    I. CALL TO ORDER & ROLL CALL: Mayor Scheel called the meeting to order at 6:04 p.m. with Council MembersMattina, Parlet, Spillman and Turner present.

    II. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Council Member Mattina 

    III. ACCEPTANCE OF AGENDA: A motion was made by Council Member Mattina, seconded by Council Membe

    Turner, and unanimously carried by voice vote, to accept agenda as posted.

    Urgency Items: There were no Urgency Items.

    IV. CONSENT AGENDA:

    A. Ordinances: Waive reading except by title, of any ordinances under consideration at this

    meeting for either introduction or passage per Government Code Section 3693

    B. Minutes: Approve minutes of the regular City Council meeting of September 15, 2015.

    C. Warrants: Approve warrant register from September 3, 2015.

    D. Application 2015-022 Approve Application No. 2015-022 with staff recommendations for the 2015

    Clear Lake High School Homecoming Parade on October 9, 2015.

    E. Conflict of Interest Code Review and adopt a revised Conflict of Interest policy for the City of Lakeport.

    Vote on Consent Agenda: A motion was made by Council Member Spillman, seconded by Council Memb

    Parlet, and unanimously carried by voice vote, to approve the Consent Agenda

    Items A-E.

    V. PUBLIC PRESENTATIONS/REQUESTS:

    A. Citizen Input: There was no Citizen Input

    B. Proclamation: Mayor Scheel presented the Proclamation designating October as DomesticViolence Awareness month to representatives from the Lake Family Resource

    Center.

    C. Presentation: Sarah Ryan, Environmental Director of the Big Valley Band of Pomo Indians, an

    Karola Kennedy, Environmental Director of Elem Indian Colony, gave a

    presentation updating the City Council on the Clear Lake Cyanotoxin Monitorin

    Program.

    D. Presentation: Rebecca Southwick from the Lake County Regional Economic Development

    Coalition gave a presentation on the Lake Leadership Summit to be held Octob

    9, 2015 at Marymount College.

    E. Presentation: Melissa Fulton from the Lake County Chamber of Commerce donated $3,324.7

    for the annual fireworks show through the Add-a-Dollar campaign.

    VI. PUBLIC HEARING:

    A. Minor Amendments and Revisions to

    Existing Ordinances:

    Community Development Director Ingram presented a staff report supporting

    the adoption of three proposed separate minor amendments and revisions to

    the Lakeport Municipal Code:

    A.  Addition of Section 15.24 relating to expedited permitting procedures

    for small residential rooftop solar systems.

    B.  Repealing Section 5.04.160.H imposing additional licensing fees on

    fortunetellers

    C.  Amending Section 10.12.180 to allow for the issuance of special parki

    permits for residential units in the central business district without

    access to on-site parking.

    Mayor Scheel opened the Public Hearing related to the amendments. No

    testimony was offered from the public. Mayor Scheel closed the hearing.

    A motion was made by Council Member Parlet, seconded by Council Member

    Spillman, and unanimously carried by voice vote, to adopt the proposed

    ordinance adding Section 15.24 of the Lakeport Municipal Code establishing a

    review process for small residential rooftop solar energy systems.

    A motion was made by Council Member Spillman, seconded by Council MembMattina, and unanimously carried by voice vote, to adopt the proposed

    ordinance repealing Section 5.04.160.H of the Lakeport Municipal Code imposi

    additional licensing fees on fortunetellers.

    A motion was made by Council Member Turner, seconded by Council Member

    Parlet, and unanimously carried by voice vote, to adopt the proposed ordinanc

    amending Section 10.12.180 of the Lakeport Municipal Code to allow for the

    issuance of special parking permits for residential units in the central business

    district without access to on-site parking.

    B. Lakeport Industrial Authority Finance Director Buffalo presented the staff report supporting the adoption of

    proposed Ordinance forming the Lakeport Industrial Development Authority.

    Mayor Scheel opened the Public Hearing related to the Ordinance. No testimowas offered from the public. Mayor Scheel closed the hearing.

    A motion was made by Council Member Turner, seconded by Council Member

    Parlet, and unanimously carried by voice vote, to adopt the proposed ordinanc

    forming the Lakeport Industrial Development Authority.

    VII. COUNCIL BUSINESS:

    A. Finance Director

    1.  Accounts Signature

    Confirmation

    Finance Director Buffalo presented the staff report regarding the signatories o

    the City’s bank accounts.

    A motion was made by Council Member Turner, seconded by Council Member

    Spillman, and unanimously carried by voice vote, to adopt the proposedResolution authorizing signatories to the City’s checking, payroll and investmen

    funds accounts, appoint the following Lakeport City Council Members, Mayor

    Scheel and Council Member Spillman, and confirm Margaret Silveira, City

    Manager; Kelly Buendia, Administrative Services Director; Brad Rasmussen, Ch

    of Police; and Kevin Ingram, Community Development Director as authorized

    signatories on the bank accounts with West America.

    B. Community Development Director

    1.  Valley Fire Registered Evacuees Community Development Director Ingram presented the staff report supportin

    the proposed Resolution.

    Council Member Turner had recommended that that the Resolution language

    amended from “registered residents” to “FEMA registered residents”.

    A motion was made by Council Member Turner, seconded by Council Member

    Mattina, to adopt the proposed resolution, as amended, providing relief to

    displaced residents of the Valley Fire who have sought temporary housing with

    the City of Lakeport from certain provisions of the Lakeport Municipal Code

    including:

    A.  The waiving of maximum thirty (30) day stay allowance at local hotels

    and other similar establishments.

    B.  The waiving of initial service and deposit fees associated with new

    sewer and water connections.

    ADDITIONAL CONCERNS REGARDING THIS EVENT.

    AFTER A CONVERSATION OVER THE TELEPHONE WITH THE APPLICANT, HE ANTICIPATED A SIGNIFICANT AMOUNT OF PEOPLE IN ATTENDANCE AS THIS IS A CHARITY EVENT. SOME ADDITIONAL CONCERNS WERE RAISED AFTER THE CONVERSATION AND ARE LISTED BELOW:

    1) THERE IS NO TRAFFIC SAFETY PLAN SUBMITTED FOR THIS EVENT.

    2) THERE IS NO PARKING PLAN SUBMITTED FOR THIS EVENT. IN SPEAKING WITH THE APPLICANT, HE WAS UNSURE AS TO HOW TO DEAL WITH THE

     ANTICIPATED LARGE AMOUNT OF TRAFFIC AND WHERE THEY COULD PARK.ONE SUGGESTION HE PROVIDED WAS TO OBTAIN PERMISSION FROM NANCY RUZICKA TO PARK IN THE HIGH STREET VILLAGE MALL AND WALK TO THE EVENT. THIS POSES A SIGNIFICANT CONCERN FOR LAW ENFORCEMENT AS THIS WOULD PLACE A POTENTIALLY LARGE CROWD OF PEOPLE WALKING ON HARTLEY RD OR ANY GIVEN SIDE STREET TO REACH THE EVENT.

    3) DUE TO THE LATE NOTICE OF THIS EVENT, POLICE STAFF WAS NOT AVAILABLE TO PROVIDE ADEQUANT TIME TO MEET WITH THE APPLICANT TO DISCUSS THESE, AND OTHER, SIGNIFICANT CONCERNS.

    4) THERE ARE TWO MAJOR EVENTS TAKING PLACE WITHIN CLOSE PROXIMITY

     TO THIS EVENT. THE KIWANIS CLUB IS HOSTING ITS ANNUAL HALLOWEEN KIDS FAIR AT THE HIGH SCHOOL WITH AN ESTIMATED ATTENDANCE OF 800 KIDS AND PARENTS THROUGHOUT THE EVENING. THE HARVEST FESTIVAL WILL BE TAKING PLACE ON 19TH ST WHICH DRAWS A SIGNIFICANTLY LARGE CROWD EACH YEAR.

    5) ADDITIONAL COST CONSIDERATIONS TO PROVIDE ASSISTANCE FOR THIS EVENT.

      1-POLICE OFFICER AT 68.00 PER HOUR FOR 5 HOURS=$340.00

      2-POLICE VOLUNTEERS AT 27.39 PER HOUR FOR 5 HOURS=$273.90

    Hilary,

     

    Given that the proposed ‘Haunted Walk’ is intended to be fundraiser and advertised as larger

     community event its impacts (i.e. traffic & safety) are likely to be greater than that of standard

     residential street closure for a neighborhood event. The Community Development Department

     would request that the applicant provide a more detailed parking and circulation plan. As

     presented parking for the event will be concentrated in the surrounding residential area which is

     limited by poor street lighting, poor sight distances, narrow roads and the lack of sidewalks. This

     combined with the large number of families and children that will also be utilizing the street on

     Halloween will also further aggravate the situation.

     

    CDD staff is willing to work with the applicant and other City agencies to address these concerns.

    Public Works Comments on the Application 2015-025, Haunted Walk (Wayne Yahnke)

     

    Public Works has the following concerns regarding this application

     

    1.  There is no “Traffic Control Plan” to address how applicant is going to deal with the

     increased traffic flow in the area.

    2.  There is no “Parking Plan” to address the issue of very limited available parking in the

     event area.

    3.  The City Streets surrounding the event area are narrow. The average street width in

     this area is 20 feet, this includes Terrace, Hillcrest and Forest

    4.  There are “No Parking” zones along the North side of Forest and Hillcrest due to the

     narrow roadways, this further compounds the “Parking” issue.

    5.  There are two other major events in this area, the “Kiwanis Halloween Kids Fair” is 2

     blocks away at the school and the “Harvest Festival” is two blocks away at 19th Street.

    6.  Safe pedestrian walkways are limited in this area as sidewalks are intermittent, this is a

     concern because of the potential for extremely high volumes of vehicular traffic.

    7.  Additional Staff, Public Works would most likely have to assist the Police Department

     with a minimum of 2 Maintenance Workers for traffic control as well as staff time to close and open the street.

    8.  This area is well known for its already high volume of “Trick or Treaters”, to add

     another large group of people could bring this area to “Critical Mass”.

    9.  Cost to the Public Works budget would be between $300.00 and $500.00 for staff and

     equipment.
