governmental, Non-profit and non-partisan organization working in Afghanistan since 1992 in the fields of

development cooperation, humanitarian and emergency aid, rehabilitation and reconstruction.

Welthungerhilfe/German Agro Action called hereinafter “the buyer“, would like to invite suitably qualified and

capable suppliers to provide the following materials.

1. General Conditions / عمومی شرائیط

All prices in your quotation must be indicated in Afghani (AFN) only. Quotations stated in other currencies

will be excluded.

With this tender Welthungerhilfe in Afghanistan requests commercial offers for Solar Home

Systems consisting of Solar Panel, Charge Controller, Inverter, Accumulator and Lightbulbs (= 1

Set).

For the purpose of this tender, the tentative amount is defined as 380 Sets. The exact amount of Sets

to be purchased will be defined once detailed prices are available – but it will be in the range of 340-

400 sets.

The following technical specification applies. Pictures are just for illustrative purposes. Your

materials may look differently. Important is that technical specification is met.

For all items, pleas add datasheets of your offered products which include pictures and technical

specifications. Without these additional documents, your offer cannot be considered.

Quotations must specify all details according to the tender text. Samples, pictures and/or technical leaflets,

must be submitted as stated in the tender documents. Quotations must reach Welthungerhilfe no later than 15-

01-2017 at 10:00 AM. local Afghanistan time to the address as mentioned in Point 7.

Incomplete offers and offers that arrive later than the deadline will be automatically excluded.

All tenders will be opened by the Welthungerhilfe tender committee and all bidders will be notified of the

results.

DDP (Delivery Duty Paid) to distribution point as designated by Buyer. The goods will be accepted after

complete check and approval by our technical staff and CDC key members here in Jalalabad at the address

provided below under point 7, Ordering Party.

Loading, Transport, Insurance, any Duty/Custom Fees and Unloading at destination point are by supplier.

Delivery must be done after awarding of contract and must be announced at least 24 hour in advance. Deliveries

are only attended from Sunday to Thursday between 8 AM to 4 PM.

4. Delivery schedule and details / د لیږدولو مهال ویش او تفصیل

In case of exceeding the delivery time more than 7 days, Welthungerhilfe has the right to cancel the contract

without any obligation of compensation towards the supplier.

Supplier must take great care of right quality, quantity during delivery, in case the wrong quality or quantity the

supplier will be liable for the cost of returning. The supplier must be free from objectionable matter and any

substances that would represent a hazard to health.

6. Inspection / پلټنه

Consignment will be inspected for quality and quantity by Welthungerhilfe at the final destination. Any

additional inspection shall be on account of the Seller. Goods not meeting the agreed quality and quantity will be

rejected. In case goods are rejected, the Seller will contractually be obliged to pay already incurred.

No advance payment! Cash against documents (CAD). Payment will be made by bank transfer latest within 15

days after the shipments/service have been delivered or done successfully to the final destination and commercial

invoice (or any other documents requested by Welthungerhilfe) has been presented.

11. Tax / مالیه

According to the Afghanistan new income tax Law, WHH- AFG-1172 is obliged to deduct 2% WHT if the total

price of contract is =500,000/=AFN or more during the year and the supplier holds valid business license and TN

number obtained from Government of Afghanistan. If the total amount of contract is =500,000/=AFN or more

during the year and supplier doesn’t has valid business licence in that case 7%WHT of the total amount will be

deducted and transfer to the Government of Afghanistan.

12. Penalties / جریمه

Delivery schedule will be negotiated and fixed in contract. In the event of delay in delivery caused other than by

force majeure Welthungerhilfe is entitled to impose a contractual penalty amounting up to a maximum of 2/1000

of the agreed purchase price for every working day (including packing and freight costs). The contractual penalty

may be invoked by Welthungerhilfe up to the time at which the purchase price is paid, even if this right was not

reserved upon acceptance of the goods. Other claims for damages shall not be prejudiced hereby. However, the

contractual penalty shall be deducted from such claims for damages. In case the quality is not in line with

specifications initially agreed by both sides, the Seller has to inform Welthungerhilfe as soon as possible. Goods

not meeting agreed quality can be rejected by Welthungerhilfe, but if Welthungerhilfe accept these goods a

deduction from the contract sum and a penalty will be negotiated.

In case of exceeding the delivery time more than 10 days, Welthungerhilfe has the right to cancel the contract

without any obligation of compensation towards the supplier.

13. Force Majeure / طبیعې پیښی

Force majeure is defined as natural disaster, earthquake, landslide, flood, war, armed conflict, and pandemic. In

the event of force majeure, the supplier shall inform Welthungerhilfe within 24 hours. Welthungerhilfe and the

supplier shall amicably decide further action after force majeure. Force majeure shall have an official declaration

by the government.

15. Selection Criteria / غوراوي معیار

When analysing the offers, Welthungerhilfe will take into account the following criteria:

Priority 40% for price, based on a per line cost basis.

Prioirty 40% for quality (substantiated through samples)

Priority 20% experience (including experience with international NGOs) Specification of the above mentioned materials and stamp of every page of tender.

Pricing, selection of vendor will be based on a per line cost basis

16. Code of Conduct / د مقرراتو یا قوانینو ټولګه

"Welthungerhilfe organizes its procurement practices in a fair and transparent manner and obeys the guidelines

for the use of public funds. Contractors and suppliers must bindingly confirm that they reject corrupt behavior

according to the definition outlined in the guideline (As per Annex ABC) and have never been legally convicted

of fraud or corruption. In the case that bribes have been offered or paid within the period of contract, the right to

end the contract should be reserved as well as the right to exclude the contractor from any further procurement

procedures with Welthungerhilfe in Afghanistan. In order to effectively prevent corruption and avoid any

semblance of corrupt behavior, Welthungerhilfe has developed guidelines for the fight against corruption which

have to be followed by the employees of the organization as well as the contractual partners (suppliers, service

providers, etc.).

The contractual partners submitting the bids/signing the contract oblige themselves to follow the guidelines (As

per Annex Prevention of conflict of interest and corruption) and to communicate these guidelines strongly to

other contractual partners (suppliers, service providers, etc.). Employees and contractual partners are encouraged

to report violations and concerns as early as possible. For this purpose, secure, easily-accessible and trustworthy

channels of information will be established. The first point of contact is the Internal Auditing Department and can

a) We are not bankrupt or being wound up, we are not having our affairs administered by the courts, have not

entered into an arrangement with creditors, have not suspended business activities, are not the subject of

proceedings concerning those matters, or are not in any analogous situation arising from a similar procedure

provided for in national legislation or regulations,

b) We have not been convicted of an offence concerning our professional conduct by a judgement which has the

c) We have not been guilty of grave professional misconduct proven by any means which the contracting

authority can justify,

d) We have fulfilled obligations relating to the payment of social security contributions or the payment of taxes in

accordance with the legal provisions of the country in which we are established or with those of the country of

the contracting authority or those of the country where the contract is to be performed,

e) We have not been subject of a judgement which has the force of res judicata for fraud, corruption, involvement

in a criminal organisation or any other illegal activity detrimental to the Communities financial interests,

have not been declared to be in a serious breach of contract for failure to comply with their contractual

h) We have not been declared to be in serious breach of contract for failure to comply with obligations in

connection with another contract with the same contracting authority or another contract financed with

Community funds,
