"Burn Notice" Intelligence Surveillance Report by JP Merlano

SATELLITE IMAGERY - 1470 16 STREET, MIAMI BEACH, FL

Wednesday, July 3, 2013, 7:00 a.m., Florida Licensed Private Investigator JP Merlano arrived in the vicinity of 1470 16 Street, Apartment 401 in Miami Beach, FL, to commence surveillance efforts. Please note that the address captioned above is owned by celebrity actor Mr. Jeffrey Thomas Donovan also known as Mr. Michael Westen from the USA Network hit series Burned Notice that is filmed mostly in Dade County, FL. The investigator obtained Mr. Donovan’s residential address from the Miami-Dade Property Appraisals Office; a matter of public record.

“OPERATION FAIR-GAME” 1

Observations entry, Mr. Donovan’s condo is located on the fourth floor. The condo has multiple balconies and the primary balcony faces the bay looking onto Venetian Causeway. There is one condo per floor. The building is only a few stories high. There are two pedestrian entry ways leading to and from the building that are located on the first floor. One of the pedestrian entry faces the bay (west) and the second pedestrian door faces north. There is a small tenant garage that is located on the first floor that houses a bicycles, scooters and a few vehicles. The confines of the garage is in open view with limited obstructions. There is only one vehicular route of departure leading to and from the the building stemming from 16 Street that runs east and west. The street is open to the public and accessible to anyone. There appears to be no internal security on the premises with the exception of a few CCTV pointing at pedestrian paths. There are valet parking attendants on the premises. No roving security were observed. There is also a roof top pool and a gym that is located across the street; Capri North. Overall, the location is suitable for surveillance due to the layout of the area with plenty of public parking found everywhere.


Operations entry, the investigator secured a suitable surveillance position anticipating Mr. Donovan’s appearance.

At 7:49 a.m., the investigator observed a white work van bearing Florida license plate number BILY43 arrived to Mr. Donovan’s building. A male was operating the van. Shortly thereafter, an unidentified male carrying a back pack and wearing what appeared to be shorts and a t-shirt proceeded to enter the van. Due to the brevity of the passenger’s appearance the investigator was not able to determine whether this in fact was Mr. Donovan. Operations entry, the investigator initiated mobile surveillance to identify the the passenger who was seated on the front passenger seat. Investigative findings revealed that the unidentified male seated on the front passenger side was in fact Mr. Donovan. The investigator recognize Mr. Donovan having personally watched over 100 episodes of Burned Notice on USA Network and counting. The investigator discontinued mobile surveillance to preserve the integrity of the case and secured a suitable surveillance position along 395 anticipating the van to pass by the investigator’s surveillance position. Shortly thereafter, the van was observed as it darted pass the investigator’s surveillance position. The investigator resumed mobile surveillance.

At 7:54 a.m., the driver of the van was observed as he arrived to a marina that is located near NW 7 Street and 12 Avenue in Miami, FL, near the courthouse. The investigator observed TVM Productions crew on site unloading and transporting equipment onto the marina grounds. The investigator observed 2-3 white work vans transporting extras to and from a designated parking lot a few blocks away. Please note that Mr. Donovan did exit from the front passenger side of the van. Instead, Mr. Donovan’s driver remained in motion and was observed circling the perimeter of the marina. The investigator observed Mr. Donovan with chin looking down at six o’clock while his driver continued to drive in circles. The investigator suspects that Mr. Donovan was reading his script and transitioning to his character for the day. Please refer to video Clip Number 284 for support, duration of clip is 15 seconds

Operations entry, the investigator secured a suitable surveillance position maintaining a visual of the trailers outside the marina hoping that Mr. Donovan would surface. Due to all the traffic of people coming and going Mr. Donovan’s whereabouts are unknown at the present time. The investigator would canvass the area periodically hoping to spot Mr. Donovan.


At 8:25 a.m., the investigator observed an unidentified male believed to be Mr. Donovan dressed in beige BDU’s and white polo shirt walking towards the trailers. Please refer to video Clip Number 288 for support, duration of clip is 6 seconds.

At approximately 9:30 a.m., the investigator located Mr. Donovan. Operations entry, the investigator secured a discreet surveillance position from outside of the marina approximately 10 yards away from Mr. Donovan for approximately the next 11 hours. Operations entry, there was a metal perimeter fence that separated Mr. Donovan from the investigator. To preserve the integrity of the case, the investigator did not turn on his vehicle engine for hours and would periodically have to turn on the engine to run the air conditioning to stay ventilated and decrease his body temperature from increasing.The investigator drank plenty of water to stay hydrated.

Please note that the investigator documented Mr. Donovan when he was not in front of the camera with the exception of my own.

At 9:32 a.m., Mr. Donovan appeared in view. Mr. Donovan was wearing black dress pants and a white long sleeve dress shirt. Mr. Donovan was observed underneath a blue tarp while standing. Mr. Donovan was observed bending at the waistline full range motion using his upper extremities to grasp for something using his right arm and erected his back shortly thereafter at 90 degrees. Mr. Donovan was observed as he proceeded to walk inside the marina warehouse using the back door and walked away from the investigator’s field of view. At 9:48 a.m., Mr. Donovan was observed as he exited from the marina warehouse using the back door. Mr. Donovan was holding a stack of white letter size papers with his right hand. TVM crew exchanged words with Mr. Donovan and judging from Mr. Donovan’s glowing smile it appears as if TVM crew was complimenting him for his performance. Mr. Donovan continued to walk away from the investigator’s field of vision. Observations entry, it appears as if Mr. Donovan is right handed noting that he is grasping the papers with his right palm. Mr. Donovan walks with a slight noticeable limp at times. Please refer to video Clip Number 308 for support, duration of clip is 52 seconds.







At 10:38 a.m. - 10:41 a.m., Mr. Donovan was observed seated underneath the blue tarp. Mr. Donovan was observed leaning his upper body forward to utilize a white cell phone believed to be an Galaxy or I-Phone 5. Mr. Donovan wore a traditional yellow wedding band and a dark watch on his left hand. Observations entry, Mr. Donovan was observed laughing exactly the same as he laughs on Burned Notice. You know that big smile that ascends from bottom to top where you can see his teeth shine. Mr. Donovan continued to look in the direction of his cell phone, something else caught his attention, he was observed closing and opening his eyes repeatedly and then resumed looking at the cell phone. He then glanced in the same direction that he was looking at before and this time he did not close his eyes. He stared and then resumed using his cell phone again. The investigator suspects that Mr. Donovan was closing and opening his eyes at a faster than normal pace to lubricate his eyes (maybe he wears contacts) or to enhance his visual acuity if attempting to see something from a distance that it is


unclear to him or maybe he is signaling someone on set covertly. Please refer to video Clip Number 314, 315, 318, 319 for support, duration of clips is 96 seconds.






At 10:41 a.m., Mr. Donovan was observed as he stood up from the chair and began to walk away towards the back door leading inside the marina warehouse. While in motion Mr. Donovan was observed using his right hand to grasp an orange color soda believed to a be Crush or Sunkist. Mr. Donovan walked inside the marina warehouse away from the investigator’s field of vision. Please refer to video Clip Number 320 for support, duration of clip is 27 seconds.

At 11:08 a.m., Mr. Donovan exited from the marina warehouse using the back door. Mr. Donovan was observed retrieving his white cell phone that was left unattended underneath the blue tarp. Mr. Donovan was observed walking away from the investigator’s field of vision. Mr. Donovan’s script was observed on his right back pocket of his dress pants. At 12:03 p.m., Mr. Donovan was observed using his left hand to gesture at an unidentified male believed to be TVM crew. Judging from the smiles, the investigator believes that Mr. Donovan was sharing a joke. Mr. Donovan walked back inside the marina warehouse using the back door away from the investigator’s field of vision. At 12:09 p.m., Mr. Donovan was observed using his left hand to grasp what appeared to be a mini hotdog. Mr. Donovan was observed wiping his hands with his other hand prior to picking up the hot dog. Mr. Donovan was observed taking a bite with his mouth open as he walked away from the investigator’s field of vision. At 12:40 p.m., Mr. Donovan was observed as he used his right arm to put something down and darted inside the marina warehouse using the back door. Once inside, Mr. Donovan was observed placing his right hand inside his dress pant pocket. Mr. Donovan walked away from the investigator’s field of vision. At 1:37 p.m., Mr. Donovan was observed speaking to an unidentified male believed to be the producer. Mr. Donovan was observed as he peddled away riding a red beach cruiser bicycle. The bicycle looks like the one that of Pee-Herman. Investigative findings revealed that the brand of model of the bicycle is an Elektra. Mr. Donovan rode away from the investigator’s field of vision onto the marina grounds. Please refer to video Clip Number 347 for support, duration of clip is 13 seconds.





At 4:23 p.m., Mr. Donovan was observed as he walked out from the marina warehouse using the back door. Mr. Donovan was not wearing a shirt. Observations entry, Mr. Donovan does not have a six pack and his upper arms are tone but can use the exercise. His dress pants had debris transfer probably from some stunt. Mr. Donovan walked way from the investigator’s field of vision with an unidentified male believed to be the producer. At 4:47 p.m., the investigator obtained video of Burned Notice Big Cheese on the set. Please refer to video Clip Number 362 for support, duration of clip is 24 seconds.

At 5:09 p.m., Mr. Donovan was observed as he exited from the marina warehouse. Mr. Donovan was observed using his upper hands to gesture to an unidentified male believed to be from the TVM crew. Please note that Mr. Donovan was smiling while conversing with this person. Mr. Donovan appeared to be very professional and not condescending or degrading whatsoever when exchanging thoughts. Mr. Donovan walked away from the investigator’s field of vision. Please refer to video Clip Number 364 for support, duration of clip is 8 seconds.






At 5:09 p.m. - 5:10 p.m., Mr. Donovan was observed as he exited from the marina warehouse. Mr. Donovan was observed as he walked away from the investigator’s field of vision. Please refer to video Clip Number 365 for support, duration of clip is 25 seconds.

At 5:22 p.m., the investigator observed one of Mr. Donovan’s doubles wearing the same attire that Mr. Donovan is filming with today. Investigative findings, Mr. Donovan’s has more than one double on set. Observations entry, Mr. Donovan’s double also wear a yellow wedding and dark watch on his left arm just like Mr. Donovan. This particular double is the one that in my opinion looks most like Mr. Donovan. However, I did notice that Mr. Donovan appears to be have more muscle mass in the upper body and a few pounds heavier than this particular double. At 5:32 p.m. - 5:34 p.m., the investigator observed two of Mr. Donovan’s doubles on set rehearsing a fight using their upper and lower extremities. Please refer to video Clip Number 374, 375, 376, 377 for support, duration of clips is 107 seconds.






At 5:45 p.m. - 5:46 p.m., the investigator obtained video of the red Pee-Wee Herman look alike beach cruiser bicycle that Mr. Donovan uses while on set to get to Point A to Point B. Observation entry, the bicycle has a black kinda lunch box case attached to the frame. Mr. Donovan keeps his scripts inside the lunch box. At 5:49 p.m. - 5:50 p.m., Mr. Donovan was observed as he exited from the marina warehouse. Mr. Donovan was observed as he walked with both of his hands inside his dress pant pockets. The investigator noticed that Mr. Donovan’s facial expression were preparing to get into character probably for his next scene. Mr. Donovan was observed as he walked away from the investigator’s field of vision. Observations entry, Mr. Donovan maintained that stare for approximately a minute. At 5:52 p.m. - 5:57 p.m., Mr.Donovan was observed as he exited from the marina warehouse using the back door and proceeded to sit on a bench. Mr. Donovan was observed withdrawing his cell phone from the left side pant pocket using his left hand. Mr. Donovan appeared to be with eyes closed and not utilizing the cell phone. The investigator suspects that Mr. Donovan is preparing for a big scene and is giving it his best to get into character and experience the momentum or his is napping on the job. Mr. Donovan was doing this in solace even though there are numerous people around him. It’s as if there is a shield around his persona that separates him from the crew and extras whenever he is getting into character. No one interrupts him. Is as if he is the invisible man and everyone around him is accustomed to his persona. Mr. Donovan would not raise his chin until minutes later when he began to scan his surroundings. At 5:57 p.m., Mr.Donovan was observed as he stood up and placed his left hand inside his left pocket of his pants. Mr. Donovan proceeded to walk inside a mobile room away from the investigator’s field of vision. The investigator suspects this is where they are putting on make-up and polishing Mr. Donovan off prior to shooting a scene. The investigator observed the unidentified male believed to be the producer or Big Cheese waiting for Mr. Donovan to enter the tent by holding the tarp up for him. Is as if the producer knows Mr. Donovan so well that no words are necessary to explain what is going on in Mr. Donovan’s mind or what is needed. At 5:59 p.m., Mr.Donovan was observed as he dashed out from the make-up room and proceeded to walk inside marina warehouse using the back door. Mr. Donovan was observed using both of his upper extremities to grasp a TVM crew member shoulders to position her out of his way; fits his character. The investigator believes that this is a sign a trust noting that Mr. Donovan has worked with TVM crew for so many years. Mr. Donovan was observed as he entered the marina warehouse using the back door and walked away from the investigator’s field of vision. At 6:11 p.m. - 6:12 p.m., Mr. Donovan was observed as he exited from the marina warehouse. Mr. Donovan was observed as he walked inside the mobile room while the Big Cheese was holding the tarp for him to enter. Mr. Donovan was smiling. Judging from Mr. Donovan’s smile the investigator suspects that the shoot was a success. Please refer to video Clip Number 403 for support, duration of clip is 8 seconds.


At 6:14 p.m., Mr.Donovan was observed as he dashed out from the marina warehouse. Mr. Donovan was observed as he walked inside mobile room. The Big Cheese was holding the tarp for Mr. Donovan to enter. Please refer to video Clip Number 405 for support, duration of clip is 6 seconds.

At 6:14 p.m. - 6:15 p.m., Mr.Donovan was observed as he walked out from the mobile room and proceeded to walk inside marina warehouse using the back door. Mr. Donovan was observed as he walked away from the investigator’s field of vision. The Big Cheese was observed escorting Mr. Donovan inside the warehouse. At 6:18 p.m., Mr. Donovan was observed as he exited from the marina warehouse. Mr. Donovan was observed with his left hand inside his front pocket of his pants. Mr.


Donovan was observed with a deep penetrating stare. Probably character-residue from his last scene or transitioning into character for his next scene. Mr. Donovan was observed as he pulled his white cell phone from his front pocket of his pant using the left hand. At 6:20 p.m. - 6:21 p.m., Mr. Donovan was observed seated on a chair underneath the blue tarp. Mr. Donovan was observed utilizing his cell phone while cervical range of motion was looking at six o’clock. Please refer to video Clip Number 411, 412 for support, duration of clips is 24 seconds.




At 6:21 p.m., Mr.Donovan was observed as he stood up and walked inside the marina warehouse using the back door. Mr. Donovan was observed as he walked away from the investigator’s field of vision. Please refer to video Clip Number 413 for support, duration of clip is 14 seconds.


At 6:46 p.m. - 6:54 p.m., Mr. Donovan was observed seated on a chair underneath the blue tarp rehearing and going over his lines; getting into his character for that particular scene. Mr. Donovan changed his facial expressions as he continued to rehearse his lines. Mr. Donovan seemed very collected and smooth talker as he continued to rehearse his scene. The investigator noticed unexpected smile on Mr. Donovan’s face occasionally while rehearsing the material. Mr. Donovan was observed as he continued to what appears to be having a conversation with himself in a calm and collected manner while zipping from some kind of can, possibly an energy drink. Mr. Donovan smoothly drinks calculated zips from the can as he continues to rehearse his lines as if he were speaking to someone else. Mr. Donovan was observed as he continued to smile in character periodically. Observations entry, this is one of my favorite video clips because there is much more going on behind the scenes than the final work product. Mr. Donovan’s character on Burned Notice is very convincible and this is why; practice

Mr. Donovan was observed as he stood up from the chair and proceeded to walk inside the marina warehouse using the back door. Observations entry, Mr. Donovan was observed as he gave a warm smile to an unidentified man as he was walking inside the warehouse. At 7:04 p.m. - 7:05 p.m., Mr. Donovan was observed as he exited from the marina warehouse. Mr. Donovan was observed seated on a chair underneath the blue tarp. Mr. Donovan was observed speaking to someone. Mr. Donovan was observed to be friendly and smiling. Please refer to video Clip Number 431 for support, duration of clip is 26 seconds.


At 7:05 p.m., Mr.Donovan was observed as he stood up and walked inside the marina warehouse using the back door. Mr. Donovan was observed as he walked away from the investigator’s field of vision. Please refer to video Clip Number 432 for support, duration of clip is 26 seconds.

At 7:22 p.m., Mr. Donovan was observed as he exited from the marina warehouse. Mr. Donovan was observed without a shirt on. Mr. Donovan was utilizing a multi-color umbrella due to rainy weather conditions. Mr. Donovan was observed with a light reddish markings behind on his right triceps. Mr. Donovan was observed as he sat down underneath the blue tarp like tenant away from the investigator’s field of vision. At 7:31 p.m. - 7:32 p.m., Mr. Donovan was observed as he used his left hand to grasp onto what appeared to be a script and transitioned the script immediately to his right hand and proceeded to walk inside the marina warehouse using the back door away from the investigator’s field of vision. Mr. Donovan wore a white tank top and what appeared to be black Converse shoes or Keds. Please refer to video Clip Number 440 for support, duration of clip is 35 seconds.


At 7:52 p.m. - 7:53 p.m., Mr. Donovan was observed as he exited from the marina warehouse. Mr. Donovan was observed wearing a white tank top. Mr. Donovan was observed standing while speaking to a crowd of people. Mr. Donovan was observed using left hand to scratch his left nostril. Mr. Donovan was observed using his left hand to gesture, point and communicate with the crowd. Mr. Donovan was also observed using his right hand to scratch his forehead on the upper right hand side. At 7:53 p.m. - 7:54 p.m., Mr. Donovan was observed standing underneath a tarp to stay out of the rain while speaking with a female wearing a loud pink top. Mr. Donovan was observed wrapping his left arm around the red markings on his right triceps. Please refer to video Clip Number 442 for support, duration of clip is 27 seconds.





At 7:54 p.m., Mr. Donovan was observed as he hopped on his Elektra bicycle and began to ride away in the rain while wearing a white tank top. The investigator maintained his surveillance position and waited for approximately 30-45 minutes anticipating for Mr. Donovan’s return. However, surveillance efforts for the day were consequently discontinued because the crew began to pack things up. At approximately 9:00 p.m., the investigator discontinued surveillance efforts and will resume tomorrow.


CONTINUATION SURVEILLANCE EFFORTS

Friday, July 5, 2013, 8:00 a.m., Florida Licensed Private Investigator JP Merlano arrived in the vicinity of 1470 16 Street, Apartment 401 in Miami Beach, FL, to resume surveillance efforts. Operations entry, the investigator secured a suitable surveillance position anticipating Mr. Donovan’s appearance. Please note that the TVM crew is not filming today at the marina.

At 1:19 p.m. - 1:23 p.m., Mr. Donovan’s wife, Mrs. Donovan (maiden name, Michele Woods) was observed jogging passed the investigator’s surveillance position. Mrs. Donovan was observed jogging on Bay Road north bound. Mrs. Donovan was wearing black tights pass her knees, a peach tank top and purple Nike jogging shoes with fluorescent orange laces and white cut off cotton socks. Mrs. Donovan was wearing white ear phones believed to be from her I-Phone 5. Mrs. Donovan wore a black top underneath her peach tank top. She also wore black sunglasses, possibly Ray Bans. She was using some kind of band to secure her hair in the back in a pony tail style. Observations entry, Mrs. Donovan was observed as she continued to jog west bound on Venetian Causeway at a fast pace. She was sprinting and was able to maintain her tempo. Mrs. Donovan was observed elevating her left arm to make contact with a tree branch that caught her attention and she tagged it by jumping up in the air and elevating her left foot and right foot to boost herself approximately two feed from above the ground. What is she listening to....? I want to listen to that song too! Please note that the investigator did not follow Mrs. Donovan pass the Venetian Causeway. Operations entry, the investigator returned to Mr. Donovan’s condo and secured a suitable surveillance position. Mrs. Donovan was observed as she returned home within the hour. At 3:44 p.m., the United States Postal Service arrived to Mr. Donovan’s community. Please refer to video Clip Number 472 for support, duration of clip is 16 seconds


At 5:25 p.m. - 5:28 p.m., Mr. Donovan was observed as he stepped outside to his balcony. Mr. Donovan was wearing a purple t-shirt that appeared to be made from cotton with a white circular marking on the back of the shirt. Mrs. Donovan was observed as she stepped out to the balcony as well. Mr. Donovan was observed stepping in an out into the balcony with what appeared to be a brown baby crib comforter. Mr. Donovan was observed to what appeared laying the comforter on the balcony floor and also withdrawing a baby car seat from the confines of the residence and depositing the car seat on the balcony. Mr. Donovan was observed bending his back full range motion repeatedly and erecting his back at 90 degrees. Mr. Donovan was observed as he secured the sliding door and walked away from the investigator’s field of vision. At 9:00 p.m., surveillance efforts were discontinued for the day due to lack of further observable activity and will resume tomorrow morning.
