What is national biodiversity authority?

• The NBA is Autonomous body and that performs facilitative, regulatory and advisory function for Government of India on issue of

• Conservation

• sustainable use of biological resource and

• fair equitable sharing of benefits of use.

(NBA) was established in 2003 to implement India’s Biological Diversity Act (2002)

Functions and Powers of NBA:

• Regulate activities, approve and advice the government of India on research, commercial, bio-survey and bio-utilization.

• Section 6 of the Act underlines this principle.

• In case of persons intending to apply for any form of Intellectual Property Right in or outside India for any invention based on any research or information on a biological resource found in India, prior permission of the NBA is required.

• The NBA may impose benefit sharing fee or royalty or conditions on the financial benefits arising out of commercial utilization of such right while granting permission. Section

The National Biodiversity Authority may

• advise the Central Government on matters relating to the conservation of biodiversity, sustainable use of its components and equitable sharing of benefits arising out of the utilisation of biological resources;

• b.    advise the State Governments in the selection of areas of biodiversity importance to be notified under sub-section (1) of section 37 as heritage sites and measures for the management of such heritage sites
