RIGHTS
WHAT IS A DISABILITY?
When most people think of the word “disability” they immediately picture someone in a wheelchair. But there are many different types of disability.
PEOPLE WITH A DISABILITY MAY INCLUDE:
people who are blind or partially sighted
people with learning or intellectual disabilities
people who are deaf or hearing impaired
people with a physical disability people with long term illnesses people with mental health or
psychological difficulties people with an acquired brain injury
AMERICANS WITH DISABILITIES ACT
A.D.A.
Protects people with a disability from being discriminated against in areas such as:
o Employmento State and Local governmento Public placeso Commercial facilitieso Transportationo telecommunication
EQUAL EMPLOYMENT AND OPPORTUNITY COMMISSION
(EEOC)Enforces laws to protect people with
disabilities: It is illegal to discriminate and not hire
someone because of race, color, religion, sex, national origin, age & disability
FAIR LABOR STANDARDS ACT
(FLSA) Establishes minimum wage & overtime
pay $7.25 per hour & Over 40 hours = 1.5
x
SECTIONS 501/502/504 OF THE VOCATIONAL
REHABILITATION ACT OF 1973 Protects disabled people from
discrimination in Federal programs
INDIVIDUALS WITH DISABILITIES
EDUCATION ACT (IDEA) Requires public schools to provide a free
and appropriate public education to all children in the least restrictive environment
Also requires public schools to develop IEP’s for each child
VOCATIONAL REHABILITATION’S INDIVIDUALIZED PLAN OF
EMPLOYMENT (IPE) Individual Plan of Employment is a
written plan for students vocational goal & services
CARL PERKINS ACT
The Act aims to increase the quality of technical education in order to help the economy
PERSON-CENTERED PLANNING
On going process to help people with disabilities.
Help plan their future
FAMILY RIGHTS PRIVACY ACT
Protects the privacy of students records
ADULT STATUS AT AGE 18
Turning 18: Child becomes a full legal adult
May register to vote in U.S., State & Federal elections
Can join the military Get married Males register for Selective Service
OCCUPATIONAL SAFETY & HEALTH ADMINISTRATION
(OSHA) A federal agency of the United States
that regulates workplace safety and health
