Registration Agreement: Purchase of Land at Huntlee

 

 

Parties

i. Huntlee Pty Ltd (ACN: 143 744 745) of 34 Main Street Ellenbrook WA (We or Us); and ii. The person, persons or company referred to as the Buyer (You or Your)

Background This Registration Agreement will secure Your preferred Lot in the Development prior to a formal Contract for Sale being entered into. Agreement In consideration of the Registration Deposit paid to Us by You, the parties agree to enter into this Registration Agreement (Agreement) to register an interest to purchase the Lot in the Development (Lot) for the purchase price specified on the LWP Property Group NSW website on the following Terms and Conditions:

1. You will pay a Deposit of $2000.00 (Registration Deposit) by way of electronic funds transfer. The Registration Deposit will be held in trust by LWP Realty NSW Pty Ltd as agent for and on behalf of The Vendor pending execution of the Contract for Sale (Contract) in respect of the Lot or cancellation of this Agreement.

2. You acknowledge that there will be no interest earned on the Registration Deposit.

3. The Registration Deposit will be credited to the full deposit payable pursuant to the Contract.

4. Either We or You may cancel this Agreement at any time prior to entering into the Contract by notice in writing to the other Party. Should the Agreement be cancelled, the Registration Deposit will be refunded in full within 10 days and issued in the form of a cheque.

5. You acknowledge that all information in respect of the Lot and the Development (including without limitation any plans and specifications provided by Us) is preliminary and may be subject to change. You further acknowledge that all plans and specifications are subject to approval by the relevant local and statutory authorities.

6. Unless this Agreement has been cancelled, then You acknowledge that, subject to approval of the Contract Terms and Conditions, You will enter into the Contract within 7 days of payment of the Registration Deposit.

7. You acknowledge that the construction of a residence and any other improvements on the Lot must comply with the provisions of the Contract including but not limited to Design Guidelines, Building Requirements and Restrictive Covenants details of which will be provided by Us prior to entering into the Contract.

8. In the event that the Contract has not been entered into within 7 days of payment of registration deposit then this Agreement will automatically terminate without notice and the Registration Deposit will be refunded to You.

9. Upon receipt of the Registration Deposit, We will confirm to You in writing details of your selected Lot.
