The 30th November, 2017

No.G.S.R.59/C.A.2/1974/S.357-A/2017.-In supersession ofall the Schemes prepared in this behalfand in

exerciseofthe powers conferred by section 357-A ofthe Code ofCriminal Procedure, 1973 (Central Act2 of

197 4 ), and all other powers enabling him in this behalf, the Governor ofPunjab in co-ordination with the

Central Government, is pleased to prepare the following scheme for providing funds for the purpose of

compensation to the victim or his dependents who have suffered loss or injury as a result ofcrime and who

require rehabilitation, namely:­

SCHEME 1. Short title and commencement­

(1) This Scheme maybe called the Punjab Victim Compensation Scheme, 2017.

(2) It shall come into force on and with effect from the date of its publication in the Official

Gazette.

(3) It shall apply to the victims and their dependent ( s) who have suffered loss, injury andrequire

rehabilitation, as the case maybe, as a result ofthe offence committed.

2. Definitions-In this Scheme, unless the context otherwise requires­

(a) "Code" means the Code ofCriminal Procedure, 1973;

(b) "Collector'' means the Deputy Commissioner of the district concerned or any person

authorized in thisbehalfbythe Government;

(c) "Dependent" includes wife, husband, father, mother, unmarried daughter, widowed/divorced

daughter, widowed daughter-in-law and minor children of the victim as determined by the

Collector, orany other authority authorized bythe Collector in this regard ;

(d) "District Legal Services Authority" means the District Legal Services Authority of the

District concerned in the State;

(e) "Fund" means the victim compensation fund constituted under clause 3 ofthis Scheme;

(f) "Government" means the Government of Punjab in the Department of Home Affairs and

Justice;

(g) "Schedule" means the Schedule appended to this Scheme ;

(h) "State" means the State ofPunjab;

(i) "State Legal Services Authority" means thePunjab Legal Services Authority;

G) "Victim" means a person as defined in clause (wa) ofsection 2 ofthe Code.

3. Victim Compensation Fund-There shall be constituted a fund to be known as the Victim Compensation Fund from which the

amount of compensation, as decided by the Punjab Legal Services Authority or the District Legal

Services Authority, as the case maybe, shall bepaidin accordance with this scheme to the victim orhis

dependent (s) who has suffered loss or injuryandrequire rehabilitation as a result ofthe crime.

4. Sources ofthe Fund-The following shall be the sources ofthe fund, namely­

(a) The Government ofPunjab shall make a budgetary provision in the annual budget;

(b) Receipt of amount of fines imposed by the court under section 357-A of the Code and

ordered tobe depositedin the Fund;

(c) Amountoffme recovered from the wrongdoer/accused under clause 8 ofthe Scheme; and

(d) Funds received from Government of India or any other source like donations or

contributions from International/ National/ Philanthropist/ Charitable Institutions/

Organizations and individuals.

5. Maintenance ofaccounts, record and operation ofthe Fund­(1) The Punjab Legal Services Authority or the District Legal Services Authority, as the case

may be, shall maintain the accounts and other relevant records and shall furnish to the

Department of Legal and Legislative Affairs the returns of the receipts and the sums

distributed annually in accordance with this scheme and the norms applied in determining

quantum of compensation. The Department of Home Affairs and Justice shall be the nodal

department for regulating, administering andmonitoring this scheme.

(2) The sums released to the Punjab Legal Services Authority or the District Legal Services

Authority out of the Fund shall be operated by the Member-Secretary of the Punjab Legal

Services Authority or the Secretary ofthe District Legal Services Authority, as the case may

be.

6. Criteria for Grant ofCompensation­(1) The victims or his dependents may file applications which may be considered for the Grant

ofCompensationby the competent authority falling inanyofthe following categories­

(a) where a recommendation has been made by the Court under sub-section (2) or sub- section

(3) ofsection357-AoftheCode;

(b) where the offender is not traced/traceable or identified, but the victim is identified and where

no trial takes place and the victim has to incur expenses on physical and mental

rehabilitation, and the victim or his dependent makes an application to the Punjab Legal

Services Authority or the District Legal Services Authority;

(c) where the Punjab Legal Services Authority or the District Legal Service Authority, as the

case may be, in order to alleviate the suffering of the victim, orders for immediate first-aid

facility or medical aid tobe made available to him, free ofcost, on the certificate ofthe police

officer concerned not below the rank of the officer-in-charge of the police station or a

Magistrate ofthe area concerned, or any other interim relief as the said authorities may deem

fit.

(2) The applications for the grant of compensation may be considered by the Punjab Legal

Services Authority ortheDistrict Legal Services Authority, subject to the following­

(a) the victim or his dependent should not have compensated for such loss or injury under any

other Scheme ofthe Central Government orPunjab Government except where any reliefhas

been granted under the following Schemes:­

(i) Prime Minister's National ReliefFund (PMNRF);

(ii) Central Victims Compensation Scheme(CVCS);

(iii) ChiefMinster ReliefFund;

(iv) the Punjab Financial Assistance to Acid Victims Scheme 2017 ofthe Department of

Social Security and Department of Development of Women and Child of the

Government ofPunjab; and

(v) any other scheme or funds which provides for relief in addition to the Victims

Compensation Scheme under Section 357-Aofthe Code;

(b) The crime, on account ofwhich the compensation is to be paid under this Scheme, should

have been occurred within the State.

Exception: - In case, the crime has occurred outside the State and the victim is found within

the limit ofthe State, he shall be eligible for interim reliefcontemplated under sub-section ( 6)

ofsection357-AoftheCode.

7. Medical help and LegalAid-To provide immediate medical help and legal aid to the victims, the Department of Health and

Family Welfare shall setup "One Stop Centre and Legal Aid Clinics" within the premises ofevery

District Civil Hospital in coordination with thePunjab Legal Services Authority. The Nodal Officers

for each such centre shall be appointed bythe Department ofHealth and Family Welfare and also by

the Punjab Legal Services Authority. The funds and the Logistic Support for the purpose oflegal aid

to the "One Stop Centre and LegalAid Clinic" shall be provided by Punjab Legal Services Authority

while the medical facilities, including Doctors and Paramedical Staff etc., would be providedby the

DepartmentofHealth and Family Welfare.

8. Procedureforgrantofconipensation­(1) Whenever, a recommendation is made by the court for compensation or an application is

received for compensation under sub-section ( 4) ofsection 3 57-A ofthe Codebythe Punjab

Legal Services Authority or the District Legal Services Authority, as the case maybe, the said

authorities shall examine the case and verify the contents ofthe claim with regard to the loss

or injury caused to the victim/ claimant. The said authorities may also call for any other

additional/ relevant information/report necessary for the consideration of the claim. After

completing the enquiry within the stipulated period oftwo months, the said Authorities shall

award the compensation, inaccordancewiththe provisions ofthe Scheme.

(2) The Punjab Legal Services Authority or the District Legal Services Authority, as the case

may be, shall decide the quantum of compensation to be awarded to the victim or his

dependentonthe basis ofthe loss caused to the victim, the medical expenses incurred orto be

incurred on treatment and minimum sustenance amount required for rehabilitation,

including incidental charges, such as immediate transportation expenses, child care expenses

etc:

Provided that the quantum ofcompensation to be awarded to the victim or his dependent ( s)

shall notbe less than as provided in the Schedule:

Provided further that in acid injury cases, no compensation shall be awarded in case ofself

inflicted injury or self suffered injury or injuries received from friendly hand or accidental

injury. In such cases, only the free emergency medical help maybe provided.

(3) The compensation mayvary from case to case depending upon the facts ofeach case.

(4) The amount ofcompensation awarded shall be disbursed to the victim or his dependent, as

the case may be, from the fund. The amount ofcompensation so awarded shall be disbursed

through theBankaccount ofthe victim orthrough a designated person to be nominatedbythe

Punjab Legal Services Authority or the District Legal Services Authority as the case may be,

in appropriate cases where it is not practically possible for the victim to himselfreceive the

compensationon account ofhis injury or otherwise.

(5) The compensation shall be paid in lump sum or in two installments as decided by the Punjab

Legal Services Authority or the District Legal Services Authority as the case may be. In the

case ofacid attack Victim, a sum ofRs.25000/- (Rupees twenty five thousand only) may be

paid to the victim or his dependent as an interim relief upon the receipt or the filing of a

certificate issued bythe Medical Officer, preferably within five working days, which shall be

part ofcompensation to be finally awarded.

(6) The Director, Social Security and Women and Child Development, Government ofPunjab

shall be sent a copy ofthe compensation award in the case ofrape victim or victim under

trauma to effectively carry forward the rehabilitation and continuous evaluation.

9. Recovery ofCompensation in certain cases­(1) Subjectto the provisions ofsub-section (3) ofsection 357-Aofthe Code, the Department of

HomeAffairs and Justice, in suitable cases, may institute proceeding before the Competent

Court oflaw for recovery ofthe compensation paid to thevictim orhis dependent(s) from the

accused person( s) responsible for causing loss or injury as a result ofthe crime committed by

such accused person(s).

(2) In case a victim orhis dependent resile in the Court from his previous statement given during

investigation or evades or refuses to appear as a witness, the victim or his dependent, as the

case may be, would refund the compensation to the Punjab Legal Service Authority or the

District Legal Service Authority, as the case may be. Upon information, the Punjab Legal

Service Authority or the District Legal Service Authority, as the case may be, would issue a

notice to the victim orhis dependent for refund ofthe compensation.

10. Orderto beplacedonrecord-The copy of the order of the compensation passed by the authority concerned under this Scheme,

shall be mandatorily placed onrecord ofthe trial court.

11. Disbursement ofcompensation­(1) The disbursement ofcompensation shall be made through the bank account ofthe victim/

dependent. The amount of compensation so awarded shall be deposited in a Nationalized

Bank or if the branch of a Nationalized bank is not available, it shall be deposited in the

branch of a scheduled commercial bank, in the joint or single account of the victim or of

dependent ( s) ofthe victim.

(2) In the case the victim is a minor, the amount ofcompensation awarded shall be deposited in

the account of the minor as fixed deposit, to be withdrawn only on attaining the age of

majority. In exceptional cases, the amount of compensation can be withdrawn for the

educational or medical needs of the beneficiary by a person as decided by the Punjab Legal

Services Authority or the District Legal Services Authority as the case maybe.

(3) The amount ofinterest of the sum so deposited in the bank shall be credited directly by the

bankinthe saving account ofthe victim/ dependent (s) onmonthly basis.

12. Rejection, withholding or reduction ofcompensation-The Punjab Legal Services Authority or the District Legal Services Authority as the case may be,

may reject, withhold orreduce the award ofcompensation where the Authority considers, that :­

(a) the applicant has failed to inform the crime to the Police authorities concerned without a

reasonable delay ;

(b) the applicant has failed to co-operate with the Police authorities or any other authority

concerned to bring the accused before justice ;

(c) the applicant has failed to give all reasonable assistance to the Punjab Legal Services

Authority or the District Legal Services Authority or other related authorities in connection

with the consideration ofthe application;

(d) the eligibility ofthe victim as confirmed by the facts and circumstances ofthe case does not

justify the award ofcompensation.

13. Dependency Certificate-The Victim or his dependent(s) shall make an application before the Collector for issuance of a

dependency certificate. The collector or the authority authorized by the Collector shall issue the

required dependency certificate to the victim within a period of fifteen days and, in no case, this

period shall be extended:

Provided that the Punjab Legal Services Authority or the District Legal Services Authority as the

case may be, in case of non-issuance of dependency certificate by the Collector for some reason,

after expiry of15 days, mayproceed on the basis ofan affidavit to be obtained from the claimant and

would ensure the availability ofthe required dependency certificate before passing the final award.

14. Limitation-N o claim made by the victim or his dependent( s) under sub-section ( 4) ofsection 357-A ofthe Code

shallbe entertained after a period ofthree years ofthe commission ofcrime:

Provided that the Punjab Legal Services Authority or the District Legal Services Authority, as the

case may be, ifsatisfied, for the reasons to be recorded, in writing, may condone the delay in filing

the claim by one year.

The Governor of Punjab is pleased to frame the scheme for providing a monthly assistance

@ 8,000/-per month to each acid attack victim.

SCHEME 1. Short title and Commencement­

(1) This scheme may be called" The Punjab Financial Assistance to Acid Victims Scheme, 201 7".

(2) It shall come into force on and with effect from the date of its publication in the official

Gazette.

2. Definitions­(a) "Acid Attack Victim"means a female, who, duetoacidattack,hasbeenrendereddisabled

within the defmition ofdisability under The Rights ofPersons with Disabilities, Act 2016 as

amended from time to time, or within the definition ofdisability under the corresponding

provision of an enactment coming into forceat alaterstageasa replacement of the

above mentioned Act.

(b) " Fund" means the Social Security Fund constituted under regulation-3 of the Notification

No. ll/52/04-5FENI/2387 dated 16.01.2005 issued by Department of Finance

( Finance Expenditure-VI Branch), Govt. ofPunjab.

(c) "District Level Committee" means a committee constituted at District Level for

the disposal of cases under this scheme and shall consist offollowingmembers:­

i) Deputy Commissioner (Chairperson)

ii) Civil Surgeon

iii) District Social Security Officer (Member Secretary)

iv) DistrictProgrammerOfficer(WCD)

v) Two or more members having expertise in matters relating to criminal law, at least

one of whom shall be a woman. (To be nominated by the concerned Deputy

Commissioner).

(d) "Family member" ofan acid attack victim shall include her husband, son, daughter, father-in

law, mother in law unmarried brother ofher husband, unmarried sister of her husband,

her parents, sister brother, and also herbrother's wife/son/daughter.

3. Eligibility for grant ofMonthly Financial Assistance­(a) The acid attack victim shouldbe a resident ofPunjab State.

(b) The case for sanction of financial assistance to the victim shall be considered upon

submission of an application to the concerned District Social Security Officer either by

the victim herselforby her guardian/heir/family member/any relative, in a case where

the victim has been rendered so disabled due to acid attack that she is not in a position to

make an application herself.

(c) The application must be supported by medical certificate to the effect that the applicant

has been rendered disabled due to an acid attack as mentioned in para-2 above. Such a

certificate must have been issued by a certifying authority prescribed under The Rights of

Persons with Disabilities Act,2016 as amended from time to time, or under the

corresponding provision of an enactment coming into force at a later stage as a

replacement ofthe above mentioned Act.

4. Procedure for application­(i) The victim or victim's parents/guardian/legalheir/familymember I any relative may

submit an applicationto the concerned District Social Security Officer.

(ii) An applicant shall be required to submit the following documents with the application:­

(a) A medical certificate as mentioned inpara 3-(c) above.

(b) Copy ofF.I.R/Complaint.

(c) An attestedcopyofanyone ofthe following documents:­

(i) Voter list,

(ii) Electoral Photo Identity Card (EPIC),

(iii) Aadhar Card,

(iv) Passport,

(v) Driving License,

(vi) Residence certificate.

(d) Particulars of the Bank Account of the applicant (along with the IFSC Code and

Aadhar CardNo., ifavailable).

5. Sanction ofCases­(a) On receipt of application, the District Social Security Officer, after completing

documentary formalities, shall immediately, and under no circumstances later than one

week, submit the case to the Deputy Commissioner, who shall call the meeting of the

District Level Committee as defined under para-2(c) above within 7 days of the

submission of the case by the District Social Security Officer.

(b) The District Legal Committee, upon being satisfied that the applicant is eligible for

the financial assistance under the scheme shall sanction the case. Ifthe committee is of

the view that the case is liable to be rejected, the committee may reject the same after

recording reasons for the same. Intimation of sanction or rejection of the application

shall be sent to the applicant.

(c) It is clarified that under all circumstances, an application for the grant of financial

assistance under the scheme shall be disposed of within a period ofone month

from the date of receipt ofthe case from the District Social Security Officer.

(d) The disbursement of the benefit under the scheme shall be payable with effect from

the month wherein the incident of acid attack had occurred or the date of publication

of this notification, whichever is later, and the same shall be made only through the

victim's BankAccount.

6. Appeal: An applicant aggrieved of the decision of the District Level Committee may submit an appeal

to the Director, Department of Social Security and Development of Women & Children, Punjab

within 15 days of the above mentioned decision, who shall dispose of the same within one

month bypassing an appropriate order.

7. Release and utilization ofbudget­(1) The Department of Social Security and Development of Women and Children being the

Nodal Department for regulating, administering and monitoring this scheme, out of the

amount received from the fund as defined under para 2(b ), an appropriate amount shall be

distributed by the Directorate of Social Security to District Social Security officers as per

requirement.

(2) District Social Security Officers shall be responsible for maintaining accounts and other

relevant records regarding the amount received by them and shall regularly furnish the

reports on monthly basis to the Directorate ofSocial Security with regard to the sanction of

cases and the expenditure incurred on disbursement under the scheme.

8. Creation ofCorpus Fund:­A Corpus Fund of Rs. 10 lac shall be created at the level of Directorate of Social Security for

immediate release of financial assistance to an acid attack victim pending the clearance ofregular

billby the treasury after the sanction ofher application by the District Level Committee. The amount

so released shall be replenished to the corpus fund upon the clearance of the regular bill for the

corresponding month by the treasury. The amount for the creation of the above mentioned Corpus

Fund shall be withdrawn from the functional head" 2235 Social Security, Women and Child

Development, Punjab" pertaining to the department.
