AB 5 (Ammiano (D)) - Homelessness Description: Enacts the Homeless Person's Bill of Rights and Fairness Act. Provides that no person's rights, privileges, or access to public services may be denied or abridged because he or she is homeless, has a low income, or suffers from a mental illness or physical disability. Provides civil and criminal immunity and immunity from employer retaliation for assisting a homeless person. Provides judicial relief and imposes civil penalties for a violation. Prohibits discrimination regarding health emergency services. Note: DPSS submitted the following comment to CEO on 1/31/2013. “The Department of Public Social Services (DPSS) indicates that any impact for the demand of additional public social services under AB 5 is unknown at this time. According to DPSS, in Los Angeles County, the number of homelessness for CalWORKs families has risen during the last six years to a historical high of 134 percent. In addition, over 50 percent of individuals on General Relief are homeless.”

Program: CalFresh Legislative Analyst: Badajos County position: Watch CWDA position: Support in Concept

AB 191 (Bocanegra (D)) - CalFresh: Categorical Eligibility Requires the State Department of Social Services to waive the CalFresh gross income test for any individual who is categorically eligible for CalFresh and who is a member of a household that receives, or is eligible to receive, medical assistance under the Medi-Cal program. Prior Legislation: AB 1560 (Fuentes) - CalFresh: Categorical Eligibility supported by DPSS failed passage in 2012. AB 197 (Stone (D)) - CalWORKs Eligibility: Asset Limits: Vehicles Deletes existing requirements for assessing the value of a motor vehicle for purposes of eligibility for public aid, including the CalWORKs program. Excludes the value of a licensed motor vehicle from consideration when determining or redetermining eligibility for aid. Prior Legislation:

AB 2352 (Hernandez) failed passage in 2012. This bill is related to CalWORKs eligibility asset limits identical to the current bill.

AB 1182 (Hernandez) was vetoed by the Governor in 2011. This bill is related to CalWORKs eligibility asset limits identical to the current bill.

AB 1058 (Beall) failed passage in 2010. This bill would have eliminated the vehicle asset test for CalWORKs applicants and recipients.

Note: On Febraury 2, 2013, the Coalition of California Welfare Rights Organization(CCWRO) sent out a request asking social agencies and advocates to support this bill. Instead of writing an indiviual support letter or adding its name to the joint support letter with other agencies, DPSS would follow the Board-approved State legislative priorities and take a position on this bill, if amended, through the Chief Executive Office’s Intergovernmental and External Affairs and have a Sacramento advocate present its position to the State Legislature.

AB 271 (Mitchell (D)) - CalWORKs: Eligibility Prohibits the denial of aid or denial of increase in the maximum aid, under the Work Opportunity and Responsibility to Kids (CalWORKs) program, payment as a result of the birth of a child. Prohibits conditioning an applicant or recipient's eligibility for aid on the applicant or recipient's disclosure of specified information regarding rape, incest, or contraception. Prior Legislation: AB 1640 (Mitchell) was signed by the Governor in 2012. Similar legislation, this bill required CalWORKs aid to be paid to a pregnant teen mother at any time after verification of pregnancy, regardless of whether she is eligible for Cal-Learn. AB 276 (Hueso (D)) - CalFresh Eligibility Requires the state to submit a request to the U.S. Department of Agriculture to waive the requirement excluding the basic allowance for housing from countable income in the calculation of eligibility and benefit level and requires the waiver to be implemented within 6 months of being granted. Requires participating counties to defer from the CalFresh E&T program a person who is currently serving in the U.S. Armed Forces or is a veteran who has been honorably discharged.

SB 528 (Yee (D)) - Care and Treatment: Minor and Nonminor Parents Specifies that nothing in those provisions shall be construed to limit the rights of dependent children to consent to specified types of medical and other care, including the diagnosis and treatment of sexual assault, medical care relating to the prevention or treatment of pregnancy, treatment of infectious, contagious, and communicable diseases, mental health treatment, and treatment for alcohol and drug abuse. Note: The issues around subsidized child care and having a priority for minor parents is one that we battle almost daily. Our AFLP girls in particular have a very hard time returning to school because they cannot afford child care and the wait list for subsidized child care can run up to 2-3 years. In Metro LA, there are very few schools that have on-site and/or coordinated child care, and because there are so few of them, getting into one is very difficult. And recently the County has closed most of the Independent Study Programs that they operated. We are fortunate that several years ago the option was given to the Cal-Learn Programs to have on-site Independent Study Programs.
