WHEREAS, West Divide Water Conservanc! District (District) has incr,rredunanticipated additional expenses in the General Stored Water Enterprise Fund (GSWEF) v''hichwere unappropriated in ihe 2013 budget year, but which were necessary for the proper operation ofthe District; and

WHEREAS, unappropriated monies were and are available for the 2013 budgetyear in the form of unappropriated and unrestricted surpluses in the GSWEF from which to peLy theexpenses as required by law; and

WHEREAS, the Board of Directors wishes to adopt a supplemental appropriationto defray the expenses in excess of the amounts budgeted for the GSWEF for the 2013 caI,=,ndaryear and has duly and timely published proper notice of the proposed supplemental appropri.ationand amended budget and public hearing as required by law; and

WHEREAS, at a regular meeting on November 21,2013, the Board of Directorsheld a public hearing on the proposed supplemental appropriation and amended budget andinterested electors were given the opportunity to file or register any objections to said proposal.

NOW, THEREFORE, be it resolved by the Board of Directors of the West DivideWater Conservancy District, Colorado:

1. T'hat the sum of $266,590 is hereby authorized and is being transferredi fromunappropriated surpluses and cash reserves and appropriated to capital outlay for the 2013 budgetyear, supplementing the $133,410 prior appropriation for a total budgeted capital outlay of$400,000.

2. l'hat the amended GSWEF budget as submitted, amended and hereinsummarized, and attached hereto as Exhibit A, is approved and adopted as the amended trudgetof the District for the year stated above.

meeting. With no comment from the public, the Board of Directors proceeded toreview the proposed 2014 budgets.

A resolution summarizing expenditures and revenues for each fund and adopting abudget for the West Divide Water Conservancy District, Colorado, for the calendar year beginningon the first day of January 2014, and ending on the last day of December20l4i

WHEREAS, the Board of Directors of the West Divide Water ConservancyDistrict has hired Barnes, Pearson & Associates, LLC, to prepare and submit a proposed budgetto said governing body at the proper time; and

WHEREAS, the proposed budget was submitted to this goveming body onOctober 17,2013, for consideration; and

WHEREAS, upon due and proper notice, published and posted in accordance withthe law, said proposed budget was open for inspection by the public at the West Divide WaterConservancy District's office, 818 Taughenbaugh Blvd., #101, Rifle, Colorado; a public hearingwas held on December l2r 2013; and interested taxpayers were given the opportunity to file orregister any objections to said proposed budget; and

WHEREAS, whatever increase may have been made in the expenclitures, likeincreases were added to the revenues so that the budget remains in balance, as required by law.


l. That the budget as submitted and herein summarized by fund, hereby isapproved and adopted as the budget of the West Divide Water Conservancy District fbr the yearstated above.

2. That the budget hereby approved and adopted shall be signed by thePresident and Secretary and made a part of the public records of the West Divide WaterConservancy District.

RBSOLUTION TO SET MILL LEVIIIS

A resolution levying general properly taxes for the year 20I4,to help defray the costsof government for the West Divide Water Conservancy District, Colorado, for the 2014, budget year:

WHEREAS, the Board of Directors of the West Divide Water Conservancy Districthas adopted the annual budget in accordance with the Local Government Budget Law onDecember 12,2013; and

WHEREAS, the amount of money necessary to balance the budget for generaloperating purposes from property tax revenue is 955,477; and

WHEREAS, the 2014 valuation for assessment Ibr the West Divide Waterconservancy District as certified by the county Assessors is $1,353,1 03,270.

NOW, THEREFORE, be it resolved by the Board of Directors of the'West DivideWater Conservancy District, Colorado :

l' That for the purpose of meeting all general operating expenses of the WestDivide Water Conservancy District during the20l4 budget year, theie is heiebyievied atax of .041mills upo:n each dollar of the total valuation for assessment of all taxable proplrty within the WestDivide Water Conservancy District for the year 2074.

2- Janet Maddock is hereby authorized and directed to certif,i t6 the CountyCommissioners of Garfield, Pitkin, and Mesa counties, Colorado, the mill levies forthe West Dividewater conservancy District as hereinabove determined and set.

RESOLUTION DESIGNATING ALL YEAR-ENDFUND BALANCES AS A ''RESERVE INCREASE''

WHEREAS. the West Divide Water Conservancy District is required to prepare anannual budget;

WHEREAS, the Board of Directors of the West Divide Water Conservancy Districthas considered the provisions of Article X, Section 20, of the Colorado Constitution and hasattempted to comply with the terms thereof;

WHEREAS, the Board of Directors finds that it is appropriate to approve a resolutionsetting forth the intentions of the Board regarding such year-end fund balances for the year 2013;

NOW, THEREFORE, be it resolved by the Board of Directors of the'West DivideWater Conservancy District that any and all year-end fund balances shall be considered a "reserveincrease" and therefore a part of 2014 "fiscal year spending" within the meaning of Article X,Section 20(2)(e), of the Colorado Constitution.
