What are the contractual issues?

• BIM level 2 is already widely introduced and working. Since every party works in its own system today’s contractual relationships and insurance cover continue to fulfil the requirements.

• BIM level 3 is where the big changes are needed, since all parties to a project will have access and edit facilities to all data. This is where FIDIC might have a need to adapt its family of contracts to address the new working environment. Some examples of issues popping up:

– Responsibility for cyber security

– Liability for incorrect information

– Ownership of data

– Intellectual property rights

– Liability if the information is subsequently used for illegal purposes

– integration with new insurance packages

• FIDIC is committed not only to address BIM related matters within its family of contracts, but take on its responsibility resulting from being the global authority relating to business practices. BIM level 3 will have a huge impact on our industry and there is a risk, that small and medium sized companies might not be able to cope with these changes.

• FIDIC has several committees which are monitoring the BIM impact on their day to day work. These are the Contracts Committee, the Capacity Building Committee and the Business Practice Committee. The FIDIC secretariat is coordinating the exchange of theses different committees with interested member associations and with EFCA – the European Federation of Consulting Engineering Associations.

FIDIC Actions

• FIDIC is launching a survey among all its member associations to get feedback to questions like:

– What is the status of BIM implementation in the specific country

– Timeline for mandatory BIM implementation

– Are standards developed and who has ownership of the model

– Has the national association a “BIM strategy”

• EFCA in parallel also started a survey among the member of its internal markets committee mainly focusing on standardization.

• Next steps will be decided within FIDIC at the upcoming Executive Committee Meeting end of May 2016.
