Recommended Actions

1. Background

At the request of the Public Safety Committee (File No. 09-0513), the City Council authorized theBoard of Police Commissioners on March 31, 2009, to issue a Request for Proposal (RFP) for anOfficial Police Garage (OPG) to provide standard duty towing and vehicle storage for theHollenbeck Police Area. For the record and for future reference, the Hollenbeck Area wasrenamed Official Police Garage Service Area 4 effective June 1, 2010, when the City Councilpassed Ordinance No. 181143 amending LAMC 80.77.4. This action established 18 Official PoliceGarage service areas with permanent geographic boundaries as depicted on the maps on file withthe City Clerk (Council File 08-0418).

Los Angeles Municipal Code 80.77.4 now states, "The Board of Police Commissioners shall,subject to the approval of the City Council, enter into contracts, awarded for a fixed term of fiveyears, with Official Police Garages for 18 Official Police Garage service areas of the City and forsuch heavy duty towing services as may, in the judgment of the Board, be necessary. Thegeographic boundaries of the 18 Official Police Garage service areas shall be those depicted on themaps on file with the City Clerk in Council File 08-0418."

Hollenbeck Area, now known as Official Police Garage Service Area 4, is located east ofdowntown Los Angeles, has a population of roughly 200,000 people and is 15.2 square miles insize. It encompasses the communities of El Sereno, Lincoln Heights and Boyle Heights, and isunder the jurisdiction of Central Bureau. Standard duty OPG towing and vehicle storage will beprovided in this service area on a 24-hour, 365-days-per-year basis. The anticipated volume ofvehicle impounds per month for Hollenbeck Area (based upon data reported in January 2009) is600. However, this estimate is not a guarantee of future volume.

The general duties of an OPG for standard duty towing include responding on a first priority basisto requests for standard duty towing services initiated by authorized Police Department andDepartment of Transportation personnel. Additional requests for towing may be initiated by anofficer of the Port, Airport, or any Los Angeles City Department authorized to request the removalof vehicles for the purpose of storage or investigation.

Typical towing situations may include, but are not limited to, the removal of illegally parkedstandard duty vehicles and vehicles that are disabled as a result of traffic accidents. Vehicles thatrequire towing by a standard duty towing vendor weigh 10,000 pounds or less, or do not possessany of the criteria that constitute a heavy duty vehicle, such as: three or more axles; a laden orunladen gross weight rating in excess of 10,000 GVWR; a combination of commercial trailers;longer than thirty (30) feet in length (including tongue); wider than eight (8) feet in width utilizing afifth wheel hitch or pintle; or the condition or position of the vehicle to be removed necessitatesheavy duty towing equipment. The determination of whether standard-duty or heavy-duty servicesare required for a given situation is solely within the discretion of the City's impounding employee.The Hollenbeck Area Standard Duty Towing and Storage contractor, however, will not be requiredto provide any heavy-duty towing services under this contract.

The new contract shall be issued only after utilizing the City's standardized bid and contractprocedures. The previous contract for this area has expired. A new contract is needed for an OPGin Hollenbeck Area.

In compliance with the established City procedures for releasing an RFP, the RFP was officiallyissued to the public by the Board of Police Commissioners on May 14, 2009, through completion ofthese public notification activities:

• Advertised a Notice of Request for Proposals in the Daily Journal, which is a weeklynewspaper, for two consecutive weeks.

• Listed the entire RFP, including attachments, on the Los Angeles Business AssistanceVirtual Network (LABAVN) website. This information was forwarded to registered usersof LABAVN and it was available to LABAVN website visitors.

• Sent the RFP via email to persons and/or company representatives who requested theinformation from Commission Investigation Division or Police Commission staff.

• Held a Pre-Proposal Conference on June 1, 2009, in Parker Center to inform proposers ofthe requirements of the proposal. The Agenda included the following:

1. The Office of Contract Compliance provided information on the EqualBenefits Ordinance, Slavery Disclosure Ordinance, the Nondiscrimination,Equal Employment/Affirmative Action Provisions and the Living Wageand Service Contract Worker Retention Ordinances. This information washelpful as the City requires companies doing business with the Citycomply with these provisions before a contract can be awarded.

2. Staff from the Mayor's Office of Housing & Economic Development,Minority Business Opportunity Center, gave a presentation on thePolicy of the City to provide minority Business Enterprise (MBE),Women Business Enterprise (WBE), and all Other Business Enterprise(OBE) concerns an equal opportunity to participate in the performanceof all City contracts and what is entailed in providing documentation of aGood Faith Effort.

Each notification advised the public that proposals were sought and would be due July 30, 2009.

Review Committee

The RFP states the method for selecting the Review Committee. A Review Committee selected bythe Police Commission was comprised of one representative from the Los Angeles PoliceCommission, one representative from the Department of Transportation, and one representativefrom the Office of the City Administrative Officer. The Review Committee evaluated the proposalsand submitted their recommendation to me on behalf of the Board of Police Commissioners.

Contractor selection was based on the professional and demonstrated qualifications of those firmssubmitting proposals. Recent and significant experience in the operation of a towing servicebusiness and adequate financial ability to provide the services and facilities required of the proposerwas considered a minimum qualification.

When making its final selection, the Review Committee was advised that they were not bound bythe numerical score of the proposals. The Review Committee members were instructed that thenumerical scores were to be considered a strong guideline, but that the Review Committee mustweigh all facets of the service the City requires and they are asked to select the proposal that bestmeets the needs of the City, which may not be quantifiable in a scoring system but should becomeevident to the Review Committee in the course of conducting their review.

Rating System

The scoring matrix is a grading system and a thirteen page score sheet (Attachment B) that takesinto account each standard referenced in the RFP. The first column on the left side of the matrixindicates the paragraph in the RFP for which the proposal is being rated. Each factor is separatelylisted and assessed. Proposals are graded in relationship to each other and therefore the same ratersare tasked with rating the same pool of proposals."'

Raters were instructed to make one of the following determinations about the response of eachproposer to each point enumerated in sequential order in the RFP and the Rating Matrix:

1. Not applicable (N/A)2. Responsive ( R ) or Not Responsive (NR)3. Pass at a Score of "5" = Excellent/outstanding4. Pass at a Score of "4" = Very Good

5. Pass at a Score of "3" = Good or Average6. Pass at a Score of "2" = Below Average7. Pass at a Score of "1" = Needs Improvement

Raters were advised in writing (Attachment B, page 1) that based on their judgment, the seriousnessof a "NOT RESPONSIVE" grade on any criteria could have been deemed "fatal" or the rater coulddetermine to set that criteria aside and require it to be suitably re-addressed by the proposer. Therater's third assessment option was to make a decision that the particular criteria could beoverlooked if it could be met by the proposer in an alternative way. This final determination wasthe privilege of the rater and the City of Los Angeles.

The request for proposal (RFP) stated the following weight and criteria would be used to evaluatethe proposals using a maximum scale of 130 points:

• FORMAL BUSINESS PLAN 40 Points• EXPERIENCE 30 Points• HISTORY OF CONTRACT COMPLIANCE 30 Points• ATTENTION TO CUSTOMER SERVICE 15 Points• ATTENTION TO HONESTY & INTEGRITY 15 Points

If there is a future situation involving a sole bidder, then it has been determined that a minimum of two of the threeraters must agree that the proposal is suitable in order for the proposal to be recommended favorably to the PoliceCommission.

The Review Committee members were asked to select the best applicant, who in their estimationwould serve the City of Los Angeles with the most efficient and effective service possible and do soprofessionally with the highest degree of integrity. The raters were also advised in writteninstructions (Attachment B, page 1) of their responsibility to grade proposals from any proposerswithout OPG experience on their related experience, strength of assets, and related abilities (asshown in their proposed business plan) which made them competitive with an experienced OPGcontract vendor. Raters were reminded that the City of Los Angeles required them to fairlyconsider all proposals.

Official Police Garage Review Committee Rating Summary

The Table of Ratings (Attachment A) provides the score awarded by each rater for each point ofeach proposal. The last page of the table in Attachment A, as well as the summary table at thebottom of this page, provide the total points per proposal per rater, the combined total points perproposal by all raters, the average score per proposal, and the ranking of the proposals with thehighest scoring proposal shown in Rank 1.

Eleven proposals were received by the deadline of July 30, 2009, for RFP 09-980-003. Early in thereview process, one proposal was withdrawn by the proposer and one proposal was disqualifiedwhen it was discovered the company did not meet one of the stated provisions for OPG selectionstated in the RFP and in Los Angeles Municipal Code 80.77.4. (E. 5.):

No owner of an Official Police Garage shall have a controlling ownership interest in anyautomobile dismantling or wrecking yard, automobile body or repair shop, used carbusiness or any other automobile related business other than an automobile towing andrelated garage business.

The Review Committee scored and ranked these proposals as shown in the Summary table below.

Finding

The Review Committee evaluated the responsive proposals and found that Absolute Towing —Hollenbeck Division, Inc., submitted the best overall proposal (highest scoring) and met all of therequirements of the RFP. This finding was based on the proposer's formal business plan,experience, history of contract compliance, attention to customer service, and attention to honestyand integrity.

It should be noted that the decision of the Review Committee included an evaluation of the pastperformance of any proposer who has previously operated as an Official Police Garage, as requiredby LAMC Section 80.77.4 (B.2.).

It should also be noted that Absolute Towing — Hollenbeck Division, Inc. held the contract forstandard towing in what is now Official Police Garage Service Area 4 (Hollenbeck Area) for thestandard duration (five years) and that at the end of that contract, the City exercised its option torenew the contract with for an additional five years. Therefore, they now have over ten yearsexperience as an Official Police Garage in this service area.

Recommendation

The Review Committee recommends Absolute Towing — Hollenbeck Division, Inc., to the Board ofPolice Commissioners, as its first choice of vendors to provide the quality standard duty towingservices expected of and required by Hollenbeck Area. In the event of any unforeseeable need foran alternate choice, the Review Committee's second choice would be Tip Top Tow and the thirdchoice would be Navarro's Tow. I concur with this recommendation.
