AN ACT DIVIDING BARANGAY PAMPANGA IN THE CITY OF DAVAO INTO THREE (3) DISTINCT AND INDEPENDENT BARANGAYS TO BE KNOWN AS BARANGAY PAMPANGA, BARANGAY ALFONSO ANGLIONGTO, SR., AND BARANGAY VICENTE HIZON, SR.

Be it enacted by the Senate and House of Representatives of the Philippines in Confess assembled:

Section 1. Division ofBarangay Pampanga. - Barangay Pam panga in th e City of Davao is hereby divided in to three (3) distinct and independent barangays to be known as: (1) Barangay Pampanga; (2) Barangay Alfonso Anghongto, Sr.; and (3) Barangay Vicente Hizon, Sr.

Sec. 2. T e rr ito r ia l B oundaries. — The te r r i to r ia l boundaries of each barangay created in the im m ediately preceding section shall be as follows:

Bounded on the Northeast (NE), pts. 1 to 9, by Barangay Sasa, Case 16;

On the Southeast (SE), pts. 9 to 11, by Barangay Sasa, Case 16;

On the Southwest (SW), pts. 12 to 21, by the shoreline of Davao Gulf; and

On the Northwest (NW), pts. 22 to pt. 1, by Barangay Vicente Hizon, Sr., Case 14.

Sec. 3. Conduct and Supervision of Plebiscite. — The plebiscite conducted and supervised by the Commission on E lec tio n s (COM ELEC) in B arangay P am p an g a on July 25, 2004, pursuant to City Ordinance No. 00161-03 of the Sangguniang Panlungsod of the City of Davao, which ratified the creation of Barangay Alfonso Angliongto, Sr. and of Barangay Vicente Hizon, Sr., shall serve as substantial compliance w ith the plebiscite requirem ent under Section 10 of R epublic Act No. 7160, as am ended, o th erw ise known as the "Local Government Code of 1991".

Sec. 4. Incumbent Barangay Officials. - The incumbent b a ra n g a y o ffic ia ls of b a ra n g a y s P am panga , A lfonso Anghongto, Sr., and Vicente Hizon, Sr., City of Davao shall continue to hold office until such time that their successors have been duly elected and qualified.

Sec. 5. Public Infrastructure and Facilities. — All public in f ra s tru c tu re a n d fa c ili tie s for pub lic use e x is tin g therein a t the time of the approval of this Act are hereby transferred w ithout cost or compensation to and shall be administered by the new barangays.

Sec. 6. Internal Revenue Allotment Shares. - Barangays Pam panga, Alfonso Angliongto, Sr. and Vicente Hizon, Sr. sh a ll be e n title d to In te rn a l Revenue A llo tm ent (IRA) shares pursuan t to Section 285 of Republic Act No. 7160, as amended, otherwise known as the "Local Governm ent Code of 1991".

Sec. 7. S eparab ility Clause. - If, for any reason, any part or provision of this Act is declared unconstitutional or invalid, other parts or provisions which are not affected thereby shadl continue to be in full force and effect.

Sec. 8. Effectivi ty. - T his Act sh a ll ta k e effec t fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
