Understanding Texas School Finance

Each year, the Texas Education Agency sends “official Chapter 41 notification” letters to school districts impacted by that rating.
There was a time in our school finance history when being classified as a Chapter 41 district meant you were a very wealthy district, at least in terms of property value per weighted student. That wealth brought with it a tremendous impact and enabled a district to raise substantially higher levels of revenue per WADA (weighted students in average daily attendance), at lower tax effort. That is why the inequities we have pointed out in the Wealth Hold-Harmless and Target Revenue
provisions exist—to enable those districts to maintain their advantages.
However, the creation of the Tier 2 copper penny level changed the impact of that definition. The yield in Tier 2 was originally set at $31.95 per WADA ($319,500 recapture level)—and is still there—so many districts of average or slightly above average wealth are now branded as Chapter 41, yet they gain little or no advantage from it.
In fact, as the table below shows, by TEA’s calculation, of the districts TEA projects to be Chapter 41 in 2015-16 school year, 213 have a wealth level below the recapture level of Continued on page 2.

In our Fall 2015 InDepth issue, Jeanette Winn, Karnes City ISD superintendent and Equity Center Regional Director, wrote an article explaining why, even though the explosion of the Eagle Ford Shale exploration and development has made KCISD a Chapter 41 district, she remains a loyal supporter and member of the Equity Center.
KCISD’s story is a familiar one, especially as more and more districts find themselves being identified by TEA as Chapter 41. As a result, we wanted to take a closer look at Texas’ school finance system and explain why being classified as a Chapter 41 district now has a completely different impact and meaning when compared to those districts who were
originally classified as Wealth Hold-Harmless Chapter 41 districts.
Perhaps a little history on the topic will help us remember what has happened, and how dysfunctional our school finance system has become. Chapter 41 was originally created as a response to the third Edgewood school finance trial. At the time, there was a single level of wealth—$280,000 per WADA—that determined whether or not a district would be classified as Chapter 41. If your wealth was below the $280,000 per WADA level, your district was under Chapter 42, and in the formula system. If your district was above it, you were classified as a Continued on page 8.

Tier 1 ($514,000 per WADA) and only face recapture if they access any Tier 2 copper pennies. In addition, 10 districts will only be “41” districts if they charge tuition for transfers, and thereby lose the ability to count those transfer students in the TEA calculation of wealth per WADA.
Based on the latest TEA near final data for 2014-15, there were 346 districts labeled as Chapter 41. However, after state aid and recapture were netted out—exactly the way TEA calculates every other districts formula amount and then nets out the per capita—only 128 of the 346 districts actually sent more money to the State than they received in state aid. Additionally, the State netted about $1.2 billion from recapture. The $1.5 billion in recapture some claim does not take into consideration the state revenue they receive. These 128 districts still maintain substantially more revenue per WADA at substantially lower tax rates than the vast majority of districts.
Coincidentally, if being a Chapter 41 district, and paying recapture, are so problematic, fixing it is easy. All that is required is to increase the guaranteed level (and, correspondingly, the equalized wealth level) in Tier 1 and Tier 2 to a reasonable level. Fact: Every increase in the Basic Allotment of Tier 1 and the Guaranteed Yield level of Tier 2 reduces the number of Chapter 41 districts and reduces recapture.
Bottom line, if for this biennium, the State had raised the Tier 2 yield per WADA and made it equivalent to the yield in Tier 1, (an equalized wealth level for both Tier 1 and 2 of $514,000 per WADA) the number of districts classified as Chapter 41 for this year would have dropped from 346 to 172—about half.
Under the current system, we have four different guaranteed yields and equalized wealth levels. It’s about time we do something to fix the real problems. Isn’t the real standard supposed to be equal yield for equal effort?

Chapter 41 district and subject to recapture. The impact of the 1993 Wealth Hold-Harmless and its corresponding exemptions reduced recapture to those districts. Even though those districts were “recaptured”, it was always at a funding level much higher than the actual equalized wealth level of the formula system. As a result, those districts remained funded well above those districts restricted by what the formula allowed.
Over the years, those advantages for Chapter 41 schools were further enhanced by formula additions to the Wealth Hold-Harmless provisions, elimination of recapture on I&S taxes for bonded debt, and the delivery of funding outside the equalized formula such as the High School Allotment, per capita apportionment, and various teacher and staff raises, etc.
With the Legislature’s response to the West Orange Cove litigation, all of the added inequities were rolled into the creation of Target Revenue. Additionally, the Legislature compressed M&O (Maintenance & Operations) tax rates, failed to set a high enough level for the Basic Allotment to adjust for the reduced number of pennies available for M&O taxes and revenue, and created three different guaranteed yields and equalized wealth levels (EWL) per
WADA—establishing what is now the current Chapter 41 muddle. The fact that it requires TEA to construct a 70+ page manual to explain “Chapter 41” status should be proof enough of the confusion. (A fourth and different guaranteed yield level exists for the facilities funding tier.)
The table below shows the standards as they have applied to TEA’s assignment of the Chapter 41 tag to a school district.
Obviously, for the expanded clarification of Chapter 41 districts using only their compressed tax rate and the golden pennies (which are not recaptured), the Tier 1 EWL has increased enough to keep most of them free of recapture.
However, that is not the case for the “copper pennies” of Tier 2. The EWL in Tier 2 has remained stagnant since its inception in 2006-07. As a result more and more districts each year are classified as Chapter 41, but only impacted if they are also forced to use any copper pennies to float their M&O budget and meet State standards in order to deliver the constitutionally required GDK (general diffusion of knowledge).
