III. Approval of MinutesMotion to approve last meeting’s minutes was moved by Senator Sadique and Seconded by Senator Perez-Lebron. Motion Passes 19:0:0.

IV. Presidential RemarksPresident McReynolds welcomed all to the 5th meeting of the 98th session of Emporia State University Associated Student Government. President McReynolds wanted to thank everyone for coming to meeting tonight. President McReynolds announced that ASG has finished reviewing and awarding the Educational Opportunity Fund to which we allocated over $23,000 to students and $17,537.04 to departments. President McReynolds stated that the minimum increase for tuition and fees for this upcoming year is 2.57%, but the new maximum of 4.17%. With proposed cuts that ASG has discretion over, the cut to student fees if all bills were passed as proposed, would total $13.45. If the other fee increases go into effect as is, our cuts would cut down the increase to student fees to just $7. President McReynolds stated that after tuition and fees meeting on April 19th, at 8:15am in the Tuition and Fees Committee meeting, she has the discretion to sign and pass these bills, or to not sign and veto these bills which would make these line items the same that they are this year. V. Vice Presidential RemarksVice President Miller welcome all to the 5th meeting of the 98th session of Emporia State University Associated Student Government. “You are officially in the home stretch of your terms! I won’t get all emotional, at least not yet, but I just wanted to say I am so proud of each

and every one of you for the work you have put into your terms. You’ve shown dedication, resilience, and have carried yourselves with lots of respect. Going around soon is a sign up to help with the Nitty Gritty Dirt Dash! It is on Saturday, April 28, from 7:30-11:30 AM, and you would get a free t shirt and just help as a pathfinder or handing out water. I did it last year and it was super easy and like I said I got a free t shirt so come on, y'all should do it. Finally it’s time to vote on our April Senator of the Month. Go ahead and write who you think has earned it and pass it to the right.” Vice President Miller. Vice President Miller ended Guest Remarks.

VI. Guest RemarksRay Lauber. Director of Human Resources / Title IX CoordinatorSenator Goetzinger moved to grant speaking privileges, which was then seconded by Senator Wank. Motion passes 19:0:0. Ray Lauber is the Director of Human Resources / Title IX Coordinator here at ESU. Lisa Mortz, Deputy Coordinator of Title IX here at ESU. Lauber stated that both of the two guest speakers tonight work in a majority of facetes with Title IX and other factors of investigation at the University. Lauber stated that as the speaker tonight, they will address some information regarding to Title IX and other investigations that are under the discretion of their office. Lauber said that during this presentation, they will use works like “complainants” instead of the word “victim” because everything that is brought to their office is started as an allegation, not as something that is confirmed. Lauber stated that Title IX is a government program that protects discrimination and harassment to anyone (student to student, faculty to student, etc.). Lauber stated that if any Title IX investigation can occur if it impacts anyone tied to the university (can include something that happened off campus). Lauber stated that Title IX as a program is prevention based with programs like THRIVE and other educational opportunities in order to help students, faculty, and staff to become more educated on Title IX events. As well, their office offers support for all those involved in these actions, not just the complainants, said Lauber. Lauber stated that it provides ESU with a technical solution to these events while providing protection for all individuals involved in these acts. Mortz went through a list of “commonly used terms” that are involved with Title IX. Mortz stated that Federal Guidelines are required to be had by Emporia State University. In a Title IX matter, their office allows the complainant to choose whether or not they want to move forward with an investigation. Also, Mortz stated that if this is a repeated complaint offense, the university could choose to investigate the matter even without the choice of the complainant. With over 50% in one way or another of proof, the office can choose to close an investigation. Title IX can not guarantee confidentiality to anyone, however there is strict confidentiality between the workers in the Title IX office. If someone brings up a compliant or if someone provides evidence, people are not able to retaliate. Mortz reviewed a presentation about what consent means. Mortz stated that they is a social stigma around the word consent and there are some ideas that are often forgotten with consent. There can not be consent with a multitude of reasons including intoxication, incapacitation, mental illness, etc. She then stated that anyone who is a “responsible employee” is required to be considered “responsible employees”. This means that if anyone shares something that happened to them, they are required to share that information with the

Title IX investigation. A “confidential resource” can include counselors, legal counselors, athletic trainers, and staff in the student health center. Mortz stated that all of these resources are great resources for our students. Lauber then stated that people are able to serve in both situations. Lauber then stated that if you talk with one of the responsible employees, that will reach out to the Title IX office in order to inform them that they have received a report. Lauber said that in terms of the investigation beginning process, they have to fill in a report. After this step, they explain the resources available for the complainant. Lauber then said that the complainant moves forward with the report, the respondent then moves to an meeting for rights before any investigation. In a majority of these situations, drugs and alcohol are involved in the Title IX investigations, however they will NOT REPORT THE USE OF EITHER, i.e. a “safe harbor”. Lauber stated that is it not under their responsibility to be a crime report resource for the complainant, only to assist them with the Title IX investigation. Lauber stated the rights of both parties during the investigations. Lauber stated that the respondent is able to know who the complainant is. Lauber said that once the complantaint has knowledge of the investigation beginning, in which the investigation begins. Lauber stated that the Title IX office is able to install santicions that are stated in the policy guidelines, which is a case by case situation. These sanctions can be anything from changing paths in travel, changing location of classes for students, etc. Lauber stated that Title IX does not make an criminal determinations to law enforcement. Lauber stated that the office advises the complainants that they are able to have the rights to report to law enforcement however they are not able to report any criminal activity. Lauber stated that it is possible that if they complainant has experiences some legal ramifications, but chose not to report. Sen. Simpson asked if there is other language that could legally be used as a complainant. Lauber stated that it is best practice to use the word complainant. Sen. Ratzlaff asked the question if the standards of proof is used by the federal level, why does the university use other things. Lauber stated that with our policy, there are individual cases where it is a different standard. Vice President Miller ended guest remarks.

VII. Committee ReportsFiscal Affairs – Senator Marten

Sen. Marten stated that we have two reserve fund requests on first readings and line item policies on general order.

Senate Operations – Senator Webb Sen. Webb stated that SO committee said that there is a PRSO on first readings this

meeting. Also, the SO committee stated that they are a slew of other policies and bills that will be on first readings this meeting. The deadline to re register RSOs on HornetLife is April 20th.

Campus and Community Relations – Senator WilliamsSen. Schneider stated that Sen. Williams could not be present at this meeting, however he

will be giving report today.

Diversity and Inclusion – Senator Perez-Lebron Sen. Perez-Lebron stated that the D&I committee would suggest to attend faculty senate

next week on Tuesday in Skyline at 3:30pm.

Treasurer – Drake Rapue Treasurer Rapue stated to remind senate to be engaged in the line item policy debate

tonight.

Legislative Director - Christina BruntonLD Brunton stated that Nov. 6th 2018 will be the midterm election day. Primary

registration for Parties is July 12th. Primary elections will be held Aug. 7th. Registration ends for the general election on Oct. 18. LD Brunton is preparing for next year voters registration drive will be under the responsibilities of the LD next administration.

SB 18035 - Center for Early Childhood Education Line Item Adjustment for Fiscal Year 2019

Sen. Marten moved to pass SB 18034 favorably, which was seconded by Sen. Webb. Sen. Marten moved to grant speaking privileges, which was seconded by Sen. Abdel- Jawad. Dr. Jenny Long came to represent the CECE. She wanted to say what a difficult decision passing these line item proposals would be. Long wanted to give a brief licensure explanation for the CECE. Long stated that the state requires adult to children ratios from one adult to five students to one adult to fourteen students. Long stated that the CECE hires students on this campus, which allows students to gain experience in the field. Long stated that the decrease would mean that funding cut would mean a large cut for the the staffing abilities. Sen. Sadique wanted to know where the CECE also gains funds. Long stated that each child has to pay and they make operating money through other avenues as well like fundraising. Sen. Simpson asked if Long had an approximate number if the cost per parent would increase with these cuts. Long stated that each age has a fee. With these cuts, the cost increase, Long stated that she did not know the number, but estimated it at a dollar. Sen. Perez-Lebron asked how many students use the CECE. Long stated that 27 students use the CECE. Sen. McAllister asked

what percentage of the ASG funds go toward student salaries. Long stated she did not know the number, but that the ASG money goes toward cutting the cost for parent students. Sen. McAllister asked if those student positions are filled by work student. Long stated that approximately 5 of the student workers are on work student. Sen. Marten asked if the CECE had a carry forward balance to which Long state they did not. Sen. Sadique wanted to know the percentage of the CECE funding is given from ASG. Long stated that just a third of student wages. It is the only thing that the CECE uses the money for. Sen. Marten asked what the total budget amount is and how much of that is funded through ASG. Long stated that they full budget is difficult to find, however based on her research, the overall percentage of the of the CECE’s budget that was given from ASG funds includes approximately $45,000 of their $409,XXX operating budget. Sen. Goetzinger asked if the university would have to cover the rest. Long said that if anything changes, there are a multitude of avenues for more money. Long stated that they would cut staffing down to per the ratio that is required by the state. Sen. Wank asked how many students are employed at the CECE. Long stated that 30 students and 6 none student workers. Sen. Marten stated that only 8% of the operating budget is funded by the CECE. Which Long stated was correct. Sen. Marten moved to call SB 18035 to question, which was seconded by Sen. Wank. Motion passes 18:0:0.

Sadique wanted to ask how the PAB funds the trip to a conference. Sen. Ratzlaff asked for Tilden to give the senators a number for the trip, however she stated that she does not have that number. Sen. Abdel-Jawad stated that all student fee moneys are supposed to provide support to students. Tilden stated that donors and department funds are able to partially help these costs. Sen. Marten asked if the PAB funds Zoiks, which Tilden stated no. Sen. Simpson asked if the PAB has an suggested amendments. Tilden then stated the amendments. Sen. Marten asked Tilden how the PAB functioned without the increase that was given last year. Tilden stated that they were not able to function as highly, but were still able to function. Sen. Sadique asked what new programs the PAB was able to do by more funding. Tilden said that nothing was done that was new. Sen. Marten asked if the departments had any fundraising for the funding of the PAB. Sen. Abdel-Jawad asked Tilden if students get in for free with these student fees. Sen. Goetzinger asked if Tilden. Sen. Williams. Sen. Ratzlaff. Sen. Simpson. Sen. Abdel-Jawad. Sen. Ratzlaff asked how often does the PAB contact those members of the PAB if they do not show up to the PAB meetings. Tilden stated that some members have not shown up often. Sen. Perez-Lebron moved to grant President McReynolds, which was seconded by Sen. Simpson. President McReynolds stated that the ASG President appoints students. Sen. Marten asked how the PAB is able to allocation $2xx,xxx dollars in three hours. Sen. Sadique asked how they are able to allocation $2xx,xxx in the matter of Hours. Sen. Abdel-Jawad asked who represents debate. Tilden stated that while Kale is the member, he is not an active member. Sen. Perez-Lebron stated that he (Kale) had no idea that he had served on this board. Sen. Marten asked how the PAB. Sen. Ratzlaff. Sen. Simpson. Sen. Abdel-Jawad asked if Tilden had met anyone from the Creative Writing Department or from Hornet Review. Sen. Todd asked if the PAB funds the Color Guard and the Stingers Dance Team. Tilden stated she did not know. Sen. Marten stated that in Appendix A, the creative writing program received less money than other PAB sources, but other areas receive much more. Sen. Simpson moved to Resend Speaking Privileges. Sen. Goetzinger wanted to remind Sen. Lund that Senators are supposed to represent the graduate school. Sen. Abdel-Jawad asked if Sen. Lund had moved. Sen. Simpson moved to textually amend SB 18036, strike $14.40 and insert $22.20, which was seconded by Sen. Lund. Motion fails 2:17:0. Sen. Todd moved to make a textual amendment to strike $14.40 to change it to $16.40 for full time students, the motion was seconded by Sen. A. Williams. Sen. Simpson moved to call the amendment to debate, which was seconded by Sen. Perez-Lebron. Sen. Simpson stated that if this proposal would go through, it would not allow the debate team to compete at the level in which they have done this will. Sen. Abdel-Jawad asked, Sen. Marten

asked if Sen. Simpson felt that debate tournaments stand as professional development. Sen. Marten asked how other students throughout the university benefit from the line item. Sen. Ratzlaff asked how the debate team fundraisers. Sen. Ratzlaff stated that with this large increase would not impact stated the students. Sen. Webb asked what the weekly circulation is, in which she did not. Sen. Schneider asked if The Bulletin had reached out to other communities. Sen. Abdel-Jawad asked if The Bulletin had thought about moving away from less physical printing editions. She stated that The Bulletin. Sen. Goetzinger asked what the percentages are for advertising vs $80,868.94, over $71,000 is from student fees. Sen. McAllister asked. Sen Marten asked what the student fees goes to. She stated that it goes to printing, the website, staff, and student workers. Sen. Abdel-Jawad. Sen. Lund asked if staffing would have to be cut. Sen. Wank ask how many of those printed get printed and how many are actually used. Also, has The Bulletin thought about only going online. Also, could those advertisements be put online. She stated yes. Sen. Ratzlaff asked if The Bulletin would be able to reallocate funds for that. She stated that particularly you need staff in order to do that reports. She stated that it is important to have open records act. Sen. Abdel-Jawad asked how many students are employed by The Bulletin, to which she stated that they employee around 20 students. For the 2018 fiscal year, they have a carry over of $11,923.66. Sen. Marten asked how much it costs to print fiscal copies every year, at she stated it was around $11,000. Sen. Simpson. Sen. Goetzinger asked how you gauge what distribution service students prefer. Also, how many students were apart of that focus group. Sen. Abdel-Jawad asked who was incharge of the budget, to which she answered. Treasurer Rapue said that with the 12% cut, it would be just over $12,000. Sen. Goetzinger. Sen. She stated that The Sunflower could be cut completely with the proposed cuts would be not allow for the yearbook potentially to be printed at all. She stated that cutting this funding would cut the staffing,. Sen. Abdel-Jawad asked how many yearbooks are picked up every year, and she stated 2,100. Sen. Perez-Lebron. Sen. Lund ask if cutting this fee woud. Sen. Abdel-Jawad asked how many staff they employee, 10. Also, how is that the only option to reduce costs beside student staff. Sen. Goetzinger asked where the funding came from for the yearbook, and she stated 100%. Sen. Ratzlaff asked how many students are benefiting from this. Sen. Ratzlaff wanted to clarify that. Sen. Nweke asked if students have asked to reprint copies. Sen. Perez-Lebron. Sen. Goetzinger said that $89,833.26 from the student line item. The carry over from last year was $5253.16. Sen. Simpson. Webb asked as 960 year books are still sitting in the union loading dock. Sen. Marten. Sen. Goetzinger asked how many dollars would you lose if this proposal went through. Sen.
