Background Information

Anthony suspects that Juana has a crush on him. He has overheard some of her friends giving her a hard time when meeting with him saying things like “see you got all dressed up for your meeting with Anthony”. Despite this feeling Anthony does not confront the situation and instead leaves it alone and makes sure that whenever they meet, they are seen publically by others so that rumors do not start.

NASPA #5 Conflict of Interest (engaging by dancing with a graduated student that close to graduation, considering the relationship that was already being rumored about, created a conflict of interest). “Give the appearance of impropriety”.

NASPA #8 Student Behavior (Anthony should have called out or addressed her behavior when he became concerned with it instead of avoiding the situation)

CAS Principle II Non Malfeasance, We Pledge to Do No Harm (Anthony did not interact with Juana in a way that would promote a positive result).

CAS Principle V Fidelity (Anthony did not act in a way to avoid conflicts of interest or the appearance of them).

ACPA 2.2 Avoid Dual Relationships With Students (Although Juana was not a student when they danced, this still applies because of the appearance of a dual relationship).

Overall Reaction

Overall, I do not think that Anthony is in any legal trouble because of his actions. He should have addressed the behavior of Juana as soon as it was happening instead of trying to avoid the confrontation. Since it was not addressed I do believe that it is reasonable to think that the students who saw him at the night club dancing could infer that Juana and Anthony had a previous relationship. He needs to inform his supervisor or whoever he reports to in the administration about the incident immediately.
