L1 - Visa category has been defined to assist the organizations intending to post their key personnel in the USA at executive or managerial levels in new locations. The organizations being permitted to apply for this class of entry permit may have a US based affiliate, or may be intending to setup one in the country. The primary qualification parameters attached to the grant of this entry permit include following

• The office of company being established must have bonafide relations with an overseas entity as a parent undertaking, branch, division or an associate; and

• The organization should either already be involved in

business or must be intending to carry on a qualified commercial activity in a minimum of one overseas location. The business activity being carried out should be either direct or indirect through a bonafide agency, and it must be carried out till the extent of stay of the permit holders in the country.


This permit is basically a non immigrant category arrangement that permits the permit holders to reside and work in the

country for a specified period of time either as specified by the employer, or to the maximum of 7 years. The initial grant

under this scheme is for one year if the employer is establishing a new office in United States. In other cases the

initial grant period is up to a period of three years. The following extensions to the permit are granted in multiple of

two years.


The permit also enables the permit holders to take their families along to the country, i.e. the definition of family

includes married spouse and dependent children under the age of 21 years. The family members must place their requests under L-2 non immigrant permit category. The tenure of such permits is dependent on the period of residence permission granted under the US L1-A Intercompany Transfer Visa. This arrangement also permits the married spouse of the permit holders to obtain permission to gain fruitful employment.

Preconditions for the Entry Scheme

US government has set some basic rules for both employment giving concerns and personnel. The employers relocating their personnel must substantiate that they are directly involved in continuous commercial activity in terms of providing goods and services; and The overseas organizations intending to shift their key personnel to the USA at executive or managerial levels must also substantiate that


• They have hired suitable space establishing new office • The personnel being shifted to the USA has been in

employment of the company for a minimum period of one year in last three years immediately preceding the date of placement of request for L-1A Visa;

• The organization would bear all the expenditure pertaining to personal and professional expenses incurred by and on personnel being shifted.


Similarly, the personnel being shifted on this permit to the US on the basis of L1-A Inter Company Transfer Visa must be able to evidence that they have been in continuous employment for a minimum period of one year in previous three years immediately preceding the date of entry into the country; and are being shifted to the country to carry out strategic functions at executive of managerial levels for a location of same organization of one of its bonafide associate or branch.


This permission also has an arrangement that enables qualifying employers to relocate their personnel to the USA without having to place separate petitions for each transfer.
