WHEREAS, the Los Angeles Department of Water and Power (LADWP) has been a member of the nonprofit Water Research Foundation (WaterRF) since 1986 when it joined this organization as a charter member; and
WHEREAS, the WaterRF fulfills a vital need for the nation's water utilities and water agencies by conducting research in areas of particular interest to water systems, providing a forum for the mutual exchange of ideas, and supplying information on problems that confront the water industry and the public; and
WHEREAS, since joining the WaterRF, LADWP has benefited from participation in 106 research projects and committees with a total project value of over $42 million.
NOW, THEREFORE, BE IT RESOLVED that LADWP continue its membership in the WaterRF for the calendar year 2012, covered by this Resolution; and
BE IT FURTHER RESOLVED that LADWP also provide funding for LADWP's urgent facilitated scientific research services on an as-needed basis conducted by the WaterRF for the benefit of LADWP for the calendar year 2012, covered by this Resolution; and
BE IT FURTHER RESOLVED that the Chief Accounting Employee of LAO:WP, upon proper certification, is authorized and directed to draw a demand on the Water Revenue Fund for the WaterRF membership in the amount not to exceed $270,000 for 2012; and
BE IT FURTHER RESOLVED that the Chief Accounting Employee of LADWP, upon proper certification, is also authorized and directed to draw a demand on the Water Revenue Fund for LADWP's urgent facilitated scientific research services on an as-needed basis from the WaterRF in the amount not to exceed $100,000 for 2012; and
BE IT FURTHER RESOLVED that the WaterRF annual membership and LADWP's urgent facilitated scientific research services on an as-needed basis shall be continued only upon the approval by the Los Angeles City Council, pursuant to the provisions of Charter Section 373 and Division 1 0, Chapter 1, Article 1, Section 10.5 of the Los Angeles City Administrative Code.

PURPOSE
The Water Research Foundation (WaterRF) is a nonprofit, membership-based scientific research organization that sponsors independent research necessary to enable water utilities to provide safe and affordable drinking water to consumers. The WaterRF was formed to provide a collective pool of funds, resources, and talents for the water industry to resolve common problems through scientific research achievement. Supporting the WaterRF is in the best interest of lADWP's water service customers because it will enable LADWP to better enhance and protect the City's water supply and water quality. Access to the highly technical and credible scientific information available through the WaterRF membership will provide direct and tangible benefits to LADWP. In addition, the membership will qualify LADWP to request urgent facilitated scientific research services from the WaterRF on an as-needed basis. Upon approval of the resolution, LADWP will be authorized to maintain its membership and research services with the WaterRF in the amount not to exceed $370,000 for calendar year 2012.

LADWP has been a member of this organization since 1986. Since that time, LADWP has benefited from participation in 106 research projects and committees with a total research value of over $42 million. See Attachment 2 for details.
The membership permits LADWP to access a variety of urgent facilitated scientific research services from the WaterRF. Such services can be used for issues that have direct impact and are time-sensitive for LADWP. If these issues are relevant to other Southern California water agencies, collaboration and cost sharing is always pursued. The authorization for such research services would be with the approval of the Senior Assistant General Manager-Water System.
The total cost for this membership and the urgent facilitated scientific research services on an as-needed basis is not to exceed $370,000. The membership contribution by LADWP and other water utilities provides funding to perform necessary research for compliance with proposed regulations under the Safe Drinking Water Act. The research subjects are selected based on the collective priorities of WaterRF subscribers and the drinking water community.
LADWP benefits from subscribing to the WaterRF by receiving its research reports, participating in project advisory committees, attending technology conferences and workshops, taking part in research projects, and accessing its network of r'esearchers and drinking water experts. LADWP will also be able to resolve its specific drinking water problems by funding locally important research subjects through the WaterRF's services.

The Department of Water and Power (DWP; Department) requests approval of a proposed resolution, authorizing DWP membership in the Water Research Foundation (WaterRF; Foundation) to continue their participation in the research group by an additional year from:. January 1, 2012 to December 31, 2012. The WaterRF conducts research related to drinking water quality and treatment and utility infrastructure to help water providers and public health agencies provide safe and affordable drinking water. The subscription fee for DWP is $270,000 plus $100,000 for studies on an as-needed basis for a total of $370,000. The amount for the as-needed studies will not be paid to WaterRF unless the Senior Assistant General Manager of the Water System requests additional studies. Pursuant to Charter Section 373 and Los Angeles City Administrative Code Section 10.5, City Council approval is required because the cumulative term exceeds three years. The City Attorney has approved the proposed resolution as to form and legality.
Background
DWP has been a member of this organization since 1986 and has benefited from participation in 106 research projects. DWP states the total value of the research is approximately $42 million. The WaterRF, originally named the American Water Works Association Research Foundation (AwwaRF), was launched in 1966 with seed money from the American Water Works Association (AWWA) and federal grants. In 1983, the Foundation brought together the three major North American water supply organizations: AWWA, the National Association of Water Companies, and the Association of Metropolitan Water Agencies to support the Foundation's mission. In 2008, the Foundation's Board of Trustees voted to change AwwaRF's name to the Water Research Foundation (WaterRF).
In 1983 the Foundation instituted a subscription-based research funding program. The membership fee per member is based on a formula that considers each participant member/utility's overall water deliveries, water purchases, and outside sales to other utilities. DWP's annual subscription fee has ranged from a low of $75,000 in 1986 to a high of $330,000 in 2007. For 2012, DWP's subscription

fee is not to exceed $270,000, while the average benefit in research DWP has received averages an annual value of $1.6 million.
By 1987, WaterRF had recruited more than 400 subscribers, including most of the large public and privately owned water utilities in North America, and its annual subscription income had reached $3.5 million. Today, approximately 950 utilities, manufacturers, and consultants subscribe to WaterRF's research, most of which are based in the U.S., although numerous are international, such as England's Anglican Water Services, Ltd and Canada's District of West Vancouver.
Research Focus
WaterRF typically sponsors between 25 and 30 research projects a year at an average funding level of $250,000-$300,000 per project. These projects are developed through extensive input from volunteer scientists, academics and regulators in the water field, who review them for timeliness and relevance to public needs. Once research is completed, the findings are then shared with the water community.
Since 1966, the Foundation has funded more than $500 million worth of research and more than 1,100 studies. It promotes global collaboration and prudent resource management by pooling and leveraging funding for water research. DWP will continue to gain from pooling funds for research;
·.··. thereby reducing DWP's financial obligations rather than funding separate DWP research projects ····· ·• from the Water Revenue Fund. DWP benefits from subscribing to the WaterRF by receiving its
research reports, participating in project advisory committees, attending technology workshops, taking part in research projects, and accessing the network of researchers and drinking water experts. DWP will also be able to access direct WaterRF services to provide meaningful solutions for managing current and future drinking water issues.
The Foundation provides a broad array of research and possible solutions to the water supply community. WaterRF's research focuses on four main areas:

In 2007, the Foundation began a Strategic Research Initiatives Program that focused on a coordinated, long-term approach to critical drinking water issues, including:
"' Climate Change and Water -Begun in 2008, this initiative helps utilities understand their vulnerabilities to current climate change, design adaptation strategies, communicate the risks associated with climate change, and measure and minimize their carbon footprints.
~~ Pharmaceuticals and Personal Care Products (PPCPs)- Begun in 2007, this initiative seeks to better understand the occurrence, fate, human health significance, and control of PPCPs in drinking water. In August 2007, the Foundation published a report on the effectiveness of current technology In removing pharmaceuticals from drinking water.

The WaterRF does not lobby or advocate policy, although it has been invited to help federal and state governments develop research needed to initiate regulation. The WaterRF has provided testimony at U.S. Congressional hearings on topics such as the toxicological relevance of PPCPs in drinking water, and how climate change will affect the quality and quantity of U.S. drinking water.
In 2010, WaterRF and the Water Environment Research Foundation were awarded a four-year Federal grant to administer $3.25 million in research that evaluates new technologies that copes with aging and failing water and wastewater systems under the Aging Water Infrastructure Initiative.
CONTRACTUAL COMPLIANCE
The City Attorney has approved the proposed resolution as to form and legality. In accordance with Charter Section 1022, it has been determined the work specified in the Agreement can be performed more economically and feasibly by Independent Contractors than by City employees. The WaterRF is the only non-profit organization that provides these research services.
RECOMMENDATION
That the Mayor:
1. Approve a proposed Resolution authorizing a subscription fee of $370,000 for the Water Research Foundation, consisting of $270,000 for continued membership and $100,000 for facilitated as-needed research services, for the calendar year from January 1, 2012 to December31,2012;and
2. Return the proposed resolution to the Department for further processing, including Council consideration.
FISCAL IMPACT STATEMENT
Approval of the proposed membership will have a $370,000 fiscal impact on the total membership expenditures budgeted for the Water Revenue Fund. This project complies with the Department of Water and Power adopted Financial Policies.
TIME LIMIT FOR COUNCIL ACTION
The City Attorney has opined that although this is a membership, this constitutes a contract for services with a cumulative term over three years. Pursuant to Charter Section 373, "long Term Contracts Approved by Council," and the los Angeles Administrative Code Section 1 0.5, "Limitation and Power to Make Contracts," unless the Council takes action disapproving a contract that is longer than three years within 60 days after submission to Council, the contract shall be deemed approved.
