EMPLOYMENT TRIBUNALS Case Number: 4109312/2012 Claimant Mr DI Gardiner V Respondent Exsto UK Ltd Dear Sir, I refer to your letters dated 3 December, 11 January, and 22 January sent to Aberdeen Employment Tribunal. Since these letters relate to the claim transferred to Bristol Employment Tribunal, Regional Employment Judge Parkin has considered them and directs me to reply as follows: 1) We apologise for the delay in dealing with your correspondence. 2) The decision to transfer the claim from Aberdeen Employment Tribunal to Bristol Employment Tribunal was made by Vice President of Employment Tribunals (Scotland) Susan Walker with the consent of the President of the Employment Tribunals (England and Wales) Judge David Latham, upon Regional Employment Judge Parkin indicating that he had no objection to such a transfer. The decision was made on the basis that it could more conveniently be dealt with in Bristol having regard to the claims presented at Bristol Employment Tribunal based upon the same employment at a location with the Bristol postcode allocated, which claims raised the same preliminary issues for determination. 3) The transfer was effected and the Pre-Hearing Review was held in this claim along with the other claims on 8 January 2013. The Judgment and Reasons were sent to the parties on 17 January 2013. 4) In the event that the decision to transfer this claim was a decision capable of review within Rule 34 of the Employment Tribunals Rules of Procedure 2004, it not being practicable for it to be considered by Vice President Walker, Regional Employment Judge Parkin refuses the application for a review as there are no grounds for it and there is no reasonable prospect of it being varied or revoked.
