3. Facility description   

The East Central Solid Waste Commission (Facility) is located at 1765 180th Ave in Mora, MN, Kanabec County, Minnesota.  The stationary source for this permit consists of a landfill and associated operations run under East Central Solid Waste Commission (ECSWC) and a landfill gas (LFG) generator owned and operated by Southern Minnesota Municipal Power Agency (SMMPA). For purposes of major source determination under federal New Source Review (NSR), National Emission Standards for Hazardous Air Pollutants (NESHAP), or Part 70 operating permit regulations, the combined emissions from both facilities must be considered. For future modifications, the two facilities must be considered one source and their respective emissions will be combined when determining if the modification is subject to NSR. SMMPA and ECSWC will be issued separate permits, Air Emission Permit Nos. 06500032‐003 and 06500033‐002, respectively. Since the combined emissions of ECSWC and SMMPA exceed 100 tons per year of carbon monoxide, the stationary source is a major source under Part 70 and both facilities must have Part 70 operating permits.     The ECSWC landfill accepts municipal solid waste (MSW) and landfills it in accordance with their solid waste permit. They operate a gas collection system that typically routes the gas to SMMPA's onsite generator. In the event that the generator is shutdown, the landfill gas is sent to a flare to be destroyed.      SMMPA purchases the landfill gas from ECSWC and operates the onsite LFG generator and associated equipment. This generator provides power to the local power grid in Mora, MN.

  5.1.1    Permit Appendices: This permit contains appendices as listed in the permit Table of Contents. The Permittee shall comply with all requirements contained in Appendices A, B, and C. [Minn. R. 7007.0800, subp. 2]

  5.1.3    PERMIT SHIELD: Subject to the limitations in Minn. R. 7007.1800, compliance with the conditions of this permit shall be deemed compliance with the specific provision of the applicable requirement identified in the permit as the basis of each condition. Subject to the limitations of Minn. R. 7007.1800 and 7017.0100, subp. 2, notwithstanding the conditions of this permit specifying compliance practices for applicable requirements, any person (including the Permittee) may also use other credible evidence to establish compliance or noncompliance with applicable requirements.  This permit shall not alter or affect the liability of the Permittee for any violation of applicable requirements prior to or at the time of permit issuance. [Minn. R. 7007.1800, (A)(2)]

  5.1.5    Circumvention: Do not install or use a device or means that conceals or dilutes emissions, which would otherwise violate a federal or state air pollution control rule, without reducing the total amount of pollutant emitted. [Minn. R. 7011.0020]

  5.1.8    Operation Changes: In any shutdown, breakdown, or deviation the Permittee shall immediately take all practical steps to modify operations to reduce the emission of any regulated air pollutant. The Commissioner may require feasible and practical modifications in the operation to reduce emissions of air pollutants. No emissions units that have an unreasonable shutdown or breakdown frequency of process or control equipment shall be permitted to operate. [Minn. R. 7019.1000, subp. 4] 

  5.1.9    Fugitive Emissions: Do not cause or permit the handling, use, transporting, or storage of any material in a manner which may allow avoidable amounts of particulate matter to become airborne. Comply with all other requirements listed in Minn. R. 7011.0150. [Minn. R. 7011.0150] 

  5.1.10    Noise: The Permittee shall comply with the noise standards set forth in Minn. R. 7030.0010 to 7030.0080 at all times during the operation of any emission units. This is a state only requirement and is not enforceable by the EPA Administrator or citizens under the Clean Air Act. [Minn. R. 7030.0010‐7030.0080] 

  5.1.11    Inspections: The Permittee shall comply with the inspection procedures and requirements as found in Minn. R. 7007.0800, subp. 9(A). [Minn. R. 7007.0800, subp. 9(A)]

  5.1.15  

  Limits set as a result of a performance test (conducted before or after permit issuance) apply until superseded as stated in the MPCA's Notice of Compliance letter granting preliminary approval. Preliminary approval is based on formal review of a subsequent performance test on the same unit as specified by Minn. R. 7017.2025, subp. 3. The limit is final upon issuance of a permit amendment incorporating the change. [Minn. R. 7017.2025, subp. 3] 

  5.1.16    Monitoring Equipment Calibration ‐ The Permittee shall either:  1. Calibrate or replace required monitoring equipment every 12 months; or 2. Calibrate at the frequency stated in the  manufacturer's specifications.  For each monitor, the Permittee shall maintain a record of all calibrations, including the date conducted, and any corrective action that resulted. The Permittee shall include the calibration frequencies, procedures, and manufacturer's specifications (if applicable) in the Operations and Maintenance Plan. Any requirements applying to continuous emission monitors are listed separately in this permit. [Minn. R. 7007.0800, subp. 4(D)] 

  5.1.17    Operation of Monitoring Equipment: Unless noted elsewhere in this permit, monitoring a process or control equipment connected to that process is not necessary during periods when the process is shutdown, or during checks of the monitoring systems, such as calibration checks and zero and span adjustments. If monitoring records are required, they should reflect any such periods of process shutdown or checks of the monitoring system. [Minn. R. 7007.0800, subp. 4(D)] 

  5.1.18    Recordkeeping: Retain all records at the stationary source, unless otherwise specified within this permit, for a period of five (5) years from the date of monitoring, sample, measurement, or report. Records which must be retained at this location include all calibration and maintenance records, all original recordings for continuous monitoring instrumentation, and copies of all reports required by the permit. Records must conform to the requirements listed in Minn. R. 7007.0800, subp. 5(A). [Minn. R. 7007.0800, subp. 5(C)]

  5.1.20    If the Permittee determines that no permit amendment or notification is required prior to making a change, the Permittee must retain records of all calculations required under Minn. R. 7007.1200. For expiring permits, these records shall be kept for a period of five years from the date the change was made or until permit reissuance, whichever is longer. The records shall be kept at the stationary source for the current calendar year of operation and may be kept at the stationary source or office of the stationary source for all other years. The records may be maintained in either electronic or paper format. [Minn. R. 7007.1200, subp. 4] 

  5.1.21    Shutdown Notifications: Notify the Commissioner at least 24 hours in advance of a planned shutdown of any control equipment or process equipment if the shutdown would cause any increase in the emissions of any regulated air pollutant. If the owner or operator does not have advance knowledge of the shutdown, notification shall be made to the Commissioner as soon as possible after the shutdown. However, notification is not required in the circumstances outlined in Items A, B and C of Minn. R. 7019.1000, subp. 3.  At the time of notification, the owner or operator shall inform the Commissioner of the cause of the shutdown and the estimated duration. The owner or operator shall notify the Commissioner when the shutdown is over. [Minn. R. 7019.1000, subp. 3] 

  5.1.22    Breakdown Notifications: Notify the Commissioner within 24 hours of a breakdown of more than one hour duration of any control equipment or process equipment if the breakdown causes any increase in the emissions of any regulated air pollutant. The 24‐hour time period starts when the breakdown was discovered or reasonably should have been discovered by the owner or operator. However, notification is not required in the circumstances outlined in Items A, B and C of Minn. R. 7019.1000, subp. 2.  At the time of notification or as soon as possible thereafter, the owner or operator shall inform the Commissioner of the cause of the breakdown and the estimated duration. The owner or operator shall notify the Commissioner when the breakdown is over. [Minn. R. 7019.1000, subp. 2] 

  5.1.23    Notification of Deviations Endangering Human Health or the Environment: As soon as possible after discovery, notify the Commissioner or the state duty officer, either orally or by

  5.1.24    Notification of Deviations Endangering Human Health or the Environment Report: Within 2 working days of discovery, notify the Commissioner in writing of any deviation from permit conditions which could endanger human health or the environment. Include the following information in this written description:  1. the cause of the deviation;  2. the exact dates of the period of the deviation, if the deviation has been corrected; 3. whether or not the deviation has been corrected;  4. the anticipated time by which the deviation is expected to be corrected, if not yet corrected; and  5. steps taken or planned to reduce, eliminate, and prevent reoccurrence of the deviation. [Minn. R. 7019.1000, subp. 1] 

  5.1.25    Application for Permit Amendment: If a permit amendment is needed, submit an application in accordance with the requirements of Minn. R. 7007.1150 through Minn. R. 7007.1500. Submittal dates vary, depending on the type of amendment needed.  Upon adoption of a new or amended federal applicable requirement, and if there are more than 3 years remaining in the permit term, the Permittee shall file an application for an amendment within nine months of promulgation of the applicable requirement, pursuant to Minn. R. 7007.0400, subp. 3. [Minn. R. 7007.0400, subp. 3, Minn. R. 7007.1150 ‐ 7007.1500] 

  5.1.26    Extension Requests: The Permittee may apply for an Administrative Amendment to extend a deadline in a permit by no more than 120 days, provided the proposed deadline extension meets the requirements of Minn. R. 7007.1400, subp. 1(H). Performance testing deadlines from the General Provisions of 40 CFR pt. 60 and pt. 63 are examples of deadlines for which the MPCA does not have authority to grant extensions and therefore do not meet the requirements of Minn. R. 7007.1400, subp. 1(H). [Minn. R. 7007.1400, subp. 1(H)] 

  5.1.27    Emission Inventory Report: due on or before April 1 of each calendar year following permit issuance, to be submitted on a form approved by the Commissioner. [Minn. R. 7019.3000‐7019.3100]

Subject Item  Sec.SI.Reqt  SI des:SI desc  Requirement & Citation landfill gas collection system and control system. The Permittee will operate this system on a continuous basis. The system will be operated and maintained in a manner that will not exceed emission levels described in the permit application and the air emission risk assessment. Collected landfill gas will be destroyed primarily by an onsite engine owned and operated by Southern Minnesota Municipal Power Agency or the Permittee's flare. [Minn. R. 7007.0800, subps. 1, 2, & 4, Minn. Stat. 116.07, subds. 4a & 9] 

  5.2.2    NMOC Tier 1 Calculations   The Permittee shall calculate the NMOC emission rate using either the equation provided in 40 CFR 60.754(a)(1)(i) or (ii). Both equations may be used if the actual year‐to‐year solid waste acceptance rate is known for part of the life of the landfill and the actual year‐to‐year solid waste acceptance rate is unknown for part of the life of the landfill. The values to be used in both equations are 0.05 per year for k, 170 cubic meters per megagram for Lo, and 4,000 parts per million by volume as hexane for the CNMOC. For landfills located in geographical areas with a thirty year annual average precipitation of less than 25 inches, as measured at the nearest representative official meteorological site, the k value to be used is 0.02 per year.   If the NMOC emission rate calculated using the Tier 1 method is less than 50 megagrams per year, then the Permittee shall submit an annual emission rate report as provided in 40 CFR 60.757(b)(1) and shall recalculate the NMOC mass emission rate annually as required under 40 CFR 60.752(b)(1) until such time as the calculated NMOC emission rate is equal to or greater than 50 megagrams per year, or the landfill closes.   If the calculated NMOC emission rate is equal to or greater than 50 megagrams per year, then the Permittee shall either comply with 40 CFR 60.752(b)(2) and 40 CFR pt. 63 subp. AAAA, or determine a site‐specific NMOC concentration and recalculate the NMOC emission rate using the procedures provided in 40 CFR 60.754(a)(3). [40 CFR 60.752(b), 40 CFR 60.754(a)(1), Minn. R. 7011.3510] 

  5.2.3    NMOC Tier 2 Calculations   (Only required if NMOC calculations under Tier 1 yield NMOC emissions of 50 Mg or greater and the Permittee does not have a compliant collection system.)   The Permittee shall determine the NMOC concentration using the following sampling procedure. The Permittee shall install at least two sample probes per hectare of landfill surface that

Subject Item  Sec.SI.Reqt  SI des:SI desc  Requirement & Citation has retained waste for at least two years. If the landfill is larger than 25 hectares in area, only 50 samples are required. The sample probes should be located to avoid known areas of nondegradable solid waste. The Permittee shall collect and analyze one sample of landfill gas from each probe to determine NMOC concentration using Method 25 or 25C of appendix A of 40 CFR pt. 60. Method 18 of appendix A of 40 CFR pt. 60 may be used to analyze the samples collected by the Method 25 or 25C sampling procedure. Taking composite samples from different probes into a single cylinder is allowed; however, equal sampling volumes must be taken from each probe. For each composite, the sampling rate, collection times, beginning and ending cylinder volumes, or alternative volume measurements must be recorded to verify that composite volumes are equal. Composite sample volumes should not be less than one liter unless evidence can be provided to substantiate that accuracy of smaller volumes. Terminate compositing before the cylinder approaches ambient pressure where measurement accuracy diminishes.    If using Method 18, the Permittee must identify all compounds in the sample and, as a minimum, test for those compounds published in the most recent Compilation of Air Pollutant Emission Factors (AP‐42), minus carbon monoxide, hydrogen sulfide, and mercury. As a minimum, the instrument must be calibrated for each of the compounds on the list. Convert the concentration of each Method 18 compound to CNMOC as hexane by multiplying by the ratio of its carbon atoms divided by six. If more than the required number of samples is taken, all samples must be used in the analysis. The Permittee must divide the NMOC concentration from Method 25 or 25C of appendix A of 40 CFR pt. 60 by six to convert from CNMOC as carbon to CNMOC as hexane.    If the landfill has an active or passive gas removal system in place, Method 25 or 25C samples may be collected from these systems instead of surface probes provided the removal system can be shown to provide sampling as representative as the two sampling probe per hectare requirement.  For active collection systems, samples may be collected from the common header pipe before the gas moving or condensate removal equipment. For these systems, a minimum of three samples must be collected from the header pipe.    The Permittee shall recalculate the NMOC mass emission rate using the equations provided in 40 CFR 60.754(a)(1)(i) or (ii) and using the average NMOC concentration from the collected samples instead of the default value provided in 40 CFR 60.754(a)(1).

  5.2.4    NMOC Tier 3 Calculations   The site‐specific methane generation rate constant shall be determined using the procedures provided in Method 2E of appendix A of 40 CFR pt. 60. The Permittee shall estimate the NMOC mass emission rate using the equation in 40 CFR 60.754(a)(1)(i) or (ii) and using a site‐specific methane generation rate constant k, and the site‐specific NMOC concentration as determined in 40 CFR 60.754(a)(3). The Permittee shall compare the resulting NMOC mass emission rate to the standard of 50 megagrams per year.    If the NMOC mass emission rate is less than 50 megagrams per year, then the Permittee shall submit a periodic emission rate report as provided in 40 CFR 60.757(b) (1) and shall recalculate the NMOC emission rate annually, as provided in 40 CFR 60.757(b)(1) using the equations in 40 CFR 60.754(a)(1) and using the site‐specific methane generation rate constant and NMOC concentration obtained in 40 CFR 60.754(a)(3). The calculation of the methane generation rate constant is performed only once, and the value obtained from this test shall be used in all subsequent annual NMOC emission rate calculations.   If the NMOC mass emission rate as calculated using the site‐specific methane generation rate and concentration of NMOC is equal to or greater than 50 megagrams per year, the Permittee shall comply with 40 CFR 60.752(b)(2) and 40 CFR pt. 63 subp. AAAA. [40 CFR 60.752(b), 40 CFR 60.754(a)(4), Minn. R. 7011.3510]

  5.2.7    The Permittee shall submit a closure report to the Administrator within 30 days of waste acceptance cessation at the controlled landfill. The Administrator may request additional information as may be necessary to verify that permanent closure has taken place in accordance with the requirements of 40 CFR 258.60. If a closure report has been submitted to the Administrator, no additional wastes may be placed into the landfill without filing a notification of modification as described under 40 CFR 60.7(a)(4). [40 CFR 60.757(d), Minn. R. 7011.3500] 

  5.2.8    Requirements of 40 CFR pt. 61 subp. M  Either there must be no visible emission to the outside air from any active waste disposal site where asbestos‐containing waste material has been deposited.   OR   At the end of each operating day, or at least once every 24‐hour period while the site is in continuous operation, the asbestos‐containing waste material that has been deposited at the site during the operating day or previous 24‐hour period shall:   ‐ Be covered with at least 15 centimeters (6 inches) of compacted nonasbestos‐containing material, or  ‐ Be covered with a resinous or petroleum‐based dust suppression agent that effectively binds dust and controls wind erosion. The agent shall be used in the manner and frequency recommended by the dust suppression agent manufacturer. Other dust suppression agents may be used upon prior approval. Used, spent, or other waste oil is not considered a dust suppression agent. [40 CFR 61.154(a), Minn. R. 7011.9920]

  5.2.10    For all asbestos‐containing waste material received, the owner or operator of the active waste disposal site shall:   (1) Maintain waste shipment records, using a form similar to that shown in Figure 4 of 40 CFR pt. 61, subp. M, and include the following information:   (i) The name, address, and telephone number of the waste generator.  (ii) The name, address, and telephone number of the transporter(s).  (iii) The quantity of the asbestos‐containing waste material in cubic meters or cubic yards.

Subject Item  Sec.SI.Reqt  SI des:SI desc  Requirement & Citation (iv) The presence of improperly enclosed or uncovered waste, or any asbestos‐containing waste material not sealed in leak‐tight containers. Report in writing to the local, State, or EPA Regional office responsible for administering the asbestos NESHAP program for the waste generator (identified in the waste shipment record), and, if different, the local, State, or EPA Regional office responsible for administrating the asbestos NESHAP program for the disposal site, by the following working day, the presence of a significant amount of improperly enclosed or uncovered waste. Submit a copy of the waste shipment record along with the report.  (v) The date of the receipt.   (2) As soon as possible and no longer than 30 days after the receipt of the waste, send a copy of the signed waste shipment record to the waste generator.    (3) Upon discovering a discrepancy between the quantity of waste designated on the waste shipment records and the quantity actually received, attempt to reconcile the discrepancy with the waste generator. If the discrepancy is not resolved within 15 days after receiving the waste, immediately report in writing to the local, State, or EPA Regional office responsible for administering the asbestos NESHAP program for the waste generator (identified in the waste ship record), and, if different, the local, State, and EPA Regional office responsible for administering the asbestos NESHAP program for the disposal site. Describe the discrepancy and attempts to reconcile it, and submit a copy of the waste shipment record along with the report.     (4) Retain a copy of all records and reports required by this paragraph for at least two years. [40 CFR 61.154(e), Minn. R. 7011.9920] 

  5.2.11    Maintain, until closure, records of the location, depth and area, and quantity in cubic meters or cubic yards of asbestos‐containing waste material within the disposal site on a map or diagram of the disposal area. [40 CFR 61.154(f), Minn. R. 7011.9920] 

  5.2.12    Furnish upon request, and make available during normal business hours for inspection by the Administrator, all records required under 40 CFR 61.154. [40 CFR 61.154(i), Minn. R. 7011.9920] 

  5.2.13    Notify the Administrator in writing at least 45 days prior to excavating or otherwise disturbing any asbestos‐containing waste material that has been deposited at a waste disposal site and is covered. If the excavation will begin on a date other than the one contained in the original notice, notice of the

       TREA 01  EU001  Flare     5.3.1    The operation of this piece of control equipment is not 

necessary in order for the process to meet applicable emissions limits. However, the Permittee wishes to take credit for its operation for the purposes of reporting actual emissions for emission inventory. Therefore, in order for the VOC to be considered controlled for the purposes of emissions inventory, the flare must comply with the requirements of this permit during the time credit for control is taken. The VOC used during that time shall be considered controlled, and the control efficiency used is the limit given in this permit. (Equipment used to comply with Minn. R. 7019.3020 (G)). [Minn. Stat. 116.07, subd. 4a] 

  5.3.2    The Permittee shall vent emissions from the landfill, EQUI 01, to either the onsite SMMPA generator or the flare, TREA 01, whenever EQUI 01 operates, and operate and maintain TREA 01 at all times that any emissions are vented to TREA 01. The Permittee shall document periods of non‐operation of the control equipment. [Title I Condition: Avoid major source under 40 CFR 52.21(b)(1)(i) and Minn. R. 7007.3000] 

  5.3.3    The Permittee shall operate and maintain control equipment such that it achieves an overall control efficiency for Volatile Organic Compounds >= 97.7 percent control efficiency. [Title I Condition: Avoid major source under 40 CFR 52.21(b)(1)(i) and Minn. R. 7007.3000] 

  5.3.4    The flare must be designed for and operated with no visible emissions except for a period not to exceed a total of 5 minutes during any 2 consecutive hours. [Minn. R. 7007.0800, subp. 14, Title I Condition: Avoid major source under 40 CFR

  5.3.6    At all times, including periods of startup, shutdown, and malfunction, the Permittee shall maintain and operate the flare in a manner consistent with good air pollution control practice for minimizing emissions. Determination of whether acceptable operating and maintenance procedures are being used shall be based on available information which may include, but is not limited to monitoring results, opacity observations, review of operating and maintenance procedures, and inspection of the source. [Minn. R. 7007.0800, subp. 14, Minn. R. 7007.0800, subp. 2] 

  5.3.7    Monitoring Equipment: The Permittee shall install and maintain thermocouples to conduct temperature monitoring required by this permit. The monitoring equipment must be installed, in use, and properly maintained whenever operation of the monitored control equipment is required. [Minn. R. 7007.0800, subp. 4, Minn. R. 7007.0800, subps. 4‐5] 

  5.3.8    Daily Monitoring: The Permittee shall physically verify the operation of the temperature recording device at least once each operating day to verify that it is working and recording properly. The Permittee shall maintain a written record of the daily verifications. [Minn. R. 7007.0800, subps. 4‐5, Title I Condition: Avoid major source under 40 CFR 52.21(b)(1)(i) and Minn. R. 7007.3000] 

  5.3.9    Visible Emissions: The Permittee shall check the flare for any visible emissions once each day during daylight hours while the flare is operating. The Permittee shall determine the presence of visible emissions using Reference Method 22 when requested by the Commissioner. [Minn. R. 7007.0800, subp. 14, Minn. R. 7007.0800, subp. 2, Minn. R. 7007.0800, subp. 4, Minn. R. 7017.2020, subp. 1] 

  5.3.10    Annual Calibration: The Permittee shall calibrate the temperature monitor at least once every 12 months and shall maintain a written record of the calibration and any action resulting from the calibration. [Minn. R. 7007.0800, subp. 14, Minn. R. 7007.0800, subp. 4, Minn. R. 7007.0800, subp. 5]

  5.3.13    Corrective Actions: If visible emissions are observed, the presence of a flame is not detected, or the flare or any of its components are found during the inspections to need repair, the Permittee shall take corrective action as soon as possible. Corrective actions shall return the flame presence, eliminate visible emissions, and/or include completion of necessary repairs identified during the inspection, as applicable. Corrective actions include, but are not limited to, those outlined in the O & M Plan for the flare. The Permittee shall keep a record of the type and date of any corrective action taken for the flare. [Minn. R. 7007.0800, subp. 14, Minn. R. 7007.0800, subp. 4, Minn. R. 7007.0800, subp. 5] 

6. Submittal/action requirements  

This section lists most of the submittals required by this permit. Please note that some submittal requirements may appear in the Limits and Other Requirements section, or, if applicable, within a Compliance Schedule section.

Subject Item  Sec.SI.Reqt  SI des:SI desc  Requirement & Citation every 5 years.   The report shall contain an annual or a 5‐year estimate of the NMOC emission rate calculated using the formulas and Tier procedures described above.    If the estimated NMOC emission rate as reported in the annual report to the Administrator is less than 50 megagrams per year in each of the next consecutive years, the Permittee may elect to submit an estimate of the NMOC emission rate for the next 5‐year period in lieu of the annual report.     This estimate shall include the current amount of solid waste‐in‐place and the estimated waste acceptance rate for each year of the 5 years for which an NMOC emission rate is estimated. All data and calculations upon which this estimate is based shall be provided. This estimate shall be revised at least once every 5 years. If the actual waste acceptance rate exceeds the estimated waste acceptance rate in any year reported in the 5‐year estimate, a revised 5‐year estimate shall be submitted. The revised estimate shall cover the 5‐year period beginning with the year in which the actual waste acceptance rate exceeded the estimated waste acceptance rate.    The NMOC emission rate report shall include all the data, calculations, sample reports, and measurements used to estimate the annual or 5 year emissions. [40 CFR 60.757(b), Minn. R. 7011.3510]
