In accordance with 24 V.S.A. § 1972, the citizens of the Town of St. Albans are hereby notified that on

August 13, 2012, the Selectboard adopted an Ordinance on the regulation of Town Parks. The purpose of

the ordinance is to protect the public health, safety and well being of citizens by regulating park activities

and to secure the quiet, orderly, and suitable use and enjoyment of public park properties, equipment, and

facilities. The ordinance provides rules and outlines prohibited activities for the use of Bay Park, Bay

Dock, Cohen Park, and the Town Forest. The ordinance also provides for an application process for

permits for all persons desiring exclusive use of the park facilities.

The citizens are further notified that within forty-four (44) days of the above provided date of adoption

that they may present a petition to the Selectboard or the Town Clerk of the Town of St. Albans signed by

Town on the question of disapproving this ordinance.

CONCISE SUMMARY: Act 62 responded to a Vermont business changing its LED sign every few seconds. The council must adopt rules on what constitutes flashing intermit-tent or moving lights or animated or moving parts within the meaning of 10 V.S.A. § 495(a)(3). The council must consider reliable empirical studies of the effect of changing or flashing signs on traffic safety; the current state of sign technology and expected future developments in sign technology; and the findings set forth in 10 V.S.A. § 482 concerning the value of the scenic resources of the state, the importance of providing information regarding services, accomodations, and points of interest to the traveling public and the hazard created by the proliferation of outdoor advertising.
