The Committee on Higher Education, Culture, Public Library, and Women's Affairs convened a public hearing on Thursday, January 7, 2016 at 4:00 p.m. in I Liheslatura's Public Hearing Room. On the agenda was the consideration on the appointment of Donovan L. Brooks; Member, KGTF/PBS Board of Trustees.
Public Notice Requirements
All legal requirements for public notices were met, with requests for publication sent to all media and all Senators; 5 day notice was sent on December 30, 2015 and the 48 hour notice was sent on January 4, 2016 via email. Copies of the hearing notices are appended to the report.

IL SUMMARY OF TESTIMONY AND DISCUSSION
Speaker \Von Pat Ed.D. announced that testimonies will be heard concerning the appointment of Donovan L. Brooks; Member, KGTF/PBS Board of Trustees. Speaker Won Pat Ed.D. mentioned that proper and adequate notices were given: a 5 day notice was sent on December 30, 2015 and the 48 hour notice was sent on January 4, 2016. Speaker Won Pat Ed.D. also mentioned that if there are additional testimonies to email testimonies to [email protected] or mail it to hand delivered at 155 Hesler Place Hagatna Guam, 96910 or fax it to 472-3589.
Speaker Won Pat Ed.D. acknowledged the presence of Senator M.C. Torres. Speaker Won Pat, Ed.D. called up Mr. Daryl Taggerty and Mr. Donovan L. Brooks.
Mr. Daryl Taggerty mentioned that he is the General Manager of PBS Guam and in support of the nominee, Mr. Donavon L Brooks. He mentioned that Mr. Donavon Brooks is highly qualified and that he was a previous board member. Mr. Daryl Taggerty mentioned that Mr. Brooks is highly regarded by the employees at PBS Guam as being serious, engaged, and very supportive of the mission and intentions of PBS Guam. Mr. Daryl Taggerty was very happy to hear from Mr. Brooks that he wanted to serve on the board once again; his name came up on a discussion of people who might be considered as board members back when there were only 3 members of the board. Mr. Daryl Taggerty also mentioned that he is very happy to see him today and looks forward in the legislature's favorable consideration and to serving as General Manager under his leadership with his consideration with the challenges and issues faced on a daily basis at PBS Board.
Speaker Won Pat Ed.D called up Mr. Brooks and told him that he can provide testimony; to tell about himself, about his background, some things that he has done, and what he is going to bring to the table.
Speaker Won Pat, Ed.D. mentioned that Mr. Brook's documents say that he was a member, and that he is not coming into the board that is completely foreign to him.
Mr. Donavan L. Brooks thanked Speaker Won Pat, Ed.D. and Senator M.C. Torres for the opportunity. He mentioned that he had a great time serving on the board of trustees under Governor Camacho's administration; the reason is because they had an engaged active board like Joe Cummingham, Gayle Hendricks, and Johnny Sablan. He also mentioned that they had a friendly proactive environment; where there was a very demanding job with the transition from the analog to the digital signal in which is what they were pretty much pushing for. Mr. Brooks mentioned that his accomplishment on that board was having everybody inclusive, to have everybody have a say where they felt welcome to contribute. Mr. Brooks stated, "If you talk to Daryl or Johnny Sablan, we accomplished a goal. Right now, they have a difficulty meeting, 1 will show up and that is one of the things is to show up, and I am here, and I am willing to show up." Mr. Brook's written testimony is appended to this committee report.
Speaker \Von Pat Ed.D stated, "! am glad that Daryl reached out to you, because there is always difficulty in finding members to serve on board who have to provide so much information, and more importantly dedicating their time to make the meetings. We are happy that you are going to be going to these meetings."
Mr. Donavan L. Brooks mentioned that he has been doing freelance work, since that time he has been self employed as a photo.i,,'Iapher, a journalist, a musician, and as well as a property maintenance person cleaning swimming pools.
Speaker \Von Pat Ed.D asked, "So you can manage your time of course, to make the meetings as well?"
Mr. Donavan L Brooks replied, "Oh yes, of course, I have a son that attends the Father Duenas Memorial School (FDMS) and I have to get him to school, to the bus stop, and I have to pick him up at all different times of the hours of the day; I know you are familiar with that role."
Speaker Won Pat Ed.D mentioned that Mr. Brooks has been active in community and civil involvements to raise monies for FDMS. So maybe with that kind of experience you can certainly reach out to help PBS/KGTF. Speaker Won Pat Ed.D mentioned that Mr. Brooks brings that personal experience in working with the board, a good relationship with people who are currently working there, and Mr. Brook's community and civic involvement shows that he is qualified to serve. Speaker Won Pat Ed.D also mentioned that you can•t have a quorum if the members cannot be present. Speaker Won Pat Ed.D asked her colleague for questions or comments.
Senator M.C. Torres stated, "Mr. Brooks, I just want to congratulate you going into the digital and helping PBS/KGTF go in to that milestone; I can see that it can be more challenging than what we anticipate or appreciate on the outside. I'm a big fan of PBS/KGTF, and one of the advantages is that people have access to that channel and it provides quality educational entertainment and cultural attributes that is maybe lacking in other venues or channels. So the health and prosperity of PBS/KGTF is very important to the community because it definitely serves a role in providing construction that otherwise people may not have access to.
Mr. Donavan L. Brooks stated,"! fully agree."
Senator M.C. Torres stated, "f also appreciate that you are an artist. Because you have a sense of what it is that grabs people's attention to have people tune in and stay tuned in to your channel. And that is one thing I find very attractive in PBS/KGTF." Senator M.C. Torres asked, "Do you have any ideas or aspirations to maximize the audience to have a larger reach to penetrate the public or to get the message, any thoughts you might have to get to the next level to reach a broader audience."
Mr. Donavan L. Brooks stated, "We were kind of headed into that direction to help guide the station. We were seeing the internet based shows and how it competed with public television. So we helped develop that plan. I've been away from the station for about 5 or 6 years, I will go in sit with Daryl and staff and see what their difficulties are and compare it to what I knew back then, and then see how does this compare and what I can do to make the station a better station.
Senator M.C Torres stated, "Just looking at another phase of my life where I have grandkids. I am little concerned about the junk they have access to. I will hope that they tune into your station more and that your station can appeal to that next generation. You have our generation hooked,
but it's that quality and that civically responsible broadcast and that is what I see that your station delivers. It is nice to see you on board and working as a group to make it get better and have consistency in the board meetings which is a good objective."
Mr. Donavan L. Brooks stated, "Yeah we were very successful when Mr. Johnny Sablan was the General Manager; we never missed a meeting, it was easy to want to go there and participate."
Senator M.C Torres replied, "And it is very promising, because you were invited by the general manager, well that is a very good start. Thank you very much for agreeing to serve."
Speaker Won Pat Ed.D asked, "Any last words you want to share?" Speaker mentioned I know you have a vision for KGTF/PBS, I'm sure in that vision is something that you would want Donovan to assist you with, maybe you can share because it is important to know where you would like to see KGTF/PBS go.
Mr. Daryl Taggerty stated, "Absolutely I have been involved in non commercial programming as volunteer and as a manger since 1981 and continuously since that time. So coming to KGTF was an opportunity to bring that entire experience bear as a government agency, not as a nonprofit organization but as a government agency that has a mission. A mandate to provide services also the backing to provide those services. Within 3 months of my confirmation in March, 2 years ago, I described my vision for the station and asked for the legislature support and the support of the board which was new at the time. And they only had 2 more meetings before they lost quorum. I did not have any one to take my vision to for 20 months. I really look forward to having discussions with the board and soliciting their support and their perspective on what it is that should be done to fulfill our mission and to move our station forward in 2016 and 2017 given the realities of the market and given what we have for opportunities already here in our community. The television market is going to a see a change since the time that cable TV came out. And technology, the capital replacement of technology, in some areas of our plans is 3 years it used to be 10 years. And we are very hard and we are 2 thirds into a capital replacement cycle and we are already 2 cycles behind. We are trying to catch up and we are trying to compete with Y ouTube and direct delivery of the great PBS programming to our viewers. So that is a huge challenge, what is PBS Guam going to be in another year or two. 1 have a vision but it can't be achieved without the board. And I am very happy that Donovan has agreed to serve because he does know the value of a 5 year strategic plan. I need to have sharp minds as we do have on the board to see how we can move the station forward to provide the services that we are mandated to provide as we have agreed to provide based on our license from the FCC and based on or assurance and agreements that we have for corporations for our public broadcasting for our annual f,'fants. Those are our 3 guiding mission statements that we have to fulfill and we can but I cannot do it alone, because it has been delegated to the board. I do not bring it to the legislature,
I bring it to my board. Thank you for your favorable consideration. thank you very much for having confirmed the nominees that were presented by the governor over the past year, I am very confident that when the board meets that we are going to be moving forward with the decisions that need to be made to stay in the game, for the benefit of the people of Guam. "
Mr. Daryl Taggerty replied, "Senator you mentioned about your grandchildren, PBS kids is the largest online viewing -we have 43 percent of the total market for number hits for children. We are taking that role very seriously. However, with the direct delivery with the PBS programming through Roku, Chromecast and !lulu it is so easy to go straight to the website and pull the programs and view them on demand. So the networks are assisting with each of the stations to bring them forward to address the new reality of the marketplace to help us transition to a more locally based production model where we can produce programs for ourselves so we can show other communities that reflect our values, our talent, and our beauty of our surroundings. And this great opportunity not only on Guam but the whole Marianas as one station to become more of a participant nationally in sharing the reality of what we have on Guam. The Legislature has funded the children's program, Nihi, which was offered to us first, offered to my predecessor; I don't know how or why the agreement broke down housing the unit at PBS Guam. But PBS children's programming is the model for Nihi, the commercial stations are required now to solicit this kind of higher quality programming to play on their stations. So Nihi is providing a very solid service to the commercial stations so they can improve the quality of their children's programming in which I am all for. But we need to take that Nihi concept, not necessarily with the legislature's support but with PBS 's support and generate 10, 15, 20 such shows being produced by local writers, actors and film makers. That is our future and it is the future for stations all around the United States. But being here from the Marianas, we have a very rich community to draw from, visually and artistically our stories and talent so that we can have something to export. We have something we can share via broadband medium. Broadcast is becoming the small part of the mission of PBS Guam, it is becoming smaller because most of our distribution is through cable and wired services and our broadcast service, while they are serving relatively small numbers of households, we need to hang on till the next generation which will be unveiled in 2017. We are going to replace the small android screens and tablets to huge screens everywhere. It's going to be an amazing technology change. We need to position ourselves with local programming so we can populate those screens with our programming to share with ourselves and everyone in the United Sates can have access to it. So these are sort of the challenges that Mr. Brooks is stepping into. We will tackle this together. This should be a lot more difficult or bigger than what he faced when changing analog to digital. Thank you very much for your interest in PBS Guam and for your support. Because that has been appreciated by us and the public over the years."
Speaker \Von Pat Ed.D stated, "Thank you for sharing your challenges and your vision, now with other members of the board you will be able to have your board meetings. Start making
plans for the future so we will work closely with you to give you ample time to work with Donovan and other members, to start moving forward with your vision and mission to address some local and federal requirements. Let's set up a time to not have an oversight but rather an update of what is going on. And that will be important to get out into the community, to see your successes of where you're going and help you in any way to promote what it is you're trying to reach out to our people and community like our neighbors and those who moved off island.

Thank you for your consideration of my nomination to the board of trustees of the Guam Educational Telecommunications Corporation, or KGTF Channel 12, Guam's PBS affiliate.
I am here because late last year, KGTF station manager Darryl Taggerty called me and asked if I would rejoin the KGTF board, as they were not always able to gather a quorum for required monthly board meetings. I was the board chairman from 2002 to 2007 during Governor Felix Camacho's administration.
I told Darryl that I would be glad to have an opportunity to once again help the station. During my previous time as a board member, the station was facing an FCC timeline to transition to a digital signal capacity that required overcoming significant logistical, technological and regulatory hurdles.
Under the leadership of Johnny Sablan, who was the station's general manager during much of my time on the board, and with other active, supportive board members like Joe Cunningham and Gayle Hendricks, among others, KGTF consistently progressed towards that digital transition.
I look forward to rejoining the board and being an active member. I hope to contribute my sense of appreciation for public television, and my time and my experience. I believe public television is important to a community because, in my view, the programming more often reflects humanity at its best, instead of at its worst. And as a father and grandfather, I want more positive messages, quality programming, and credible information available for my children and grandchildren that one might find on broadcast television.
