• The National Heavy Vehicle Regulator (NHVR) is Australia’s national independent regulator for all vehicles over 4.5 tonnes gross vehicle mass.

• We are an independent, statutory body corporate – this means we are not a government-owned corporation nor a government agency, and there are no shareholders.

• We are based in Brisbane and have a national focus.

• Our CEO reports to a Board and the Board is accountable to Responsible Ministers under the Heavy Vehicle National Law (HVNL).

• We are evolving into a one-stop-shop for heavy vehicle road transport business with government.

• When the Heavy Vehicle National Law (HVNL) and Regulations commence later in 2013, the NHVR will be looking after one rule book for heavy vehicles over 4.5 tonnes gross vehicle mass.

• For the first time, heavy vehicle drivers, operators and others in the supply chain where the law has commenced, will be working to the same rules, regardless of where they operate.

We aim to:

• administer one set of laws for heavy vehicles under the HVNL

• minimise compliance burden on the heavy vehicle transport industry

• cut costs, red tape and confusion

• reduce duplication and inconsistencies across states

• boost innovation

• unlock productivity gains of up to $12.4 billion over the next 20 years.

One point of contact for access permits

• Local governments have a new statutory role in approving your access to their road network.

• If you are not satisfied with the outcome of your application, you can ask for an internal review.

• State road transport agencies will still accept and process permit applications under their current law until the new national law commences.

• Use the NHVR Journey Planner to help you find approved access routes on the road network.

• The NHVR Journey Planner will be launched when the national law commences.

• It is initially for Higher Mass Limits, PBS, B-Double, Road Trains and a selection of commodity routes.

• The Journey Planner will work like Google Maps. You enter your origin, waypoints, and destination and can easily zoom in and out of the map.

• The NHVR Journey Planner will help you identify the need to submit an access application.

• Journeys can be saved and retrieved and used as the basis for indicating route requirements for a permit application to the NHVR.

• Although the initial data is limited to key national routes, there is significant potential for additional information to be included such as bridge restrictions, height restrictions and details from many local productivity initiatives.

Heavy vehicle access customers

• When the HVNL commences, submit your heavy vehicle access application online via our website, by fax, or by mail.

• When you apply for the first time, we will create your unique Regulator Customer Number (RCN) and personal identification number (PIN) so you can do business with us quickly and easily.

• Pay your application fee up-front by cheque, money order, or credit card.

One point of contact for NHVAS

• We will continue to be the single, national administrator for the National Heavy Vehicle Accreditation Scheme (NHVAS) including all enquiries, applications and renewals.

• There are no changes to the entry requirements for NHVAS accreditation.

• Heavy vehicle operators can apply to the NHVR for accreditation under the following modules: Mass Management; Maintenance Management; Basic Fatigue Management (BFM); Advanced Fatigue Management.

• Any current NHVAS accreditation will be preserved for the life of that accreditation.

• The Performance-Based Standards (PBS) Scheme offers the heavy vehicle industry the potential to achieve higher productivity and safety through innovative and optimised vehicle design.

• PBS vehicles are tested against stringent safety standards and infrastructure standards to ensure they fit the existing road network and are safe.

• The PBS Scheme has been administered by the NHVR since 21 January 2013.

• We will continue to approve PBS Scheme design and vehicle applications (including PBS-approved vehicle access application) with advice from the PBS Review Panel.

• Nationally consistent penalties will promote consistent enforcement for drivers, operators and others in the supply chain.

• For information about the penalties that apply under the HVNL (infringeable offences, court imposed penalties and demerit points), download a summary of penalties from our website.

One set of national fees

• The NHVR will operate under a single fee structure for access permits, NHVAS accreditation and the national driver’s work diary.

• We will charge one set of fees so that service costs are predictable and consistent across the country.

• The schedule of fees can be found on our website.

One set of national notices

• State and territory road and transport authorities currently issue local productivity initiatives (LPIs).

• LPIs are local regulations, instruments, or operational practices that depart from national laws to allow for better productivity, efficiency or sustainability.

• When the new national law commences, the NHVR will be responsible for issuing all new notices and reviewing LPIs.

• All existing notices will be preserved and transitioned under the NHVR or replaced by a national notice.

• We will review LPIs annually with jurisdictions to achieve harmonisation for industry where possible.

National approach to fatigue management

• Driver fatigue is a significant safety hazard for the road transport industry.

• Heavy vehicle operators can apply for accreditation to the NHVAS under Basic Fatigue Management (BFM) or Advanced Fatigue Management (AFM) modules.

• These optional accreditations give operators more flexibility on when a driver can work and rest, as long as they have a compliant fatigue management system that properly manages the risks of driver fatigue.

National approach to fatigue management

• Advanced Fatigue Management (AFM) offers increased flexibility to manage heavy vehicle driver fatigue.

• The NHVR has developed a new approach under AFM called the Risk Classification System (RCS).

• RCS is based on fatigue science and research and helps to assess the levels of fatigue risk associated with combinations of work, rest and sleep.

• RCS includes a risk matrix tool that will be used by the NHVR when assessing an AFM application.

• Apply to the NHVR and align your business practices with nationally consistent fatigue management laws.

Updated and improved national driver work diary

• The updated national driver work diary is easier to fill out, and includes more advice on the fatigue laws and examples to guide you.

• When the new national law and regulations commence, purchase the updated national driver work diary for $20 nation-wide at the same places you currently buy your work diary.

• You can use your existing work diary for up to six months after the national law and regulations commence.

• Apply to the NHVR for a work diary exemption (permit).

100km radius change for QLD

• Currently in Queensland, drivers use a national driver work diary when operating outside of a 200km radius from the home base.

• When the new national law commences, drivers operating to standard hours must use the updated national driver work diary when operating outside of a 100km radius from the home base.

• This will bring Queensland into line with other states operating the 100km radius.

National vehicle standards and modifications

• When the new law commences, submit applications for heavy vehicle standards modifications and exemption permits directly through our website.

• Applications to modify heavy vehicles outside the National Code of Practice for the Modification of Heavy Vehicles must apply to the NHVR.

• All other modification approvals within the national code will go through an approved vehicle examiner.

• Existing approved vehicle examiner schemes and services will continue to be managed by each road transport authority.

National vehicle standards and modifications

• Jurisdictions and approved vehicle examiners will continue to provide services to the NHVR for heavy vehicle inspections, issuing certificates of modification for heavy vehicles that have been modified, and affixing a plate or label to all modified heavy vehicles.

• By applying through the NHVR, you will take advantage of mutual interstate recognition of inspections and defect clearances and reduce vehicle downtime.

Vehicle standards customers

• When the HVNL commences, submit your modification application or vehicle standards permit application in writing by email, fax, or mail.

• Although there is no fee to apply for NHVR vehicle standards services, there are some transactions in the modification and permit process where you may be required to pay a fee set by individual states and territories.

What’s not changing?

• For heavy vehicle registration, inspections, driver licensing and matters related to carriage of dangerous goods, deal with the relevant state or territory government department.

• State and territory police, and authorised officers will continue to enforce heavy vehicle offences under new national law.

• Legal and court processes will largely remain as they are.
