subs tan t i a l t r ade , p r inc ipa l ly be tween the Uni t ed S ta te s and
the fore ign s ta te of wh ich he is a na t io na l ; or ( i i ) so le ly to develop
and di rec t the oper a t ions of an enterpr ise in which he has inves ted ,
or of an enterprise in which he is actively in the process of invest
ing, a subs tant ia l amount of
c a p i t a l ;
(F) an a l ien having a res idence in a fore ign country which he
has no in tent ion of abandoning, who is a bona f ide s tudent qua l i
fied to pursue a full course of s tudy and who seeks to enter the

and such other offices as the Secretary of State may deem to be appro

sons pr ior to the da te of enac tment of th is Act sha l l be cont inued,
and, except as o therwise provided in sec t ion 202 (e) , the minimum
quota for any quota a rea sha l l be one hundred.

be made by the Secre tary of Sta te , the Secre tary of Commerce , and the

(d) Th e provis ion of an im m igra t ion quota for a quota a rea sha l l

of te rr i tory f rom one country to another , or recogni t ion of a govern
ment not recognized by the Uni ted Sta tes .

quota immigrants in the order in which a pe t i t ion on behalf of each
such immigrant i s f i led wi th the At torney Genera l as provided in
section 204; and shall be issued in the firs t calendar month after receipt
of not ice of approval of such pe t i t ion in which a quota number i s
ava i lable
for
an immigrant chargeable to such quota a rea .
(c ) Quota immigrant v isas i s sued to a l iens in the c lasses des ignated
i n p a r a g r a p h s ( 2 ) , ( 3 ) , an d (4) of subsection (a ) s hal l , in th e case of

officer shall not grant such status unti l he has been authorized to do
so as provided in this section.
(b) Any person, ins t i tu t ion, f i rm, organiza t ion, or governmenta l
agency des i r ing to have an a l ien c lass i f ied as an immigrant under sec
t io n 101 (a) (27) ( F ) (i) or section 203 (a ) (1) (A ) shall f ile a
pe t i t ion wi th the At torney Genera l for such c lass i f ica t ion of the a l ien .
The pe t i t ion sha l l be in such form as the At torney Genera l may by
regula t ions prescr ibe and sha l l s ta te the bas is for the need of the
services of such a l ien and conta in such addi t iona l informat ion and be
sup po rted by such doc um enta ry evidence as ma y be require d by the
At to rn ey Gene ra l . Th e pe t i t ion sha l l be ma de unde r oa th ad min
