I an writing this letter during the last week of October due to the length of time it takes to put together a quarterly and the printing. By the time you read this we will have elected a new U. S. President and also be in the middle of the Christmas season [with all that going on, you may not read it]. I hope this has been a good year for you and may I extend my best wishes for the very best in 1983.

October is a month I look forward to each year. That's when the Stone Mountain, Georgia, annual SCOTTISH FESTIVAL & HIGHLAND GAMES are held. This was their 16th year and as ever was a week—end of fun, entertainment and enlightenment on things Scottish. Stone Mountain is only one of many locations all over the country where Scottish festivals are held through out the year. I have ties with the BLAIR, BRUCE, JOHNSTON/E ft STEHART CLANS along with a few others that I need just a little more work on to make that final documented connection. If you have Scottish blood lines and have not associated with any of the Clans, check into joining. It is great fun and most Clans maintain genealogical records and/or libraries which offer help i n fami1y research.

I ran across an interesting item in the Fall 1988 edition of the HEART OF TEXAS RECORDS, a publication of the Central Texas Genealogical Society, which I did not know and possibly some of you have not heard about. According to the article, the Social Security Administration plans to destroy the original 3? million applications for Social Security. It went on to say, some of the information had been computerized but that the information of a genealogical nature had been omitted. The early Social Security files include many persons born in the 1860's ft 1870*8 along with many records of naturalized citizens. They were encourging their membership to write the Social Security Administration, 6401 Security Blvd. , Baltimore, Md 21235, and also members of Congress, to oppose the move. We should do likewise.

I would like to thank all of the people who have taken the time to write me personal letters. They have come from all parte of the country, from Clovis and Taft, CA to Maryville and Chattonooga, TN. You were very kind in your comments. Of course there have been two or three of the other kind but they tend to be of a local nature.

I look forward to seeing as many Of you meeting which will be in Ft. Payne, Ala. another part of the quarterly.

MINUTES NORTHEAST ALABAMA GENEALOGICAL SOCIETY, INC.

OCTOBER 8, 1988

The Northeast Alabma Genealogical Society met October 8, 1988 at the Nichols Memorial Library, Gadsden, AL for the regular quarterly meeting. Marvin Kelly, President, opened the meeting with the Pledge of Allegiance to the Unted States Flag. Reports were received from the officers and committees.

It was noted that the Society voted in July to alternate meeting places every other quarter between Nichols Memorial Library and the adjoining counties. The January 14, 1989 meeting will be held in Fort Payne, AL at the Museum. Tommy Guice, a teacher and genealogical researcher, will speak on research in Fort Payne and DeKalb County, AL.

It was announced that the second largest Scottish Festival in America would be held at Stone Mountain, Georgia on October 14, 15, and 16. Those with Scottish heritage were especially urged to attend this unique and entertaining event.

New business concerned the need of a committee to study and review the physical needs of the Nichols Library building. A review and recommendation regarding the old and deteriorated electrical wiring is particularly needed. Tree limbs extending over the roof of the Library needs to be trimmed to protect the roof and building.

Mrs. Emma Linder, Second Vice President and Program Chairman, introduced the speaker, Mrs. Marilyn Davis Hahn Barefield, Author and Genealogist of Birmingham. Mrs. Barefield reviewed her beginning interest in genealogy, history, and writing in her early childhood visitation the the local library. She encouraged all members to write their family histories and to compile county, city, and state records and histories. She mentioned alternative ways to research counties where courthouse records were burned. This can be done by using newspapers, church records, oral interviews, individual diaries and Bible records. Much information can be gleaned at the State Archives through land records, voter registration, manuscript collections, state census and state military and pension records. Federal census records are very helpful in pinpointing individual families, along with federal military and pension records. Check American State Papers for land records and Indian affairs. Mississippi Territorial Papers will give much information on the early settlers into the territory which became Alabama in 1819. She cautioned researchers to always check original documents in courthouse research if possible. Errors are often found in the journals to which the original information was transferred.

After a question and answer session the meeting adjourned and refreshments were served to the members and guests.

ESTABLISHMENT OF ETOWAH COUNTY, FORMERLY BAINE COUNTY, ALABAMA

Etowah County was created by the State Legislature as Baine County, December 7, 1866, and it was abolished December 3, 1867 by the Constitutional Convention of that year. It was re-established with its present name, Etowah, by the legislature December 1, 1868.

When Alabama's first Post Civil-War legislature convened in Montgomery in November 1866, a petition from residents of the counties of Blount, Calhoun, Cherokee, DeKalb, Marshall and St. Clair was presented, "Praying for the formation of a new county, the center of which would be at or near Gadsden, in Cherokee County." The bill passed, and the new county was created December 7, 1866. It was named Baine in honor of Lt. Col. David William Baine, a Confederate hero and former resident of Centre, Cherokee County, Alabama. He was killed while leading his Fourteenth Alabama Infantry against a Federal battery at Frazier's Farm during the Seven Day's Battles in Virginia, June 30, 1862.

Baine County survived one year under the military government in 1867. The Carpetbag controlled Constitutional Convention voted to abolish the county named for Baine, a passionate Secessionist. The State Legislature repealed the ordinance abolishing Baine County on December 1, 1868, and restored the previous boundry lines. The new name "Etowah" was given the county, a derivative from the Cherokee Indian word "Itawa", meaning strong tree.

David William Baine, a lawyer, was born August 28, 1829 at Western Reserve, Ohio, the son of John and Maria (Adkins) McBain. He was graduated from Transylvania University, Meadville, PA., at the age of seventeen, and took first honors in law. He taught school in Cherokee County, Alabama and was admitted to the Alabama bar in 1848. He became a partner of Hon. Thomas B. Cooper, at Centre, Cherokee County. He moved to Lowndes County, Alabama in 1856 where he was the law partner of S. P. Smith. He was a delegate to the Charleston National Convention in 1860.

Baine married November 29, 1848 in Cherokee County, Alabama to Mary Hogue, daughter of Jesse and Mildred Lewis (Powell) Hogue, who lived at Clarksville, Habersham County, Georgia. Mary's great-great-great-great grandfather was David Lewis of Hanover County, Virginia, who with his brother, Gen. Robert Lewis, emigrated from Wales and settled in Virginia about 1660. Children of David and Mary: (1) Mary Baine, married in 1864 to Hon. Willis Brewer of Hayneville, Alabama; (2) Thomas Cooper Baine, born February 9, 1860, married in 1884 to Annie Lee Gilchrist, granddaughter of Archibald Gilchrist of Lowndes County, Alabama.

BAINE COUNTY, ALABAMA ELECTIONS

By vote in a special election on March 4, 1867, Gadsden became the seat of Baine County. The following officers were elected:

L. E. Hamlin, Judge of Probate Samuel Edmondson, County Treasurer A. D. Bennett, Circuit Clerk T. B. Means, Tax Assessor Thomas J. Burgess, Sheriff G. W. Garmany, Tax Collector D. W. Reid, County Commissioner WM. N. Cowan, Superintendent of R. B. Rhea, County Commissioner Public Schools A. H. Colvin, County Commissioner G. W. Martin, County Commissioner

Maj. Gen Wager Swayne, Commander of the Alabama Military District (1867), notified Judge Hamlin that the election was null and void, but that the elected officials could retain their offices if they subscribed to the amnesty oath. Thomas J. Burgess, Sheriff, was removed from office for refusing to sign the amnesty oath. Probate Judge L. E. Hamlin was also unseated. Unionist, Samuel Dillard, was appointed Sheriff, and James M. Moragne was appointed Probate Judge by Governor Robert M. Patton to fill the vacancies.

Officers of the City of Gadsden elected in the same election were:

R. B. Kyle, Intendent H. Herzberg, Alderman Wm. P. Hollingsworth, Alderman J. T. Barrett, Alderman R. 0. Randall, Alderman D. C. Lewis, Marshall

All submitted to the amnesty oath.

Dr. Whitley T. Ewing, a strong Unionist, represented Baine County in the legislature. He was born in Washington County, Virginia, December 28, 1823, the son of Samuel and Mary (Davis) Ewing. He graduated from St. Louis Medical College in 1848, moved to California, entered medical practice and ran a hospital in the gold field area of Placerville and Cold Springs.

Dr. Ewing returned to St. Louis in 1855 and married August 24, 1855 to Hannah I. Pettengill of Massachusetts. That same year they moved to Cass County, Georgia where he practiced medicine eight years. His unpopular Unionist views prompted his move to Gadsden about 1862 where he devoted much of his attention to the practice of medicine. Despite his strong Unionist views, he gained respect of the local people by his courtesy and gentlemanly treatment of them. He was appointed Gadsden's Postmaster in 1866 and served until 1885. He died sometime after his wife, who died in June 1886. They had five children: Arthur Eugene Ewing, St. Louis, Missouri; Munetta Jane Ewing, wife of William P. Shahan, Attalla, Alabama; Charles Whitley Ewing, husband of Mollie Lay; Stella May Ewing; and Thomas Gale Ewing, Gadsden, Alabama.

Dr. Ewing was a member of the Reconstruction Conventions of 1867-1868 in Montgomery. The following letter from Ewing to Gen. Wager Swayne reveals some of his radical views:

General Swayne:

I have the honor to apply for the position of Inspector of Registration for this Congressional District. An extensive acquaintance with the Union people of the counties composing this District leads me to believe that I will be able to give satisfaction to yourself and the government.

The Union cause is progressing'well in this section. Though we meet with bitter opposition in the way of cold contempt from the so-call old conservatives. The war of muskets is over, but the war of the old political leaders against the people is just begun.

The Union meeting for Baine County to choose delegates to the Convention to meet in Montgomery on the 1st Tuesday in June (1867) will take place on the 11th of May next. We expect to hoist the Union Flag on that day where in 1860 it was torn from the liberty pole, and even the pole itself was cut down at the ground and burned by the Confederate soldiery.

BLOUNT COUNTY, ALABAMA

Blount County was created by the Territorial Legislature February 6, 1818. The original territory was very large and included the present county of Jefferson and that part of Walker County east of the Sipsey Fork of the Black Warrior River. It lay almost wholly within the Creek Indian Cession of August 9, 1814. The county was named for Governor Willie G. Blount of Tennessee.

The county is drained by Locust and Mulberry forks of the Warrior River and their tributaries. The northern part of the county is drained by Brown and Big Spring Creeks, which flow into the Tennessee River.

Several Indian mounds and village sites have been found in Blount County. Chipped implements are found in many sections. Crump's Cave, which is located about fifteen miles south of Blountsville, is an Indian burial cave. Skeletons, a wooden trough, bark matting, and copper articles have been found in this cave. In 1882, a cache containing seventeen fine chipped implements was found in a cultivated field near Blountsville. About this same time, Indian skeletons and pottery were found in a cave near Village Springs. Bear Meat Cabin, the home of a Creek Indian chief, was located near Blountsville.

The first white settlements in Blount County were connected with the events of the Creek Indian War of 1813-1814. Tennessee troops opened a wagon road to Baird's Bluff, which is near the Blount County line. General John Coffee's mounted troops marched through Brown's Valley and Blountsville in their campaign against the Indians of the Black Warrior Town (Tuscaloosa). In this way a great number of Tennesseans became familiar with the country and at the close of the war sought homes there. Among the first settlers who came with their wagons to Blount County in the fall of 1816 were "Devil" John Jones and his brother-in-law, Caleb Friley. Both of these came from Madison County, Alabama. Mr. Friley settled at Blountsville; while "Devil" John Jones moved on some sixty miles to the south and founded Jonesboro, now in Jefferson County. The East Tennesseans came down the Tennessee River in flatboats, which were loaded with their provisions, household effects, wagons, and livestock, and landed at Deposit or Gunter's Landing, now Guntersville. In 1818 and 1819, many South Carolinians settled in the county and helped to make its history. In 1816, the first sermon heard in Blount County was preached by Reverend Ebenezer Hearne, a famous Methodist evangelist, who was born in North Carolina but later removed to Alabama.

Blount County is noted for its fruits, particularly for its apples. The first apple trees were brought to the county by John Fowler in 1817. Five years later, he imported many varieties from East Tennessee. In recent years, Blount County has become noted for its fabulous tomato crops. The soil and climate seem to be ideal for the production of this vegetable.

PETITION TO RECOMMEND A RECORDER FOR BLOUNT COUNTY, ALABAMA - 1867

This petition recommending George White as Recorder of Blount County, Alabama represents him as competent, well acquainted with most men in Blount County opposed the Rebellion went north to serve with the United States for two years, came home last June (1866), put up a United States flag at his portico which remains there yet :

At a respectable meeting of a portion of the citizens of Broom Town Valley, convened at Cobb's Mills on Friday evening, 2?th June, for the purpose of making suitable arrangements to celebrate our national anniversary, Dr. U. C. Hale, was called to the chair, who in a few spirited remarks explained the object of the meeting.

On motion of Mr. Joel Moasley. it was Resolved, That the Chairman appoint a committee, to consist of seven persons,

whose duty it shall be to superintend and make all suitable arrangements to celebrate the approaching anniversary.

Uhercupon the Chairman appointed the following gentlemen, viz: James McCullough, David Taylor, David Pickle, J. M. Moasley, M. R. Anderson, John Doherty and John H. Fitzer.

The committee report called for a free barbacue. orations by Dr. Urn. C. Hale and Col. Wm. L. Cain, and that Parsons Grogan and Leith be requested to attend. The procession was to form in front of the dwelling house of Mr. Lemuel Cobb. Capt. Miller Peden was to be martial of the day. No ardent spirits permitted on the ground. Prayer by Rev. Josiah Leith. Toasts read from the stand by Mr. Acker. Signed by William C. Hale, Chr.

At Turkeytown, Isaac 6reen, Esq. was marshal of the day; R. W. Wright, orator. Jno. Porter, W. U. Wright, Thos. Lancaster, Sen., N. Lancaster, E. Powell, and J. Favours, Committee of Arrangements.

Col. Stiff: - As an offset to the shameful and slanderous, but sly attacks upon you in Cedar Bluff, perhaps the following from the Jonesborough Whig, edited by Rev. Urn. 6. Brownlow, an eminent clergyman of the Methodist Church, may not be without its uses, particularly when the parties mentioned are chums with all your foes, and the daily associates of your village Post Master. Sawrie, Weir and Browning. "There are several pinks in the vicinity of Cedar Bluff, in Alabama, who take quite a pleasure in abusing the editor of this paper, three of who we have named above. If we had leisure and room, we would notice more than the above mentioned. Sawrie who edits a filthy little snoot called the Messenger, -first entered the country as a Methodist Missionary, and preached and swindled about there till he got out of the Church. He then got some goods on a credit, and soon broke -next he took to school keeping, and failed; and finally turned lawyer - obtained a license, but got no practice. At a religious revival, he went of as a mourner -took a new start in religion - and failed again. When he is sent to the Penitentiary, we will again notice him.

Mr. Weir, sometimes known as "Old Dad," is an old acquaintance of ours. We knew him when he lived near Athens - we knew him when he left there and went to Calhoun, and was whipped by Bright for turning-his hogs into his corn field - we knew him when he filched from Keith his portion of a small store. But since he went to Jacksonville, Terrapin Valley, and Cedar Bluff, where he has been swamped in divers law suits, and charged with all manner of crimes, we have not noticed his career.

As to Israel J. Browning, we "knew him like a book." We were one of a quarterly conference here, who once convicted him of lying. Shortly after that, he ran away from this County for stealing flour from Mr. Collins, of Leesburg. He left between two days. The good people of Alabama had better keep an eye on Israel. When he steals flour, he dresses in women's clothes!"

Obituary - Died, in this vicinity, on Friday the 9th inst., Mary Josephine, aged 5 years 9 months and 11 days, only daughter of Major G. W. [sic - should be G. J.I and Martha Williamson, daughter of Major C. Daniel.

Notice. There will be let to the lowest bidder, on the 1st Monday in November next, in the town of Centre, Cherokee County, Ala., the building of a Jail for said county. Also, at the same time and place, will be some town lots offered for sale, to the highest bidder.

Runaway Negro. Committed to my charge as Sheriff at Cherokee County, there being no legal jail therein, on this day a Negro slave who says his name is John and that he belongs to James Jones of Davidson Co., Tenn. About 30 years old, 5 feet 5 or 6 inches high, vry dark, slow of speech, no marks or brands perceivable. The owner will please come forward, prove his property and pay charges as the law directs, or he will be sold pursuant to the statute in such cases made and provided. Lewis Cunningham, Sheriff. Obituary - Died, in this county, on the 17th inst. after a lingering illness, Mrs. Harriet Allen, consort of Asa W. Allen, in the 46th year of her age. The deceased was born in South Carolina, but her parents moving to Georgia in her infancy, she remained there until 1835, at which time her husband emigrated to this county. As a neighbor she was kind and benevolent, as a member of the Methodist Episcopal Church which she had been for the last 17 years previous to her death, she was pious and exemplary. She has left behind an affectionate husband and a dutiful son to mourn her absence; with their sorrow is mingled the consolation that from abundant evidence given during her illness, death to her was but a transition from a scene of earthly care and affection [affliction?) to the enjoyment of that reserved for those who hold out faithful unto the end, and the anticipation of which has been her only comfort while suffering here on earth.

This issue carries the Minutes of the Tallasachatchee Baptist Association meeting held on Oct. 3, 1846. Introductory sermon delivered by Elder Urn. R. Harris. Elder Silas Wytt elected Moderator and W. Williams, Clerk. Delegates from Liberty, Cherokee County, and Bethany, Paulding, Ga., presented their letters. To arrange preachers: Brethren Taylor, Gaver, Richey, Borders, Berry. To arrange business of Association: Brethren J. M. Crook, W. N. Chandler and Whatley with the Moderator and Clerk. The committee of finance, Brethren Holcomb, Burden and White. Received from the Coosa River Association a letter and minutes by the hands of 6. L. Jenkins, her messenger, a letter and minutes from the Cherokee Baptist Association by her messenger, Bro. Wm. C. Mynatt. Appointed Messengers to the following Associations: Brother Whatley to write to the Cherokee Association. Brethren Whatley, Wilson, Chandler, Taylor and Minton, Messengers. Brother Harris to write the Coosa River Association. Brethren Harris, Borders, Kemp, Richey and Wytt, messengers. On the Sabbath, the stand was occupied by Elder Pace, Harris, Wm. C. Mynatt and S. G. Harris from the third. Union meetings were appointed in the first at Providence Friday before the second Sabbath in September 1847. Elected by ballot Bro. Wm. Wilson to preach the next introductory sermon. Bro. H. Whatley, alternate and Bro. Wm. Williams was elected to write the next circular letter, H. Whatley, alternate. Next meeting of the Association to be held at Mt. Gilead, Benton county, Ala. commencing on Saturday before the first Lord7 s day in October 1847, 9 miles north of Jacksonville. State vs Wm. Weir. In this cause, the Defendant indicted for Murder, and also for being an accessary to a Murder, postponed the trial until the next term of the Circuit Court, by swearing that his witnesses were not all present. A mere pretext to evade that retributive justice he has so well earned.

State vs J. V. Hoge. The Defendant made oath that in consequence of the Pamphlet written by us detailing the murder of Sheriff Stallings, and also of the influence of our paper, that he could not get a fair and impartial trial in this county. Trial ordered to Benton county week after next.

George Weir was indicted in two cases, one for Forgery and the other for an attack with intent to kill, and it is among the singular occurrences of this present week, that five Indictments were found against a single man whose influence was sworn to be so great that justice could not be done in the case of J. V. Hogg, one of the Hinton Murderers.

The plot thickens as we go, and by and by every body will understand as well as we do the most villainous combinations upon the face of the earth.

Well, this is a great country and no mistake. We have just returned from the City of Centre, the seat of Justice, so called by this Cherokee County, and before we left answered to the following beautiful falsehoods and figures made out by the Grand Jury, or rather by Jno. M. Hall, Mr. Turnley, and all that despicable set of scoundrels so often heralded to the world in our paper.

Indictment No. 1 - Alledged "carrying concealed weapons." Bond entered for $200.

Indictment No. 2 - Alledged attempt to murder. Bond entered for $600. Indictment No. 3 - Alledged Assault and Battery. Bond entered for $100. Indictment No. 4 - Alledged Libel published in the Cherokee Sentinel. Bond

The State vs James V. Hogg. This case for which a change of venue was granted from this county to Benton, is further postponed on account of the non-appearance of his Honor Judge Coleman. At our last Court the sureties of Hogg, surrendered him to the custody of the Sheriff who in turn, handed the delinquent over to the Sheriff of Benton County, in whose hands, or in prison he will most likely remain for the next six months. It will be remembered perhaps that Hogg with the Weirs are charged with aiding in the murder of the Sheriff of this County and it should not be forgotten that two indictments were found against George Weir at the late session of the Grand Jury, viz, one for forgery and one for shooting from behind his door at the Senior Editor of this paper. Elizabeth Farmer. When did they die - who were their parents? Their son, Andrew J. Beazley, b. c. 1835, VA; apparently d. during Civil War since his widow, Judith B., married 25 Jan 1865, Caroline Co., VA, as his second wife, George W. Gray. Andrew J. Beazley and Judith B. Wright were married c. 1855. Judith was a daughter o-f Wiley Wright and Verlinda Caroline (or Catherine) Rennolds. Andrew J. Beazley served in Co. A, 55th VA Regt., CSA.

Benjamin Overton Brooks, b. c. 1823/24/VA; d. before 1880; married 15 Jul 1850, Caroline Co., VA, Frances A. Wright, b. c. 1826/28: died before 1880, daughter of Wiley Wright and Verlinda Caroline (or Catherine) Rennolds. Verlinda C. Rennolds/Reynolds was a daughter of John Rennolds and Mary Pemberton. Need parents and siblings of Benjamin Overton Brooks and Wiley Wright.

David William Ward, b. c. 1876, WV; d. c. 1945, St. Louis, M0; married (1) c. 1895 Susan Jane demons, b. c. 1875, WV; d. 4 Mar 1915, Covington, Alleghany Co., VA; married (2) Eula Rice from King George Co., VA. David is said to have had brothers, Bradford and Tom.

The following has been received from Mr. Tommy Guice, 815 Grand Avenue, North Fort Payne, AL 35967 and was taken from Fort Payne newspaper of 8 Apr 1914: Mrs. S. W. Duff born in Green Co., 6A, 1 Jan 1838. Her maiden name was Henrietta F. Sayre. She came with her parents to Ft. Payne, AL. Married S. W. Duff 27 Jul 1859. One son, Dr. Wm. S. Duff. S. W. Duff was in Civil War. She was married 54 years, 8 months, 11 hours, dying 28 Mar 1914.

The publication will be available after 1 Dec 1988 and can be ordered from Cherokee County Library, P. 0. Box 550, Centre, AL 35960. The price will be $25.00 postpaid. A copy will be presented to the Northeast Alabama Genealogical Society, Inc. Cherokee County, Alabama marriages begin in 1882 (one earlier marriage was rerecorded). The courthouse burned in May 1882.
