County Administrator Cordes said the award will be made but not a notice to proceed, still waiting for Norfolk Southern. Discussions were had with Chicago FTA and the federal rail commission. The board had awarded a contract prior for the construction manager but have not authorized the notice to proceed either. The county is putting all the parts needed together to meet deadlines but need the Norfolk Southern and Amtrak before anything can proceed.

WHEREAS, Section 5513.01 (B) provides the opportunity for Counties, Townships, Municipal Corporations, Conservancy Districts, Township Park Districts, Park Districts created under Chapter 1545 of the Revised Code, Port Authorities, Regional Transit Authorities, Regional Airport Authorities, Regional Water and Sewer Districts, County Transit Board, State Universities or Colleges to participate in contracts of the Ohio Department of Transportation for the purchase of machinery, material, supplies or other articles.

NOW, THEREFORE, be it ordained by the Lorain County Board of Commissioners:

Section 1. That the Lorain County Board of Commissioners hereby requests authority in the name of the Lorain County Transit to participate in the Ohio Department of Transportation contracts for the purchase of machinery, materials, supplies or other articles which the Department has entered into pursuant to Ohio Revised Code Section 5513.01 (B).

Section 2. That the Lorain County Board of Commissioners is hereby authorized to agree in the name of Lorain County Transit to be bound by all terms and conditions as the Director of Transportation prescribes.

Section 3. That the Lorain County Board of Commissioners is hereby authorized to agree in the name of Lorain County Transit to directly pay vendors, under each such contract of the Ohio Department of Transportation in which Lorain County Transit participates, for items it receives pursuant to the contract.

Section 4. That Lorain County Transit agrees to be responsible for resolving all claims or disputes arising out of its participation in the cooperative purchase program under Section 5513.01 (B) of the Ohio Revised Code. Lorain County Transit agrees to waive any claims, action, expenses, or other damages arising out of its participation in the cooperative purchasing program which Lorain County Transit may have or claim to have against ODOT or its employees, unless such liability is the result of negligence on the part of ODOT or its employees.

Don Romancak, Director – Lorain County Community Development Department introduced WSOS consultants; Don Corley and Tiffaney Shaver who will be presenting the public hearing today.

Mr. Corley said the approximate funding anticipated for the following major CDBG funds (from the DRAFT State of Ohio Program Year 2018 consolidated plan, to be finalized following the 30 day comment period after a March 8, 2018 Public Hearing in Columbus OH.)

1. Lorain County is eligible for the following Program Year 2018 Community Development programs administered by the State of Ohio, Development Services Agency, providing the County meets the applicable requirements:A. Community Development Allocation Funding Program – not eligible in PY’18. Lorain County will be eligible to apply for

two years of funding in 2019.1. Each project must meet one of these National Objectives: (a) benefit LMI persons (80% median income); (b) aid in elimination of slums or blight. Must meet the LMI criterion by one of the following:a. Having a project in a Census area that is over 51% LMI households (there are very few of these areas);b. Having a project in a neighborhood that is surveyed door-to-door, and the survey documents that over 51% of the households are LMI. c. Having a project exclusively benefit one of several types of beneficiaries, known as “limited clientele”. These sets include abused children, elderly persons, battered spouses, homeless persons, adults that are “severely disabled”, illiterate adults, persons living with AIDS, and migrant farm workers. Programs commonly provide services and facilities for the elderly, and include projects undertaken to accommodate the disabled.

2. State objectives: Improved housing for LMI, construction and improvement of public facilities and infrastructure in communities with LMI concentration; create and retain permanent private sector job opportunities, principally for persons of LMI, through expansion and retention of business and industry; assist communities in alleviation of threats to public health or welfare requiring immediate resolution; assist in revitalization of Central Business Districts; assist communities in their compliance with federal laws to affirmatively further fair housing; and assist in the development of local micro-enterprise businesses.

3. Funding for program year 2018: Approximate Allocation to County – NA

B. Community Housing Impact & Preservation Program (CHIP):The County intends to request funds from CHIP, which includes HOME and CDBG funding. Under the current CHIP, the State of Ohio is encouraging cities and counties to partner on CHIP applications. Lorain County is eligible for up to $400,000 of 2018 CHIP Program funding. Lorain County is eligible to partner with the City of Sheffield Lake and the City of Oberlin in PY’18 to apply for CHIP funds. Together, the three jurisdictions are eligible for up to $1,000,000.Lorain County and the two cities are discussing a PY 2018 agreement to partner, with the County to serve as lead applicant and grantee. A second public hearing will be held to cover the details of the CHIP application. Specific activities and funding requests will be based on recommendations from the results of the Housing Needs Assessment that is in the process of gathering information from local stakeholders.CHIP eligible activities include financing residential rehabilitation or repairs for low and moderate income homeowners, rehab and repair loans for rental properties where tenants are low and moderated income, homeownership assistance including financial support for new construction in partnership with Habitat for humanity, and tenant rental assistance. CHIP is a competitive grant program - not all applicants will receive funds.

C. Downtown Revitalization ProgramNot eligible in PY’18. Lorain County will be eligible to apply for funding in 2019.Eligible activities include, but are not limited to: uniform façade improvements; interior and exterior building code violation corrections; ancillary streetscape activities; administrative costs directly related to the downtown program; and architectural and engineering work related to specific revitalization activities.

The Downtown Revitalization program is designed primarily to improve the quality of privately owned buildings in the Central Business District. A maximum of 30 percent of CDBG grant funds, exclusive of administration, will be eligible for infrastructure activities. These activities must be stand-alone projects separate of projects overseen by other public entities such as ODOT, OPWC, etc.Residential development, non-building-related private improvements (e.g. parking facilities, landscaping), and other investments undertaken in the downtown area during the CDBG project period can be counted as leverage or coordination. However, CDBG funds cannot be used to pay for these activities, unless an OCD grants a waiver during the grant period. (up to $300,000).

D. Neighborhood Revitalization ProgramNot eligible in PY’18. Lorain County will be eligible to apply for funding in 2019Eligible activities include public facilities improvements such as constructing, reconstructing, and/or rehabilitating infrastructure in targeted areas of distress that do not fit within the criteria of other Ohio State CDBG competitive programs. At a minimum, Neighborhood Revitalization program applications must include three activities, exclusive of administration. Demolition/Clearance activities are capped at $100,000 or 25 percent of the project request, exclusive of administration. (up to $500,000)

E. Critical Infrastructure The County is eligible to apply for up to $300,000 – designed to fund public infrastructure improvements with a significant community impact. Eligible Applicants: PY 2018 and PY 2019 Community Development Program Counties and Direct Cities. Counties may apply on behalf of non-direct cities, villages, and unincorporated areas.The Critical Infrastructure Program was created to assist communities with funding for high priority, single-component, projects, such as roads, flood and drainage, and other public facilities projects with high community-wide impact and that benefit primarily residential areas.Eligible activities include constructing, reconstructing or rehabilitating infrastructure components. Eligible infrastructure components include streets and bridges; sidewalks; flood and drainage; water and sanitary sewer; and fire protection facilities. Applicants must submit a map of the proposed service area indicating the proposed infrastructure project’s boundaries and location. Applicants are expected to explain how the service area and project beneficiaries were determined. Communities will be required to complete an Infrastructure Condition Certification to catalog the targeted infrastructure’s existing condition, and the degree to which the proposed Critical Infrastructure program will improve the identified conditions.Communities must qualify activities under the HUD Ohio State Administered CDBG program national objectives of low- and moderate-income (LMI) area-wide benefit or the prevention/elimination of slum or blight.Application Timing: Submission: Open cycle begin 6/15/18, reviewed quarterly

F. Economic Development Loan and Public Infrastructure Grant Program Total Funds: Approximately $10 million in CDBG funds will be made available.The County is eligible to apply. The county must apply on behalf of villages and townships. The county may apply on behalf of cities within its jurisdiction.Eligible applicants may submit applications for one or more of the following categories of funding: Residential Public Infrastructure Program, Economic Development Public Infrastructure Program, and/or Economic Development Loan Program.Local Program Benefit/National Objective: Communities must qualify activities under the HUD Ohio State CDBG program national objective of low- and moderate-income benefit.Economic Development and Public Infrastructure: up to $500,000 – grants and loans designed to improve infrastructure directly and primarily related to creating, expanding or retaining a business in the community.Residential Public Infrastructure: up to $600,000 - designed to create safe and reliable drinking water and properly disposed of sanitary waste.Application Timing: Submission: Continuous starting July 1

G. Target of Opportunity Program The County is eligible to apply.Up to an amount to be determined - designed to provide a means to fund worthwhile "targets of opportunity" projects and activities that do not fit within existing program structures and to provide supplemental resources to resolve immediate and unforeseen needs.

Application Timing: Submission: On-going July 1 – March 31, until committedH. New Horizons Fair Housing Assistance

The county is eligible to apply for up to $15,000 alone, with an additional $5,000 per jurisdiction in a consortium up to a maximum of $30,000. The program offers funds for communities to affirmatively further fair housing and eliminate impediments to fair housing, actions to remedy or mitigate conditions limiting fair housing choice. Proposed activities should exceed standard fair housing requirements.Application Timing: Submission: On-going July 1 – March 31. 1/3 awarded each 3-month cycle

BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby enter into an Agreement with GT Environmental, Inc., Westerville in amount of lump sum of $8,000.00 per month/50 hours. If hours exceed 50 cost will be an additional $145/hour to provide technical assistance to the Lorain County Collection Center.

FURTHER BE IT RESOLVED, this is temporary technical assistance at the collection center and is considered a part hereof to this resolution by reference thereto and can be found on file in the Commissioners/Purchasing/Solid Waste Office.

BE IT FURTHER RESOLVED, we hereby authorize said payment within said agreement to be paid from Acct. #prof serv for the following, but not limited too;

Prepare loads for shipping to the HHW contractor and other vendors as needed; Ordering necessary supplies for the Collection Center operations; Supervising Collection Center or District staff to schedule paper shred truck activities and baling; Ensure any maintenance activities are completed as necessary; Work with District administration to review schedules that are to be prepared by administrative staff or Lorain County Collection
