The pladntl, Alcelde Boummehaud, li the dulyelected juege of the parish court for the perish ofPointe Coupee. and .as such alleges that he isauthorized and empowered by the Coustitutlon ofthis State to exoerise and perform all the dutiesappertaining to said office, and to collect sd re-ncie all the fees and emoluments appertalalnn or

belonging thereto, or which are allowed by lawfor seek services as the law required the clerks ofthe late district cowrt to reader in succeseniocsese, and such civil suits as have been by theConstitution of 1868 transferred to the perishcourt; that these rights are given to the judge ofthe parish exclusively, by article 86 of the Con.stittttio.

The plaintiff further alleges that the act of theLegislature approved 4th September, 168, so faras it requires clerks of district courts to set asolerks of the parish coarts, and to be thesslves,or by a regularly qualified deputy, always s at.tendance on the parish court at all its terms andIsittings, and making the clerks of the districtcourts ez oficio clerks of the parish oosrt, andprohibiting the parish judges from reeeiving anyfees of ofme, i In vioaintioo of the Costittion,4and null and void.

Defendant denies that plaintiff has say interestin the matter at lssue, or that he has shows anyoanue of action, and also pleads the generalissue.

From a careful examination of the provisions ofthe Constitution, the court is clearly of opinionthat the judge of the parish is entitled to receiveasalary and fees to be provided by law, and untilthe Legislature establishes other fees, he is ea*titled to receive all the fees which clerks of dis.trict courts were authorised to charge is suchcase as have been transferred by law to theparish courts.

It is. therefore, ordered, adjudged and deereedthat the injunction sued out by plaintiff in thecase be maintained. That the plaintiff, AloeideBoesaebhad, judge of the parish court for theparish of Pointe Conpes, be decreed to have thesole and exclusive right to act as clerk of his owncourt, and to receive all the fees allowed by lawfor bustness in his court ; and that the defendant.Charles D.
