This report features information on bills that have been introduced in the Legislature and have provisions that may impact the programs administered by Los Angeles County Department of Public Social Services (DPSS). The first page of this report “Hot Sheet” highlights legislation that is especially noteworthy. At this point of the legislative process, many bills identified have little information. As the bills move through the Legislature and become more developed, Intergovernmental Relations in consultation with DPSS Program managers will work with the Chief Executive Office staff to analyze their impact and determine which bills the County could take an active position on. AB 5 (Ammiano (D)) - Homelessness Description: Enacts the Homeless Person's Bill of Rights and Fairness Act. Provides that no person's rights, privileges, or access to public services may be denied or abridged because he or she is homeless, has a low income, or suffers from a mental illness or physical disability. Provides civil and criminal immunity and immunity from employer retaliation for assisting a homeless person. Provides judicial relief and imposes civil penalties for a violation. Prohibits discrimination regarding health emergency services. Note: DPSS submitted the following comment to CEO on 1/31/2013. “The Department of Public Social Services (DPSS) indicates that any impact for the demand of additional public social services under AB 5 is unknown at this time. According to DPSS, in Los Angeles County, the number of homelessness for CalWORKs families has risen during the last six years to a historical high of 134 percent. In addition, over 50 percent of individuals on General Relief are homeless.”

AB 25 (Campos (D)) - Employment: Social Media Description: Applies existing law that prohibits a private employer from requiring or requesting an employee or applicant for employment to disclose a username or password for the purpose of accessing personal social media, to access personal social media in the presence of the employer, or to divulge any personal social media to public employers.

AB 50 (Pan (D)) - Health Care Coverage: Medi-Cal: Eligibility Description: Requires the Department of Health Care Services to establish a process to allow a participating hospital to elect to be a qualified entity for purposes of eligibility for Medi-Cal and providing medical assistance during the presumptive eligibility period. Requires the department to inform enrollees of their options with regard to service. Relates to enrollee service option notification. Regards certain program contract extension. Program: CalFresh Legislative Analyst: Badajos County position: Watch CWDA position: Support in Concept

AB 191 (Bocanegra (D)) - CalFresh: Categorical Eligibility Requires the State Department of Social Services to waive the CalFresh gross income test for any individual who is categorically eligible for CalFresh and who is a member of a household that receives, or is eligible to receive, medical assistance under the Medi-Cal program. Prior Legislation: AB 1560 (Fuentes) - CalFresh: Categorical Eligibility supported by DPSS failed passage in 2012. AB 197 (Stone (D)) - CalWORKs Eligibility: Asset Limits: Vehicles Deletes existing requirements for assessing the value of a motor vehicle for purposes of eligibility for public aid, including the CalWORKs program. Excludes the value of a licensed motor vehicle from consideration when determining or redetermining eligibility for aid. Prior Legislation:

AB 2352 (Hernandez) failed passage in 2012. This bill is related to CalWORKs eligibility asset limits identical to the current bill.

AB 1182 (Hernandez) was vetoed by the Governor in 2011. This bill is related to CalWORKs eligibility asset limits identical to the current bill.

AB 1058 (Beall) failed passage in 2010. This bill would have eliminated the vehicle asset test for CalWORKs applicants and recipients.

Note: On Febraury 2, 2013, the Coalition of California Welfare Rights Organization(CCWRO) sent out a request asking social agencies and advocates to support this bill. Instead of writing an indiviual support letter or adding its name to the joint support letter with other agencies, DPSS would follow the Board-approved State legislative priorities and take a position on this bill, if amended, through the Chief Executive Office’s Intergovernmental and External Affairs and have a Sacramento advocate present its position to the State Legislature.

Program: CalWORKs Legislative Analyst: Yin County position: Watch CWDA position:

AB 271 (Mitchell (D)) - CalWORKs: Eligibility Prohibits the denial of aid or denial of increase in the maximum aid, under the Work Opportunity and Responsibility to Kids (CalWORKs) program, payment as a result of the birth of a child. Prohibits conditioning an applicant or recipient's eligibility for aid on the applicant or recipient's disclosure of specified information regarding rape, incest, or contraception. Prior Legislation: AB 1640 (Mitchell) was signed by the Governor in 2012. Similar legislation, this bill required CalWORKs aid to be paid to a pregnant teen mother at any time after verification of pregnancy, regardless of whether she is eligible for Cal-Learn. Program: CalFresh Legislative Analyst: Badajos County position: Watch CWDA position:

AB 276 (Hueso (D)) - CalFresh Eligibility Requires the state to submit a request to the U.S. Department of Agriculture to waive the requirement excluding the basic allowance for housing from countable income in the calculation of eligibility and benefit level and requires the waiver to be implemented within 6 months of being granted. Requires participating counties to defer from the CalFresh E&T program a person who is currently serving in the U.S. Armed Forces or is a veteran who has been honorably discharged.



AB 309 (Mitchell (D))- CalFresh: Homeless Youth Clarifies that eligibility for CalFresh benefits, including expedited services, is not dependent on the age of an applicant and that county welfare departments must accept applications from unaccompanied homeless children and youths. Requires departments to make information about CalFresh expedited services targeted to the homeless population available to local educational agency liaisons. FACT SHEET AVAILABLE

AB 361 (Mitchell (D)) - Medi-Cal: Health Homes for Medi-Cal Enrollees Authorizes the State Department of Health Care Services to create a health home program for medical enrollees with chronic conditions, as authorized under federal law. Provides that those provisions shall not be implemented unless federal financial participation is available and additional General Fund moneys are not used to fund the administration and service costs. AB 411 (Pan (D)) - Medi-Cal: Performance Measures Requires all Medi-Cal managed care plans to analyze their Healthcare Effectiveness Data and Information Set measures, or their External Accountability Set performance measure equivalent, by race, ethnicity, and primary language, and to implement strategies to reduce identified disparities between members of different races and ethnicities and with different primary languages. AB 419 (Lowenthal B (D)) - CalWORKs: Eligibility Relates to criteria for eligibility for the CalWORKs program. AB 422 (Nazarian (D)) - Health Care Applications Requires notices of a Healthy Families Program application to include prescribed advisements about the availability of free or reduced-cost comprehensive health care coverage through Medi-Cal or the California Health Benefit Exchange respectively.

AB 505 (Nazarian (D)) - Medi-Cal: Managed Care: Language Assistance Services Requires the State Department of Health Care Services to require all Medi-Cal managed care plans contracting with the department to provide language assistance services, which includes interpretation and translation services, to limited-English-proficient enrollees. AB 518 (Atkins (D)) - Community-Based Adult Services Establishes the Community-Based Adult Services program as a Medi-Cal benefit. AB 776 (Yamada (D)) - Medi-Cal Amends the Medi-Cal program that states beneficiaries residing in counties participating in certain projects be provided long-term services and supports and requires the Department of Health Care Services to consult stakeholders. AB 812 (Mitchell (D)) - Child Care: Contracts: Termination and Suspension Repeals the requirement that the State Department of Education provide an independent appeal procedure in the instance of contract suspension. Repeals the requirement that the contracting agency submit all previously required standard monthly or quarterly reporting forms before filing an appeal petition.

AB 814 (Bradford (D)) - CalWORKs: Eligibility: Truancy Deletes the requirement that the aid grant of a family be reduced if the county determines that an eligible child under 16 years of age is not regularly attending school. Requires that if the county determines that that child is not regularly attending school or participating in a welfare-to-work plan, the county document that the child has been offered a meaningful opportunity to be engaged in the creation of his or her plan, including an age-appropriate assessment, before the county reduces the aid.

AB 889 (Frazier (D)) - Health Care Coverage Codifies the Department of Managed Health Care regulation and require every health care service plan or health insurance policy that provides coverage for outpatient prescription drug benefits, to provide coverage for all medically necessary outpatient prescription drug benefits. Sets forth standards regarding such benefits. Places restrictions on copayments, coinsurance and deductibles. AB 985 (Cooley (D)) - Aid to Families With Dependent Children Authorizes a nonminor to receive Kin-GAP benefits if he or she is 21 years of age or younger and meets any of certain criteria, including, among others, that he or she attends a postsecondary institution of higher education or is employed at least 80 hours per month. Authorizes a nonminor in high school or a General Education Development program to continue to receive aid if he or she is reasonably expected to complete an educational program by age 20. AB 1107 (Garcia (D)) - CalWORKs Eligibility: Domestic Violence Requires the State Department of Social Services to establish a standard, statewide notice and process to ensure that applicants for, or recipients of, CalWORKs aid who are past or present victims of domestic violence are not placed at further risk or unfairly penalized by program requirements or procedures. AB 1217 (Lowenthal (D)) - Home Care Services Consumer Protection Act of 2013 Enacts the Home Care Services Consumer Protection Act of 2013 to provide for the licensure and regulation of home care organizations and the certification of home care aides. Imposes a civil penalty for operating without a license. Requires the agency to give client specified information prior to arranging for services. Relates to the maintenance of liability insurance. Requires background checks for home care aides. Requires such aides to show they are free of active tuberculosis. FACT SHEET AVAILABLE



AB 1263 (Perez J (D)) - Medi-Cal: CommuniCal Establishes the Medi-Cal Patient Centered Communication program to provide and reimburse for medical interpretation services to Medi-Cal beneficiaries who are limited English proficient. FACT SHEET AVAILABLE

SB 28 (Hernandez E (D)) - Medi-Cal: Eligibility Description: Implements various provisions of the federal Patient Protection and Affordable Care Act by modifying provisions relating to determining eligibility for certain groups. Extends Medi-Cal eligibility to specified adults and requires that income eligibility be determined based on modified adjusted gross income. Note: DPSS provided a pursuit of County Position to Support Legislation for the Expansion of the Medi-Cal Program as Provided Under Federal Health Care Reform.

SB 134 (Rubio (D)) - CalFresh Requires the State Department of Social Services to modify the list of allowable food items purchasable under CalFresh to prohibit recipients of CalFresh benefits from purchasing with those benefits sweetened beverages containing more than 10 calories per cup. Provides an exception. Requires the department to seek all necessary federal approvals.

SB 172 (Beall (D)) - In-Home Supportive Services: Sales Tax Makes a technical, nonsubstantive change to existing law that creates the Personal Care IHSS Quality Assurance Revenue Fund and requires the IHSS provider tax and related supplementary payments to be implemented no earlier than a specified date, and provides for these provisions to become operative only if a specified federal approval is granted.

SB 192 (Liu (D)) - Child Care: Early Learning and School Support Resources Requires childcare resources and referral programs to provide information about certain child care services available when a family is determined eligible for child care and development services or recertified as eligible for those services under the alternative payment program, or Stage 2 or 3 Child Care program. Requires those agencies to give priority to providing information about safe, caring, and age-appropriate early learning and school support environments for specified persons. SB 252 (Liu(D)) - Social Services: CalWORKs: Paid Family Leave Requires the State Department of Social Services to work with the Employment Development Department to ensure that each applicant and recipient of CalWORKs provided with information about paid family leave benefits. FACT SHEET AVAILABLE



SB 283 (Hancock (D)) - CalWORKs and CalFresh Eligibility Authorizes CalWORKs and CalFresh benefits to be paid to an individual who is convicted in state or federal court of any offense classified as a felony that has as an element of possession, use, or distribution of a controlled substance. Provides that if the person is on supervised release, he or she would be ineligible for benefits during any period of revocation of that supervised release. Prior Legislation: AB 828 (Swanson) - Failed passage in 2012. This bill was similar to SB 283. AB 1756 (Swanson) – Failed passage in 2010. This bill was similar to SB 283. AB 1996 (Swanson) - Vetoed by the Governor in 2008. This bill was also similar to SB 283.

SB 343 (Yee (D))- Dependent Children: Documents Requires the county welfare department to submit reports at the first regularly scheduled hearing after the child has attained 16 years of age and at the hearing immediately prior to the child attaining 18 years of age, verifying that it has provided certain information, documents, and services to the child. SB 346 (Beall (D)) - Public Social Services Programs: Records Authorizes a county welfare department to share information with other local governmental programs, departments, or entities participating in the administration of public medical assistance or other social services programs in that county for the purposes of establishing a client-centered approach to the provision of those services. Requires the local governmental program, department or entity to comply with applicable state and federal confidentiality and privacy laws.

SB 353 (Lieu (D)) - Health Care coverage: Language Assistance Requires a health care service plan and a health insurer that advertises or markets in a language other than English, and does not meet certain enrollment thresholds, to translate into that language specified documents. Revises provisions regarding the prior submission of advertisements to the Department of Managed Health Care. SB 464 (Jackson (D)) - Child Care: Healthy Eating and Physical Activity Act Enacts the Healthy Eating and Physical Activity Act. Establishes standards with respect to nutrition and physical activity for early childhood education programs, and afterschool programs conducted under the Child Care and Development Services Act.

SB 528 (Yee (D)) - Care and Treatment: Minor and Nonminor Parents Specifies that nothing in those provisions shall be construed to limit the rights of dependent children to consent to specified types of medical and other care, including the diagnosis and treatment of sexual assault, medical care relating to the prevention or treatment of pregnancy, treatment of infectious, contagious, and communicable diseases, mental health treatment, and treatment for alcohol and drug abuse. Note: The issues around subsidized child care and having a priority for minor parents is one that we battle almost daily. Our AFLP girls in particular have a very hard time returning to school because they cannot afford child care and the wait list for subsidized child care can run up to 2-3 years. In Metro LA, there are very few schools that have on-site and/or coordinated child care, and because there are so few of them, getting into one is very difficult. And recently the County has closed most of the Independent Study Programs that they operated. We are fortunate that several years ago the option was given to the Cal-Learn Programs to have on-site Independent Study Programs. That has been extremely helpful for our program. - Childcare program



SB 579 (Berryhill T (R)) - In-Home Supportive Services Makes technical, nonsubstantive changes to provisions of existing law providing for the county-administered In-Home Supportive Services (IHSS) Program relating to county-only funds to fund both the county share and the state share when any increase in IHSS provider wages or benefits is negotiated or agreed to by a public authority or nonprofit consortium.

Requires the Exchange to enroll individuals in a bridge plan. Authorizes the Exchange to adopt related regulations. Authorizes a health care service plan or insurance carrier offering a bridge plan product in the Exchange to limit the products it offers in the Exchange to the bridge plan product.

Reconsideration Granted:

Spot Bill: A bill that proposes non substantive changes to a code section in a particular subject. Often used as a legislative vehicle later in the legislative session for ideas not fully fleshed out when the bill is introduced.

Suspense File: Bills exceeding certain appropriation threshold in fiscal committees are placed on the suspense file. Current threshold set at $50,000. Fiscal committees in each house hold a special hearing close to the fiscal committee deadlines (late May and August) to determine which bills will come off the suspense file and move forward.

Two-Year Bills: Bills that failed passage in the first session of a two-year legislative session and reintroduced in the second year (e.g., a bill failed passage in 2011 could be reintroduced in 2012.)
