PREAMBLE

Chapter 1. The Fundamentals of the Constitutional System

Article 1 1. The Donetsk People's Republic is an independent sovereign democratic law-governed state. 2. If the consent of the federative state is expressed in response to the appeal of the Donetsk People's Republic on the admission of the Donetsk People's Republic into its federal state, the Donetsk People's Republic automatically becomes a part of the federal state (hereinafter referred to as the federative state) as its individual subject. 3. The pre-joining of the Donetsk People's Republic to a federal state in accordance with paragraph 1 of this article, the Donetsk People's Republic has all the full power of state power. 4. The territory of the Donetsk People's Republic is unified and indivisible, and in the case of the accession of the Donetsk People's Republic to the federal state, the territory of the Donetsk People's Republic is an integral part of the territory of the federal state.

Article 2 1. The source of power in the Donetsk People's Republic is its people. 2. The people exercise their power directly, as well as through state bodies and local self-government bodies. 3. The highest direct expression of the power of the people is the referendum and free elections. 4. Assignment of power or seizure of power is unacceptable and punishable by law.

Article 3 Man, his rights and freedoms are the highest value. Their recognition, observance, respect and protection are the responsibility of the Donetsk People's Republic, its state bodies and officials and are guaranteed from the moment of conception of a person.

Article 4 1. The Donetsk People's Republic is a social state. 2. Social policy of the Donetsk People's Republic is aimed at creating conditions that ensure a dignified life and free development of a person, people's welfare, accessibility of the basic material and spiritual fields, on the basis of understanding traditional religious, social, cultural and moral values. 3. The labor and health of people are protected in the Donetsk People's Republic, the state support of the traditional family is provided as a union of men and women, motherhood, paternity and childhood, invalids and elderly citizens registered in accordance with the law, a system of social services is developed, and social protection guarantees are established.

Article 5 1. In the Donetsk People's Republic are recognized and equally protected private, state, municipal and other forms of ownership. 2. Land and other natural resources are used and protected in the Donetsk People's Republic as the basis for the life and activities of peoples living on its territory, and in the case of the joining of the Donetsk People's Republic to a federal state as the basis of life and activities of peoples living on the territory of a federal state. 3. Article 6 1. State power in the Donetsk People's Republic is carried out on the basis of a division into legislative, executive and judicial. Legislative, executive and judicial authorities are independent.

2. The Supreme Council of the Donetsk People's Republic - the Parliament of the Democratic People's Republic of Lithuania, the Council of Ministers of the Donetsk People's Republic - the Government of the Democratic People's Republic of Lithuania and the Security Council of the Donetsk People's Republic, formed in accordance with this Constitution, exercise power in the Donetsk People's Republic. 3. The system of public authorities of the Donetsk People's Republic is established by the Donetsk People's Republic independently in accordance with this Constitution, and in the case of the accession of the Donetsk People's Republic to a federal state in accordance with the foundations of the constitutional structure of the federal state and the general principles of the organization of legislative (representative) and executive organs of state power of subjects of the federal state, providedfederal lawfederal of the state. 4. The bodies of state power of the Donetsk People's Republic, while exercising their powers and performing their duties, respect the traditional religious, social, cultural and moral values of the Russian World.

Article 7 1. The Donetsk People's Republic has its own Constitution and legislation operating throughout the territory of the Donetsk People's Republic. 2. Laws of the Donetsk People's Republic are subject to official publication. Unpublished laws are not applied. Normative-legal acts of the Donetsk People's Republic, affecting the rights, freedoms and duties of a person and citizen, can not be applied if they are not published for general information. 3. In case of the accession of the Donetsk People's Republic to a federal state, the bodies of state power of the Donetsk People's Republic, local self-government bodies established in the territory of the Donetsk People's Republic, officials, citizens and their associations are obliged to observe the Constitution of the federal state, laws and other regulatory legal acts of the federal state, the Constitution The Donetsk People's Republic, laws and other regulations of the Donetsk People's Republic.

Article 8 In the Donetsk People's Republic local self-government is recognized and guaranteed. Local self-government is within its powers independently. Local government bodies are not part of the system of state government.

Article 9 1. The Donetsk People's Republic recognizes ideological and political diversity, a multi-party system. 2. In the Donetsk People's Republic, the Orthodox faith (Faith Christian Orthodox Catholic of Eastern Confession), professed by the Russian Orthodox Church (Moscow Patriarchate), is the predominant and dominant faith. 3. Historical experience and the role of Orthodoxy of the Russian Orthodox Church (Moscow Patriarchate) are recognized and respected, including as system-forming pillars of the Russian World.

Article 10 1. The state languages of the Donetsk People's Republic are Russian and Ukrainian. 2. The status of the state languages of the Donetsk People's Republic shall be established by legislation. 3. The principle of the diversity of cultures is recognized in the Donetsk People's Republic, their equal development and mutual enrichment is ensured.

Article 11 1. The provisions of this chapter of the Constitution form the basis of the constitutional system of the Donetsk People's Republic.

2. No other provisions of this Constitution can contradict the foundations of the constitutional order of the Donetsk People's Republic.

Chapter 2. PROTECTION OF HUMAN AND CITIZEN RIGHTS AND FREEDOMS

Article 12 1. The rights and freedoms of a person and a citizen are recognized and guaranteed in the Donetsk People's Republic in accordance with generally recognized principles and norms of international law and in accordance with the Constitution of the Donetsk People's Republic, and in case of joining the Donetsk People's Republic to a federal state, also in accordance with the Constitution of the federal state. 2. Fundamental human rights and freedoms are inalienable and belonging to each person from the moment of conception. 3. Rights and freedoms of man and citizen are immediate. They determine the meaning, content and application of laws, the activities of the legislative and executive authorities, local self-government and are provided with justice. 4. The exercise of the rights and freedoms of man and citizen shall not violate the rights and freedoms of others.

Article 13 1. Everyone is equal before the law and the court. 2. The state guarantees equality of rights and freedoms of a person and citizen regardless of gender, race, nationality, language, origin, property and official status, residence, attitude to religion, beliefs, membership of public associations, and other circumstances. Any forms of restriction of the rights of citizens on grounds of social, racial, national, linguistic or religious affiliation are prohibited. 3. A man and a woman have equal rights and freedoms and equal opportunities for their implementation.

Article 14 1. Everyone has the right to life. 2. The right to necessary defense, that is, the protection of the individual and the rights of the defending or other persons protected by law, the interests of society or the state against socially dangerous assault, if this encroachment is connected or can be obviously connected, based on the criteria of reasonableness in determining this evidence, , dangerous for the life or health of the defending or other person, or with an immediate threat of such violence, is recognized and guaranteed by the state. 2. The dignity of the individual is protected by the state. Nothing can be a basis for its belittling. 3. No one shall be subjected to torture, violence, other cruel or degrading treatment or punishment. Nobody can be subjected to medical, scientific and other experiments without voluntary consent.

Article 15 1. Everyone has the right to freedom and personal inviolability. 2. Arrest, detention and custody shall be allowed only by judicial decision. Until a court decision, a person can not be detained for more than 48 hours.

Article 16 1. Everyone has the right to inviolability of private life, personal and family secrets, protection of his honor and good name. 2. Everyone has the right to privacy of correspondence, telephone conversations, postal, telegraphic and other communications. Restriction of this right is allowed only on the basis of a court decision.

Article 17 1. The collection, storage, use and dissemination of information on a person's private life without his consent is not allowed. 2. Bodies of state power and local self-government bodies, their officials are obliged to provide everyone with the opportunity to get acquainted with documents and materials directly affecting his rights and freedoms, unless otherwise provided by law.

Article 18 A dwelling (a building, a premise in it, the ground area) is inviolable. No one has the right to penetrate into the dwelling of the opposers of the persons residing therein, except in cases stipulated by law, or on the basis of a judicial decision.

Article 19 1. Everyone has the right to determine and indicate his nationality. No one can be forced to determine and indicate his national identity. 2. Everyone has the right to use his native language, to freely choose the language of communication, education, training and creativity.

Article 20 Everyone who is lawfully in the territory of the Donetsk People's Republic has the right to move freely, choose the place of residence and residence.

Article 21 Everyone is guaranteed freedom of conscience, freedom of religion, including the right to profess individually or jointly with others any religion or not to profess any, freely choose, have and disseminate religious and other beliefs and act in accordance with them. In this, nothing in this Constitution limits the Donetsk People's Republic in law the implementation of policies to protect the public from the activities of religious sects in accordance with the law.

Article 22 1. Everyone is guaranteed freedom of thought and speech. 2. Propaganda or agitation that incite social, racial, national or religious hatred and enmity is not allowed. Propaganda of social, racial, national, religious or linguistic excellence is prohibited. 3. No one shall be compelled to express his opinions and beliefs or refuse them. 4. Everyone has the right to freely seek, receive, transmit, produce and disseminate information by any lawful means. 5. Freedom of the media is guaranteed. Censorship is prohibited.

Article 23 1. Everyone has the right to association, including the right to create professional unions to protect their interests. Freedom of activity of public associations is guaranteed. 2. No one shall be compelled to enter into any association or stay in it.

Article 24 Citizens of the Donetsk People's Republic and the federal state have the right to assemble peacefully, without weapons, to hold meetings, rallies and demonstrations, marches and pickets.

Article 25 1. Citizens of a federal state residing in the territory of the Donetsk People's Republic shall have the right to participate in the management of the affairs of the federal state and the Donetsk People's Republic both directly and through their representatives. 2. Citizens of a federal state residing in the territory of the Donetsk People's Republic shall have the right, in accordance with the law of the federal state, this Constitution and the law of the Donetsk People's Republic, to elect and be elected to state bodies and local self-government bodies, as well as to participate in referendums. 3. Citizens who are recognized as legally incompetent, as well as those held in places of deprivation of liberty on the verdict of a court, have no right to elect and be elected. 4. Citizens of the Donetsk People's Republic and citizens of a federal state on the territory of the Donetsk People's Republic shall have equal access to public service. 5. Citizens of the Donetsk People's Republic and citizens of a federal state in the territory of the Donetsk People's Republic have the right to participate in the administration of justice.

Article 26 In the Donetsk People's Republic, citizens of the Donetsk People's Republic and citizens of the federal state have the right to convert personally, as well as to send individual and collective appeals to state bodies and local self-government bodies.

Article 27 1. Everyone has the right to freely use his abilities and property for entrepreneurial and other economic activities not prohibited by law. 2. In the Donetsk People's Republic, economic activities aimed at monopolization and unfair competition are not allowed.

Article 28 1. The right of private property is protected by law. 2. Everyone has the right to own property, to own, use and dispose of it alone as well as jointly with other persons. 3. No one shall be deprived of his property except by decision of the court. Forced alienation of property for state needs can be made only on condition of a preliminary and equivalent refund. 4. The right of inheritance is guaranteed.

Article 29 1. Citizens and their associations have the right to own a land in private ownership. 2. In the territory of the Donetsk People's Republic, possession, use and disposition of the land

and other natural resources is carried out by their owners in accordance with the legislation of the Democratic People's Republic of, and in case of the accession of the Donetsk People's Republic of the federal state - in accordance with the legislation of the federal state, Donetsk People's Republic. 3. Ownership, use and disposal of land owners and other natural resources should not damage the environment and violate the rights and legitimate interests of other persons.

Article 30 1. Labor is free. Everyone has the right to freely dispose of their abilities to work, to choose the kind of activity and profession. 2. Forced labor is prohibited. 3. Everyone has the right to work in conditions meeting the requirements of safety and hygiene, to remuneration for work without any discrimination and not below the minimum wage established by the law of the Donetsk People's Republic or the law of the federal state, as well as the right to protection against unemployment. 4. The right to individual and collective labor disputes is recognized through the use of legal means for their resolution, including the right to strike. 5. Everyone has the right to rest. Workers under the employment contract are guaranteed legally established working hours, weekends and holidays, paid annual leave.

Article 31 1. Paternity, motherhood, the rights of parents and childhood, as well as the family as a union of a man and a woman registered in accordance with the law, are under the protection of the state. 2. Caring for children, their upbringing is the equal right and duty of both parents: men and women. 3. No forms of perverted unions between people of the same sex in the Donetsk People's Republic are recognized, not sanctioned and prosecuted by law.

Article 32 1. Everyone is guaranteed social security by age, in case of illness, disability, loss of bread-winner, for the upbringing of children and in other cases established by law. 2. State pensions and social benefits are established by law. 3. Voluntary social insurance, the creation of additional forms of social security and charity are encouraged.

Article 33 1. Everyone has the right to a dwelling. No one can be arbitrarily lodged in a dwelling. 2. Bodies of state power of the Donetsk People's Republic and local self-government bodies, formed on the territory of the Donetsk People's Republic, encourage housing construction, create conditions for the implementation of the right housing. 3. The poor, other citizens specified in the law who need housing, it is provided free of charge or for affordable payment from state, municipal and other housing funds in accordance with the norms established by law.

Article 34 1. Everyone has the right to health care and medical assistance.

In the Donetsk People's Republic, medical assistance in state and municipal health institutions is provided to citizens free of charge by means of the appropriate budget, insurance premiums, other income. 2. In the Donetsk People's Republic, regional programs for the protection and promotion of public health are funded, measures are being taken to develop state, municipal, private health systems, activities promoting the enhancement of human health, the development of physical culture and sports, environmental and sanitary-epidemiological well-being are encouraged. 3. The concealment by officials of facts and circumstances that create a threat to life and health of people entails responsibility in accordance with the law.

Article 35 Everyone has the right to a favorable environment, reliable information about her condition and to compensation for damage caused by his health or property by an environmental offense.

Article 36 1. Everyone has the right to education. 2. In the Donetsk People's Republic, accessibility and free of pre-school, basic general and secondary vocational education in state or municipal educational institutions at enterprises are guaranteed. 3. Everyone has the right, on a competitive basis, to receive free of charge higher education in a state or municipal educational institution and at the enterprise. 4. Basic general education is compulsory. Parents or persons who replace them, ensure that children receive basic general education. 5. Various forms of education and self-education are maintained in the Donetsk People's Republic.

Article 37 1. Everyone is guaranteed freedom of literary, artistic, scientific, technical and other forms of creativity, teaching. Intellectual property is protected by law. 2. Everyone has the right to participate in cultural life and the use of cultural institutions, access to cultural values. 3. Everyone is obliged to take care of the preservation of historical and cultural heritage, to preserve monuments of history and culture. 4. In the Donetsk People's Republic, equal conditions are created and maintained for the preservation and development of the cultures of all peoples living in it.

Article 38 1. In the Donetsk People's Republic, state protection of the freedoms of man and citizen is guaranteed. 2. Everyone has the right to defend his rights and freedoms in all ways not prohibited by law.

Article 39 1. Everyone is guaranteed judicial protection of his rights and freedoms. 2. Decisions and actions (or inaction) of public authorities, local self-government bodies, public associations and officials may be appealed to the court. 3. Everyone has the right, in accordance with the international treaties of the Democratic People's

Republic of, and in the case of the accession of the Donetsk People's Republic to a federal state, in accordance with international treaties of the federal state, to turn to the interstate bodies for the protection of human rights and freedoms if all domestic legal remedies are exhausted.

Article 40 No one shall be deprived of the right to have his case examined in that court by that judge, to whose jurisdiction it is attributed by law.

Article 41 1. Everyone is guaranteed the right to receive qualified legal aid. In cases provided for by law, legal aid is provided free of charge. 2. Everyone arrested, detained, charged with the commission of a crime, has the right to receive the assistance of a lawyer (counsel) from the time of arrest, detention or prosecution, respectively.

Article 42 1. Everyone charged with a crime is considered to be innocent until his guilt is proven in accordance with the procedure provided for by law and established by a court that entered into legal force. 2. The accused does not have to prove his innocence. 3. Irremovable doubts about a person's guilt are interpreted in favor of the accused.

Article 43 1. No one shall be repeatedly convicted of the same offense. 2. In the administration of justice, the use of evidence obtained in violation of the law is not allowed. 3. Everyone convicted of a crime has the right to review a sentence by a higher court in accordance with the procedure established by law, as well as the right to seek pardon or commutation of punishment.

Article 44 No one is obliged to testify against himself, his spouse and close relatives, whose circle is determined by law.

Article 45 The rights of victims of crimes and abuses of power are protected by law. The state provides victims with access to justice and compensation for the damage caused.

Article 46 Everyone has the right to compensation by the state for damage caused by unlawful acts (or inaction) of public authorities or their officials.

Article 47 1. The law establishing or aggravating the liability does not have any retroactive effect. 2. No one shall be liable for an act which at the time of its completion was not recognized as an

offense. If after the offense is committed, the responsibility for it is eliminated or mitigated, a new law is applied.

Article 48 1. The enumeration in the Constitution of the Donetsk People's Republic of fundamental rights and freely should be interpreted as the denial or derogation of other universally recognized rights and freedoms of man and citizen. 2. Rights and freedoms of a person and a citizen may be limited by law only to the extent necessary for the protection of the foundations of the constitutional order, morality, health, the lawful interests of other persons, ensuring the country's defense and the security of the state. 3. In the conditions of a state of emergency, to ensure the security of citizens and protect the constitutional order, certain restrictions on rights and freedoms may be established in accordance with the law, specifying the limits and duration of their operation. 4. An emergency situation on the entire territory of the Donetsk People's Republic and in its individual localities may be introduced in the presence of circumstances and in the manner prescribed by law.

Article 49 Everyone who is in the territory of the Donetsk People's Republic is obliged to observe The Constitution of the Donetsk People's Republic, the laws and regulations of the Donetsk People's Republic, respect the rights and freedoms of others, and in the case of the Donetsk People's Republic joining a federal state - also observe the Constitution of the federal state and its laws and other regulatory legal acts.

Article 50 Everyone is obliged to pay legally established taxes and fees. Laws establishing new taxes or worsening the position of taxpayers do not have retroactive effect.

Article 51 Everyone is obliged to preserve nature and the environment, to take care of natural resources carefully.

Article 52 1. Protection of the common Fatherland is a duty and duty of a citizen of the Donetsk People's Republic. 2. A citizen of the Donetsk People's Republic bears military service in accordance with the law. 3. A citizen of the Donetsk People's Republic, in case his conscientiousness or belief contradicts the performance of military service, as well as in other cases established by law, has the right to be replaced by an alternative civil service.

Article 53 A citizen of the Donetsk People's Republic can independently exercise his rights and duties in full from 18 years of age.

Article 54 The laws of the Donetsk People's Republic may establish additional guarantees not provided for

in the Constitution of the Donetsk People's Republic and laws, the implementation of human and civil rights and freedoms through financial, material and other means of the Donetsk People's Republic.

Chapter 3. STATE DEVICE OF THE DONETSK PEOPLE'S REPUBLIC

Article 55 1. In case of joining the Donetsk People's Republic to a federal state, the Donetsk People's Republic becomes an equal subject of a federal state. 2. The status of the Donetsk People's Republic is determined by the Treaty between the federal state and the Donetsk People's Republic on the admission to the federal state of the Donetsk People's Republic and the formation of new subjects in the federal state, the Constitution of the federal state, the Federal Constitutional law of the federal state, regulating the admission to the federal state and education as part of the federal state of the new subject - the Donetsk People's Republic, the Constitution of the Donetsk People's Republic. 3. The status of the Donetsk People's Republic can be changed by mutual consent of the federal state and the Donetsk People's Republic in accordance with the federal constitutional law.

Article 56 1 The territory of the Donetsk People's Republic at the time of joining the Donetsk People's Republic to a federal state is determined by the boundaries of the former Donetsk region as part of the Republic of Ukraine. 2. The Donetsk People's Republic independently solves the problems of its administrative and territorial structure. 3. The administrative and territorial units of the Donetsk People's Republic are regions and cities of national importance. 4. The boundaries of administrative-territorial units shall be established and amended by the law of the Donetsk People's Republic.

Article 60 1. The state flag, coat of arms and hymn of the Donetsk People's Republic, their description and the procedure for official use are established by the law of the Donetsk People's Republic. 2. The capital of the Donetsk People's Republic is the city of Donetsk. The status of the capital of the Donetsk People's Republic is established by the law of the Donetsk People's Republic.

Article 61

1. The system of taxes levied in the budget, and the general principles of taxation and fees in the Donetsk People's Republic are established by law. 2. State loans are issued in accordance with the procedure determined by law and are placed on a voluntary basis.

Chapter 4. THE SUPREME COUNCIL OF THE REPUBLIC OF THE DONETSK PEOPLE'S REPUBLIC

Article 62 1. The Supreme Council of the Donetsk People's Republic - The Parliament of the Donetsk People's Republic is the permanently acting supreme and sole legislative (representative) body of state power of the Donetsk People's Republic. 2. The Supreme Council of the Donetsk People's Republic is elected for a period of five years. 3. The Supreme Council of the Donetsk People's Republic consists of [●] deputies.

4. The Supreme Council of the Donetsk People's Republic shall be eligible if at least two thirds of the number of deputies specified in paragraph 3 of this article is elected. 5. The Supreme Council of the Donetsk People's Republic independently solves the questions of organizational, legal, information, material and technical and financial support for its activities. 6. The expenses for ensuring the activities of the Supreme Council of the Democratic People's Republic of Latvia are provided separately from other expenses in the budget of the Donetsk People's Republic. 7. The Supreme Council of the Donetsk People's Republic has the rights of a legal person, has a stamp.

Article 63 1. Deputies of the Supreme Council of the Democratic People's Republic of Lithuania are elected on the basis of universal equal and direct suffrage by secret ballot. 2. The procedure for the election of deputies of the Supreme Council of the Democratic People's Republic of is established by law.

Article 64 1. A citizen of the Donetsk People's Republic (or) a federative state, who has reached the age of 21 and has the right to participate in elections, may be elected as a deputy of the Supreme Council of the Democratic People's Republic of Tajikistan. 2. During his term of office, a deputy of the Supreme Council of the Donetsk People's Republic can not engage in activities and replace positions incompatible in accordance with the law with the status of a deputy. Restrictions on the passive electoral rights of citizens are established by law, and in the case of the accession of the Donetsk People's Republic to a federal state - the federal law of a federal state. 3. The number of deputies exercising their authority on a professional permanent basis is established by the law of the Donetsk People's Republic. From the deputies exercising their powers on a professional permanent basis, the Presidium of the Supreme Council of the Donetsk People's Republic is formed. 4. A deputy of the Supreme Council of the Donetsk People's Republic, exercising its powers on a professional permanent basis, can not engage in other paid activities, except for teaching, scientific and other creative activities, unless otherwise provided by law. 5. A deputy of the Supreme Council of the Donetsk People's Republic does not have the right to use his status for purposes not related to the exercise of deputy mandates. 6. Deputies of the Supreme Council of the Donetsk People's Republic have an unimpaired duration of their term of office. 7. The status of a deputy of the Supreme Council of the Donetsk People's Republic is determined by the Constitution of the Donetsk People's Republic, the law of the Donetsk People's Republic.

Article 65 1. The Supreme Council of the Donetsk People's Republic shall meet for the first meeting no later than fourteen days from the day of its election to the rightful composition. 2. The first meeting of the Supreme Council of the Donetsk People's Republic of the New Legislative Assembly shall be opened by the oldest deputy. 3. From the day the work of the Supreme Council of the Donetsk People's Republic of the new convocation began, the powers of the Supreme Council of the Donetsk People's Republic of the previous convocation cease.

Article 66 1. The Supreme Council of the Donetsk People's Republic elects from its composition the Chairman of the Supreme Council of the Donetsk People's Republic, its deputies. 2. The Chairman of the Supreme Council of the Donetsk People's Republic, his deputies are elected from the Supreme Council of the Donetsk People's Republic by a majority of votes from the established number of deputies. 3. The Supreme Council of the Donetsk People's Republic: 1) forms committees and commissions, conducts parliamentary hearings on its own affairs; 2) forms the Presidium of the Supreme Council of the Donetsk People's Republic; 3) on the proposal of the Chairman of the Supreme Council of the Donetsk People's Republic, forms the Office of the Supreme Council of the Donetsk People's Republic; 4) upon nomination of the Chairman of the Supreme Council of the Donetsk People's Republic, appoints and dismisses the head of the Office of the Supreme Council of the Donetsk People's Republic; 5) conduct parliamentary hearings on its issues. 4. The Supreme Council of the Donetsk People's Republic adopts its regulations to decide on the internal arrangements of its activities. 5. To exercise control over the execution of the budget of the Donetsk People's Republic, the Supreme Council of the Donetsk People's Republic forms the Accounts Chamber of the Democratic People's Republic of China. The composition, the procedure for its formation and activities are determined by the law of the Donetsk People's Republic.

Article 67 1. Meetings of the Supreme Council of the Donetsk People's Republic are open, except in cases provided for by this Constitution, by law or by the regulations of the Supreme Council of the Donetsk People's Republic. 2. A meeting can not be considered eligible if it has less than half of the elected deputies, as well as in other cases provided for by the law of the Donetsk People's Republic. The session of the Supreme Council of the Donetsk People's Republic is held no more than once every three months.

Article 68 The jurisdiction of the Supreme Council of the Donetsk People's Republic includes: 1) the adoption of the Constitution of the Donetsk People's Republic, the laws of the Donetsk People's Republic, the introduction of changes in them; 2) interpretation of the Constitution of the Donetsk People's Republic, laws of the Donetsk People's Republic;

3) the adoption of resolutions of the Supreme Council of the Donetsk People's Republic and the introduction of amendments thereto; 4) the appointment of the Chairman of the Council of Ministers of the Donetsk People's Republic and the adoption of a decision on his resignation; 5) the formation of the Council of Ministers of the Donetsk People's Republic, the adoption of a decision on the resignation of the Council of Ministers of the Donetsk People's Republic, with the exception of such decisions with regard to the Minister of Defense of the Donetsk People's Republic, the Head of the Security Service of the Democratic People's Republic of Donetsk and the Minister of Internal Affairs of the Donetsk People's Republic; 6) the formation of the Security Council of the Donetsk People's Republic, the decision to dismiss the Security Council of the Donetsk People's Republic or its individual members; 7) establishment of the administrative and territorial structure of the Donetsk People's Republic and the order of its change; 8) consideration of issues on changing the borders of the Donetsk People's Republic, approval of an agreement on border changes; 9) approval of the budget of the Donetsk People's Republic and a report on its implementation; 10) approval of socio-economic development programs of the Donetsk People's Republic; 11) hearing of the annual report of the Chairman of the Council of Ministers of the Donetsk People's Republic on the performance of the Council of Ministers of the Donetsk People's Republic and other executive authorities, including on issues raised by the Supreme Council of the Donetsk People's Republic; 12) the appointment of elections to the deputies of the Supreme Council of the Donetsk People's Republic; 13) expression of distrust to the members of the Council of Ministers of the Donetsk People's Republic, which are appointed by the Supreme Council of the Donetsk People's Republic; 14) establishment, within the limits determined by law, of the procedure for holding elections to local self-government bodies in the territory of the Donetsk People's Republic; 15) the appointment of a referendum; 16) establishment of republican (regional) taxes, as well as the order of their collection; 17) establishment of the order of management and disposal of the property of the Donetsk People's Republic, including shares (shares, shares) of the Donetsk People's Republic in the authorized (joint-stock, collateral) capital of business entities, partnerships and enterprises of other organizational and legal forms; 18) approval of the budgets of territorial state budget funds of the Donetsk People's Republic and reports on their execution; 19) implementation, along with other authorized bodies, of monitoring compliance with and enforcement of the laws of the Donetsk People's Republic, the implementation of the budget of the Donetsk People's Republic, the execution of budgets, territorial state extra-budgetary funds of the Donetsk People's Republic, compliance with the established order of disposal of the property of the Donetsk People's Republic; 20) establishment of awards of the Donetsk People's Republic; 21) establishment of honorary titles of the Donetsk People's Republic; 22) establishment of official holidays of the Donetsk People's Republic; 23) approval of the candidature of the Prosecutor General of the Donetsk People's Republic; 24) the exercise of other powers established by this Constitution and the laws of the Donetsk

People's Republic, and in the case of the annexation of the Donetsk People's Republic to a federal state - established by the Constitution of the federal state, the laws of the federal state, this Constitution and the laws of the Donetsk People's Republic.

Article 69 1. The law of the Donetsk People's Republic: 1) the budget of the Donetsk People's Republic is approved and the report on its execution; 2) the procedure for holding elections to the deputies of the Supreme Council of the Donetsk People's Republic, the procedure for the formation of the Council of Ministers of the Donetsk People's Republic, the deputies of the Supreme Council of the Donetsk People's Republic, and the procedure for holding elections to local self-government bodies in the territory of the Donetsk People's Republic; 3) the procedure for appointing and holding a referendum is established; 4) the programs of social and economic development of the Democratic People's Republic are approved; 5) republican (regional) taxes and fees are established, as well as the order of their collection; 6) the budgets of the territorial state-budget funds of the Donetsk People's Republic are approved and reports on their execution; 7) establish the procedure for managing and disposing of the property of the Donetsk People's Republic, including shares (shares, shares) of the Donetsk People's Republic in the authorized (joint-stock, collateral) capital of business entities, partnerships and enterprises of other organizational and legal forms; 8) the conclusion and termination of contracts of the Donetsk People's Republic shall be approved; 9) establish the administrative and territorial structure of the Donetsk People's Republic and the procedure for its change; 10) determine the system of executive bodies of state power of the Donetsk People's Republic; 11) awards and honorary titles of the Donetsk People's Republic are established, as well as the procedure for awarding; 12) other issues related to this Constitution, laws of the Donetsk People's Republic are regulated, and in the case of the accession of the Donetsk People's Republic to a federal state - in accordance with the Constitution of the federal state, the laws of the federal state, this Constitution and the laws of the Donetsk People's Republic to the jurisdiction and authority of Donetsk Of the People's Republic. 2. Resolution of the Supreme Council of the Donetsk People's Republic: 1) the regulations of the Supreme Council of the Donetsk People's Republic are adopted and the internal order of its activities is resolved; 2) officials are appointed and dismissed from office, appointment to the post and dismissal of which belongs to the jurisdiction of the Supreme Council of the Donetsk People's Republic; 3) consent is given to the appointment of officials to the post, if giving such consent belongs to the jurisdiction of the Supreme Council of the Donetsk People's Republic; 4) elections of deputies of the Supreme Council of the Donetsk People's Republic, 5) a referendum is appointed; 6) a decision is made on mistrust (confidence) to the Chairman of the Council of Ministers of the Donetsk People's Republic; 7) a decision is made on distrust (confidence) of the members of the Council of Ministers

Donetsk People's Republic, in the appointment to which the Supreme Council The Donetsk People's Republic took part; 8) an agreement on changing the borders of the Donetsk People's Republic is approved; 9) in the case of the accession of the Donetsk People's Republic to a federal state, a draft agreement on the delineation of powers between the bodies of state power of the federal state and the organs of state power of the Donetsk People's Republic is approved; 10) other decisions are made on the issues referred to in this Constitution, the laws of the Donetsk People's Republic, and in the case of the annexation of the Donetsk People's Republic to a federal state, the laws of the federal state, the laws of the federal state, the laws of the Donetsk People's Republic and those of the Supreme Council of the Donetsk People's Republic. 3. Laws and resolutions of the Supreme Council of the Donetsk People's Republic, adopted within its powers, are binding on execution in the Donetsk People's Republic.

Article 70 1. Laws of the Donetsk People's Republic shall be adopted by a majority of votes of the established number of deputies, unless otherwise provided by law. 2. Decrees of the Supreme Council of the Donetsk People's Republic are adopted by a majority vote of the number of elected deputies, if none is provided for by law. 3. The Council of Ministers of the Donetsk People's Republic has the right to appeal to the Supreme Council of the Donetsk People's Republic with a proposal to amend the decisions of the Supreme Council of the Donetsk People's Republic or to abolish them, and also have the right to appeal these decisions in a judicial procedure.

Article 71 1. The right of legislative initiative in the Supreme Council of the Donetsk People's Republic belongs to the deputies of the Supreme Council of the Donetsk People's Republic, the Council of Ministers of the Donetsk People's Republic, the Security Council of the Donetsk People's Republic. Legislative initiative also belongs to the Prosecutor General of the Donetsk People's Republic on the issue of its conduct. 3. The draft laws on the introduction or abolition of taxes, exemption from payment, changes in financial obligations of the Donetsk People's Republic, other draft laws that provide for expenses covered by the budget of the Donetsk People's Republic, are considered at the request of the Council of Ministers of the Donetsk People's Republic or, Republic. 4. The draft laws are considered by the Supreme Council of the Donetsk People's Republic in two readings. The decision on the adoption or rejection of the draft law, as well as on the adoption of the law, is formalized by a resolution of the Supreme Council of the Donetsk People's Republic.

Article 72 1. The adopted law of the Donetsk People's Republic within five days is sent to the Council of Ministers for signing and promulgation. 2. The Council of Ministers of the Donetsk People's Republic shall, within fourteen days from the day when the law of the Donetsk People's Republic arrive, sign it and promulgate it in accordance with the procedure established by the law of the Donetsk People's Republic. 3. If the Council of Ministers of the Donetsk People's Republic rejects it within fourteen days from the date of the law's receipt, the Supreme Council of the Donetsk People's Republic shall

review this law in due course. If the law is approved in a previously approved editorial by less than two-thirds of the number of deputies, it shall be signed by the Council of Ministers of the Donetsk People's Republic within seven days and published. 4. The law of the Donetsk People's Republic comes into force after its official publication. The law and other regulatory legal acts of the Donetsk People's Republic on the protection of human and civil rights and freedoms enter into force no earlier than ten days after their official publication.

Article 73 1. The powers of the Supreme Council of the Donetsk People's Republic may be terminated ahead of schedule in accordance with the decision of the Council of Ministers of the Donetsk People's Republic in the event of: 1) adoption by the Supreme Council of the Donetsk People's Republic of the decision about self-dissolution; 2) entry into force of the decision of the Supreme Court of the Donetsk People's Republic of incompetence of this composition of deputies of the Supreme Council of the Democratic People's Republic of, including in connection with the addition of deputies of their powers; 3) dissolution of the Supreme Council of the Donetsk People's Republic by the President of the federal state in cases provided for by the federal law of the federative state - in case of joining the Donetsk People's Republic to a federal state. 2. In the event of early termination of the powers of the Supreme Council of the Donetsk People's Republic, the Supreme Council of the Donetsk People's Republic shall be appointed for an early election. Such elections shall be held in accordance with the law established by law.

Chapter 5. THE COUNCIL OF MINISTERS OF THE DONETSK PEOPLE'S REPUBLIC

Article 74 1. The executive power in the Donetsk People's Republic is exercised by the Council of Ministers of the Donetsk People's Republic and other bodies of the executive power of the Donetsk People's Republic. 2. The Council of Ministers of the Donetsk People's Republic is a permanent acting state body of the executive power of the Donetsk People's Republic. 3. The Council of Ministers of the Donetsk People's Republic is composed of the Chairman of the Council of Ministers of the Donetsk People's Republic, the deputies of the Chairman of the Council of Ministers of the Donetsk People's Republic and the Ministers of the Donetsk People's Republic. 4. The members of the Council of Ministers of the Donetsk People's Republic shall be subject to restrictions established by law, and in the event of the accession of the Donetsk People's Republic to a federal state, the federal state established by federal law. 5. The Council of Ministers of the Donetsk People's Republic ensures the implementation of this Constitution, the laws of the Donetsk People's Republic, and in the case of the incorporation of the Donetsk People's Republic into a federal state - the Constitution of the federal state, federal laws and other regulatory legal acts of the federal state, this Constitution, laws and other normative legal acts of the Donetsk People's Republic on the territory of the Donetsk People's Republic. 6. The Chairman of the Council of Ministers of the Donetsk People's Republic organizes the

work of the Council of Ministers of the Donetsk People's Republic.7. The order of the Council of Ministers of the Donetsk People's Republic is determined by the rules of procedure approved by it.8. The financing of the Council of Ministers of the Donetsk People's Republic and the heads of the executive bodies of the Donetsk People's Republic shall be financed by means of the budget of the Donetsk People's Republic provided for in a separate article.9. The Council of Ministers of the Donetsk People's Republic has the rights of a legal entity, it has a stamp.

Article 75 1. The President of the Council of Ministers of the Donetsk People's Republic shall be appointed on the proposal of the Supreme Council of the Donetsk People's Republic, or on the proposal of the Donetsk People's Republic of the Security Council and approved by the Supreme Council of the People's Republic of Donetsk.2. The formation of the Council of Ministers of the Donetsk People's Republic takes place upon the decision of the Supreme Council of the Donetsk People's Republic upon nomination by the Chairman of the Council of Ministers of the Donetsk People's Republic of candidates for the posts of Ministers of the Donetsk People's Republic, with the exception of the Minister of Defense of the Donetsk People's Republic, the Head of the Security Service of the Democratic People's Republic of Donetsk and the Minister of Internal Affairs of the Donetsk People's Republic, which are appointed solely by decision of the Security Council of the Donetsk People's Republic.

Article 76 The Council of Ministers of the Donetsk People's Republic: 1) develops and implements measures to ensure the complex socio-economic development of the Donetsk People's Republic;

2) ensure, within its authority, the conduct of a unified state policy in the fields of finance, science, education, culture, health, physical culture and sports, social security, road safety and ecology;

3) carries out within the limits of his powers measures for the implementation, maintenance and protection of human and citizen's rights and freedoms, protection of property and public order, counteraction to terrorism and extremism, and combating crime;4) carries out within the limits of his powers measures to ensure state guarantees for the equality of rights, freedoms and legitimate interests of a person and citizen irrespective of race, nationality, language, religion or other circumstances; prevention of restriction of the right to discrimination on grounds of social, racial, national, linguistic or religious affiliation; preservation and development of the ethno-cultural variety of peoples living on the territory of the Donetsk People's Republic, their languages and cultures; protection of the rights of national minorities; social and cultural adaptation of migrants; prevention of ethnic (ethnic) conflicts and the provision of inter-ethnic and inter-religious harmony;

5) develops, for submission to the Supreme Council of the Donetsk People's Republic, a draft budget of the Donetsk People's Republic and draft programs for socio-economic development of the Donetsk People's Republic;

6) ensure the implementation of the budget of the Donetsk People's Republic, prepare a report on its implementation, as well as reports on the implementation of socio-economic development programs of the Donetsk People's Republic;

7) forms other executive bodies of the Donetsk People's Republic;8) manages and disposes of the property of the Donetsk People's Republic in accordance with the laws of the Donetsk People's Republic, and also manages the property transferred to the Donetsk People's Republic in accordance with the laws of the Donetsk People's Republic, in case of joining the Donetsk People's Republic to a federative state, with federal laws and other regulatory- legal acts of the federal state, the Constitution and laws of the Donetsk People's Republic, and in the case of the annexation of the Donetsk People's Republic of the republic to a federal state - established by the Constitution of a federal state, laws and other regulatory and legal acts of a federal state, the Constitution of the Donetsk People's Republic, laws and other regulations of the Donetsk People's Republic.

Article 77 1. The Council of Ministers of the Donetsk People's Republic, on the basis of and in fulfillment of its powers, issues decrees and orders.2. Resolutions and orders of the Council of Ministers of the Donetsk People's Republic adopted within the limits of its authority are binding for execution in the Donetsk People's Republic.3. Decrees and orders of the Council of Ministers of the Donetsk People's Republic must contradict this Constitution and the laws of the Democratic People's Republic of, and in case of the accession of the Donetsk People's Republic to a federal state - the Constitution of the federal state, its laws, acts of the President of the federal state and the Government of the federal state, the Constitution and laws of the Donetsk People's Republic.

Chapter 5. Security Council Donetsk People's Republic

Article 78 1. The Security Council of the Donetsk People's Republic is formed by the decision of the Supreme Council of the Donetsk People's Republic.2. The Security Council elects from its composition the President of the Security Council of the Donetsk People's Republic, which organizes its work.3. The Security Council of the Donetsk People's Republic appoints and terminates the powers of the Minister of Defense of the Donetsk People's Republic, the Head of the Security Service of the Donetsk People's Republic and the Minister of Internal Affairs of the Donetsk People's Republic, who are obligatory members of the Council of Ministers of the Donetsk People's Republic.

Chapter 6. Judicial and Prosecuting Authorities in the Donetsk People's Republic

Article 79 1. Justice in the Donetsk People's Republic is carried out only by the court.

2. Republican courts and world judges operate in the Donetsk People's Republic. Powers, the procedure for the formation and activities of republican courts and magistrates are determined by the legislation of the Donetsk People's Republic.

Article 80 1. The Prosecutor's Office of the Donetsk People's Republic oversees the observance of this Constitution and the implementation of laws in force in the territory of the Donetsk People's Republic, performs other functions established by the laws of the democratic Donetsk People's Republic.2. The Prosecutor General of the Donetsk People's Republic is appointed to the post and dismissed by the Supreme Council of the Donetsk People's Republic, and in the event of the Donetsk People's Republic joining the federative state - appointed by the President of the Federal State on the proposal of the Prosecutor General of the federal state coordinated with the Supreme Council of the Donetsk People's Republic, President of the federal state.

Chapter 7. LOCAL GOVERNMENT Article 81 1. In the Donetsk People's Republic, local self-government is recognized and guaranteed for self-determination by the population of issues of local importance, possession and use, and disposal of municipal property.

2. Local self-government is exercised by citizens through a referendum, elections and other forms of direct expression of will, through elective and other bodies of local self-government.

4. The procedure for interaction between public authorities of the Donetsk People's Republic and local government is determined by law..

Article 82 1. Local self-government in the Donetsk People's Republic is carried out in urban settlements, including those with intra-urban divisions (intra-urban areas), and rural settlements, taking into account historical and other local traditions.

2. The change of the boundaries of the territories in which the local governance is carried out, as well as the change in the status of the urban or rural population, is carried out taking into account the opinion of the population of the corresponding territories, including the representative bodies of the corresponding municipal formations.

Article 83 1. Local self-government bodies independently manage municipal property, formulate, approve and execute a local budget, establish local taxes and fees, implement public order protection, and solve other issues of local self-management.

2. The bodies of local self-government may be endowed with the law of the Donetsk People's Republic with separate state powers with the transfer of material and financial means necessary for their implementation. The realization of the transferred powers is under the control of the organs of state power of the democratic Donetsk People's Republic.

Article 84 Local self-government in the Donetsk People's Republic is guaranteed to be entitled to judicial protection, to compensate for additional expenses incurred as a result of decisions taken by public authorities of the Donetsk People's Republic, and a ban on restricting the rights of local self-government established by this Constitution and the laws of the Donetsk People's Republic.

Article 85 The organization of local self-government in the Donetsk People's Republic, the powers and procedures for the activities of local self-government bodies are determined by law.

Chapter 8. The adoption of the Constitution Donetsk People's Republic as amended

Article 86 1. The Constitution of the Donetsk People's Republic is adopted by the Supreme Council of the Democratic People's Republic in less than two thirds of the total number of deputies.

2. The Constitution of the Donetsk People's Republic comes into force from the day of its official publication.

Article 87 1. Proposals for amending the Constitution of the Donetsk People's Republic may be submitted by the Council of Ministers of the Donetsk People's Republic, the Supreme Council of the Donetsk People's Republic, as well as a group of at least one third of the established number of deputies of the Supreme Council of the Donetsk People's Republic.

2. The proposal to amend the Constitution of the Donetsk People's Republic is formalized in the form of a draft law of the Donetsk People's Republic on amending the Constitution of the Donetsk People's Republic.

3. The law of the Donetsk People's Republic on the introduction of amendments to the Constitution of the Democratic People's Republic of Ukraine is adopted by the Supreme Council of the Donetsk People's Republic by less than two-thirds of the total number of deputies.

Chapter 11. TRANSITIONAL PROVISIONS Article 88In the case of the accession of the Donetsk People's Republic to a federal state prior to the settlement of the issues of integration of the Donetsk People's Republic into the economic, financial, credit and legal systems of the federal state, to the system of federal government bodies, as well as adoption of the laws and other normative acts of the Donetsk People's Republic , The Constitution of the Donetsk People's Republic is applied taking into account the provisions of the Treaty between the federal state and the Donetsk People's Republic on the

admission to the federal state of the Donetsk People's Republic of education in the federal state of new subjects and the provisions of the Federal Constitutional Law regulating the acceptance of the federal state of the Donetsk People's Republic and the formation of a new subject, the Donetsk People's Republic, as part of the federal state.
