    term "consular officer" means an officer designated by the Governor of

    the Canal Zone , or the governors of the out ly ing possess ions , for the

    (10) Th e t e rm "c r ew ma n" mean s a pe rson s e rv ing in any capac i ty

    on board a vesse l or a i rc raf t .

    (11 ) Th e t e rm "d ip lom a t i c v i s a " mean s a non im mig ran t v i s a bea r

    ing tha t t i t le and issued to a nonimmigrant in accordance wi th such

    regu la t ion s as the Secr e tary of Sta t e ma y prescr ibe .

    (i i) upon a basis of reciprocity, other officials and employees

    who have been accredi ted by a fore ign government recognized de

    S ta te , and the members o f the i r immedia te fami l i e s ; and

    (i i i ) upon a bas is of rec iproc i ty , a t tendants , se rvants , personal

    employees, and members of their immediate families , of the offi

    c i al s and employees who have a non im mig ran t s t a tus und e r ( i )

    and ( i i ) above;

    (B ) an a l ien (o ther than one com ing for the purp ose of s tudy

    or of performing ski l led or unski l led labor or as a representa t ive

    of fore ign press , rad io , f ilm, or o ther fore ign in form at ion me dia

    com ing to engag e in such voca t ion) ha vin g a res idence in a fore ign

    country which he has no in tent ion of abandoning and who is v is i t

    is a national, and the spouse and children of any such alien if

    accompanying or fo l lowing to jo in h im: ( i ) so le ly to carry on

    subs tan t i a l t r ade , p r inc ipa l ly be tween the Uni t ed S ta te s and

    the fore ign s ta te of wh ich he is a na t io na l ; or ( i i ) so le ly to develop

    and di rec t the oper a t ions of an enterpr ise in which he has inves ted ,

    or of an enterprise in which he is actively in the process of invest

    ing, a subs tant ia l amount of

    c a p i t a l ;

    (F) an a l ien having a res idence in a fore ign country which he

    has no in tent ion of abandoning, who is a bona f ide s tudent qua l i

    fied to pursue a full course of s tudy and who seeks to enter the

    Uni ted Sta tes temporar i ly and sole ly for the purpose of pursuing

    such a course of s tudy a t an es tabl ished ins t i tu t ion of learning or

    other recognized place of s tudy in the Uni ted Sta tes , par t icular ly

    des igna ted by h im and approved by the At to rney Gene ra l after

    shal l app ear necessary and pro per . H e is autho r ized to confer or

    impose upon any employee of the Uni ted Sta tes , wi th the consent of

    the head of the Department or o ther independent es tabl ishment under

    whose jur isdic t ion the employee is serving, any of the powers , pr iv

    i leges , or dut ies conferred or imposed by th is Act or regu la t ion s is sued

    the reu nd er upon officers or employ ees of the Service. H e m ay, with

    the concurrence of the Secretary of State, establish offices of the Serv

    ice in foreign countr ies ; and, a f te r consul ta t ion wi th the Secre tary of

    sent of the Senate, and shall receive compensation at the rate of $17,500

    and such other offices as the Secretary of State may deem to be appro

    of te rr i tory f rom one country to another , or recogni t ion of a govern

    ment not recognized by the Uni ted Sta tes .

    the issuance of immigrant visas to the classes specified in para

    subsection (a) shall , in the case of each quota area, be issued to eligible

    quota immigrants in the order in which a pe t i t ion on behalf of each

    such immigrant i s f i led wi th the At torney Genera l as provided in

    section 204; and shall be issued in the firs t calendar month after receipt

    of not ice of approval of such pe t i t ion in which a quota number i s

    ava i lable

    for

    an immigrant chargeable to such quota a rea .

    (c ) Quota immigrant v isas i s sued to a l iens in the c lasses des ignated

    i n p a r a g r a p h s ( 2 ) , ( 3 ) , an d (4) of subsection (a ) s hal l , in th e case of

    officer shall not grant such status unti l he has been authorized to do

    so as provided in this section.

    (b) Any person, ins t i tu t ion, f i rm, organiza t ion, or governmenta l

    agency des i r ing to have an a l ien c lass i f ied as an immigrant under sec

    t io n 101 (a) (27) ( F ) (i) or section 203 (a ) (1) (A ) shall f ile a

    pe t i t ion wi th the At torney Genera l for such c lass i f ica t ion of the a l ien .
