BOOKING  PROCEDURES,  TERMS  AND  CONDITIONS    

PRICES:  All  prices  are  quoted  ‘per  person’  unless  otherwise  stated.  Land  component  prices  are  priced  in  Japanese  Yen  (JPY)  and  are  converted  to  Australian  Dollars  (AUD)  using  an  indicative  exchange  rate,  which  is  listed  on  your  quote/invoice.  The  final  AUD  payable  to  SkiJapan.com  is  determined  using  the  invoiced  JPY  amount.  This  will  be  converted  to  AUD  using  the  exchange  rate  applicable  on  the  day  final  payment  is  made.  The  offer,  prices  and  all  terms  and  conditions  on  this  booking  form,  in  the  brochure,  on  our  website  and  all  our  promotional  material  are  subject  to  change  or  withdrawal  without  notice  prior  to  final  payment  being  received  by  SkiJapan.com.    DEPOSIT:  A  NON-­‐REFUNDABLE  deposit  of  $500  per  person  is  required  within  7  days  of  your  confirmed  reservation,  together  with  a  signed  booking  form,  to  secure  your  booking  otherwise  your  reservation  may  be  automatically  cancelled.  Some  suppliers  may  require  deposit  payment  inside  the  standard  7  days  and/or  an  increased  deposit  to  secure  the  booking.  Payment  of  a  deposit  indicates  acceptance  of  these  booking  conditions.  Passengers  are  responsible  for  checking  all  names  of  people  traveling,  travel  dates  and  the  arrangements  are  correct  at  time  of  confirmation.  If  there  is  a  discrepancy  SkiJapan.com  must  be  notified  immediately.  Subsequent  changes  may  incur  amendment  and/or  cancellation  fees.    BOOKING  FORM:  It  is  the  responsibility  of  the  person  who  signs  the  booking  application  form  to  inform  all  other  people  traveling  under  their  name  of  these  booking  conditions.  The  person  who  signs  the  booking  form  shall  be  liable  for  all  fees  for  the  entire  traveling  party  in  the  event  of  any  cancellation.  SkiJapan.com  is  not  obliged  to  continue  to  hold  any  booking  unless  a  signed  Booking  Form  is  received.    FINAL  PAYMENT:  Final  payment  is  payable  75  days  prior  to  departure  date.  Bookings  made  between  15  -­‐  75  days  from  departure,  require  full  payment  within  7  days  of  confirmation.  Bookings  made  less  than  15  days  before  departure  require  full  payment  immediately  on  confirmation  as  per  ‘Late  Booking’  conditions.  Some  suppliers  may  require  full  payment  prior  to  the  final  payment  deadlines  set  out  above,  your  SkiJapan.com  consultant  will  advise  you  of  this.  On  the  day  final  payment  is  made  to  SkiJapan.com,  prices  for  all  land  components  will  be  calculated  on  the  daily  outward  remittances  exchange  rate,  as  published  on  the  Commonwealth  Bank  website:  www.commbank.com.au/guides/personal/other/foreignexchangerates.asp      Deposit/s  will  be  subtracted  from  this  amount  for  final  payment.  Failure  to  pay  by  the  due  date  may  result  in  auto  cancellation  of  your  booking  and  reinstatement  fees  may  be  incurred.    PAYMENTS:  Payments  can  be  made  by  the  following  methods:    cash,  cheque,  credit  card,  or  direct  deposit  into  our  bank  account.  Payments  by  travel  agents  can  be  made  via  Enett,  Payment  Gate  or  direct  deposit.  Please  note:  there  is  a  1%  charge  when  paying  with  Visa  or  Mastercard  &  3.1%  charge  when  paying  with  an  American  Express  Card.  PART  PAYMENTS:  SkiJapan.com  will  accept  deposits  and  final  payments  only.  Part  payments  towards  bookings  will  not  be  accepted.    EARLYBIRD  DISCOUNT:  Earlybird  discounts  apply  to  selected  SkiJapan.com  products  and  are  detailed  in  our  brochure.  Earlybird  offers  are  not  applicable  in  conjunction  with  any  other  discounts  offered.  To  be  eligible  for  the  discount  the  booking  must  be  made  and  paid  according  to  each  offer’s  conditions.  All  Earlybird  discounts  will  be  removed  from  the  booking  in  the  event  the  required  payment  is  made  after  the  cut  off  date  and  normal  payment  conditions  will  apply.  SkiJapan.com  strongly  advises  all  clients  in  a  booking  pay  by  the  Earlybird  deadline.  All  clients  in  a  booking  may  be  liable  for  increases  in  the  accommodation  rate  on  certain  properties  if  this  condition  is  not  met.  Earlybird  bookings  are  subject  to  availability  and  may  be  withdrawn  at  any  time.    LATE  BOOKING:  Bookings  made  less  than  15  days  before  departure  will  incur  a  $100  late  booking  fee  per  file.  To  commence  a  booking  SkiJapan.com  requires  credit  card  guarantee  and  final  payment  will  be  taken  immediately  on  confirmation  of  the  booking.  Normal  cancellation  fees  will  apply.    AMENDMENT:  Any  amendments  made  after  deposit  is  received  will  incur  a  SkiJapan.com  $50  administration  fee  per  trip  per  amendment;  this  is  in  addition  to  any  supplier  amendment  fees  charged.  Changes  to  issued  air  tickets  may  incur  fees  as  set  out  by  the  Airlines  in  their  conditions;  these  fees  are  in  addition  to  the  amendment  fee  by  SkiJapan.com.    CANCELLATION:  In  the  event  of  cancellation  more  than  75  days  prior  to  departure,  a  cancellation  fee  of  $500  per  person  will  be  charged  (loss  of  deposit).  For  cancellations  made  after  final  payment  or  75  –  45  days  prior,  a  cancellation  fee  of  $500  per  person  will  be  charged  in  addition  to  any  airline,  accommodation  and  supplier  fees.  For  cancellations  within  45  days  100%  cancellation  fee  will  apply.  No  allowance  or  refund  can  be  made  on  any  unused  package  components  once  travel  has  commenced.  If  a  person  or  persons  cancel  from  a  SkiJapan.com  booking,  they  and  the  remaining  people  in  the  booking  will  be  liable  for  the  additional  accommodation  costs  that  result  from  the  cancelling  persons.

TRAVEL  INSURANCE:  Travel  insurance  is  highly  recommended  at  the  time  of  deposit  to  cover  cancellation,  accidents,  baggage  loss,  personal  liability,  additional  expenses  and  strikes.    ACCOMMODATION:  SkiJapan.com  reserves  the  right  to  substitute  and  confirm  alternative  accommodation  of  a  comparable  or  superior  standard,  if  necessary,  should  that  included  in  a  confirmed  booking  not  be  available.    AIRFARE  CONDITIONS:  Airfares,  taxes  &  conditions  can  change  at  any  time  and  the  only  way  to  guarantee  prices  quoted  is  to  purchase  tickets  immediately.  It  is  not  always  possible  for  SkiJapan.com  to  advise  clients  of  increases  or  change  to  conditions  issued  by  the  airlines.  It  is  each  passenger’s  responsibility  to  make  themselves  aware  of  any  airfare  conditions  and/or  restrictions  relevant  to  airfares  purchased  as  part  of  a  SkiJapan.com  package  prior  to  departure.  If  you  are  in  any  doubt,  please  ask  and  we  will  confirm  the  conditions  that  apply  to  your  airfare.  Airline  taxes  and  levies  are  included  in  your  trip  price  however  they  are  subject  to  change  up  until  the  time  of  final  payment.  Airfares  are  subject  to  100%  cancellation  fee  once  tickets  are  issued.    NOT  INCLUDED:  All  other  costs,  apart  from  those  detailed  in  a  quote/invoice,  are  at  the  clients’  own  expense  eg:  passport  and  visa  fees,  inter-­‐airport  transfers,  meals  or  any  other  items  including  those  of  a  personal  nature  unless  otherwise  stated.  If  flight  or  other  travel  delays  lead  to  missed  connections,  SkiJapan.com  cannot  be  responsible  for  train  fares,  taxis  or  other  extra  expenses.    BOOKINGS  THROUGH  TRAVEL  AGENTS:  A  Travel  Agent  does  not  receive  monies  from  clients  as  an  agent  for  SkiJapan.com  and  SkiJapan.com  accordingly  bears  no  responsibility  for  such  monies  until  they  are  actually  received  by  us  from  the  Travel  Agent.  Similarly,  booking  adjustments  made  via  a  Travel  Agent  will  be  deemed  to  be  received  on  the  day  they  are  actually  received  in  the  Company’s  office,  not  on  the  day  the  client  placed  the  booking  with  the  agent.    RESPONSIBILITY:  SkiJapan.com  acts  only  as  an  agent  for  the  companies  or  persons  (principals)  providing  or  offering  the  means  of  travel,  accommodation  and  other  services  (the  principals’  services)  and  bookings  are  made  subject  to  the  terms  and  conditions  under  which  the  principal’s  services  are  provided.  Accommodation,  flights,  transportation  and  any  other  services  are  subject  to  availability  at  the  time  of  booking.  The  principals  reserve  the  right  to  change  the  prices  of  their  services  without  notice.  Confirmations  and  invoices  are  subject  to  re-­‐issue  if  incorrect  through  error  or  omission  and  the  passenger  accepts  liability  to  pay  the  correct  costs  for  services.  SkiJapan.com  reserves  the  right  to  cancel  or  withdraw  any  tour  or  passenger  booking  or  to  decline  to  accept  or  retain  any  person  as  a  member  of  a  Tour  or  passenger  booking.  This  agreement  is  governed  by  the  laws  of  the  State  of  NSW,  Australia.    TOUR  SERVICE:  The  tour  services  in  Hokkaido  are  operated  by  SkiJapan  Pty  Ltd,  a  company  incorporated  in  Japan,  who  acts  as  the  tour  operator  for  SkiJapan.com  in  Japan,  not  as  SkiJapan.com  itself.  The  operations  of  SkiJapan  Pty  Ltd  are  subject  to  the  jurisdiction  of  Japanese  law,  including  liability  and  legal  indemnity.    LIABILITY:  To  the  extent  permitted  by  law,  neither  SkiJapan.com  nor  anyone  on  its  behalf  can  be  held  liable  for  any  alterations,  act  or  omission  on  the  part  of  the  service  providers/principals  for  any  consequential,  loss,  death,  injury,  accident,  delay  or  damage  occasioned  to  any  person  or  their  belongings  (including  baggage)  in  connection  with  the  tour  or  holiday  offers  supplied  by  SkiJapan.com  whether  or  not  such  loss,  injury  or  damage  is  due  directly  or  indirectly  to  any  default,  negligent  act,  misrepresentation,  breach  of  duty,  or  omission  of  the  travel  operator,  their  respective  representatives,  servants,  contractors  or  agents.  Matters  outside  the  control  of  SkiJapan.com  may  affect  the  services  offered  and  SkiJapan.com  will  not  be  responsible  for  any  such  matters.  Programs,  offers,  tour  prices,  services  and  conditions  are  current  at  the  time  of  publication  of  promotional  material  are  subject  to  change  without  notice  due  to  unforeseen  circumstances,  including  increases  in  operating  costs.  SkiJapan.com  will  not  accept  responsibility  or  liability  for  any  traveler  who  contravenes  the  law  or  regulation  of  any  country  visited.  SkiJapan.com  strongly  advise  against  the  use  or  possession  of  prohibited  drugs  in  foreign  countries  and  warns  travelers  that  if  found  to  be  involved  in  the  use  or  possession  of  illegal  drugs  on  a  SkiJapan.com  tour  or  travel  package,  we  reserve  the  right  to  discharge  the  traveler  from  a  tour.  This  is  a  zero  tolerance  policy.    FORCE  MAJEURE:  Except  where  otherwise  expressly  stated  in  these  booking  conditions,  neither  we  nor  any  Third  Party  Supplier  can  accept  liability  or  pay  any  compensation  where  the  performance  or  prompt  performance  of  our  or  the  Third  Party  Supplier’s  contractual  obligations  is  prevented  or  affected  by  or  you  otherwise  suffer  any  damage  or  loss  as  a  result  of  force  majeure.  In  these  booking  conditions,  ‘force  majeure’  means  any  event  which  we  /  the  supplier  of  the  service(s)  in  question  /  the  Third  Party  Supplier  could  not,  even  with  all  due  care,  foresee  or  avoid.  Such  events  may  include,  whether  actual  or  threatened,  war,  riot,  civil  strife,  terrorist  activity,  industrial  dispute,  natural  or  nuclear  disaster,  adverse  weather  conditions,  epidemics,  fire  and  all  similar  events  outside  the  control  of  the  party  concerned.    SkiJapan.com  is  a  full  member  of  IATA  (International  Air  Transport  Association)  and  is  licensed  by  the  Department  of  Fair  Trading  to  carry  on  business  as  a  Travel  Agent.      Travel  insurance  has  been  offered  to  me  by  SkiJapan.com  which  I:
