1. What is an application for provisional release to the court? Suchapplicationisforprovisionalreleasewithoutbail,orwith
bail,orwithbailandsecuritysubmittedtothecourttoconsiderfor areleaseofanaccusedoradefendantforaspecifiedperiodoftime.
2. Is filing of an application for provisional release complicated? Notatall,apublicrelationsofficeroftheCourtofJusticemay
provideinformationonstepsofapplicationforprovisionalreleaseand
helptheapplicantsinfillingoutapplicationform.1Theapplicants2may

6.6 Whentheprofessionalpractitionersuchasmedicaldoctor,
pharmacist,nurse,engineer,architect,auditor,teacher,massmediaand
communicationpractitionerisanaccusedordefendantforthecharge
resultingfromtheperformanceofsuchdutyorpractice,he/shemayuse
personalpledgeforbailbondnotmorethan15timesofcurrentsalaryor
averagemonthlyincome.
7. How to surrender the security for bail? 7.1 Incaseofusinglandtitledeed,NorSor3orNorSor3Kor,
itisnecessarytoobtainthepriceappraisalletterbeingissuedwithinthe
periodnotmorethan6monthsfromprovinciallandofficeorfromthe
districtofficewherethelandislocated.Thepriceappraisalletterissued
byprovinciallandofficemustbecertifiedbytheprovinciallandofficer
oractingprovinciallandofficeroranyauthorizedofficer.Ifissuedby
districtoffice,suchlettermustbecertifiedbythedistrictchiefofficer ordistrictclerkactingfordistrictchiefofficerordistrictlandmanaging
officer.
7.2 Incaseofusingthebankaccountbook,itisnecessaryto enclosethebanklettercertifyingthecurrentbalanceintheaccount fromthebranchwheretheaccountisopened,withthestatementto theeffectthatbankwillnotallowanywithdrawalfromsuchaccount unlessinstructedotherwisebythecourt.
7.3 Incaseofusingpersonalpledgeasspecifiedin6.5as security,itisnecessarytoobtaincertificationletterfromtheirorganization
indicatingcurrentpositionholding,levelofsalaryscaleandthisshould
beclearlyspecifyingforwhomthebailisposing.Incasewherethereis
anypledgeinotherbailapplicationortheuseofpersonalpledgeforother
person,thelettershallindicatesuchpledge.
7.4 Incaseofusingthecarregistrationormotorcycleregistration documentassecurity,thecarormotorcyclehastobeinspectedand appraisedbycourtofficer.

7.5 Incaseofusingaresidentialhouse,theapplicantshould
presentapictureofsuchhouseandaletterofappraisalissuedbythe
subdistrictheadmanorvillageheadman.
7.6Incaseofusingthesecurityundermortgageoranycharge, theapplicantmustshowthatthepriceofthesecurityexceedingtheamount ofthemortgageoranychargeissufficienttocoverthebail.
7.7 Wheretheparentsposebailfortheirchildren,thecourtmay
grantbailwithoutsecurities.Theparentsmustprovidesufficientproof
oftheirrelationship.
Remark Incasesecuritysubmittedisinsufficienttocovertheamount ofbailspecifiedbythecourt,thecourtmayallowtheapplicanttobring additionalsecuritywithinthetimespecified.
8. Means to authorize someone to submit the application for provisional releaseTheownerofthesecurity,whowishestoauthorizesomeone
tosubmittheapplicationforprovisionalrelease,mustexecutethepower
ofattorneyatthedistrictofficewheretheownerlivesorthesecurity
islocated.Suchpowerofattorneymustbecertifiedandattestedwith thesignatureofthedistrictchiefofficeroractingofficertogetherwith
authorizedpositionsealaffixed.Thepowerofattorneymayalsobemade
beforethecourtofficer.Indoingso,thepersonalidentificationcardor
governmentofficeridentificationcardandcopyofhouseholdregistration
oftheappointorandappointeemustbepresented.However,somecourts
maynotallowtheownerofthesecuritytoappointanyonetosubmit thefirstapplicationforprovisionalreleaseonhis/herbehalf.Somecourts
maygrantprovisionalreleaseonlyincasewheretheownerofthesecurity
isarelativeofthepersonforwhomthebailisposed,inordertoprevent
thefraudulentactionbyexploitingotherpersonspropertyinbail.

9. How to use a certification letter from an insurance company as security? Theuseofcertificationletterissuedbyaninsurancecompanyas
securityforbailorbailpolicycantake2forms:
Form 1 : freedom insurance before offence is committed Itistheinsuranceforanypersonwhowishestomakeanadvance securityforbailbecauseofhavingriskorpotentiallycommittingany
criminaloffencebynegligence,e.g.driver,physician,construction contractor.Suchpersonmayusethecertificationlettertoapplyinthe
courtforhis/herownapplicationforprovisionalrelease.
Form 2 : freedom insurance after offence is committed Whenapersonischargedtobeanaccusedoradefendantand
wishestohaveanysecurityforbail,suchperson,friendorrelatives
maycontacttheinsurancecompanytobuyfreedominsuranceandthe companywillissueapolicyandcertificationletterfortherequired amount.Suchcertificationlettercanbeusedassecurityforbailinthecourt. Ingeneral,theapplicantcanusefreedominsuranceforalloffences excepttheoffencerelatedtothedistributionofdrugsandnarcotics. Afterobtainingtheinsurancecertificate,theapplicantshouldcheck againstthename,familyname,offence,amountforbail,etc.for thecorrectness.Whentheprovisionalreleasehasbeengranted,thecourt mustnotifytheinsurancecompanyfortheamountofbailwithout delay.

Thereisalsoanothertypeofinsurancesocalledthebailinsurance forvehicledriverwhichtheinsurancecompanyprovidesadditional protectioninadditiontothevoluntarycarinsurance.Thecertificateof thistypeofinsurancecanbeusedassecurityforbailofthedriveras
well.
Remarks Insurancecompanymayrefundtheinsurancepremiumtothe
applicantasfollows:
(1) freedominsurancebeforetheoffenceiscommitted:itisonly
refundablewhentheinsureepassesawayandthereisnoclaimduring theprotectionoftheinsurance.
Iftheinsureeonceusestheinsurancecertificatebutnotupto
thefullinsuringamountasstatedintheinsurancetable,theinsureemay
requestanewinsurancecertificatefortheremaininginsuringamount bynotificationinwritingtotheinsurancecompany;
(2) freedominsuranceaftertheoffenceiscommittedis refundableon5groundsasfollows:
a. ifthecourtdeniesprovisionalrelease,theinsurance companyshallrefundtheinsureeforthepremiumwithdeductionfor managementchargeof500baht.
Remark Incaseofbeingnotcertainwhetherthecourtwillgrant
provisionalreleaseornot,theapplicantshouldsubmitanapplicationfor
provisionalreleasebeforebuyinginsurance.Whentheprovisionalrelease
isgranted,theapplicantthenbuysthefreedominsurance;

at20%ofthepremium;

10. Can the securities from previous provisional release in other stages be used? 10.1 Incaseofcashorothersecuritysurrenderedasbail security

provisionalreleaseattheinquiryofficialorpublicprosecutorandstill
notrequestsuchsecurityretrieval,ifwished,maycontinuetoapplyfor
provisionalreleaseandsubmittheapplicationtothecourttotakesuch
cashorsecurityassecurityforbail.

22. What are the duties of the bailor? Thebailormustbringtheaccusedorthedefendanttoappear

23. If the accused or the defendant absconds or is likely to abscond, what should the bailor do? Thepersonenforcedbythebailconditions6mayseektheassistance fromthenearestadministrativeofficerorpolicetoarresttheaccused
orthedefendant.Incasewherethereisnosuchassistance,suchperson
shallhaveapowertoarresttheaccusedorthedefendant.Afterarresting, suchpersonshallsendtheaccusedorthedefendanttothenearest administrativeofficerorpolice.
24. What is the consequence if the bailor fails to bring the accused or the defendant to appear before the court? Thefailuretobringtheaccusedorthedefendanttoappearbefore thecourtwithoutreasonablegroundsisabreachofbailconditions. Thecourt,then,shallorderthebailor,enforcedbythebailconditions,for
finepaymentandseizethesecuritiestoauctionifthefineisnotpaid.
