No. HI"8.225/2{117/83.- In supersessicn of the Medical Colleges of Assam and Region*lDental College, Guwahati {Regulatio* of Admission into lu' year MBBS/BDS Courses) Rules,2015 and its subrequent a*endments till date except ae respects the things dane or ornitted to bedane befure such supersession, the Gcvernor of ,{ssam is hereby pleased to rnake the foltawingrules to regulate the admission of students i*ta the MBBS/BDS courses in the lvledical Collegesanel Denkl Colleges of Assam" namely:-

shall be applicable from the academic session 2Al7 b regulate the admission of stadentsto the MBBS/BDS courses in the Medical Colleges and Dental Colleges of Assam,respectively.

2. Definitioss.In these rules, unless the context stherwise requires,

Provided that this shall not be applicable to the soa#daughters of officersof All India $ervices allotted to Assam (cefiificate regarding the service offather/mothnr of the candidate from the concerned authority/ D*partmentof Government of Assam must be submitted if a candidate is called forcounselling).

(c) The ca$djdate rnust study in all ctasses from Class-VII to XII in the State

of Assaru and must pass. the Qualifying Examination or its equivalentexamination from any Instituts situated in ths State af Assam. {Certificateat Annexure-Il in Application Form at Schedule-I of these nrlcs must besubmitted if a candidate is called for counselling):

Provided that if a candidate studies outside Assarn from Class-VII onwardsbecause his/her father/mother is posted outside Assam as a Assam StateGovemrnent employee or as a Central Govemment Employee or as anEmployee of a Corporatiorl Agency/ instrumentality under Govt. ofAssam or Cenfral Gavt. whether on deputation or transfer or regularposting, then the period for which the said father/ mother is workingoutside the State shall be relaxable for such candidate, (Certificate ofemployment of.father/mother outside the state indicating the period ofservice from the concerned authority must be submitted if a candidate iscalled for counsslling).

{n) Candidate's age should n*t bE below 17 years and abave 25 years cf age on the3lut day of December of the year in rvhieh the admissian is sought for:Provided that the maximrm age limit is relaxable by 3 years in case of

candidaJes belonging to the SC/ST(Py STiH) / OBC / MOBC category.

4. Muds of Selection of St*te Quota C*ndidates--

(l) The candidates who qualify in the NEET as per NEET Rules fu'r admission into I't yearMBBS/3DS Courses shall have to apply to the DME in a Declaration Form as per theEducational Notice publielred [:], the DMA immediately after the declaration of NFETresult, The Dsclaration Form shnll be availahle in the office website(yrrvw.dmEassam..sov.in)"

(21 Efigibility af the candidates to be called for counselling.-

(a) The candidate nrust pass the qualifying exami*ation.

{b) The candidate must pass all the four subjects i.e. Physics, Chemistry, Biology/Sioteehnology (which shall include practical tests in these subjects) andEtrglish of the qualifying examination in the same sitting afid wifhout gracemarks"

(c) The candidate must obtain a minimurn of 60% marks taken together inPhysics, Chemistry and BiologylBiotechnology at the qualifying examinalionin case of^candidates belongrng to General/[Jnreserved category. In rmpect of

candidstes belonging to $C/$T(FyST(H) /OBC/MOFC category the marks

" obtained in Phyuics, Chemistry and BiologylBiotechnology taken together inthe qualifying examin*tion shall be 50%.

(d) The Candidatss who have secured a position in the rank of l$ and 2nd in thecurent HSSLC (Sc.) examination canducted by Assam Higher SecondaryEducatian Council shall also be eligible to be called for counseling.However he/she must securc the qualifying marks in the NEET. Such acandidate must apply to the DME with authenticaiedproof regarding hisArerposition in the HSSLC {Sc.) examination within 7{seven) days of dmlamtion' of ths result of the ITSSLC (Sc.) examination or NHET whichever is latcrprovided helshe fulfills all ather conditions.

The names of the rank holders shall be ineluded at the top of thecounse[ing list of respective Category in order of t]reir rank in ITSSLC(Science) irrespective of their Rank in NEET and admission shall be offeredprovided he/$he fulfllls all other criteria for admissisn.

(3) The Direcftlr of Medical Edecation, Assam shall prep€Lre the counseling listimmediately after receiving the Declaration Forms from the State Quota candidates as

well as State Merit List prepared by Examination Conducting Authority. Thecounseling list shall be pubtished as an Educalional Notice in the leading ilew$ papsrsof the State of Assam and in the Official Website (Www,dmgass_am.gpv,furJ indicatingthe dates for eounseling and important terms and conditiors to be fulfilled by thecandidatss called fbr counselfurg.

Conditions to be fullilledwhile aftending the counselling .

{a) The candidates who are called fcr couneelling must be physically present beforethe $Electia$ Board.

{b) They must submit the duly signed and campleted Application Form along withall the relevant oertificates at Annexures which must be signed by all theconcerned Authoritiesloffrcers as noted and iustructed in thE Annexures.

{e} They must bring all original documents trike Admit Csrd of NEET, Adrnit Cardand pass eertifisate of HSLC or equivalent examinations, Mark sheet and Pass

Certificate of HSSLC or eqnivalett examinations, Permanent RsidentialCertificale {PRC), Caste Certificate issued by competent authority, Certificateissued by competent authority for any other reserved Category claimed by thecandidates.

{d) Candidate should also bring a set of self attested photocopies of all the originaldoouments to be submitted at the time of eouuselling.

{e) A candid*te shall bE required to deposit *n amount of R*. 5001- (Rupees fivehundred) only or any amount as fixed by DME from time to time as counsellingfee in eash to the Director of Medical Education, Assamo at fbe time ofcounselling" The Director of Medical Education, Assam shall utilize the amountso collectect as counselling fee for conducting the counselling procedure,provided he shall be required to submit the expenditure statement along with theutilization certificate to the Government.

7. Selection Board,

The Selection Board for the purpose of selection of candidates for admission into the lsyearMBBS/BDS couffss shall consist of the f:ollowing members:-

DME/Chairman of the Selection Board to assist himin the proc€s$ of counsellingo if required.

In case of abserree af Member Secretary, the Chairman shall appoint one of theMembers of the above Commitee as Member Secretary.

8. Selection of Candidates.

(a) During the counselting the candidates shal1 be called in order of merit and theyshall pay their counselling fees.

(b)The Application Form and its relevant certificates, testimonials a*d documentsshall be scrutinized by a Committee constituted by the DME to determine all theeligibility criteria sf the candidate for State Quota seat.

(c)After scrutiny and verification of the docrrments if the candidate is for:nd eligiblethen Selection Board shall allot a seat to the cand^idate in the MBBSIBIIS coursesin a college according to ths choice of the candidate and subject to availabilrty ofthe seat in that particular eollege st the point af time of hi*/h*r appearing beforcthe Selection Board;

Ptovided that in case of non-av*ilability of seats, in the CollegelCourse ofhis first choicen a eandidate shall be allotted seat in the collegelcourse of his nextorda of preference and so on.

Provided that a reserved category candidaCI as iu 5 (a),{b),(c),{d} in theSchsdule-[I of these Rules entitled for selection on the basis of his&er rneritposition in GeneraL'[Jnreserved Categcry shaltr have the option of taking a seatin the college $'here a specified number of seats have been kept reserved fbrrEserved category buf whilE conrputi*g the perce*tage of reservation he/sheshall be deemed to have been admitted as a General/ Unreserved categorycandidate and not as a re$erved category candidate. Under sush circurnsiancesone sset ofunreserved category ofanother college ofhis/her next preferenceshall be converted to the respective rsserved category of that particularcandidate to maintain the total number of reserved category seats.

{d) If the Se}ection Board is satisfied prima-facie that any documents i*eluding PRC,age and schooliug, easte ce*ificate etc. produced by the candidate is of doubtfulin natnre, the Board shall u'ithheld the selection a{ter allotment of the seat andthe documexts shall be referred for ither verification by the Oovemment ofAssam. The viel'vs of the Sovemment in this regard shall be final i* determiningthe eligibility of the candidate.

Howevcq no *dmission wili be allowed unless the c*ndidete is found to bephysically fit by the Medica! fixaminatioa Bonrd at the tir*e of admission.

{b) The candidate must deposit their original Certificates/Testimanials at t}:eOffice of the Frineipal of the respective Calleges at the time af admissiorrrn hich shall be retumed aficr campletior: af the coilrse. Such documents maybe returired earlier befcre the last elnte cf admission if the ca*didate applies tothe respective Principal for reeeiving thc sarxe specifyir:rg ju*tified ground withprocf. Howsver, the certificat*s shall be returned to the candidate with a

eo*ilition that the candidale shall submit l:ack the documents again within a

fixed perir:d of time before flre last date of admission *s decided by thePrincipa"l failing which thn sest shall be trsated ss surrendered. 14. Appcnl.

The Government shall dispose of *ll appeals before the last dnte af admissicn for thatparticular sessio* as frxEd by MCVDGHS.

15. Agreemenl

{a) All candidates selected for admissio* into h{FBS Cornse in the Medicnl Colleges ofAssam shall enter into an agreement in * nan judicial stamp pepsr of Rc.t00/- (Rupeeri

{b} All candidates selected for admissian into EBS course shaff enter into an agreeinent ina non.judicial sta.mp pnper of Rs.l00/- (Rup*es one hu*dr*d) only with theGovemrnent of Ass*m as in $sheduls - 1I * S appended to these ruler for bindinghirnselfherself to serve under the Covemment of Assam for a period of 5 years in aryinstitute sffered bythe Govt. or I ye*r Rural Service on completion of the BD$ courseand in breach thereof to pey e sum sf Rs.20,SS,0001 (Rrryees twffify laklrs) only to theGovernmeut &s compensation.

Refund of paid fees.

The annount of fees p*id by the pandidets at the tirne of admission shall be refundedafter iledustion of 10% of the total amowrt of paid fees if the candid*te surxendsrshis/her seat before the last date sf adrnission as fixed by MCI/DGHS.

A*fi Ragging M+asnres.In pursuanee to the Judgement of the Hon'ble $upreme Court of India datsd: 08105/2009in Civil Appe*l No.88?i2009, fhe Medical Council af India has framed the "MedlcnlCoancil of Indi* {Frevention and Prohibition *f Ragging in ModicalCollege/Ccllegos/Instituticns) Regutrationro ?il090' rvhich have bJen notified on 3dAugust,2009 by whieh raeging is prchibited by Law in all its forms,'fipm MedicalCollegesl lnstifutions in the Counfl'y. Pr*venting its occcrrenee by following the pravisionof, this Regulation and plrnishing those whe indulge in raggi*g, as provided for in thisregulations and the *ppropriate law in ferce, the Medical Council of India has made itmandatary for all st*dentsl parents to suhmit anti-ragging related affidavits to theinstitutions at tlre time of Admisrion {details c*n be downlo*d*d from the web site ofMCr).

Inferpretntioli of any clauuu of thsse rule*.In case of any doubt regarding i*terpretation of any clause sf thes* rulec during thecounselling period then the desision of tlre Selectian Board regarding the interpretatian ofthat particular elause shall be final.

Power to relax.-Where the Ocvernmsnt is of the opinion that it is necessary ar exp*dient so to do so, itmcy by ordsr, not inconsistent with the pravisions of these rules and ftr r-easons to berecarded i* +vriting, relax any of the provi*ions of these rul*s.
