In North Carolina, drivers are considered impaired & a citation is issued when their blood alcohol content (BAC) is 0.08 or above.

A Driver May Also Be Issued A DWI If:• Drivers with other impairing
substances within their system, both illegal and prescribed, may also be given a citation.• Drivers who are under
21 with a blood alcohol content higher than 0.00 may be given a driving while impaired citation.

If a driver is convicted with a DWI, their driver’s license is revoked for a period of at least one year and their name is placed in a national DWI registry.

T• After a DWI conviction, the court will
require the driver to complete a DWI Assessment by an approved substance abuse treatment provider.
• The DWI Assesseemnt entails a clinical interview and completion of approved substance abuse screening tools. At the end of this assessment, the driver will be recommended for DWI education or treatment.

T• Once the assessment is completed,
the approved DWI facility will submit to the DWI State Office an electronic Assessment Completion Form or Form E-508.

T• DWI Substance Abuse Treatment may
include:- Education: Also known as Alcohol and Drug
Education Traffic School or ADETS
- Outpatient Treatment: Minimum of 20 (short-term) and maximum 89 hours (long-term) of substance abuse group sessions
- Intensive Outpatient Treatment: Requires a minimum of 90 hours for 90 days.
- Inpatient/Residential Treatment: Driver resides at a treatment facility over a period of time.

• The DWI facility will report completion of treatment via Form E-508• The DWI State Office
will review the E-508s, and send the driver’s information the DMV for approval. • After approval, the
driver may contact or go to the local DMV regarding outstanding fees for revocation and reinstatement of their driver’s license.

• DWI offenders who do not reside in North Carolina are still subject to NC state DWI Laws as follows:• Assessment and treatment are required,
but may be completed the driver’s home state • Documentation of completion must be
submitted to an authorized DWI facility in North Carolina to submit to DWI state office for review.• The DWI State Office submits
documentation to NC DMV for approval.
• After approval, the driver may contact the NC DMV for reinstatement of their driver’s license.
