorum necessary for the transaction of business at a meeting of the Committee shall be five members of the Committee.
If at a meeting of the Committee called for the transaction of business, a quorum is not present, the Committee shall adjourn the meeting to a subsequent date, which shall be notified to the members in the usual way.
(d) Proceedings: The proceedings of the meeting of the Committee shall be recorded in a minute book kept for the purpose, and placed before the Board in its next meeting for consideration.
(e) Decision of matters: All questions coming before a meeting shall be decided by the majority of the votes of the members present. No member shall vote on any matter in which he has a personal interest.
(f) Confirmation by the Board: The proceedings / minutes of a meeting of Bazar Committee shall be placed before the Board as recommendations. The Board may reject, revise, disagree, agree with certain modifications or confirm the minutes / proceedings of a meeting of the Building Committee. Decision of the Board on the minutes of a meeting shall be considered as final.

Resolution: The Board considered and approved the agenda. These regulations and delegations be sent to the Federal Govt through proper channel for approval/publication as required under sub-section (2) & (3) of section 44 of the Cantonments Act, 1924. ITEM
RECONSTITUTION OF ASSESSMENT COMMITTEE
Reference: CBR No. 06 dated 3-10-2014 & Approval dated 20-1-2015 under section 25 of the Cantonments Act, 1924.
To consider re-constitution of Assessment Committee, Peshawar Cantonment. Earlier the PCB vide note under section 25 of the Cantonments Act, 1924 approved constitution of assessment committee comprising of the following:-
1. Maj Muhammad Iqbal, Chairman 2. Maj Ayaz Masud Member
3. Lt. Hassan Zahid Member 4. Addl: Cantonment Executive Officer Secretary
However, the Chairman of the above said committee is not available due to his posting to Ammunition Depot Niaz Baig Lahore, therefore, Maj Muhammad Nadeem has been nominated vide 75 Ordnance Unit letter No.7501/HQ/Ord-83HQE8 dated 19-8-2015.
In view of above, re-consititution of Committee is required under section 68(4) of the Cantonments Act, 1924, for disposal of cases of assessment / re-assesment.

Role/Mandate and Framework
The Assessment Committee shall be required to play its role as defined in section 68 of the Cantonments Act 1924. While performing its job, the Committee shall ensure the following:
a) To assess all alike properties in a locality uniformly b) To address on priority the issues of uneven assessments in an
area with the help of Revenue Branch c) To exercise powers of reduction of proposed assessment up to a
maximum of 30% in justified cases only.

d) To explain procedure and reasonability of assessments to property owners who think that their assessments are unreasonable.
e) To coordinate with elected members for ensuring early recovery of Cantonment Board dues from their respective wards
f) To put up a monthly report for the information of the Board showing number of cases assessed and amount of recovery facilitated by the elected members during the period under report.
The President further directed that a briefing on assessment/re-assessment shall be given by the Asstt: Secretary to the Assessment Committee. ITEM
RECONSTITUTION OF BUILDING COMMITTEE Reference: CBR No.9 dated 14-2-2013. To note / confirm action taken by the Cantonment Executive Officer, Peshawar Cantt with the prior approval of PCB as required under section 25 of the Cantonments Act, 1924 regarding re-constitution of Building Committee. In this connection, it is mentioned here that earlier the Board vide CBR under reference approved re-constitution of Building Committee comprising the following members: -

However, the said committee was required to be re-constituted due to absence of member and addition of new members / representatives nominated by PCATP Deptt:. Therefore, the PCB vide note under section 25 of the Cantonments Act, 1924 approved the following composition of the Building Committee for scrutiny of Building, revised, regularization and completion Plans under section 179 & 185 of the act ibid, in conformity with the Building Bye-Laws and the rules and regulations framed for the purpose: -

CONSTITUTION OF COMMITTEES UNDER SECTION 44(1)(E) OF THE CANTONMENTS ACT 1924
To consider the appointment of committees for various purposes and the determination of all matters relating the committees for dealing with different cases, as required under section 44(1)(e) of the Cantonments Act, 1924, which is reproduced hereunder: -
“44. Power to make regulations
(1) A Board may make regulations consistent with this Act and with the rules made there under to provide for all or any of the following matters, namely: -
(e) the appointment of committees for any purpose and the determination of all matters relating to the constitution and procedure of such committees, and the delegation to such committees, subject to any conditions which the Board thinks fit to impose, of any of the powers or duties of the Board under this Act other than a power to make regulations or bye law.
Resolution: The Board considered the proposal for constitution of the following four committees for various purposes and the determination of the matters related to these committees for dealing with different cases, as required under section 44(1)(e) of the Cantonments Act, 1924: -
(i) Legal Affiars Committee (ii) Procurement Committee (iii) Vigilance & Enforcement Committee (iv) Works Committee

The Board further resolved that the specific role/mandate, framework, feasablity and suitability of these committees be workedout and place before the Board. Moreover, performance of all the committees constituted by the Board at any stage shall be reviewed after every six months. ITEM
PESHAWAR CANTONMENT (SHOP-BOARDS) BYE-LAWS 2015 To consider approval of the following bye-laws for regulation of the position, size, shape or style of the name boards and shop-boards in the Cantonment Board, Peshawar, as required under clause (23) of section 282 of the Cantonments Act, 1924 (II of 1924) read with section 283 thereof, for general information, namely: -
1. Short title and commencement. – (1) These bye-laws may be called the Peshawar Cantonment (Shop-boards) Bye Laws 2015.
(2) They shall come into force at once. 2. Definitions. – In these bye-laws, unless there is anything repugnant
in the subject or context; (a) “Act” means the Cantonments Act, 1924 (II of 1924)
(b) “assessment of shop-board” means on site visit, measurements of size of a sign-board, frontage, category of sign-board and other calculations required under these bye-laws.
(c) “contractor” means a licensee who is authorized to collect shop sign- board tax and window graphy and vinyl painting;
(d) “Director” means the Director Military Lands and Cantonments, Peshawar Region Peshawar.
(e) “frontage” means the width of the shop on either side;
(f) “permission” means approval of application for erection, fixation or display of sign-boards on shop in the manner granted under these bye-laws;
(g) “shop” means a building or part of a building where goods or services are offered for sale or display or any office thereof established for the management of administration of the given purpose;
(h) “shop-board” means a Shop-board, displaying the name or logo of business of product or name of the shop displayed on a shop or office or property which also include single painting and window graphy used for promotion of business or product; and
(i) “vinyl painting and window graphy” include Pictures, images, drawings, stickers used to publicize logo or business of a shop or graphs used as decoration or making everything more distinctive and attractive for the customers or any other display material not considered as hoarding and charged accordingly;

3. Permission to display shop-boards.- (1) No person shall erect,
exhibit, fix, retain or display or cause to be erected, exhibited, fixed, retained or displayed any shop-board on any shop or office or property, in any manner, without prior permission of the Executive Officer.
(2) Every person desiring to erect, exhibit, fix, retain or display shop-
board shall, prior to fifteen days of display of such shop-board, make an application to the Executive Officer.
(3) The application under sub-bye-law (2) shall include specification of
size and frontage of the shop-board, the type and title of the shop or office or property.
(4) Permission to the applicant, having made application under sub-bye-
law (1), may be granted if deemed appropriate from municipal point of view subject to one-time payment of shop-board registration fee of one thousand rupees and fulfillment of other conditions under these bye-laws.
(5) The grant or, as the case may be, refusal of the permission under sub-
bye-law (4) may be intimated to the applicant, at the earliest, but not late than fifteen days from the date of application.
(6) Permission under sub-bye-law (4) will be granted after assessment of
shop-board is made by a person authorized by the Executive Officer. (7) The permission shall indicate assessed taxable amount, size of the
shop-board and its positioning as approved by the Executive Officer. (8) Tax on a shop-board shall be chargeable on annual basis. (9) For any change in size, placement etc in the permitted shop-board
the applicant shall be required to seek permission from the Executive Officer, provided that no further registration fee shall be chargeable for the permitted change.
4. Nothing in these bye-laws shall apply to the shop-boards displayed
or exhibited by any department of the Federal or provincial Government or by armed forces or by judicial authorities or related to any service in a mosque, church or temple.
5. Tax on Shop-boards. – (1) subject to these bye-laws, there shall be
charged and collected a tax specified in column (4) of the Table below in respect of the shop-board of the size specified in column (3) of that table displayed on the shop, office or property having frontage specified in column (2) of the said table, namely: -

(2) In respect of additional shop-board for the same shop, office or property, double the rate of tax under sub-bye-law (1) shall be charged and collected.
6. Withdrawal of permission. – The permission granted under these bye-laws may be withdrawn by the Executive Officer at any stage in the following instances, namely: -
(a) violation of terms and conditions of the permission; (b) Changes made in size and structure of a shop-board without prior
permission and; (c) in the interest of public order and prevention of public nuisance or
municipal cluttering of the shop-board.
7. Power to refuse permission to display a shop-board. – (1) The Executive Officer shall have power to refuse permission or alter size, location, structure and number of shop-boards or any adjustment at site.
(2) The Executive Officer may also refuse permission on the ground that
contents or the manner of display of a shop-board are indecent or otherwise offensive to good taste, public interest, sentiments, politically or religiously offensive or undesirable.
8. Appeal. – An appeal against the assessment of, or against the refusal
to refined, tax under these bye-laws, may within thirty days of such assessment or, as the case may be, refusal, be made to the Director for disposal in accordance with section 84 of the Act.
9. Period of Taxation. – (1) The tax on a shop-board shall be
chargeable and collected for a financial year from the date of permission or mounting of the sign-board, whichever is earlier.
(2) The tax under these bye-laws shall be levied on annual basis and payable within thirty days of issuance of the tax invoice.
(3) In case of failure to pay the tax under these bye-laws, the defaulter
shall be liable for action under section 92 to 96 of the Act without prejudice to any other action under the Act.
10. Removal of shop-boards. – Where the permission has been refused, cancelled or withdrawn under these bye-laws or the owner is in default of payment of the tax or the shop-board has been installed without permission in writing, the Executive Officer shall cause the unauthorized shop-boards to be removed, without notice, at the cost of the offender.

11. Auction of collection rights of tax on shop-boards. – The Board for its administrative convenience may put to open auction the collection rights of the tax on shop-boards, as a whole or in part thereof levied under these bye-laws. The contractor as authorized by the Board shall bear all the rights and privileges on behalf of the Board in collection of the tax under these bye-laws as per terms & conditions of the Board.
12. Penalty. – Any person who contravenes any of the provisions of
these bye-laws shall be punishable in accordance with section 283 of the Act.
13. Method of recovery. – Notwithstanding anything contained in these bye-laws, arrears of any tax, cost and fine may be recovered together with the cost of recovery through the method provided for in the Act. Resolution: The Board considered and resolved to constitute a committee comprising the following for the purpose of comparison of slabs and to review rates & categories with the adjoining municipalities and other Cantonments. ITEM SPECIAL EDUCATION / REHABILIATION SERVICES IN PESHAWAR CANTT Reference: Cardic Care Foundation letter No.CCF, dated 26-8-2015. To consider proposal received from the Cardiac Care Foundation, an NGO registered with Government of Khyber Pakhtunkhwa, having objective of free services for needy ill patients, vide letter under reference requesting therein for provision of isolated space on one of the floors in Cantonment General Hospital, Peshawar Cantt for special education / rehabilitation of ill children wherein they will provide facilities like speech therapy, psycho therapy and other rehabilitation services, free of cost. In this regard they further added that the foundation will take care of the staff salary and the equipment needed while the Cantt General Hospital will provide the space and an orderly for the security purposes. These services will be free of cost and employees of Cantonment Board will be given prefence. The timing of these services may vary in morning and afternoon depending upon the availability of special education teachers. The foundation can sign an MOU with the management for a minimum of five years. All connected papers are placed on the table.

are in serious need of ladies Academy so as to engage the housewives, school and college female students in healthy and learning activities. This idea is based on Mujahida Academy Institute. The operational expenses (Accomodation instructor, utility bills etc) can be generated from the nominal fee to be charged on the members of the academy. The fee for members should be nominal and reasonable so that those from lower middle class and poor even could take benefit of the facility. Following are the brief details of the activities / opportunities: - (a) Cooking and baking facility – Training facility for ladies (b) Stitching and handicraft facilty - Training facility for ladies (c) Swimming and Gym facilities – These facilities may be provided
through proper female instructors
2. Cantonment Sports Festival – The Cantonment Board should organize sports festivals like cricket, hockey, football, badminton, table tennis etc, for cantonment residents male / female players. This will not only promote the sports activities amongst the residents of the locality but will also bring a positive change in them.
3. Student Scholarship – Brilliant students of different schools, colleges and Universities may be provided financial support by way of scholarships.
4. To avoid un-employement – Now-a-days due to un-employement people get involved in crimes. One can avoid this by providing various institutes and giving job opportunities to youngsters especially so that they are able to use their energies for good purposes and to earn money for their families as well.
5. Lady Health Visitors courses should be organized

The historical and old building in the cantonment area should be preserved – The idea of constructing multi storey buildings in the vacant / parking spaces of pre-partitions buildings should be abandoned e.g. in Mohallah Husain Aabad (previously called Sahib Sing Building) and Jinnah Street (Radha Kishan Building) at Saddar Road the previous CEO had planned to construct a four storey building in the parking area / lawn. Such like plans should not be followed anymore as it not only disturbs the historical structure of the buildings but also affects the residents and environment of the area.
Resolution: The Board considered. The PCB appreciated the points presented by the member. The Board resolved that there is a need to have further deliberations on the points mentioned on agenda side for which Dy.CEO was detailed to deal with the lady member and comeup with concrete and practical proposals alongwith all related details i.e, financial, technical and administrative feasibilities. The Board further considered the proposal for separating the co-education in both CB schools and approved the same in principle and directed to establish separate blocks for boys and girls after having detailed working / planning by the headmistresses of both schools. HEALTH CARE FACILITIES IN CGH To consider the following proposal floated by Cantonment Board Member Ward No.V for improving the quality of health care facilities in CGH Peshawar Cantonment so that community may benefit in a better way: -
(1) Exemption in general formalities in case of emergencies- general exemption and cutting down un-necessary formalities for emergency cases patients to be treated in Cantonment General Hospital Peshawar Cantt is proposed, so that a patient having casualty can be treated in efficient way without any obstacles / hurdles either financial or otherwise. In this regard the following views / recommendations are given for consideration of the Board: -
(a) Availablity of Doctor and necessary equipments in the Casualty
ward 24/7. (b) Exemption in general registeration of patient (c) Exemption in fee for registeration, medical tests, and medicines
etc that are to be necessary for handling the casualty / emergency / first aid to be given at Cantt General Hospital.

GLASS FRAME / MESH AT ENTRANCES OF SHOPS To consider proposal floated by Vice-President regarding installation of glass-frame-structure or Mesh on self-help-basis in front of all kind of shops in Peshawar Cantonment. Generally, it has been observed that the shopkeepers in Peshawar Cantonment place their items/goods outside the premises by crossing the limits/jurisdiction for the purpose of occupying excess area, CB land or footpath, creating encroachments and inconvenience to the pedistrains / passersbye. To avoid the above said encroachments made by the shopkeepers and to specify difference in the materials owned by shop keepers & Hawkers, the following instructions to be given and implementation of the following practice by all the shopkeepers of Peshawar Cantonment, are proposed: -
(a) All shopkeepers shall use their premises only and will not cross the specified limits/boundaries.
(b) No shopkeeper will display and place the selling materials/goods outside his shop and placing it beyond the jurisdiction of premises shall be considered as encroachments.
(c) All shopkeepers must install the glass-frame or mesh at the entrance of shop and footpath must be free/cleared for pedistrains.
(d) In case of non-complaince to the above said instructions, the property owner/tenant/shopkeeper will be penalized which may include heavy fine and permanent confiscation of their material.
Resolution: The Board considered and approved in principle. The PCB, however, assigned the task to VP, Member W-3 & W-4 for conducting detailed survey through office bearers of all traders associations, prior to its implementation for having uniformity throughout commercial areas. ITEM

In this connection, it is submitted that due to increasing numbers of dental patients visiting the Cantt General Hospital Peshawar Cantt, and establishment of new dental department in Cantt General Hospital Peshawar Cantt, there was a genuine need to have two dental surgeons in the morning shift, thus, appointment of one more Dental Surgeon for morning shift was made by the Board vide CBR under reference. Last extension in temporary service of the said doctor was approved by the PCB vide note under section 25 of the Cantonments Act, 1924 for a period of six months w.e.f. 12-9-2014 and sanction by the competent Authority vide RHQ Psc letter No.33/G/220/DPR dated 13-3-2015.
The case shall be referred to the DML&C Peshawar for confirmation of above appointment under Rule 9(b) of Pakistan Cantonment Servants Rules 1954.

ENHANCEMENT OF RATE / WAGES FOR PROVISION OF SECURITY SERVICES – SARHAD SECURITY SERVICES
To consider Director Sarhad Security Services (Pvt) Ltd letter No.SSS/CBP-INC/ Gen0-18 dated 20-8-2015, regarding enhancement of rate for provision of Security Services. As per letter cited above, the present rate / wage of Security Guard (SG) is Rs.7,800/-, however, after deduction of taxes, monthly wage of one SG comes to Rs.7,176/-, and the same is considered as very low wage rate by the company, keeping in view the Labor Law. They have further added that the concerned Labor Law Deptt: is pressing hard to increase the wage rate of SGs. In this connection, it is mentioned here that earlier an agreement between the said security company and CBP was executed on 15-4-2010 for provision SGs at the rate Rs.7,800/- P.M per security Guard and Supervisor each, for provision of full support and protection to the CBP’s Vigilance and Enforcement Squad in demolition, removal of Vendors, Hawkers and anti-encroachment activities anywhere in the Cantt area and security of CB parks / offices and compliance of the orders of the Cantt Executive Officer in all such respects. UNAUTHORIZED BUILDING ACTIVITES (UBA) STRATEGY To consider the report dated 21-08-2015 prepared by the Engineering Branch to develop an understanding of different nature of Unauthorized Building Activities (UBA), strategy to prevent them, and to attend to the UBAs effectively and rationally by invoking all possible means available as per law. Cantonments Act 1924 (CA 1924), under section 185, empowers the Board to accept a composition fee that it decides on the basis of reasonability against an unauthorized construction in case if it does not otherwise decides to get such construction altered or demolished. Although the CA 1924 under various provisions gives vast scope to the Board to deal the way it prefers with an unauthorized construction activity, however any decision of the Board has to be guided by the principles of equity and fair play. As a lot of discretion has been available to Boards with regard to the levy of composition fee against a building offence, in certain instances a Board would compound a similar nature of building violation on different rates or varying offences on a uniform rate without any proper justification. When such cases were controverted before judicial forums, they would cause embarrassment for the Board as well as the ML&C Department. Ministry of Defence, therefore, issued a Policy Guideline in this regard vide their letter dated 6th of November 1994 for Station commanders, MEOs and CEOs in order to define basic principles and parameters for considering cases of unauthorized construction etc. In the light of relevant provisions of the CA 1924, the Policy Guideline of 1994 and keeping in view the sensitivities and peculiarities involved in the nature of unauthorized building activities in the milieu of Peshawar Cantonment, following proposal is being submitted before the Board for the care of consideration please:
a) Prevention of Unauthorized Building Activity (UBA): A proper Building Control Section (BCS) in the Engineering Branch headed desirably by an Assistant Cantonment Engineer, at least, under the overall supervision of the Branch In-charge should be established.

The basic task of the BCS would be to check and control UBA in the limits of the cantonment. It would be required to submit a monthly report to the board regarding any UBA. A copy of all building plans approved by the Board should be endorsed to the BCS, who would in turn ensure checking of the building at all the important stages of its construction so as to prevent unauthorized construction. However, the primary responsibility would lie with a builder to notify it to the office of the Executive Officer when it commences a building and subsequently before every important stage of construction like plinth level, first floor roof slab, second floor roof slab & subsequent floors and upon completion. The builder shall further be required to notify completion of his/her/their building and seek a completion certificate from the Board. On receipt of such a request, the BCS shall survey the construction and issue a completion certificate or start regularization process, if required, on case-to-case basis. If a builder fails to submit requisite notices timely, he/she/they shall be considered to have committed a building offence and such construction shall be liable to be dealt with under section 185 of the CA 1924, whenever the same is brought to the notice of the Board. UBA that is considered to be a security threat or otherwise a threat to the life and property of dwellers/users or those related to it in any way, shall have to be altered/demolished solely at the cost of the builder without exception. For all other UBAs, the Board may like to consider regularization by way of accepting a composition fee that it may decide keeping in view merits of the case as per law.
b) Composition of UBA: During the course of construction, certain minor departures from approved building plan (ABP) remain inevitable and those need to be viewed by the Board as leniently as possible. Nevertheless, deviations of serious nature are supposed, ideally, to be avoided by timely preventive measures as defined in sub-para ‘a’ above. In any case, if a UBA has been committed in the light of the CA 1924, Building Bye-Laws and understanding of the Board, the same is proposed to be dealt with by the Board in the following manner: i) Minor Building Offence:
The minor building offences are essentially such building deviations from the ABP that are committed remaining within the parameters of approved covered area, floors, FAR etc. and are not considered as a major building offence otherwise. Following rates are proposed:

ii) Major Building Offence:
It is rather a very complicated job to define serious UBAs distinctly and even more difficult to propose rational composition rates against each category as so many factors have to be reckoned with for the purpose. While compounding major building offences, the approach of the Board should be to fix such composition fees that could act as a deterrent to offenders as otherwise composition fees on lower slabs might rather appear as an incentive to builders encouraging them to indulge into building offences of serious nature and pay relatively nominal amounts as composition fee in the end. Although the priority of the office would remain the prevention of major building offences, however for all those cases where the Board considers regularization of UBAs by way of accepting composition fee, following definitions and rates are proposed for the consideration of the Board:
a. Construction in Compulsory Open Space (COS): COS means that part of a plot which is to be left completely open to sky, as per specifications given in the building bye laws, over which no structure or any integral part of the building shall be permitted.
b. Un-auth Addition of Storeys: means additional storeys constructed carried out without approval of the Board.
c. Un-auth Structured changes: means change in structure without
approval of the Board.
d. Un-auth increase in Saleable Area: means saleable area more than the area approved as such in the building plan.
e. Un-auth increase in Covered Area: means more covered area than
the area approved in the building plan. Proposed Composition Fee rates for regularizing major building offences under different categories as defined above are given in the table below for the consideration of the Board:
