R.A 9147 is jointly implemented by DENR, Department of Agriculture and Palawan Council for Sustainable Development (PCSD).

DENR- responsible for all terrestrial plant and animal species, all turtles and tortoises and wetland species, waterbirds and all amphibians, and dugong.

DA - responsible for aquatic habitats and resources (fishes, aquatic plants, invertebrates and marine mammals, except dugong).

PCSD – for all wildlife species found in Palawan areas (RA 7611).

• refers to species or subspecies that is not critically endangered nor endangered but is under threat from adverse factors throughout their range and is likely to move to the endangered category in the near future.

The Act makes it Unlawful for any person to undertake the ff.:1. Killing and destroying wildlife species.

2. Inflicting injury w/c cripples and/or impairs the reproductive system of wildlife species.

3. Effecting any of the ff. acts in critical habitats;a) dumping of waste products detrimental to

wildlife

b) squatting or otherwise occupying any portion of the critical habitat

c) mineral exploitation and/or extraction.

d) burning; logging and quarrying

4. Introduction, reintroduction or restocking of wildlife resources.

5. Trading of wildlife.

6. Collecting, hunting or possessing wildlife, their by-products and derivatives.

7. Gathering or destroying of active nests, nest trees, host plants and the like.

8. Maltreating and/or inflicting other injuries not covered by the preceding paragraph.

9. Transporting of wildlife.

FINES AND PENALTIES

For Critically Endangered species:

Six (6) years and one (1) day min. to twelve (12) years imprisonment

Php. 100,000.00 to Php. 1,000,000.00 fine

For Endangered species:

Four (4) and one (1) day to six (6) years imprisonment

A fine of a Php. 50,000.00 to Php. 500,000.00

For Threatened species:

one year and 1 day to 2 years imprisonment

A fine of Php. 20,000.00 to Php. 200,000.00

For other wildlife species:

6 months and 1 day to one year imprisonment

A fine of Php. 10,000.00 to Php. 100,000.00.

For Vulnerable species: Imprisonment of two (2) years and one (1) day to four years A fine of thirty thousand pesos (Php 30,000.00) to three hundred thousand pesos (Php. 300,000.00)

to be derived from fines imposed and damages awarded, fees, charges, donations, administrative fees or grants.

administered by DENR as a special account in the National Treasury. used primarily to finance rehabilitation or restoration of habitats. will also support scientific research, enforcement and monitoring activities, as well as enhancement of capabilities of relevant agencies.
